3 ORDINANCE NO. NOHO WEST SIGN DISTRICT An Ordnance establshng the NoHo West Sgn Dstrct pursuant to the provsons of Secton of the Los Angeles Muncpal Code (Code). WHEREAS, the NoHo West Project wll be located n the North Hollywood - Valley Vllage Communty Plan, where the General Plan Framework calls for preservaton and enhancement of the postve characterstcs of exstng resdental neghborhoods whle mprovng the functon, desgn and economc vtalty of the commercal corrdors; WHEREAS, the Project s located on the ste of the former Laurel Plaza Shoppng Center, and on November 29, 2011, the Laurel Canyon Corrdor Sgn Dstrct was ntated by Moton of Counclmember Paul Krekoran; WHEREAS, the Project wll enhance the neghborhood through the actvaton of an underutlzed shoppng center and creaton of a communty hub wth a well balanced mx of offce, retal, and resdental amentes; WHEREAS, the Project wll provde new commercal and offce space, whch wll house a varety of busnesses that wll serve the neghborhood and surroundng area; WHEREAS, the Project wll preserve and repurpose the orgnal Macy's buldng on the ste for use as offce space; WHEREAS, unque and vbrant sgnage that nforms and attracts vstors to the Project s a necessary component for the success of the Project; WHEREAS, the permttng of off-ste sgns and commercal dsplays at the Project wll drectly advance the purposes of mprovng the aesthetcs of the area by carefully regulatng the placement and desgn of such sgns; and WHEREAS, the establshment of the Sgn Dstrct wll foster a vbrant urban envronment wth a unfed aesthetc and sense of dentty, by settng standards for unform sgnage desgn, provdng well-planned placement of sgnage wth consderaton for surroundng uses, and drectng functonal way-fndng and buldng dentfcaton throughout the ste. NOW, THEREFORE, THE PEOPLE OF THE CITY OF LOS ANGELES DO ORDAIN AS FOLLOWS: Page 3

4 SECTION 1. ESTABLISHMENT OF THE NOHO WEST SIGN DISTRICT. The Cty Councl hereby establshes the NoHo West Sgn Dstrct, whch shall be applcable to that area of the Cty shown wthn the heavy dashed lne on Exhbt B - Sgn Zone Map, comprsng the approxmately 24.7 acre ste located at the southeast corner of Laurel Canyon Boulevard and Erwn Street, and generally bound by Erwn Street to the north, Radford Avenue to the east, Laurel Canyon Boulevard and the State Route 170 (Hollywood) Freeway to the west and Oxnard Street to the south. Ths area s referred to as the Sgn Dstrct. SECTION 2. PURPOSES. The NoHo West Sgn Dstrct s ntended to: A. Support and enhance the land uses and urban desgn objectves of the North Hollywood - Valley Vllage Communty Plan; B. Create a unque and recognzable dentty through sgnage elements, to draw vstors to the North Hollywood area to beneft the local economy and reduce lngerng blght; C. Permt a varety of sgnage elements to allow for creatvty and flexblty n desgn over tme; D. Ensure that new Off-Ste sgns, Dgtal Dsplays, and Supergraphc Sgns are responsve to and ntegrated wth the aesthetc character of the structures on whch they are located; E. Protect adjacent resdental communtes from potental adverse mpacts by concentratng sgnage away from resdental areas, and settng standards for sgnage amounts, sze, llumnaton, and sgn moton/anmaton; and F. Coordnate the locaton and dsplay of sgns so as to enhance the pedestran realm, mnmze potental traffc hazards, protect publc safety, and mantan compatblty wth surroundng uses. SECTION 3. APPLICATION OF SUPPLEMENTAL USE DISTRICT REGULATIONS. A. The regulatons of ths Ordnance are n addton to those set forth n the Plannng and Zonng provsons of the Code. These regulatons do not convey any rghts not otherwse granted under the provsons and procedures contaned n the Code or other relevant ordnances, except as specfcally provded for n ths Ordnance. B. Wherever ths Ordnance contans provsons that establsh regulatons that are dfferent from, more restrctve than, or more permssve than those contaned n the Code or other relevant ordnances, ths Ordnance shall preval. SECTION 4. DEFINITIONS. Whenever the followng terms are used n ths Ordnance, they shall be construed as defned n ths Secton. Notwthstandng Code Secton 13.11, words and phrases not defned here shall be construed as defned n Sectons and Artcle 4.4 of the Code. Page 4

