1 Making $ and f Yur Ryalties SOCAN administers the public perfrmance and cmmunicatin right in ur members musical wrks. What des that mean exactly? It means that whenever a cpyrighted piece f music is played publicly, such as n the radi, in cncert, r n televisin, the writers and cpyright wners f that piece f music are legally entitled t a "perfrmance ryalty." And where des the mney fr that perfrmance ryalty cme frm? Music users pay license fees t SOCAN thrugh a series f "tariffs" designed fr a variety f unique music uses. A tariff is essentially a rate set by the Cpyright Bard f Canada, which determines the license fee payable t SOCAN fr the public use f live r recrded music. Our jb as Canada's perfrming rights sciety is t cllect n these tariffs and put the resulting ryalties in the hands f the writers and publishers whse musical wrks have been publicly perfrmed. SOCAN has reciprcal agreements with scieties arund the wrld, meaning we als cllect and distribute ryalties t internatinal perfrming right scieties fr the perfrmance f their musical wrks in Canada, and they, in turn, cllect fr SOCAN's repertire in their respective territries. Thrugh these agreements, SOCAN is able t cllect fr ur members' perfrmances all ver the wrld. This all amunts t an enrmus amunt f data: the entire wrld's catalgue f musical wrks, perfrmed in a myriad f different ways, all needing t be tracked and paid. While the prcess by which these ryalties are calculated and distributed can initially appear daunting, it's yur right as ur member t understand where yur ryalties are cming frm and why they are calculated in the way that they are. This dcument is intended as a basic, easy-t-understand utline f why, when, and hw we pay ryalties t yu, ur member, and what yur respnsibilities are as a SOCAN member t make sure that we have all the infrmatin we need in rder t help yu maximize yur perfrmance incme. We hpe that yu find it helpful. Earning Ryalties In Canada Hw Lng Will It Take t Receive My Ryalties? Befre yu start thinking SOCAN has missed accunting fr yur recent perfrmances, yu shuld knw that there is a set schedule by which we calculate and distribute ryalties t ur members. There is a lt f infrmatin t prcess between the date f the perfrmance and when the ryalties fr that perfrmance can be distributed. 2 Getting Paid fr Radi and Pay Audi Perfrmances SOCAN cllects license fees frm radi statins as well as venues, sprting events and theme parks t create the pls frm which radi perfrmances are paid. These pls are the CBC Pl, Survey Radi Pl and Radi Pl. In additin t radi perfrmances, members als receive ryalties fr Pay Audi perfrmances. What We Need Frm Yu! Register yur wrks nline Include any alternative names (AKAs) fr the title in the registratin Register yur wrks with Nielsen BDS Radi (Tariffs 1A, 1B & 1C) SOCAN distributes ryalties n radi perfrmances acrss Canada. T determine hw much a radi perfrmance is wrth, musical wrks are first given a duratin credit depending n their length. Less than 1:00 minute: 1 credit 1:00 6:59: 4 credits 7:00 r lnger: 1 credit per additinal minute The credit value f a radi perfrmance is determined by dividing the ttal payable credits fr the quarter int the ttal amunt f mney available in the pl. As there are three radi pls, credit values vary depending n which pl a perfrmance is paid frm. The fllwing frmula is used t determine the ryalty amunt payable fr a radi perfrmance: Duratin Credit x # f Perfrmances x Credit Value = Ryalty ($) Ryalties are then paid ut t the writer(s) and publisher(s) based n the wrk registratin. Exceptin: Cmmercial messages, advertisements, prgram prms and public service annuncements f ne minute duratin r less are nt eligible fr radi distributin. Radi Pl (Cmmercial & Nn-Cmmercial Radi): Cmmercial radi statins (privately wned) that are mnitred by Nielsen BDS, are paid n a census basis. In rder fr a wrk t be captured in the census, it must be registered with Nielsen BDS. T register with Nielsen BDS, please send an with Virtual Encde as the subject t the BDS Client Services Department at clientservices@bdsnline.cm t btain a username and passwrd. Survey Radi Pl (Cmmercial & Nn-Cmmercial Radi): Cmmercial radi statins nt mnitred by BDS technlgy are required t prvide prgramming each quarter t SOCAN. CBC Pl: All CBC radi perfrmances are paid frm a dedicated CBC Pl. Netwrk and reginal CBC radi perfrmances are tracked n a census basis, while lcal CBC radi perfrmances are sampled acrss the cuntry and weighted accrding t the ppulatin in each lcality. Pay Audi: Digital Pay Audi service prviders allw satellite and cable televisin subscribers t access cmmercial-free, annuncer-free, digital sund quality, pre-packaged music. Pay Audi perfrmances are paid frm a sample f prgramming infrmatin, cnsisting f 21 days each distributin perid. The prgramming infrmatin is given t SOCAN by the pay audi service prviders. 4 Getting Paid fr Ringtnes In Canada, ringtnes are cnsidered a telecmmunicatin and are licensed by SOCAN under Tariff 24. SOCAN distributes frm the Ringtne Pl based n infrmatin frm the Ringtne prviders. In rder t receive ryalties fr ringtne perfrmances, make sure yur wrks are registered with SOCAN. 5 Getting Paid fr Satellite Radi Satellite radi prviders are licensed by SOCAN under Tariff 25. Satellite radi ryalties are distributed frm the Satellite Radi Pl and are based n a sample f prgramming infrmatin fr the last 7 days f each mnth fr each satellite channel. These perfrmance lgs are reprted by the satellite prviders transmitting in Canada. In rder t receive ryalties fr satellite radi perfrmances, make sure yur wrks are registered with SOCAN. 5

