2 FOREWORD BY THE CHAIRMAN I am pleased t be able t intrduce the first annual reprt fr the Cmmunicatins Cmmissin. We have develped this reprt in the spirit f penness and transparency and we hpe that it prves useful t licence hlders and stakehlders alike. Telecmmunicatins is an increasingly imprtant part f ur everyday lives fr cnsumers and businesses arund the wrld, and the Isle f Man is n different. This is why we were pleased t see that telecmmunicatins featured s highly in the Prgramme fr Gvernment We are cmmitted t help achieve these gals. The Cmmunicatins Cmmissin plays an imprtant rle in facilitating and regulating telecmmunicatins and the aim f this Annual Reprt is t highlight the wrk we have undertaken this past year. The Cmmissin is als playing an active part f the key wrk planned in the Prgramme fr Gvernment, cnsidering ur infrastructure t supprt new technlgies, the quality f ur bradband and the lng term sustainability f technlgy n Island. Last year we wrked with DED t cmmissin a reprt n the technlgical landscape f the Island, lking at cnnectivity fr businesses and planning fr the future, including 5G and the Internet f Things. That reprt has led t further wrk being cmmissined specifically t cnsider the ptins fr fibre n the Island. We expect this reprt t be finished this summer. We als regulate 3 lcal radi bradcasters, each f which plays an imprtant part in keeping cnsumers up t date, infrmed and entertained. Hn W M Marlarkey MHK Chairman 1

3 INTRODUCTION BY THE DIRECTOR 2016/17 was a busy and exciting year fr the Cmmissin. Whilst the full list f ur achievements during the year is cntained further dwn within this reprt, I will cmment n sme f the highlights first. We gained a new Chairman, Hn W M Malarkey, wh Chaired his first meeting in Octber We welcme the Chairman and thank him fr his cmmitment and supprt during the part f the year that he was with us fr. We als said gdbye t tw f ur lng standing Members, The Speaker, the Hn Juan Wattersn MHK and Ms Kathy Harrisn. Bth made invaluable cntributins t the wrk f the Cmmissin during their time n the Bard. Mr Nigel Crdwell, Mr Maurice Mawdsley and Mr Rbert Frize cntinue their service. We als gained tw new Members, Mr J P Dnni and Mr Brian Parkin. Between them, ur Members bring a wealth f experience gained thrugh building lngstanding careers within the telecmmunicatins, satellite, legal, financial services and ICT industries. We als gained a new member f staff in July, t fill the vacant psitin f Regulatry Manager, which has helped us manage ur ever increasing wrklad. Manx Telecm has cmmitted cnsiderable resurce t meeting its Significant Market Pwer bligatin t prduce separated accunts and we received the first set at the end f December Wrk nw cntinues t develp and analyse these accunts. We are already seeing a psitive impact frm their bligatin fr cst-rientatin and this has led t reductins in VDSL bradband