The Tenderer shall ensure that the prpsed HT wrk shall be installed at the existing site cnditins. Hence, the tenderers are advised t inspect the site in this regard befre quting fr the jb. Nte : 1) The tender withut cmplete infrmatin and certified phtcpies f dcuments in supprt f fulfilling the Pre qualificatin criteria will nt be entertained. 2) If any infrmatin furnished by the Tenderer is fund t be incrrect at a later stage, the Tenderer shall be liable t be debarred frm tendering/taking up the wrk in UIIC. 3) The UIIC reserves the right t verify the particulars furnished by the Tenderer independently. 4) Shrt- listing f Tenderers will be finalized after inspectin f wrks and btaining cnfidential reprts frm previus emplyers fr nly thse firms wh fulfill the afresaid Pre qualificatin criteria and that specified in Technical bid. 5) The tenderer shall take care t price his tender ratinally. Extreme under pricing r verpricing in item-rates ttal amunt will be cnsidered adversely in the assessment f tenders. The tenderer shall n demand submit analysis f rates f sme items f wrk if s required by the Emplyer i.e. UIIC Ltd., r its cnsultant. 6) The Emplyer / UIIC is nt bund t accept the lwest tender and reserves the right t accept r reject any r all tenders, either in whle r in part, withut assigning any reasn fr ding s. 7) All the cmpetitive tenders will be received upt the specified date and time. 7 2. ELIGIBILITY CRITERIA HT Wrks 1. The Tenderers shall be themselves licensed electrical cntractrs wh have executed the wrk f HV (High Vltage) / MV (Medium Vltage) installatins including testing and cmmissining at Gvernment /Public Sectr Undertakings / PSBs / IT / reputed business rganizatins. 2. The tenderers shall prduce the fllwing dcuments duly attested alng with tender dcuments. Audited financial statement cnsisting f financial turnver and prfit & lss accunt fr the past 5 years. Thse tenderers wh have achieved annual turnver f atleast Rs lakhs each in all the past 3 years( April 2011 t March 2014) are nly eligible t tender fr the wrk. The tenderer shuld nt have incurred lss during the last 3 years ut f 5 years in the past. 3. The tenderer shall have a minimum f 5 years experience in the executin f bth HV and MV electrical wrks. The tenderer shall prduce the details f wrk dne and enclse wrk rders / agreements and satisfactry wrk cmpletin certificate in each ne f the last 5 years. 4. The tenderer shuld have a slvency fr an amunt f Rs 20 lakhs duly certified by any Scheduled bank btained n r after and enclse cpy f the same. 5. The tenderer shuld have its wn after-sales service unit at Chandigarh/ Tri-city. The address and full cntact details shuld be given. 6. The Tenderer shuld have executed HV and MV installatin wrks in nn residential multi-stried building f (a) Three wrks each csting nt less than the amunt equal t 40% f the estimated cst i.e Rs 20 lakhs r (b) Tw wrks each csting nt less than the amunt equal t 50% f the estimated cst i.e Rs 25 lakhs r (c) One wrk csting nt less than the amunt equal t 80% f the estimated cst i.e Rs 40 lakhs under single agreement in Chandigarh/ Punjab / Haryana etc. during the last 3 years ending with The tenderer shall prduce cpies f valid licenses issued by Electricity Department, Chandigarh fr the executin f HV and MV installatins at Chandigarh/Punjab / Haryana etc. Signature f the Tenderer Page 7

11 4. SPECIAL CONDITIONS OF CONTRACT HT Wrks 1. Scpe f Wrk: The scpe f wrk fr the purpse f this tender cnstitutes the wrk f availing HT Supply at United India Insurance Cmpany Limited, Reginal Office, S.C.O , Sectr 17-B, Chandigarh The wrks shuld be carried ut in accrdance with the Drawings and Schedule f quantities. 2. Price Basis: a. The unit rates mentined in schedule f rates shall remain firm and shall nt be subjected t any escalatin thrughut the currency f the cntract. b. The quted rates shall be inclusive f supply f all materials required fr cmpleting the item wrks. c. Payment shall be made n the actual quantum f wrk executed, duly certified by Engineer-in-Charge / Cnsultant. d. The rates quted shall be based n laws, levies, taxes and duties applicable n the date f Letter f Award. Any Statutry Variatins theret and / r new levies due t an act r enactment, after the date, shall be t the Emplyer s accunt against dcumentary evidence within the cntractual cmpletin date. Any such variatin/impsitin f new taxes and levies beynd the cntractual cmpletin date shall be t the Tenderer s accunt. e. The Tenderer shall clearly indicate every element f taxes, duties, levies and cess cnsidered in the quted price. f. Tenderer shall satisfy himself n the applicability f varius taxes, duties, levies, ctri, including sales tax, wrks - cntract tax, turnver tax, VAT, etc. as applicable fr such wrk and quted prices shall be inclusive f all such liabilities. Emplyer / Cnsultant shall nt be liable t any liability f the Tenderer n this accunt. Tenderer shall peridically prduce dcumentary prf fr having fulfilled the abve bligatins in time, including prf f payment, prf f filing f returns, etc. failing which Emplyer / Cnsultant reserve the right t take apprpriate actin at the cst and cnsequence f the Tenderer. Service Tax, Educatin Cess and Secndary & Higher Educatin Cess, as applicable at the prevailing rates, shall be shwn separately in Tenderer s Bills. g. Incme Tax and Wrks Cntract Tax, at applicable rates, shall be deducted frm the Tenderer s Bills, and TDS Certificate issued theref. 3. Terms f Payment: Signature f the Tenderer Page 11