5 Advertsng Kosk. A freestandng, double-sded, ground-mounted sgn whch s ncorporated nto a free standng archtectural structure, and whch may ncorporate dgtal dsplays and off-ste sgnage. Archtectural Canopy Sgn. An enclosed structure that s attached to the wall of a buldng wth the face of the sgn approxmately parallel to the wall and wth the message ntegrated nto ts surface. Banner Sgn. A sgn that s attached to a buldng and fxed n place and generally constructed of fabrc, canvas, metal or smlar materal. Bllboard. Any sgn on one or more poles that s: structurally separate from an exstng buldng; supported by ndependent footng nsde an exstng buldng or other mprovements; and /or support a sold sgn panel that s attached to pole(s), or column(s) that may be cantlevered over a buldng. Box Sgn. Also known as a Cabnet Sgn. An nternally llumnated cabnet style box consstng of a frame and faces n whch letterng or graphcs are appled two dmensonally and are not ndvdually artculated, Canster/Can/Cabnet Sgn. An opaque or clear sgn wth llumnated or non-llumnated text, logos, or symbols placed on, behnd, or extruded through the plastc face of an enclosed cabnet attached to the face of the buldng. Captve Balloon Sgn. Any object nflated wth hot ar or lghter-than-ar gas that s tethered to the ground or a structure. Dgtal Dsplay. A sgn face, buldng face, and/or any buldng or structural component that dsplays stll mages, scrollng mages, movng mages, or flashng mages, ncludng vdeo and anmaton through the use of grd lghts, cathode ray projectons, lght emttng dode dsplays, plasma screens, lqud crystal dsplays, fber optcs, or other electronc meda or technology that s ether ndependent of or attached to, ntegrated nto, or projected onto a buldng or structural component, and that may be changed remotely through electronc means. Feather Sgn/ Sal Sgn/ Wnd Banner. A freestandng or mounted sgn that s supported by a flexble or sem-flexble full or partal frame wthn whch s a materal constructed of vnyl, paper, or other wnd-resstant and moveable materals. Inflatable Devce. A sgn that s a cold ar nflated object, whch may be of varous shapes, made of flexble fabrc, restng on the ground or structure and equpped wth a portable blower motor that provdes a constant flow of ar nto the devce. Inflatable devces are restraned, attached, or held n place by a cord, rope, cable or smlar method. The term nflatable devce shall not nclude any object that contans helum, hot ar or a lghter-thanar substance. Interor Sgn. Any Sgn that s: (a) wthn an nteror courtyard, nteror concourse or nteror plaza of a buldng that s not ntended to be vsble n any way from the street, publc rghtof-way, or publcly accessble plaza or drveway adjacent to a publc rght-of-way or (b) mmedately adjacent to a buldng on the premses and ntended to be vewed prmarly from grade by pedestrans wthn the Commercal Zone of the Sgn Dstrct area. 6 Marquee Sgn. A sgn that projects from the face of a buldng, ether n a horzontal or vertcal orentaton, ndcatng the name of the busness as well as events that occur on the same premses. Monument Sgn. A sgn that s erected drectly upon the exstng or artfcally created grade, or that s rased no more than 12 nches from the exstng