8 Pririty Actin c safety related traffic infrmatin MS shall designate sectins f the TERN where traffic and safety cnditins require the deplyment f the rad safety-related service Public and/r private rad peratrs and/r service prviders shall share and exchange the data they cllect. Fr that purpse, they shall make these data available in the DATEX II (CEN/TS 16157) frmat r any fully cmpatible and interperable with DATEX II machine-readable frmat thrugh an access pint. Member States shall manage a natinal access pint t the data referred t, which regrups the access pints established by public and/r private rad peratrs and/r service prviders perating n their territry. These data shall be accessible fr exchange and reuse by any user: n a nn-discriminatry basis; within the Unin irrespective f the Member State f establishment; in accrdance with access rights and prcedures defined in Directive 2003/98/EC (PSI Directive); within a timeframe that ensures the timely prvisin f the infrmatin service; thrugh the natinal access pint Public and private rad peratrs and service prviders shall ensure the timely renewal and quality f data made available thrugh their access pint.

9 Pririty Actin c safety related traffic infrmatin Public rad peratrs, service prviders and bradcasters shall prvide rad safety-related minimum universal traffic infrmatin t end users prir t the prvisin f any ther nn-safety-related traffic infrmatin. Public and private rad peratrs and service prviders shall cllabrate t harmnise the presentatin f the cntent f the infrmatin prvided t end users. They shall infrm end users f the existence f the infrmatin service and its cverage. Member States shall designate an impartial and independent natinal bdy cmpetent t assess whether the requirements set ut in Articles 3 t 8 are fulfilled by public and private rad peratrs and service prviders and bradcasters dedicated t traffic infrmatin. Tw r mre Member States may designate a cmmn bdy cmpetent t assess cmpliance with these requirements n their territries. Public and private rad peratrs, service prviders and bradcasters dedicated t traffic infrmatin shall prvide the designated natinal bdies with their identificatin details and a descriptin f the infrmatin service they prvide, and submit a declaratin f cmpliance with the requirements set ut in Articles 3 t 8. The designated natinal bdies shall randmly inspect the crrectness f the declaratins f a number f public and private rad peratrs, service prviders and bradcasters dedicated t traffic infrmatin, and shall request prf f cmpliance.

10 Pririty Actin c safety related traffic infrmatin Member States shall cmmunicate t the Cmmissin n later than 12 mnths fllwing the entry int frce f this Regulatin the fllwing infrmatin: the natinal bdy designated fr the assessment f cmpliance with the requirements set ut; the descriptin f the existing r envisaged natinal access pint. At the latest 12 mnths fllwing the entry int frce f this Regulatin and every calendar year thereafter, Member States shall cmmunicate t the Cmmissin the fllwing infrmatin: the prgress they have made in implementing the infrmatin service, including the criteria used t define its level f quality and the means used t mnitr its quality; the results f the assessment f cmpliance with the requirements set ut; with regard t the infrmatin service already deplyed n the date f entry int frce f this Regulatin, it shall apply frm 1 Octber 2015.

11 Pririty Actin d truck parking infrmatin Cvers TERN Member States shall designate areas where traffic and security cnditins require the deplyment f infrmatin services n the safe and secure parking places. They shall als define pririty znes where dynamic infrmatin will be prvided. Data n safe and secure public and private parking areas describing the parking facility, t be prvided t the users, shall be cllected and supplied by public r private parking peratrs and service prviders. Public r private parking peratrs and service prviders shall use DATEX II prfiles r ther internatinally cmpatible frmats in rder t ensure interperability f the infrmatin services acrss the Unin. Static data, safety equipment infrmatin, dynamic data Data shall be accessible fr exchange and reuse by any public r private infrmatin service prvider and/r parking peratr n a nn-discriminatry basis, and in accrdance with access rights and prcedures defined in Directive 2003/98/EC. The static data shall be accessible thrugh a natinal r internatinal access pint

12 Pririty Actin d truck parking infrmatin Fr dynamic data, Member States (r natinal authrities) shall be respnsible fr setting up and managing a central natinal r internatinal pint f access referencing all individual single pints f access f each truck parking peratr and/r service prvider n their territry in the interests f users. Member States shall designate a natinal bdy cmpetent t assess whether the requirements set ut are fulfilled by service prviders, parking peratrs and rad peratrs. This bdy shall be impartial and independent. Tw r mre Member States may designate a cmmn reginal bdy cmpetent t assess cmpliance with thse requirements n their territries. All services prviders shall submit a declaratin t the designated bdies n their cmpliance with the requirements set ut Designated bdies shall randmly inspect the crrectness f the declaratins f a number f public and private service prviders and parking peratrs, and request a demnstratin f cmpliance. The quality f the service may als be assessed using user-generated cmment.