12 HT Wrks Prgress Payment: 70% f value f Cntract /Interim bill value n receipt f materials at site and against submissin f invice, duly certified by UIIC / Cnsultant, subject t deductin f 5% twards retentin mney, 20% f the cntract value upn the cmpletin f erectin and Cmmissining subject t deductin f 5% twards retentin mney, Balance Amunt (10%) shall be released n submissin f all statutry apprvals frm relevant statutry Authrities & submissin f invice duly certified by UIIC / Cnsultant subject t deductin f 5% twards retentin mney,. 50% f bth retentin mney deducted, as stated abve and EMD shall be released n successful cmpletin f wrk and n receipt f all final technical dcuments and all relevant statutry apprvals against submissin f the fllwing: a) Invice duly certified by UIIC/Cnsultant b) NO CLAIM certificate c) NOC/ Permissins frm UT Electricity Department / Electrical Inspectrate Officials r ther statutry bdies. The Emplyer / Cnsultant will entertain nly ne running bill per mnth and fr a minimum grss amunt f Rs. 15, 00, 000/- (Rupees Fifteen Lakhs nly). Emplyer may withhld payment n accunt f any defect/deficiency in the wrk already executed and payment released, based n subsequently discvered evidence, failure t make payments t Sub-Tenderers, damage caused by the Tenderer t Emplyer s prperty, prperties f ther agencies within the premises, unfulfilled statutry bligatins, etc. The Cmpletin Certificate shall be issued by Electrical Cnsultant / Engineer- in Charge nly after ttal jb cmpletin and fulfillment f all cntractual bligatins by the Tenderer. 4. Effective date, Time schedule and Liquidated damages fr delay: a) The date f issue f Wrk Order/letter f intent shall be deemed as the Effective Date f cntract. b) The entire wrk cvered under the cntract shall be cmpleted in all respects within 90 days frm the Effective Date. c) Time is the essence f this prject and hence cmpletin schedule f 90 days shuld be strictly adhered t. 5. 13 HT Wrks The Quantities set ut in the schedule f items and rates are estimated quantities f wrk. The final quantities f wrk executed by the Tenderer in fulfillment f his bligatins under the cntract shall be jintly measured by the Tenderer and the Emplyer / Cnsultants. The Emplyer / Cnsultants will be final authrity fr the measurement relating t bills. The intending tenderers are als required t make their wn assessment f adequacy and crrectness f the quantities befre submitting their tenders. 6. Respnsibility: Emplyer / Cnsultant reserve the right t inspect the electrical installatins at the Manufacturer s /Tenderer s Wrks as per the technical specificatins and the equipment shall be dispatched nly after receipt f a Release Order issued by the Engineer-in-Charge / Cnsultant. Hwever, such inspectin/release rder shall nt abslve the Tenderer f his respnsibility t supply the materials in the required quantities and carry ut the wrk as per technical specificatins. Unless therwise specified in the cntract / Wrk rder / Purchase Order, the cmpletin f wrk shall nt be deemed t have been achieved until all the wrks required t be carried ut under the cntract have been cmpleted t the entire satisfactin f the Engineer-in-Charge / Cnsultant, in all respects and Cmpletin Certificate is issued. It is the respnsibility f the Tenderer t btain all statutry apprval frm statutry authrity related t scpe f wrk in the tender and hand ver the same t the Emplyer thrugh the Cnsultant. 7. Prgress Reprt: The Tenderer shall submit t the Emplyer / Cnsultant nce in tw weeks prgress reprt fr the previus perid shwing up-t-date cumulative prgress and prgress during the preceding perid alne n all prgress items f each sectin r prtin f the wrks in the prfrma prescribed by the Emplyer / Cnsultant. 8. Tenderer s Engineer: The Tenderer shall keep qualified and experienced Engineers fr full time during executin f wrk fr entire Cntract. Signature f the Tenderer Page 13