or artfcally created grade to the bottom of the sgn, and that has a horzontal dmenson equal to or greater than ts vertcal dmenson. Off-Ste Sgn. A sgn that dsplays any message drectng attenton to a busness, product, servce, professon, commodty, actvty, event, person, nsttuton or any other commercal message, whch s generally conducted, sold, manufactured, produced, or offered or occurs elsewhere than on the premses where the sgn s located. For purposes of the sgn regulatons n ths ordnance, the premses shall nclude all propertes wthn the Commercal Zone of the Sgn Dstrct. On-Ste Sgn. A sgn that s other than an off-ste sgn. Pllar Sgn. A freestandng sgn that s mounted drectly on the ground, consstng of rectangular sgn faces or a sculptural themed shape, wth a vertcal dmenson equal to or greater than ts horzontal dmenson. Pole Sgn. A freestandng sgn that s erected or affxed to one or more poles or posts and that does not meet the requrements of a monument sgn or pllar sgn. Projectng Sgn. A sgn, other than a Wall Sgn, that s attached to a buldng and projects outward from the buldng wth one or more sgn faces approxmately perpendcular to the face of the buldng. Roof Sgn. A sgn erected upon a roof of a buldng. Sgn. Any whole or part of a dsplay board, wall, screen or object, used to announce, declare, demonstrate, dsplay or otherwse present a message and attract the attenton of the publc. Supergraphc Sgn. A sgn, consstng of an mage projected onto a wall or prnted on vnyl, mesh or other materal wth or wthout wrtten text, supported and attached to a wall by an adhesve and/or by usng stranded cable and eye-bolts and/or other materals or methods, and whch does not comply wth the followng provsons of the Code: (Wall Sgns), (Temporary Sgns), (Temporary Sgns on Temporary Constructon Walls), (Off-Ste Sgns), and/or (Art Murals and Publc Art Installatons). Tenant Frontage. The lnear buldng frontage of a tenant space along a publc street or rght-of-way, drveway, or pedestran walkway or plaza. Wall Sgn. Any sgn attached to, panted on or erected aganst the wall of a buldng or structure, wth the exposed face of the sgn n a plane approxmately parallel to the plane of the wall. Page 6

7 Wndow Sgn. Any sgn that s attached to, affxed to, leanng aganst, or otherwse placed wthn sx feet of a wndow or door n a manner so that the sgn s vsble from outsde of the buldng. SECTION 5. PROCEDURAL REQUIREMENTS. A. Buldng Permts. The Department of Buldng and Safety (LADBS) shall not ssue a permt for a sgn, a sgn structure, sgn llumnaton, or alteraton of an exstng sgn wthn the Sgn Dstrct unless the sgn comples wth (1) the requrements of ths Ordnance as determned by the Drector of Plannng (Drector) and (2) relevant requrements of the Code. B. Drector Sgn-Off. LADBS shall requre a Drector sgn off on any sgn permt applcaton wth the Sgn Dstrct. The Drector shall sgn off on the permt applcaton f the sgn comples wth all of the applcable requrements of ths Ordnance and Exhbt Maps and the applcable requrements of the Code. The Drector s approval shall also be ndcated by stampng the permt plans. C. Exempt Sgns. LADBS permt applcatons for the followng sgn types shall be subject to LADBS revew and the relevant requrements of the Code, but are exempt from Drector s revew and do not requre a Drector s permt sgn-off: wndow sgns, temporary sgns, art murals, and publc art nstallatons. D. Project Permt Complance. LADBS shall not ssue a permt for Supergraphc Sgns or Dgtal Dsplays unless the Drector has ssued a Project Permt Complance approval pursuant to the procedures set forth n Secton of the Code and Secton 7.H. and Secton 7.1 of ths ordnance. E. Request for Devatons from Regulatons. The procedures for adjustments, exceptons, amendments and