13 Pririty Actin d truck parking infrmatin At the latest 12 mnths fllwing the entry int frce f this Regulatin and every calendar year afterwards, Member States shall cmmunicate the fllwing infrmatin: the number f different parking places and parking spaces n their territry; the percentage f parking places registered in the infrmatin service; the percentage f parking places prviding dynamic infrmatin n the availability f parking spaces and the pririty znes t the Cmmissin. It shall apply: frm 1 Octber 2015 t the prvisin f services already deplyed n the date f entry int frce f this Regulatin, frm 1 Octber 2013 t the prvisin f services t be deplyed after the date f entry int frce f this Regulatin

14 Pririty Actin b real-time traffic infrmatin It shall apply t the cmprehensive TERN, as well as mtrways nt included in this netwrk, and pririty znes identified by natinal authrities where they cnsider this t be relevant. Natinal access pints Each Member State shall set up a natinal access pint. The natinal access pint shall cnstitute a single pint f access fr users t the rad and traffic data, including data updates, prvided by the rad authrities, rad peratrs and service prviders and cncerning the territry f a given Member State. Existing natinal access pints that have been set up t cmply with the requirements arising frm ther delegated acts adpted under Directive 2010/40/EU may be used, if deemed apprpriate by the Member States, as natinal access pints. Natinal access pints shall prvide apprpriate discvery services t users. Rad authrities and rad peratrs, in cperatin with digital map prducers and service prviders, shall ensure that they prvide the apprpriate metadata in rder t allw users t discver and use the datasets t which access is prvided thrugh the natinal access pints. Assessment f cmpliance Member States shall assess whether the requirements set ut are cmplied with by the rad authrities, rad peratrs, digital map prducers and service prviders. In rder t prceed t the assessment, the cmpetent authrities f Member States may request frm the rad authrities, rad peratrs, digital map prducers and service prviders the fllwing dcuments: a descriptin f the rad and traffic data, digital map r real-time traffic infrmatin services they prvide as well as the infrmatin n the quality theref and the cnditins f re-use f these data; an evidence-based declaratin f cmpliance with the requirements set ut in Articles 3 t 10. Member States shall randmly check the crrectness f the declaratins referred t.

16 Pririty Actin b real-time traffic infrmatin DATA CATEGORIES The types f the static rad data include in particular: rad netwrk links and their physical attributes, such as: speed limits; gemetry; rad width; number f lanes; gradients; junctins; rad classificatin; traffic signs reflecting traffic regulatins and identifying dangers, such as: access cnditins fr tunnels; access cnditins fr bridges; permanent access restrictins; ther traffic regulatins; traffic circulatin plans; freight delivery regulatins; lcatin f tlling statins; identificatin f tlled rads, applicable fixed rad user charges and available payment methds; lcatin f parking places and service areas; lcatin f charging pints fr electric vehicles and the cnditins fr their use; lcatin f cmpressed natural gas, liquefied natural gas, liquefied petrleum gas statins; lcatin f public transprt stps and interchange pints; lcatin f delivery areas.

17 Pririty Actin b real-time traffic infrmatin The types f the dynamic rad status data include in particular: rad clsures; lane clsures; bridge clsures; vertaking bans n heavy gds vehicles; rad wrks; accidents and incidents; dynamic speed limits; directin f travel n reversible lanes; pr rad cnditins; temprary traffic management measures; variable rad user charges and available payment methds; availability f parking places; availability f delivery areas; cst f parking; availability f charging pints fr electric vehicles; weather cnditins affecting rad surface and visibility. Thse shrt term data need nt t be included in digital map updates as they shall nt be cnsidered as changes f a permanent nature. The types f the traffic data include in particular: traffic vlume; speed; lcatin and length f traffic queues; travel times; waiting time at brder crssings t nn-eu Member States.