6 Getting Paid fr Cncert Perfrmances SOCAN cllects license fees frm venues and prmters fr live perfrmances. These ryalties are then paid ut t the writer(s) and publisher(s), based n the wrks perfrmed. Cncerts licensed under 3A (Club shw) will receive a distributin f $75 maximum. Cncerts licensed under 4A, 4B r 5B will receive a minimum distributin f $75 n the perfrmance, with the amunt increasing based n the license fee cllected. Fr a cncert where the license fee received is $500 r mre and there are tw r mre musical acts, ryalties shall be allcated and distributed in the fllwing manner: One Headline Act and One Supprt Act 90% Headline 10% Supprt Three r Fur Musical Acts 70% Headline 30% Supprt Mre than Fur Musical Acts Allcated equally based n duratin f wrks Tw r Mre Headline Acts Acts will share in equal prprtin f 90% Exceptins: Nt all cncerts are distributable. SOCAN must first cllect the license fee frm either the venue r prmter befre we can distribute ryalties. 8 Getting Paid fr Audi Visual Perfrmances SOCAN cllects tariffs frm televisin statins (Tariff 2 & Tariff 17A) and cinemas (Tariff 6) fr the public perfrmance f music cntained within the prgrams and films they exhibit. What We Need Frm Yu! Cue Sheets Make sure all the infrmatin requested n the cue sheet is prvided (actrs, prducer, directr, instrumental/vcal, etc.). Make sure the cue sheet is signed by the prducer Identify which US Sciety will be representing yu fr this prductin (SOCAN/ASCAP, SOCAN/BMI) Make sure yur publisher has the same US affiliatin as yu. Make sure all interplated wrks (sngs) are registered with SOCAN Televisin (Tariffs 2 & 17A): SOCAN distributes ryalties fr all bradcast (terrestrial) and nn-bradcast (cable & specialty) televisin in Canada. All mney received frm the Bradcast TV statins and Cable statins is placed int tw separate pls; the Bradcast TV Pl and Nn-Bradcast (Cable) Pl. In rder t distribute n these pls, SOCAN receives dmestic prgramming infrmatin frm Tribune Media Services (TMS), a cmpany that tracks cntent that airs n TV arund the wrld, and matches it t cue sheet infrmatin in SOCAN s database. If there is n cue sheet in the database, an unidentified perfrmance is created and a cue sheet is requested frm the prductin cmpany, the freign sciety r the statin that aired the prgramming A credit system is used in rder t determine the amunt f ryalties fr a specific use f music. One credit is given fr each secnd f duratin. The type f music use indicated n the cue sheet will impact the amunt f credits received: Theme music (bth pening and clsing) - 100%. Feature/surce music - 100%. Cncert feature music - 200%. Backgrund/scre music - 60%. Lg music - 5%. The time f day the prgram is shwn als impacts the number f credits granted. The perfrmance f music in televisin (bradcast and nn-bradcast statins) between 2:00 A.M. and 5:59 A.M. receives 5% f the credit it wuld nrmally receive if bradcast at anther time. The statin the prgram is exhibited n als impacts the amunt f ryalties. This is called "Statin Weight". Fr Bradcast TV, the Statin Weight is in direct prprtin t the license fees received frm each Bradcast TV statin. Fr Cable TV, effective with the February, 2011 distributin (2Q10) and fr subsequent three quarters, up t and including the Nvember, 2011 distributin (1Q11,) the weight will be calculated using a cmbinatin f the 8

9 audience data and license fees received fr each cable statin. Starting with the February, 2012 distributin (2Q11) Cable TV statin weights will be in direct prprtin t the license fees. Each quarter, the ttal number f credits (Ttal Payable Credits) fr each pl are calculated and divided int the ttal amunt f mney in each pl t give a Credit Value. The fllwing frmula is used t determine the amunt f ryalties a specific music use shwn n televisin is wrth: Duratin x Use x Statin Weight x Time f Day x # f Perfrmances x Credit Value = Ryalty ($) The ryalties calculated are then paid ut accrding t the share percentages fr the writer(s) and publisher(s) utlined n the cue sheet. Exceptin: Cmmercials, advertisements, jingles and prms f 1 minute duratin r less are nt subject t any distributin in Canada. Hwever, freign scieties may distribute ryalties fr