nterpretatons to ths Ordnance shall follow the procedures set forth n Secton E-H of the Los Angeles Muncpal Code. SECTION 6. GENERAL REQUIREMENTS. A. General Requrements of Code. Unless specfed n ths Ordnance to the contrary, the general sgn requrements set forth n the Code shall apply to ths Sgn Dstrct for permts, plans, desgn and constructon, materals, street address numbers, dentfcaton, mantenance, prohbted locatons and sgn llumnaton. B. Sgn Zones. Ths Sgn Dstrct s dvded nto two (2) Sgn Zones as shown n the Sgn Zone Map (Exhbt B), whch ncludes the Commercal Zone and Resdental Zone. C. Permtted Sgns. All sgns defned n Secton 7 of ths Ordnance and all sgns otherwse permtted by the Code shall be permtted wthn the Sgn Dstrct. D. Prohbted Sgns. The followng sgns shall be prohbted: 1. Banner Sgns; 2. Bllboards; Page 7

8 3. Box Sgns, except as provded n Secton 7.C.5.; 4. Can / Canster / Cabnet Wall Sgns, except as provded n Secton 7.C.5.; 5. Captve Balloon Sgns; 6. Inflatable Devces; 7. Pole Sgns; 8. Roof Sgns; 9. Sal Sgns / wnd banners / feather sgns; 10. Advertsng Kosks, Archtectural Canopy Sgns, Dgtal Dsplays, Large Pll Sgns, Projectng Sgns, and Supergraphc Sgns, n the Resdental Zone; and 11. Any Sgn not specfcally authorzed by ths Ordnance or by the Code. E. General Sgn Locaton Requrements. The locaton of sgnage s subject to standards dentfed n Secton 6 and Secton 7 of ths Ordnance and Code Secton C (Prohbted Locatons). In addton: 1. Sgnage shall be nstalled n substantal conformance wth the approxmate locatons dentfed for each sgn type n the Sgn Locaton Map (Exhbt A). 2. No sgn shall be placed over the exteror surface of any openng of a buldng, ncludng ts wndows, doors, and vents, unless the Los Angeles Fre Department ( LAFD ) determnes that the sgn would not create a hazardous condton. F. Illumnaton. 1. All llumnated sgns shall have a brghtness lmtaton of 0.3 foot candles above ambent lghtng. 2. All llumnated sgns shall be desgned, located, and/or screened so as to mnmze lght travel onto the exteror walls of resdental unts and wndows of commercal buldngs, ncludng those on the same ste as the sgn. 3. All llumnated sgns shall have a nghttme brghtness no greater than 300 candelas per square meter and a daytme brghtness no greater than 5,000 candelas. 4. The brghtness of any sgn that ncludes neon, neon-lke, or LED elements shall be fully dmmable and controlled by a tmer whch shall be mantaned n good workng order. 5. No sgn shall use hghly reflectve materals such as mrrored glass. 6. All sgns shall have a maxmum total lumen output of no more than 20 lumens per square foot. Page 8

9 7. All lght emttng dodes used wthn any sgn shall have a maxmum horzontal beam spread of 165 degrees and a maxmum vertcal beam spread of 65 degrees. All lght emttng dodes shall be orented towards the street, rather than towards the sky. 8. Any Dgtal Dsplay shall make a smooth transton at a consstent rate between the permtted daytme to nghttme brghtness levels begnnng 45 mnutes pror to sunset and concludng 45 mnutes after sunset. 9. Illumnaton Testng Protocol for Dgtal Dsplays. Pror to the operaton of any Dgtal Dsplay, the applcant shall conduct testng to ndcate complance wth the llumnaton regulatons of ths Ordnance, and provde a copy of the results along wth a certfcaton from an LADBS approved testng agency to the Drector and to LADBS statng that the testng results demonstrate complance wth the requrements of ths Ordnance. The testng shall be at the applcant's expense and shall be conducted as follows: a. In order to determne whether the llumnaton comples wth Artcle 4.4 of the Code and the requrements of ths Ordnance, a representatve testng ste shall be establshed on or next to those lght senstve receptors, as