and leased line pricing. Sure was granted Cde Pwers, which enables it t build its wn fixed netwrk, and its licence was subsequently amended. We see this as psitive fr the industry as it increases cmpetitin. The satellite filing industry was pened up t allw a secnd cmpany t file thrugh the Isle f Man. We als licence Earth Statins, the first licence being awarded t SES Satellite Leasing Limited in January All f these utcmes serve t increase cmpetitiveness and success f the industries we regulate. There is significant verlap between the Isle f Man, the UK and EU regulatin in telecmmunicatins and bradcasting in certain areas. Althugh, at the time f writing, there is n clear infrmatin n the implicatins f Brexit n the scpe f the Cmmissin's wrk, we will mnitr and react t develpments as they arise. 4 ABOUT THE COMMISSION Bard Members The Cmmunicatins Cmmissin is a Statutry Bard cmprising six members. As enshrined in legislatin, the Chairman f the Cmmissin is the Minister fr Hme Affairs. The ther 5 Members are appinted by the Cabinet Office, fr 5 year terms and are eligible fr reappintment at the end f the terms. The Chairman hlds an equal vte. Bard Meetings are held n a bi-mnthly basis, thugh special meetings can be held where necessary. T achieve a qurate there must be a minimum f 4 Members. 5 Staff The Cmmissin has a staffing establishment f 4 full-time equivalent staff rganised as fllws: Directr Dr Carmel McLaughlin Head f Regulatry Plicy Ms Sue Strang Regulatry Manager Miss Katy Cllister Regulatry Assistant Mrs Lynda Lane Dr Carmel McLaughlin - Directr f the Cmmunicatins Cmmissin Dr Carmel McLaughlin tk up her psitin as Directr f the Cmmunicatins Cmmissin in July 2008 and has ver twenty years experience in cmmunicatins regulatin. Dr McLaughlin left the Office f Cmmunicatins (Ofcm) in Lndn, where she was a Principle within the Spectrum Plicy Grup, t take up her psitin in the Isle f Man. Prir t Ofcm, Dr McLaughlin wrked fr fur years at the Cmmissin fr Cmmunicatins Regulatin (CmReg) in Dublin and previusly held a number f management appintments with Ofcm legacy regulatrs (the Independent Televisin Cmmissin and the Independent Bradcasting Authrity). Dr McLaughlin has a PhD frm the University f Cambridge, a BSc frm the University f Edinburgh and is a frmer pupil f Kylemre Abbey Schl, Cnnemara, Cunty Galway. Ms Sue Strang - Head f Regulatry Plicy Sue has wrked fr IOM Gvernment since 1997, firstly in the Department f Educatin befre transferring t the Department f Trade and Industry t specialise in emplyment law and plicy. She mved t the Department f Cmmunity, Culture and Leisure as Legislatin and Plicy Manager in 2010 befre jining the Cmmunicatins Cmmissin in Sue has a law degree frm Nttingham University and a Masters in Law and Emplyment Relatins frm Leicester University. She has many years f experience in wrking n the develpment f primary and secndary legislatin. 4