14 HT Wrks 9. Equipment: The Tenderer shall make his wn arrangement t prcure all cnstructinal plant and equipment fr his wrk. He shall als submit with the tender, the type and number f different equipments with their capacities in gd wrking cnditins, which he will use n the site t ensure cmpletin f the wrk in specified time. All materials, cnstructin plant and equipment etc., nce brught by the TENDERER n the site are nt t be remved frm there withut the written apprval frm the Emplyer / Cnsultant. 10. Extra Items: Extra items, if any, shall be paid n the basis f analysis f rate f cst f materials and labur prduced by TENDERER, and the item-rates agreed upn with the Emplyer / Cnsultant. The executin f extra item is cmpulsry in rder t cmplete the prject wrk. In case the Tenderer fails t execute extra item, Emplyer / Cnsultant will have the right t execute these items thrugh ther agency / agencies at the risk and cst f the Tenderer. While arriving at the agreed rate f extra items, the Plant & Machinery / Overheads / prfit shall be cnsidered t the tune f 15% f cst f materials and labur. Emplyer / Cnsultant reserves the right t verify the price f material thrugh market survey. 11. Guarantees / Liabilities: The Installatin including all cmpnents and accessries shall be guaranteed fr a perid f 12 mnths frm the date f virtual Cmpletin f the same against defective material, shrtfall in perfrmance and faulty wrkmanship. The Tenderer shall immediately make free replacement f any f the parts r cmpnents that might g ut f rder within this perid and UIIC / Cnsultant s decisin in this regard will be final and binding n the Tenderer. Free maintenance shall be prvided during the guarantee perid. The cntract invlves the wrk f availing HT Supply at United India Insurance Cmpany Limited, Reginal Office, S.C.O , Sectr 17-B, Chandigarh Hence, the guarantee perid shall cmmence n cmpletin f cmmissining f HV and MV installatins including prductin f safety certificate frm the Electrical Inspectrate Department. 15 HT Wrks 12. Wrk Frnt: Wrk frnt fr the Tenderer may / may nt be guaranteed thrughut the pendency f the cntract, especially during mnsn. N cmpensatin will be paid fr idle labur hurs and ther incidental charges. Tenderer may suitably arrange requisite labur / manpwer / equipment t meet the requirement f lean perid, if any. The Tenderer have t execute the wrk in such place and cnditin where ther agencies will als be engaged fr ther wrks, such as mechanical, electrical, instrumentatin wrk, etc. N claim shall be entertained due t wrk being executed in the abve circumstances. The Tenderer shuld ensure that there is n interference with the wrk f ther agencies at Site. 13. INCOME TAX CLEARANCE (I.T.C) CERTIFICATE Attested cpy f the latest Incme Tax Clearance Certificate in the prfrma prescribed by the Gvernment f India shuld be attached with the bid dcument. The I.T.C. Certificate shuld be in the name f the firm/individual wh has quted fr the tender. In the absence f the abve clearance certificate, Tenderer may nt be awarded the wrk tendered fr, in the light f gvernment directives/instructins in this regard. 14. INSURANCE Tenderer shall btain and maintain any and all necessary insurance cver fr the entire wrk up t Virtual cmpletin date, that may be required under any law r regulatins applicable, including but nt limited t the fllwing: Tenderer s All Risk Plicy, fr Tenderer s Scpe f Wrk. All materials and Tenderer s wn machinery, equipment, tls & tackles, vehicles, etc. Third Party liability. Wrkmen Cmpensatin ESIC Emplyer s Liability The quted price shall be inclusive f all csts fr such insurance cverage. In all such plicies, Emplyer shall be made C-insured. Als ther Tenderers, wrking at the Site, be cvered under the plicy. The Third party insurance shall be fr a sum f Rs 5.00 lakhs per accident. Signature f the Tenderer Page 15

16 HT Wrks 15. COMPLETION TIME : Tenderer shall cmplete the entire wrk within 90 days frm the date f issue f Wrk Order/letter f intent r date f which the site is handed ver whichever is later. During the abve time frame, the tenderer shuld als btain required apprvals frm CEA / Electrical Inspectrate and ther statutry authrities. 16. GENERAL These Special Cnditins f Cntract (SCC) shall be read in cnjunctin with the terms and cnditins stipulated in the General Cnditins f Cntract (GCC). Hwever, if there is any cntradictin between the terms and cnditins mentined in this SCC and thse in the GCC, stipulatins f SCC shall prevail t that extent. Signature f the Tenderer Page 16

AND * Shri S/D/ resident f the sle prprietr f M/s having ffice at the fllwing address * M/s. the partnership firm having an administrative/principal ffice at represented by its Managing/duly authrised partner. * M/s. cmpany/bdy crprate incrprated under the prvisins f the Cmpanies Act 1956 having its registered ffice at the fllwing address, duly represented at duly represented by its cnstituted and authrised Managing Directr, Shri (hereinafter referred t as the "Tenderer") which expressin shall include its successrs, legal representatives and assigns f the secnd part. WHEREAS THE Emplyer intends t avail HT supply at UIIC, Reginal Office: S.C.O , Sectr 17-B, Chandigarh WHEREAS the Emplyer has caused drawings and tender dcuments t be prepared by their Electrical cnsultant Mr. S Chandrasekaran, Chennai (hereinafter referred t as Cnsultant ). AND whereas the Emplyer has called fr tenders fr erectin f electrical installatins as per Emplyer s NIT dated and whereas the tender dt submitted by the Tenderer has been accepted fr such sum as may be ascertained t be payable in terms f the Bill f Quantities and which sum is estimated t be Rs (Rupees ) hereinafter referred t as the said "Cntract Sum". AND whereas the Tenderer has agreed t execute the wrk as per drawings, specificatins, cnditins f cntract f the tender and Wrk Order fr the Emplyer s prject f availing HT Supply at United India Insurance Cmpany Limited, Reginal Office, S.C.O , Sectr 17-B, Chandigarh Signature f the Tenderer Page 17