defned by the Cty's CEQA Gudelnes, whch have the greatest exposure to sgnage lghtng on each of the four facades of the Project. A lght meter mounted to a trpod at eye level, facng the Project buldngs, shall be calbrated and measurements taken to determne ambent lght levels wth the sgn on. An opaque object shall be used to block out the vew of the sgn and the buldng from the lght meter at a dstance of at least four (4) feet away from the trpod. A readng shall then be taken to determne the ambent lght levels wth the sgn off. The dfference between the two measurements shall be the amount of lght the sgn casts onto the senstve receptor. Alternatvely, the applcant may measure lght levels by usng the same trpod and same lght meter, but by turnng the sgnage on and off. b. The llumnaton and ntensty levels of all Dgtal Dsplays shall also be metered from a mnmum of four perspectves (.e., a perspectve meterng each facade) usng the Candela as unt of measurement, and shall ndcate conformance wth the standards of ths Ordnance. c. In addton, f, as a result of a complant or otherwse, LADBS has cause to beleve the Project's sgnage lghtng s not n complance wth ths Ordnance, LADBS may request, at the expense of the applcant or ts successor, that the testng protocol outlned n ths secton be mplemented to determne complance. If the testng reveals that the sgnage s not n complance wth ths Ordnance, the applcant or ts successor shall adjust the sgnage llumnaton to brng t nto complance mmedately. G. Refresh Rate. The Refresh Rate s the rate at whch a Dgtal Dsplay may change content. The Refresh Rates shall be as follows: Page 9

10 1. The Controlled Refresh Rate shall be no more frequent than one refresh event every one mnute wth an nstant transton between mages. The sgn mage must reman statc between refreshes. 2. The Non-Controlled Refresh Rate s the Refresh Rate of all Dgtal Dsplays that are not made subject to a Controlled Refresh Rate pursuant to ths Ordnance and whch shall permt mages, parts, and/or llumnaton that flash, change, move, stream, scroll, blnk, or otherwse ncorporate moton to change at an unrestrcted rate. H. Vsual Mantenance. All sgns shall be mantaned to meet the followng crtera at all tmes: 1. The buldng and ground area around the sgns shall be properly mantaned. All unused mountng structures, hardware, and wall perforaton from any abandoned sgn shall be removed and buldng surfaces shall be restored to ther orgnal condton. 2. All sgnage copy shall be properly mantaned and kept free from damage and other unsghtly condtons, ncludng grafft. 3. All sgn structures shall be kept n good repar and mantaned n a safe and sound condton and n conformance wth all applcable codes. I. Hazard Revew. Sgns that adhere to the regulatons outlned n ths Ordnance shall be exempted from further Hazard Determnaton revew procedures n Code Secton All sgns shall contnue to be subject to Caltrans approval, where applcable. J. Freeway Exposure. Sgns that adhere to the regulatons outlned n ths Ordnance shall be exempted from the Freeway Exposure regulatons n Code Secton All sgns shall contnue to be subject to Caltrans approval, where applcable. K. New Technologes. The Drector may permt the use of any technology or materal whch dd not exst as of the effectve date of ths Ordnance, utlzng the Drector s Interpretaton procedure outlned n Code Secton H, f the Drector fnds that such technology or materal s consstent wth the regulatons descrbed heren. L. Alteratons, Repars or Rehabltaton. Any alteraton, repar or mantenance work on a legally permtted sgn or sgn structure shall be governed by the Code. M. Materals. The materals, constructon, applcaton, locaton and nstallaton of any sgn shall be n conformance wth the Los Angeles Buldng Code and the Los Angeles Fre Code. SECTION 7. STANDARDS FOR SPECIFIC TYPES OF SIGNS. A. Monument Sgns 1. Intent. Monument Sgns dentfy the project ste or buldngs near the street or drveway entrances, and are ntended to be vewed prmarly from vehcles. Page110

