7 Series 1: Cherkee Natinal Recrds Intrductin The Cherkee Natin in Indian Territry maintained its wn cnstitutinal gvernment and recrds fr many years in its districts and at its capital at Tahlequah. In 1893, Cngress prvided fr the creatin f the Cmmissin f the Five Civilized Tribes (Dawes Cmmissin) and authrized this bdy t meet with representatives f the Five Civilized Tribes, including the Cherkees, t persuade them t cnsent t the extinguishment f title t their lands. This effrt met with resistance and rejectin. Then, in 1898, the Curtis Act prvided that a census be prepared by this cmmissin fr each f the Five Civilized Tribes which wuld be used t determine thse individuals wh were citizens f the tribes and therefre entitled t alltment f land in severalty. It was necessary t acquire many f the natinal recrds f the tribes invlved in rder t carry ut the respnsibilities f the Cmmissin. These recrds were taken frm the varius natinal repsitries t Muskgee where the main Cmmissin ffice was lcated. The Curtis Act als prvided that the five gvernments be ablished n Mar. 6, 1906 prir t Oklahma statehd. Hwever, at this time the wrk f the Cmmissin was nt cmpleted, and the Act f Cngress, Apr. 26, 1906, prvided fr the cntinuance f the tribal gvernment with limited autnmy. The recrds, that were later stred in the federal building at Muskgee, caught the attentin f Dr. Grant Freman, wh believed that they were f great histrical value and shuld be inventried and placed in sme rder and place where they wuld be accessible t histrians. He gained the permissin f the Indian Office t direct the calendaring f the dcuments in Later, he and thers were instrumental in having the cllectin placed in the Oklahma Histrical Building in Oklahma City. An act f Cngress, Mar. 27, 1934, (H. R Public N. 133) transferred the recrds t the Oklahma Histrical Sciety s care, althugh wnership remained with the federal gvernment. 8 Mrs. Rella Watts, later Rella Lney (Archivist, ) divided the Cherkee recrds int these categries and filed them chrnlgically within each categry. The 730 bund vlumes f the Cherkee Natinal Recrds riginated with the natinal gvernment as well as in the Cherkee Districts: Canadian, Cweescwee, Delaware, Flint, Ging Snake, Illinis, Saline, Sequyah, and Tahlequah. These recrds, bund and unbund, date mainly frm 1868 t 1907, with a few dcuments dating in the years back t The bund vlumes fr the natinal gvernment include: Acts f Natinal Cuncil, jurnals, registers f apprpriatin acts and miscellaneus Natinal Cuncil Recrds, schl recrds include the minutes f the Bard f Educatin and recrds relating t the different schls in the natin, bth primary and seminary and Clred High Schl. Recrds reflecting the wrk f the citizenship cmmissin f the natin include recrds f claimants, affidavits f citizenship, jurnals, recrds f citizenship cases, Freedmen dubtful cases, Cherkee rejected cases. Auditr recrds include register f claims, clerks reprts, warrants, etc. The Cherkee Treasurer s recrds include reprts f natinal funds, f revenue cllected, registers f vuchers, cash jurnals, sheriffs and districts clerks sales f estray prperty, apprpriatin acts, etc. The district gvernmental recrds included reprts f administratrs, estray prperty, recrds f wills, civil and criminal district curt recrds, circuit and supreme curt recrds, recrds f bnds, f appraisements f imprvements, curt minute bks, recrd f appintments, recrds f marks and brands f livestck, register f twn lts, fficers reprts f twn lt payments, sheriffs registers, and ther categries. These Cherkee vlumes, many f which were rebund, may have three riginal titles: a spine title, a frnt cver title, and an inside page title. There may be als an Indian Archives title written n a prtective cver. These titles are nt always the same. The spine title may be errneus, especially in leather bund vlumes designated t be used by ne branch f the gvernment, i.e. Supreme Curt, but actually used by anther branch f the Cherkee gvernment, that is, the Natinal Cuncil, fr example. The archives vlume number is given first in identificatin, then an riginal title, if ne was given, then an Archives title if ne was assigned. In sme cases, ne title will be given if there is an agreement between all titles n, in, r assigned t the vlume. Cherkee vlumes ften cntain a variety f different entries. These will be briefly utlined n each cntent page fr each vlume. A secnd part f the Cherkee Natinal Recrds came t the Indian Archives, Oklahma Histrical Sciety, sme years after the first grup described abve. They riginated in Tahlequah and are therefre listed as Cherkee (Tahlequah). They were kept separate frm the already calendared and partially indexed first grup. The Tahlequah cllectin has nt been calendared r indexed, but is filed accrding t categries similar t thse f the unbund recrds f the first accessined grup. The Natinal Recrds kept by the Cherkee Natin are cnsidered t be valuable t histrians and thers because they represent, alng with the natinal tribal recrds f the Chctaw, Chickasaw, Creek, and Seminle, the largest grup f recrds f svereign Indian natins knwn t exist t this date. As such, they give a view f Indian histry that is unknwn fr ther American Indian tribes wh did nt have cnstitutinal gvernments and written recrds. 3