18 HT Wrks AND whereas the parties herein being desirus f reducing the agreed terms int writing as under: NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:- 1) In cnsideratin f the said Cntract Sum t be paid at the times and in the manner set frth in the said General Cnditins t the Cntract, the Tenderer shall carry ut and cmplete all the Civil, electrical Wrks as per terms and cnditins herein cntained and accrding t the general cnditins f the cntract, ntice inviting tender, special cnditins f cntract, general scpe f wrk, technical specificatins, schedule f rates and instructins t be given by Electrical Cnsultant and t the entire satisfactin f the Emplyer. 2) Cntract Price, Taxes and Payment Terms: Ttal cntract price is Rs... which is inclusive f cst f materials, equipment, installatin charges and tls and tackles required fr executin f the jb. Abve price is inclusive f all taxes & duties including excise duty, sales tax, wrks cntract tax, incme tax, ctri etc. in respect f this cntract. N claim in this respect will be entertained. Sales tax n wrks cntract & Incme tax n payments will be deducted and depsited by Emplyer in accrdance with the sales tax law f the state and the prvisins f tax deductins at surce under Incme Tax Act Hwever, interim payment will be made as per the site measurements n Item Rate basis and certificatin f the Cnsultant : 3) Cmpletin Perid: Time is the essence f the Cntract. The wrk is t be cmpleted in all respects within 90 days frm the date f receipt f the Wrk Order /letter f intent by the Tenderer. If the Tenderer fails t cmplete the jb within the agreed time perid the Tenderer will have t bear liquidated damages as per the relevant clause mentined in the Tender Dcuments. 4) Earnest Mney: The Tenderer has depsited Bank Guarantee/Demand Draft fr an amunt f Rs. 46,500/- (Rupees Frty Six Thusand and Five Hundred nly) as earnest mney. 5) Inspectin f Site: The Tenderer has inspected the site befre submitting his tender and has satisfied himself as t the nature f the wrk t be executed n the site. Any difficulties which the Tenderer may cme acrss in the curse f the wrk shall in n way entitle the Tenderer t claim r receive extra payment unless the Emplyer is f Signature f the Tenderer Page 18

19 HT Wrks the pinin that such difficulties culd nt have been freseen and the Emplyer cnsents in writing. 6) Supply f Material and Labur: The Tenderer shall arrange all labur, materials, equipments, tls, tackles and everything necessary fr the cmpletin f the wrk. The Tenderer will assume all respnsibility fr the safety, prtectin and accunting f all material and equipment and the wrk during cnstructin. All materials used by the Tenderer shall be f the best quality cnfrming t the required specificatin mentined in the tender dcument and will be subject t the apprval f the Electrical Cnsultant / Emplyer. All such materials nt apprved by Electrical Cnsultant / Emplyer shall be remved at nce by the Tenderer at his wn expense. The Tenderer shall als at his wn expense arrange fr carrying ut any test f materials which the Electrical Cnsultant / Emplyer may frm time t time require r if s desired by the emplyer. 7) Defective Wrk / Materials: If any part f the wrk dne by the Tenderer is fund defective in wrkmanship r if bad r inferir materials have been used the Tenderer shall at his wn risk and cst demlish all such defective wrk and rebuild the same and / r replace the bad r inferir materials used within a time frame mentined t the satisfactin f the Electrical Cnsultant / Emplyer. The decisin f the Emplyer / Electrical Cnsultant in this regard shall be final and binding n the Tenderer. In case f default f the Tenderer t remve the defective wrk and rebuild the same r replace bad r inferir materials as directed by the Emplyer, the Emplyer shall be entitled t emply anyne else t carry ut the same at risk and cst f the Tenderer and recver all expenses incurred in this regard frm the Tenderer. 8) Inspectin f Wrk: During prgress f the wrk the site engineer f the Emplyer and Electrical cnsultant/ Emplyer shall be entitled at all times t have access t and inspect the wrk. If the wrk is inspected by the Gvernment/ UIIC s authrized persns, the Tenderer will fully c- perate and extend all help t meet the bservatins. 