6 Miss Katy Cllister - Regulatry Manager Katy jined the Cmmissin in July 2016, having previusly wrked within the Isle f Man Office f Fair Trading and Ecnmic Affairs within the Cabinet Office. Katy has a degree in Business Ecnmics frm Lancaster University and a Pstgraduate Diplma in Ecnmics fr Cmpetitin Law frm King s Cllege Lndn. Mrs Lynda Lane - Regulatry Assistant Lynda Lane jined the Cmmissin in March 2014, having previusly wrked as a PA in the Chief Executive and Minister s Office within bth the Department f Scial Care and the DHSS. Lynda wrked ff island fr many years fr Merseyside Plice and undertk varius rles including managing a busy Perfrmance Management Infrmatin Unit, was an Admin Manager within a Training Unit and als wrked as a Clerical Officer within the Traffic Department fr 12 years. 5

7 WHAT WE DO The Cmmunicatins Cmmissin licenses and regulates telecmmunicatins and bradcasting in the Isle f Man under the Telecmmunicatins Act 1984, the Radi Masts Regulatin Act 1988 and the Bradcasting Act We act independently f Gvernment and cmmercial interests in rder t carry ut ur activities and perate in a manner t prmte cnsumer s best interests. Our cre and statutry functins fcus arund the fllwing sectrs: Telecmmunicatins The Cmmissin exercises its functins in the manner that it cnsiders best prmtes the interests f cnsumers, purchasers and ther users f telecmmunicatins services in the Island. It aims t ensure that all thse wh run telecmmunicatins systems cmply with the terms and cnditins f their licences. It wrks in crdinatin with ther Departments t implement the Gvernment s brader space, e-business and Visin 2020 strategies. The Cmmissin liaises clsely with the UK Office f Cmmunicatins (Ofcm). The Island is part f the UK Telephne Numbering Scheme and Ofcm manages the radi spectrum n behalf f the UK Gvernment, Crwn Dependencies and Overseas Territries. Bradcasting The Cmmissin licenses and regulates the cntent f prgramme services prvided frm places in the Isle f Man. All lcal bradcasters must cmply with the Cmmissin s Cdes f Practice n prgramme cntent, advertising and spnsrship. Spectrum The Cmmissin wrks clsely with Ofcm n radi spectrum issues. Ofcm is respnsible fr the licensing f radi spectrum under the Wireless Telegraphy Act 2006, which it des in cnsultatin with the Cmmissin t take int accunt differences between UK and Isle f Man Gvernment plicies. Radi Masts The Cmmissin licenses the cmmercial site sharing f transmitter mast facilities n the Island fr bth the public and the private sectrs. Space The Cmmissin places filings fr gestatinary satellite rbital slts thrugh Ofcm t the Internatinal Telecmmunicatins Unin (ITU), thrugh its cntractrs. Incme Generatin The Cmmissin charges licence fees t its licence peratrs which fund its peratins and cnsistently generates a surplus f arund 500,000 fr Treasury. 6

9 At the April 2017 sitting f Tynwald, the reprt titled Delivering the Prgramme fr Gvernment was cnsidered. This reprt suggested that the take up f VDSL bradband, plus sync speed data frm the netwrk int the ruter, culd be a natinal indicatr fr measuring the quality f bradband. We are cmmitted t wrking with Gvernment t help t measure this indicatr. 8

10 THIS YEAR AT A GLANCE During the financial year 2016/17 there has been a wide and varied range f wrk undertaken by the Cmmissin. Sme f the highlights are nted belw: Telecmmunicatins - We received Manx Telecm s first set f separated accunts at the end f 2016 which are required t ensure it fulfils its ther bligatins f transparency, nn-discriminatin and cst-rientatin, and we have begun ur review f these accunts - We carried ut wrk int cstings which resulted in reductins in whlesale leased line prices and VDSL bradband - We have assisted with facilitatin f wrking grups between the fully licenced peratrs t develp whlesale prducts t enhance cmpetitin. - We have supprted peratrs with the intrductin f Fixed Number Prtability, with an expected launch date f Q We began ur review f market statistics cllected and published and aim t prduce a new range f statistical figures in the cming mnths and t keep what we cllect and publish under review - We assisted the Department f Ecnmic Develpment with its Telecmmunicatins Infrastructure Review - We set up wrking grups fr the telecmmunicatins licenced peratrs - We created and published a set f principles fr use f Isle f Man numbers which peratrs must adhere t. This is imprtant if we are t maintain 6 digit dialling in the Isle f Man - We have cntinued t chair the Licenced Operatr (LO) frum at bi-mnthly intervals, t allw peratrs a chance t discuss and develp slutins t industry wide issues - We amended Sure s Telecmmunicatins Act licence t include Cde Pwers - We attended wrking grups aimed at refrming planning plicy and wayleave regimes t assist in the rll ut f 5G - We cnsulted n Mbile Terminatin Rates remaining at 1.25ppm and that decisin was implemented with effect frm 1 st May We wrked with DED n the finalisatin f a reprt int the Technlgy infrastructure f the Island and its sustainability int the future. 9