11 2. Sgn Area. Monument Sgns may be ncorporated wth landscape walls and other archtectural elements. The ndvdual sgn area of a Monument Sgn s measured based on the area contanng sgnage, and does not nclude any adjacent or attached landscape or archtectural elements. Maxmum Indvdual Sgn Area for Monument Sgns Commercal Zone Resdental Zone Maxmum 1350 SF 60 SF 3. Heght. 4. Locaton. a. Monument Sgns n the Commercal Zone shall not exceed a maxmum of 15 feet n heght. b. Monument Sgns n the Resdental Zone shall not exceed a maxmum of 6 feet n heght. Maxmum Number of Monument Sgns Commercal Zone Resdental Zone Maxmum One (1) on Oxnard Street and one (1) at the corner of Laurel Canyon Boulevard and Erwn Street One (1) per each resdental buldng elevaton 5. Desgn. Channel Letters (nternally llumnated letters, numbers or fgures, ndvdually formed n a three dmensonal U-shaped channel) on three dmensonal archtectural letters are requred for letters greater than 6 n heght. Monument Sgns may be double sded. 6. Illumnaton. Monument Sgns may be non-llumnated or llumnated. If llumnated, the sgn shall be nternally llumnated or lghtng shall be nstalled to face the monument sgn and be hdden from vew. 7. Off-Ste Standards. Monument Sgns shall not be Off-Ste Sgns. 8. Dgtal Standards. Monument Sgns shall not nclude Dgtal Dsplays. B. Projectng Sgns 1. Intent. Projectng Sgns dentfy tenants or buldngs n the Commercal Zone. 2. Sgn Area. Maxmum Indvdual Sgn Area for Projectng Sgns Commercal Zone: Buldngs A through M Maxmum 50 SF Page111

12 Commercal Zone: One sgn on the northwest corner of 300 SF Buldng H Commercal Zone: West elevaton of Parkng Structure 350 SF 3. Heght. Projectng Sgns shall not be located lower than eght (8) feet above sdewalk grade or edge of roadway grade nearest the sgn. Projectng sgns, except for those located on the west elevaton of the Parkng Structure, shall not extend above the top of the buldng wall. In addton, the heght of Projectng Sgns must be equal to or greater than the wdth for any Projectng Sgn larger than 10 square-feet n sgn area. 4. Locaton. Projectng Sgns are prohbted n the Resdental Zone. Maxmum Number of Projectng Sgns Commercal Zone: Number permtted per ndvdual tenant space on Buldngs A through M, except one addtonal sgn s allowed to accommodate a sngle Buldng H tenant Commercal Zone: Number permtted along the western elevaton of the Parkng Structure Maxmum 1 per tenant Desgn. Each Projectng Sgn shall be located at a mnmum dstance of 15 feet away from any other Projectng Sgn. The plane of the sgn face of the projectng sgn shall be wthn 15 degrees of beng perpendcular to the face of the buldng, except at the corner of the buldng. Projectng Sgns may be double-sded. Channel letters, push-thru letters, cut-thru letters, and other archtecturally ntegrated methods for letterng are requred for letters greater than 6 n heght. 6. Illumnaton. Projectng Sgns shall be non-llumnated or nternally llumnated. 7. Off-Ste Standards. Projectng Sgns shall not be Off-Ste Sgns. 8. Dgtal Standard. Projectng Sgns shall not nclude Dgtal Dsplays. C. Wall Sgns 1. Intent. Wall Sgns dentfy tenants or buldngs, and nclude tenant Wall Sgns, multtenant Wall Sgns, and resdental Wall Sgns. Wall Sgns do not nclude Supergraphc Sgns or Dgtal Dsplays. 2. Sgn Area. Maxmum Indvdual Sgn Area for Wall Sgns Commercal Zone: tenant Wall Sgns Commercal Zone: mult-tenant Wall Sgns Resdental Zone: resdental Wall Sgns Maxmum 1.5 SF per 1 lnear foot of tenant frontage.