9) Supervisin: The Tenderer shall prvide ne r mre cmpetent and technically qualified engineers duly and fully authrized t act n his behalf in all matters relating t the wrks t be carried ut under r any ther matter cncerning this agreement and wh shall at all times be present at the wrks while any wrk is in prgress as per directins, explanatins & instructins f Emplyer / Electrical Cnsultant. 20 HT Wrks 10) Cmpliance with Statutry Regulatins & Wrk Rules: The Tenderer shall be respnsible fr cmplying with the applicable laws / bye laws / Regulatins in frce frm time t time and shall have t bear all statuary liabilities t the wrkers / persnnel engaged fr the jb. Nthing will be paid extra in this regard. If any amunt is paid by the Emplyer in this regard the same amunt shall be deducted frm the Tenderer's dues. The Tenderer shall have t arrange insurance cver fr the wrkers / persnnel engaged by him fr the jb. 11) Determinatin f Cntract: In the event f Tenderer failing t keep / adhere t agreed schedule f wrk, r in the event f the Tenderer failing t cmply with the prvisins f this cntract by default and / r negligence and / r suspensin f wrk r in the event f Tenderer failing t cmplete the wrk within the stipulated perid, the Emplyer may terminate this Agreement frthwith and emply, at the Tenderer's risk and cst, anther Tenderer r sufficient number f wrkmen t cmplete the wrk. 12) Frce Majeure: In case any Frce Majeure cnditin herein mentined ccurs and cntinues fr a perid exceeding 15 days the parties heret undertake t sit tgether and devise ways fr expeditius and prper perfrmance f the bligatins f the parties under this rder. This clause will be perative nly if the wrk is delayed by a) Acts f Gd b) Earthquake r flds r similar natural calamities. c) Serius lss r damage by fire r lightning. 13) Arbitratin: In the event f any dispute r difference relating t interpretatin and applicatin f prvisins f the cntract and all disputes/claims whatsever which shall either during the cntinuance f the cntract r afterwards either between the parties t the cntract r the respective representatives tuching the cnstructin/applicatin f any prvisin/clause mentined in the cntract r any accunt r liability between the parties t the cntract r as t any act r deed r missin f any party t the cntract, in any way relating t these presents, shall be first at the discretin f the UIIC attempted t be reslved in gd faith by mutual discussin within 30 days f the dispute r questin being raised failing which the same shall be settled by arbitratin in accrdance with prvisins f Indian Arbitratin and Cnciliatin Act, 1996, as amended up t date. DEFINITIONS / INTERPRETATIONS: In cnstruing these Cnditins and the Specificatins, Schedule f Quantities and Cntract Agreement, the fllwing wrds, shall have the meanings herein assigned t them except where the subject r cntext therwise requires: (a) The `Cntract' means the dcuments frming the tender and acceptance theref and the agreement duly executed between the Emplyer and the Tenderer, tgether with the dcuments referred t therein including thse cnditins, the specificatins, schedule f quantities, tender agreement, designs, drawings and instructins issued frm time t time by the Engineer-in-Charge. All these dcuments taken tgether, shall be deemed t frm ne cntract and shall be cmplementary t ne anther. (b) The `Tenderer' r `Supplier' r `Licensed Electrical Cntractr' shall mean the individual Kartha, r Manager f HUF, firm r Cmpany, whether incrprated r nt, undertaking the wrks and shall include the legal heirs/representatives f such individual r the partners cmpsing firm and theirs legal heirs and successrs, r cmpany's authrised and cnstituted attrneys/agents and permitted assignees f such firm r cmpany. The `Emplyer' shall mean United India Insurance C Ltd., with their Reginal Office at S.C.O , Sectr 17-B, Chandigarh and shall include their heirs, legal representatives, assignees and successrs in interest. (d) Engineer in- Charge shall mean the persns nminated by the Emplyer/ Electrical Cnsultant and shall include thse wh are expressly authrized by him t act fr and n his behalf fr peratin f the cntract and c- rdinatin f different wrks. (e) The Electrical cnsultant shall mean M/s Creatins, S.C.O- 50, 2nd flr, Swastik vihar, M.D.C, Sectr -5, Panchkula n Mail: CREATIONS_30B@REDIFFMAIL.COM (f) Cntract Price shall mean the final accepted rates in the Price Bid heret. (g) Date f Cntract means the `Calendar date n which the Emplyer and Electrical Cntractr have signed the Agreement n the Stamp Paper. (h) Accepting Authrity shall mean the UIIC (the Emplyer). (k) Ntice in writing' r `written ntice' shall mean a ntice in writing typed r printed characters delivered t r sent by registered pst t the last knwn address private r business address r registered ffice address, and shall be deemed t have been received when in rdinary curse f pst it wuld have been