Bradcasting - We published a set f prcedures fr dealing with bradcasting cmplaints - We partially upheld ne cmplaint which resulted in a right f reply being ffered and subsequent aplgy t the cmplainant - We issued a statement f Cmpliance t Manx Radi cvering the perid stating that we partially upheld 1 cmplaint n the basis f nt ffering the right f reply, as required under Sectin 2.14 f the Prgramme Cde - We assisted Treasury n a reprt n the future f Manx Radi s AM transmissin netwrk Space - We engaged in a prcurement exercise and awarded tw Agreements, t ManSat Ltd and SES Satellite Leasing Ltd, t allw fr the respective cmpanies t engage in satellites filings thrugh the Isle f Man. Legislatin - We cntinued t wrk thrugh the respnses t the Cmmunicatins Bill cnsultatin - We began testing licences under the Cmmunicatins Bill t ensure they remain fit fr purpse - We wrked with Ofcm t extend a number f Regulatins under the Wireless Telegraphy Act. 12 TRANSPARENCY AND ACCESS REQUESTS Cnsultatins Cnsultatin is a vital part f a caring sciety and an essential means f tw-way cmmunicatin between gvernment, regulatrs and the public. As such, it is very much in line with the principles f penness and cmmunity fcus endrsed by the Isle f Man Gvernment and Tynwald. The purpse f cnsultatin is t gather views and cmment s that issues are decided, as far as pssible, n cnsideratin f all the relevant infrmatin and arguments. It infrms the decisinmaking prcess, raising pints t be taken int accunt that might therwise have been verlked. The Cmmissin is dedicated t wrking in an pen and transparent manner. During 2016/17 year the Cmmissin went ut t public cnsultatin n tw separate matters: - Between 13 May and 13 June 2016 the Cmmissin cnsulted n its recmmendatin t award Cde Pwers t Sure (Isle f Man) Limited fllwing an applicatin. This recmmendatin was carried and Sure s licence was subsequently amended. - Between 21 February and 22 March 2017 the Cmmissin cnsulted n its recmmendatin fr the Mbile Terminatin Rate t remain at 1.25ppm. Tw respnses were received and the recmmendatin carried. Additinally, we als cnsulted with Licenced Operatrs (LOs) n varius matters, including: - Between 8 th Nvember and 2 nd December 2016 we cnsulted LOs regarding ur wish t cllect and publish an assrtment f market statistics data. This was a useful exercise and we are nw in the prcess f cllecting and cmpiling a new range f statistics t publish, relating t Q nwards. - Between 7 th February and 7 th March 2017 we cnsulted n updating the Other Licenced Operatr (since renamed Licenced Operatr) frum terms f reference. The updated versin was published n ur website in April Between 27 March and 24 April 2017 we cnsulted LOs n a draft Vluntary Cde f Practice fr Bradband speeds. Wrk n this is still prgressing Infrmatin Access Requests During 2016 the Cmmissin received n requests fr infrmatin under the Cde f Practice fr Access t Gvernment Infrmatin, r under the Data Subject Access Request prvisins within the Data Prtectin Act

We did receive ne applicatin fr a licence amendment, hwever the Cmmissin required further infrmatin befre it culd cnsider the applicatin. The infrmatin is still awaited. 13

15 COMPLIANCE Cmpliance Telecmmunicatins During 2016/17 there were n breaches f licence cnditins. Cmpliance Bradcasting During 2016/17 there was 1 bradcasting cmplaint partially upheld by the Cmmissin, against Radi Manx Limited (Manx Radi). There was als 1 advertising campaign remved frm air as bradcasters felt that it culd have breached the Cde f Advertising and Spnsrship by quting the wrd free when there was in fact a charge fr the prduct in questin. 14