such usage, dependant n their distributin rules. Cinema (Tariff 6): SOCAN pays ryalties fr music used in mvies that are shwn in cinemas acrss Canada. Cinemas pay license fees accrding t hw many seats they cntain, and the mnies cllected g int a pl. As with televisin, cue sheets are used and credits are determined accrding t the same use types (theme, feature, cncert, backgrund, and lg). One mvie being shwn fr ne week n ne screen cunts fr ne cinema perfrmance. This differs frm televisin, in that every exhibitin f an episde cunts as a perfrmance. Credit Value is determined in the same way as televisin, by dividing the Ttal Payable Credits fr the quarter int the ttal amunt f mney available in the pl. The fllwing frmula is then emplyed t determine the amunt payable, which is then divided between the writer(s) and publisher(s) as per the cue sheet: Duratin x Use x # f Perfrmances x Credit Value x Statin Weight = Ryalty ($). Exceptin: As with televisin, cinema cmmercials and trailers are nt subject t any distributin in Canada, but may be subject t ryalties in ther territries. Think Yu Haven't Been Paid? 10 Getting Paid fr Internet Perfrmances SOCAN cllects license fees frm Internet services under Tariff 22(A-G). All revenues received frm nline music sites, frm YuTube fr nline musical wrks perfrmances, frm audi websites, and frm game sites will be placed in the new Internet pl. All mnies in the Internet pl will be distributed based n infrmatin received frm the licensed Internet services fr their nline music streams fr each distributin perid. These services prvide SOCAN with their full usage data. Where infrmatin frm sme licensees is missing r incmplete, mnies will be distributed based n prgramming received frm ther licensees fr that same quarter. Perfrmances have been summarized s that 100 actual perfrmances will be represented by 1 perfrmance n statements, and we have set a minimum threshld f 5 summarized perfrmances (representing 500 actual perfrmances) fr a payment t ccur. The $ per perfrmance amunt is calculated based n the distributable pl amunt and the number f perfrmances, similar t traditinal distributin methdlgies. Revenues received frm the fllwing Internet services will be allcated t the existing pls as fllws: Fees received frm bradcast and nn-bradcast televisin licensees fr nline audi-visual services g t the Televisin pls. Fees frm YuTube nline mvie rentals g t the Cinema pl. Fees frm the websites f cmmercial radi statins, nn-cmmercial radi statins and CBC Radi g t the crrespnding Radi pls. Fees frm pay audi services fr nline cntent g t the Pay Audi pl, and Fees frm nline satellite radi services g t the Satellite Radi pl. All mnies in the Cinema pl received frm YuTube fr nline mvie rentals will be distributed based n perfrmance infrmatin received frm the licensee and receive ne credit per viewing reprted. Cntent streamed frm websites wned by radi, pay audi, bradcast and cable televisin peratrs are paid accrding t the census/survey data received fr terrestrial prgramming. Please nte that cmmencing in February 2014, Internet ryalties will be distributed ne quarter behind ur regular ryalty perids. Fr example, in February 2014, SOCAN will distribute Internet ryalties fr the perfrmance perid January t March

11 Earning Ryalties Arund the Wrld SOCAN, thrugh its reciprcal agreements with affiliated Perfrming Rights Organizatins (PROs) arund the wrld, is passinate abut ensuring that we cllect and distribute the maximum available revenue t yu, ur members. When will I get paid? SOCAN distributes internatinal ryalties t its members n a quarterly basis, cinciding with its distributin f ryalties frm dmestic perfrmances. In sme cases, payments will include perfrmances frm the previus year; hwever, in ther cases, ryalties may be applicable t perfrmances dating back tw, three, r fur-plus years, depending n the territries and the distributin practices f the freign PROs. Wh des what? Each PRO has its wn unique survey methdlgies, its wn distributin rules and prcedures, and is bund by the cpyright laws f its wn cuntry smetimes influenced by scial, plitical, and ecnmic cnditins. In sme cases, tariffs cvering certain types f music usage have been apprved in certain territries, but nt in Canada and vice versa. In effect, each territry is an island unt itself, while still bligated t fllw certain prescribed plicies and standards as signatries t internatinal cpyright cnventins, and as members f the Internatinal Cnfederatin f Scieties f Authrs and Cmpsters (CISAC), the Paris-based umbrella rganizatin whse members include PROs such as SOCAN. Hw d we d it? SOCAN enjys excellent wrking relatinships with its internatinal affiliated PROs. We send ntificatins f perfrmances t freign territries, and pursue claims n behalf f SOCAN members. We als manage and maintain internatinal agreements invlving ur members t ensure that the crrect publishers and sub-publishers are cmpensated.