delivered, and/r delivered persnally, r therwise prved t have been received. (l) Virtual cmpletin' shall mean that the wrk/installatin is cmplete in all respects in the pinin f the Emplyer and fr which the cmpletin/clearance certificate has been issued by the Engineer -in-charge / Cnsultant and the installatin is fit fr usage. (m) `Drawings' shall mean all drawings and/r design drawings furnished by the Tenderer/ sketches duly signed by the authrised Engineer-in-charge r the Cnsultant n behalf f the Emplyer befre cmmencement r during the prgress f the wrk. (n) Letter f Acceptance' shall mean an intimatin by a letter issued by the Accepting Authrity t tenderer that his tender has been accepted in accrdance with the prvisins in the said letter. () "Defect Liability Perid" (DLP) shall mean a perid f TWELVE (12) mnths. The DLP shall cmmence frm the date f handing ver f entire HV and MV installatins by the supplier/tenderer/licensed Electrical Cntractr with safety certificate t cmmissin the HV and MV installatins frm CEA/Lcal Electrical Inspectrate and certified by the cnsultant / Engineer-in-charge and accepted by the Emplyer. (P) Schedule f quantities" frming part f this cntract. shall mean the schedule f quantities as specified and (q) Priced Schedule f Quantities shall mean the schedule f quantities duly priced with the accepted quted rates f the tenderer. (r) "The wrk shall mean the wrk r wrks t be executed r dne under this cntract. It is seen generally that RMU unit is lcated ppsite t cnsumer s premises inside parking area (n the rads). The exact lcatin frm where electricity department supply is t be tapped is nt knwn, a tentative length f 150 metrs f 3 cre 150 sq. mm. cable (2 runs x 75 metrs) is included in the BOQ. 2. Supply and Installatin 11 KV CT/PT metering unit and 11KV VCB at grund flr f cnsumer s premises. 3. It is seen in nearby building that the 11 KV/433V HV substatin with cnnected MV switchgear has been installed in the terrace f the building in a cmpact frm since sufficient space is nt available fr the installatin f same in Grund Flr. Similarly, due t the site cnstraints, the 11KV/433V substatin in the cmpact frm is prpsed in the terrace f the building (UIIC). 4. Supply and installatin f CSS cnsisting f 11 KV HT VCB, 400 KVA Dry type cast resin transfrmer, MV panel, autmatic pwer factr crrectin panel (APFC), cnnectivity between each and every items mentined abve, earth cnnectins etc., 5. LT cabling frm the CSS t the existing panels lcated belw the staircase landing at Grund Flr. 6. Prviding earthing and earth cnnectins. 7. Liasining wrk with the cncerned department fr the smth executin and cmmissining f wrk. The wrks shuld be carried ut in accrdance with the "drawings" and "schedule f quantities". It includes prviding all the materials, wastage f material, labur, transprt, tls & equipments and management necessary fr and incidental t the cmpletin f the wrk. All wrk during its prgress and upn cmpletin shall cnfrm t the lines, elevatins and grades as shwn n the drawings furnished by the Emplyer. If there are varying r cnflicting prvisins made in any ne r mre dcument(s) frming part f the cntract, the Accepting Authrity shall be the deciding authrity with regard t the intentin f the dcument and his decisin shall be final and binding n tenderer. Any errr in descriptin r quantity r rate in Schedule f Quantities r any missin there frm shall nt vitiate the Cntract r release the Tenderer frm the executin f the whle r any part f the wrks cmprised therein accrding t drawings and specificatins r frm any f his bligatins under the Cntract. Emplyer r their authrized representative may in their abslute discretin issue further drawings and/r written instructins, details, directins & explanatins which are, hereafter cllectively referred t as " The emplyer's instructins" in regard t: a) The variatin r mdificatin f the design quality r quantity f wrks r the additin r missin r substitutin f any wrk. b) Any discrepancy in drawings r between the schedule f quantities and/r drawings and/r specificatins. c) The remval frm the site f any defective material brught theren by the Tenderer and substitutin f any ther material theref. d) The demlitin, remval and re-executin f any wrk executed by the tenderer/s. e) The dismissal frm the wrk f any persns emplyed thereupn. f) The pening up fr inspectin f any wrk cvered up. g) The rectificatin and making gd f any defects under clauses hereinafter mentined and thse arising during the defect liability perid(retentin perid). The Tenderer shall frthwith cmply with and duly execute any wrk cmprised in such Emplyer's r his agent/engineers instructins, prvided always that verbal instructins, directins and explanatins given t the Tenderer r his representative upn the wrks by the emplyer r his agent shall, if invlving a variatin, be cnfirmed in writing t the Tenderer/s within seven days. N wrks fr which rates are nt specifically