16 WHAT WE SAID.VS. WHAT WE DID The Business Plan fr set the Cmmissin a range f bjectives, as set ut belw. This sectin details whether thse bjectives were met and if nt, why we did nt meet them. 1. Successfully undertake the 4G mbile spectrum award, ensuring the licensees achieve successful rll-ut f their netwrks, accrding t the criteria and timings set ut in the licence(s) issued. Objective Met We cnsulted n awarding spectrum during 2013 and subsequently awarded licences t Manx Telecm and Sure. We requested peridic updates n rll-ut statistics frm bth peratrs t ensure adherence t the licence cnditins. Bth peratrs have met, and we understand have nw exceeded, the cverage requirement in their licences f 95% ppulatin cverage fr 4G. 2. Bring the Cmmunicatins Bill t the branches f Tynwald, fllwing stakehlder cnsultatin. Objective Partially Met A great deal f wrk has gne int preparatin f a draft Cmmunicatins Bill and thanks are due t the Attrney General s Chambers fr the resurce that they have prvided t assist with drafting f the Bill. The first draft Bill went ut t cnsultatin in 2015, which prvided a wide variety f helpful and thrugh feedback frm varius institutins. Wrking thrugh these respnses tk lnger than anticipated and this meant that we did nt meet ur bjective t get the Bill t the branches f Tynwald by the end f 2016, but instead we are nw wrking twards a target f the end f Take the Cmmunicatins Bill thrugh the branches f Tynwald, btaining parliamentary agreement (and eventual Ryal Assent). Objective Nt Yet Met As detailed abve, wrk is still prgressing n the Cmmunicatins Bill. 4. Cmplete the prcess f pening up the Island s whlesale telecms markets thrugh the Other Licensed Operatrs (OLO) frum, s that a first set f whlesale prducts are specified and develped, and an active prcess fr future prducts is in place and perating. Objective nging. The OLO frum cntinues t meet (generally n a bi-mnthly basis) and this has prvided a useful mechanism fr discussin f new prducts and subsequent develpment. Sme f the new prducts include whlesale line rental and fixed number prtability, which is currently at the final stage f develpment. We have since re-named this frum the Licenced Operatr (LO) frum. 5. T keep the Isle f Man at the frefrnt f innvatin in cmmunicatins technlgy and services, thrugh the develpment f a test & trial licence regime t allw use f the Island s land and spectrum resurces fr testing new applicatins. Objective nging The Island remains cmmitted t using its spectrum efficiently and t the best effect fr cnsumers and has undertaken cnsultatins n and awards f spectrum in the 3.4GHz band, 3.6 GHz band as well as fr 4G. 6. Overhaul the licensing prcesses in all sectrs. This wuld invlve streamlining, allwing fr renewals, test & trial licences etc. Objective Partially Met This wrk stream must lead ut f the Cmmunicatins Bill being taken thrugh the branches f Tynwald. Hwever, wrk has begun in relatin t testing whether the licences in 15

17 their current frmat are cmpatible with the Cmmunicatins Bill. We will make the necessary amendments as and when required t ensure the licences remain fit fr purpse. 7. Overhaul the fees structure in all sectrs. This will invlve ensuring licensed activities are subject t fees (if desired) and that these are prprtinate and maintain returns t the IM Treasury. Objective Met During 2014 the Cmmissin cnsulted n increasing the ISP licence fees and subsequently intrduced the amendment. In 2016 we als published a set f guidance n hw t calculate the licence fee payable t the Cmmissin t ensure that all relevant turnver is included and nn-regulated activity revenue is nt. The Cmmissin als issued a licence fr Earth Statins fr SES t build a teleprt n the Isle f Man t prvide satellite telemetry, tracking and cmmanding facilities and the ptential t prvide a range f bradcasting and data service. 8. Cntinue the Cmmissin s current wrk with the BBC, ITV and Ofcm n matters such as the representatin f the Island in the media, service receptin n-island, spectrum licensing and crdinatin, and regulatry standards and practice. Objective Met We stay in regular cntact with ther regulatrs and prvide advice and assistance where we can, in return fr the same. This ensures that we can learn frm ther jurisdictins experience. We have rganised a Small Regulatrs Cnference fr May 2017 which will allw fr an pen frum within which we can share and learn frm the experience f ther regulatrs in small jurisdictins. 9. Review and revise Bradcasting cdes. Objective Nt Yet Met This wrk stream must lead ut f the Cmmunicatins Bill being taken thrugh the branches f Tynwald. 10. The Cmmissin will cntinue t wrk with ManSat t develp the Island s satellite filings industry, and will cnsider (alng with Gvernment) the best way fr the Island t prceed fllwing the end f ManSat s cntractual exclusivity in Objective Met Mansat have wrked with the IOM Gvernment n Satellite filing fr many years.