mentined in the priced schedule f quantities, shall be taken up withut written permissin f the emplyer r his agent. TENDERER SHALL VISIT THE SITE: The tenderers are advised t have a free inspectin f the site befre tendering t ensure that the RMU, CSS etc. shall be installed in the prpsed lcatin with required specificatins as per nrms prescribed by Lcal Electrical Inspectrate. Als the Tenderer shall visit the site and make himself thrughly acquainted with the lcal site cnditins, nature and requirements f the wrks, facilities f transprt cnditin, effective labr and materials, access and strage fr materials and remval f rubbish. Tenderer shall prvide in their tender fr cst f carriage, freight and ther charges as fr any special difficulties and including the plice restrictin fr transprt etc. Fr prper executin f wrks as indicated in the drawings. The successful tenderer will nt be entitled t any claim f cmpensatin fr difficulties faced r lsses incurred n accunt f any site cnditin which existed befre the cmmencement f the wrk r which in the pinin f the Emplyer r his agent/engineer might be deemed t have reasnably been inferred t be s existing befre cmmencement f wrk. 4. DRAWINGS AND SPECIFICATIONS : The Wrk shall be carried ut t the entire satisfactin f the Emplyer and the Electrical cnsultant and in accrdance with the signed drawings, specificatins and ther Cntract dcuments and such further drawings and details as may be prvided by the Electrical Cnsultant and in accrdance with such written instructins, directins and explanatins as may frm time t time be given by the Emplyer / Electrical Cnsultant. N drawing shall be taken as in itself an rder fr executin unless, in additin t the Electrical Cnsultant s signature, it is marked VALID FOR CONSTRUCTION. N claim fr payment fr extra wrk shall be allwed unless the said wrk shall have been executed under the prvisins f Clause 21 (Authrities, Ntices, Patent Rights and Ryalties), r by the authrity, directins in writing f the Electrical cnsultant as herein mentined. On receipt f wrk rder, the Tenderer shall submit the fllwing Drawings within 10 days fr apprval f UIIC/Cnsultant. 1) Electrical Physical Layut Drawings 2) Electrical single line diagram, cntrl wiring single line diagram, cable layut,panel GA drawing etc.even if part may have been prvided by the wner. 3) Lcatin f earth pits and details f earthing even thugh these may have been prvided by wners. 5. SCHEDULE OF QUANTITIES: The Schedule f the Quantities unless therwise stated shall be deemed t have been prepared in accrdance with the standard prcedure f quantity measurement, and shall be cnsidered t be apprximate and n liability shall attach Emplyer fr any errr that may be discvered therein. SUFFICIENCY OF SCHEDULE OF QUANTITIES: The Tenderer shall be deemed t have satisfied himself befre tendering as t the crrectness and sufficiency f his tender fr the wrks and f the prices stated in the Schedule f Quantities. The Tenderer's Rates and Prices shall cver all his bligatins under the Cntract, and all matters and things necessary fr the prper cmpletin f the wrks. 7. ERRORS IN SCHEDULE OF QUANTITIES: Shuld any errr appear in the Schedule f Quantities, ther than in the Tenderer s prices and calculatins, it shall be rectified, and such rectificatin shall nt vitiate the Cntract but shall cnstitute a variatin f the Cntract and shall be dealt with as an authrized extra r deductin. 8. NOTICES: The Tenderer shall give all ntices and pay all fees and ryalties t the Gvernment departments in cnnectin with his cnstructinal activities and shall cmply with all Acts and Regulatins fr the successful cmpletin f the Cntract Wrks. 9. TENDERS: The entire set f tender paper issued t the tenderer shuld be submitted fully priced and als signed n the last page tgether with initials n every page. Initials/signature will indicate the acceptance f the tender papers by the tenderer (Als see General Rules and instructins fr the guidance f Tenderer). The schedule f quantities shall be filled as fllws a) The "Rate" clumn t be legibly filled in ink in bth English figures and English wrds. b) Amunt clumn t be filled in fr each item and the amunt fr each subhead as detailed in the schedule f quantities. c) All crrectins t be initialed. d) The "Rate" clumn fr alternative items shall be filled up. e) The "Amunt" clumn fr alternative items f which the quantities are nt mentined shall nt be filled up. f) In case f any errrs/missins in the quted rates, the rates given in the tender marked "Original shall be taken as crrect Rates. N mdificatins, writings r crrectins can be made in the tender papers by the tenderer, but he may at his ptin ffer his cmment mdificatins in a separate sheet f paper attached t riginal tender papers. The emplyer reserve the right t reject the lwest r any tender and als t discharge any r all f the tenders fr each sectin r t split up and distribute any item f wrk t any specialist firm r firms, withut assigning any reasn. The tenderer shuld nte that the tender is strictly n item rate basis and their attentin is drawn t the fact that the rates fr each and every item shuld be crrect, wrkable and self-supprting. 29 HT Wrks The wrks will be paid fr as measured wrk" n the basis f actual wrk dne and nt as "lump sum" cntract, unless therwise specified. All items f wrk described in the schedule f quantities are t be deemed and paid as cmplete wrks in all respects and details including preparatry and finishing wrks invlved, directly, related t and reasnably detectable frm the drawings, specificatins schedule f quantities and n further extra charges will be allwed in this cnnectin. In the case f lump-sum charges in the tender in respect f any item f wrks, the payment such items f wrk will be made fr the actual wrk dne n the basis f lump-sum charges as will be assessed t be payable by the Emplyer/Cnsultant. The Emplyer has pwer t add t, r mit frm the scpe f wrk, any wrk as shwn in the drawings r described in the specificatins r included in schedule f quantities and intimate the same in writing but n additin, missin r variatin shall be made by the tenderer withut authrizatin frm the Emplyer. Any such unauthrized variatin shall vitiate cntract. The tenderer shall nte that his tender shall remain pen fr cnsideratin fr a perid f 90 days frm the date f pening f the price bid f the tender. 10. AGREEMENT: The successful tenderer, shall be required t sign the cntract agreement, the prfrma f which is enclsed and shall pay fr all stamps and legal expenses, incidental theret. 11. PERMITS AND LICENSES: Permits and licenses fr release f materials r its purchases which are under Gvernment cntrl will be arranged by the tenderer. The emplyer will render necessary assistance, Sign any frms r applicatins that may be necessary. It may be clearly understd that n cmpensatin r additinal charges can be claimed by the tenderer fr nn-availability f such materials in due time n this accunt r accrding t his wn requirements. The tenderer may, hwever, be eligible t a prprtinate extensin f time n this accunt that in the pinin f the Emplyer is reasnable. 12. GOVERNMENT AND LOCAL RULES: The tenderer shall cnfrm t the prvisins f all lcal bye-laws and acts relating t the wrk and t the regulatins etc. f the Gvernment and Lcal Authrities. The tenderer shall give all ntices required by the said Act, Rules, Regulatins and bye-laws etc and shall indemnify the Emplyer against such liabilities and shall defend all actins arising frm such claims r liabilities. 30 HT Wrks 13. TAXES AND DUTIES: The tenderer must include in their tender prices quted fr all duties ryalties, cess and sales tax, value added tax r any ther taxes r lcal charges if applicable. N extra claim n this accunt will in any case be entertained. The tenderer shall keep necessary bks f accunts and ther dcuments fr the purpse f this cnditin as may be necessary and shall allw inspectin f the same by a duly authrised representative f the Emplyer and / r the Engineer-in-charge and further shall furnish such ther infrmatin / dcument as the Emplyer may require frm time t time. 14. QUANTITY OF WORK TO BE EXECUTED: The quantities shwn in the schedule f quantities are intended t cver the entire wrks as per the drawings / scpe f wrk, and therefre the Tenderer is bund t cmplete the wrks at the same quted rates. In the event f quantity exceeding the specified bill f quantity, the Emplyer reserves the right t execute nly a part r the whle r any excess theref withut assigning any reasn therefre. 15. OTHER PERSONS OR AGENCIES ENGAGED BY THE EMPLOYER: The Emplyer reserves the right t execute any part f the wrk included in this cntract by ther agency r persns and Tenderer shall allw reasnable facilities and use f his facilities fr the executin f such wrk. The main Tenderer shall extend all c-peratin in this regard. 16. EARNEST MONEY, INITIAL SECURITY DEPOSIT, RETENTION MONEY & TOTAL SECURITY DEPOSIT : The Tenderer will have t depsit the specified amunt in the frm f Demand Draft drawn in favur f United India Insurance C Ltd., payable at Chandigarh (r) Bank Guarantee in the apprved frmat frm any Scheduled Bank in favur f United India Insurance C Ltd. Chandigarh, at the time f submissin f tender as Earnest Mney. N interest shall be paid n the earnest mney. The earnest mney f unsuccessful tenderer will be refunded withut any interest sn after the acceptance f the selected Tenderer r after the expiry f the validity perid f the tender. The successful tenderer t whm the cntract is awarded will have t depsit as Initial Security Depsit 2% (tw percent) f the value f the accepted tender including the Earnest Mney. The Initial Security Depsit will have t be made within 14 days frm the date acceptance f tender failing which the emplyer at his discretin may revke the letter f acceptance and frfeit the Earnest Mney Depsit furnished alng with the tender.
