Putra (415) adran.putra@sfgov.org PROJECT DESCRPTON The proposal s to modfy an exstng wreless telecommuncatons servces (WTS) faclty by nstallng three panel antennas to a WTS faclty that s operated by Verzon Wreless. The exstng Verzon Wreless WTS faclty conssts of sx panel antennas that are mounted and concealed wthn a faux cupola located on the rooftop of a tourst hotel (dba Msson nn ). The three proposed antennas wll be mounted and concealed wthn ths faux cupola as well. The purpose of the new antennas s to enhance the exstng WTS faclty s speed and data streamng capabltes (.e. 3G Data Network) and wll not mpact the exstng coverage. Each antenna measures approxmately 4 0 long by 1 0 wde by 7 thck. The antennas would be mounted and concealed wthn a faux cupola located on the rooftop of the Msson nn. The antennas would at a maxmum heght of approxmately 45 0 above grade. The three panel antennas wll be powered by Verzon s exstng equpment cabnets located nsde of a garage at the ground floor wthn a 12 6 x 12 6 lease area. Under the WTS Facltes Stng Gudelnes the Project s a Locaton Preference Number 4 Ste snce the subject buldng s consdered a Commercal Structure and s located n the NC 2 Dstrct. STE DESCRPTON AND PRESENT USE The project ste s a through lot wth street frontages on Msson Street and Ellngton Avenue and s located between Naglee and Whpple Avenues. However the lot s developed wth a three story tourst hotel (dba Msson nn ) that fronts Msson Street. The project ste contans an a WTS faclty operated by Verzon Wreless consstng sx panel antennas and one GPS antenna and a WTS faclty operated by

The antennas for both of these facltes are mounted on the rooftop of the hotel. SURROUNDNG PROPERTES & NEGHBORHOOD The Project Ste s located n an NC 2 (Neghborhood Commercal Small scale) Zonng Dstrct that s located along a span of Msson Street that runs between Slver Avenue to Pope Street. Surroundng ths neghborhood commercal dstrct s the RH 1 (Resdental One Famly) Dstrct contanng mostly sngle famly dwellngs. Other land uses n the mmedate project vcnty nclude a mx of stand alone commercal uses two story mxed use buldngs and three story apartment buldngs. Addtonally Longfellow Elementary School at 501 South Arlngton Heghts Road s located approxmately 180 feet away to the southeast from the Project Ste. ENVRONMENTAL REVEW STATUS The proposed project was determned by the San Francsco Publc Utltes Commsson s Bureau of Envronmental and Regulatory Management to be categorcally exempt from the envronmental revew process pursuant to Class 3 exemptons of Ttle 14 of the Calforna Admnstratve Code. BASS FOR RECOMMENDATON The Department beleves ths project s necessary and/or desrable under Secton 303 of the Plannng Code for the followng reasons: The project meets the crtera establshed under the 1996 Wreless Telecommuncatons Servces Facltes Stng Gudelnes and t s consstent wth the objectves and polces of the Commerce and ndustry Element the Communty Safety Element the Resdence Element and the Urban Desgn Element of the General Plan. The project s desrable as t wll mprove Verzon Wreless moble telephone network by enhancng ths exstng WTS faclty s speed and data streamng capabltes (.e. 3G Data Network). PREAMBLE On June James Sngleton on the behalf of Verzon Wreless (herenafter ʺproject sponsorʺ) made an applcaton (herenafter ʺapplcatonʺ) for Condtonal Use authorzaton on the property at 5630 Msson Street Lot 012 n Assessorʹs Block 7098 (herenafter ʺproject steʺ) to modfy an exstng wreless telecommuncatons servces (WTS) faclty by nstallng three panel antennas to a WTS faclty located on the rooftop of a tourst hotel (dba Msson nn ) located at the property as part of the Verzon wreless telecommuncatons network n a NC 2 (Neghborhood Commercal Small scale) Zonng Dstrct and a 40 X Heght and Bulk Dstrct. The categorcal exempton and all pertnent documents may be found n the fles of the plannng department as the custodan of records at 1650 Msson Street San Francsco. The proposed project as approved heren s consstent wth the project descrpton contaned n the categorcal exempton and would not result n sgnfcant mpacts not dentfed n the categorcal exempton or cause sgnfcant effects already dentfed n the categorcally exempton to be substantally more severe. On March the Commsson conducted a duly notced publc hearng at a regularly scheduled meetng on the applcaton for a Condtonal Use. The Commsson has heard and consdered the testmony presented to t at the publc hearng and has further consdered wrtten materals and oral testmony presented on behalf of the applcant department staff and other nterested partes. MOVED that the Commsson hereby authorzes the Condtonal Use n Applcaton No C subject to the condtons contaned n EXHBT A of ths moton based on the followng fndngs: FNDNGS Havng revewed the materals dentfed n the preamble above and havng heard all testmony and arguments ths Commsson fnds concludes and determnes as follows: 1. The above rectals are accurate and consttute fndngs of ths Commsson. 2. Ste Descrpton and Present Use. The Plannng Commsson held a duly advertsed publc hearng on August to consder adopton of gudelnes for the stng of WTS facltes n the Cty whch would nclude standard condtons of approval for wreless communcatons facltes whch are regulated by the FCC and requred to meet the health and safety standards. The Plannng Commsson by Resoluton No adopted the proposed WTS Facltes Stng Gudelnes on August The sample condtons of approval presented n the Gudelnes form the bass for the development of condtons of approval for ths Applcaton and Moton. On July the Commsson conducted a duly notced publc hearng at a regularly scheduled meetng on the applcaton for a Condtonal Use pursuant to Plannng Code Sectons and to allow the nstallaton of a WTS faclty consstng of sx panel antennas and one GPS antenna on the rooftop of an the Msson nn located at 5630 Msson Street as part of the Verzon Wreless telecommuncatons network. On September the buldng permt was ssued by the Department of Buldng nspecton for the nstallaton of a WTS faclty consstng of two mcro panel antennas mounted to an exstng rooftop penthouse structure as part of the MetroPCS telecommuncatons network. 6. Locaton Preference. The WTS Facltes Stng Gudelnes dentfy dfferent types of buldngs for the stng of wreless telecommuncatons facltes wth Locaton Preference 1 beng the most desrable locaton and Locaton Preference 7 beng the least desrable locaton. Under the Gudelnes the Project s a Locaton Preference Number 4 Ste snce the subject buldng s consdered a Commercal Structure and s located n the NC 2 Dstrct. 7. Rado Waves Range. Accordng to the Project Sponsor the proposed wreless network wll transmt and receve calls by rado waves operatng n the and Megahertz (MHz) bands whch are regulated by the Federal Communcatons Commsson (FCC) and whch must comply wth the FCC adopted health and safety standards for electromagnetc radaton and rado frequency radaton. 8. Radofrequency (RF) Emssons: The Project Sponsor retaned Hammett & Edson nc. a rado engneerng consultng frm to prepare a report descrbng the expected RF emssons from the proposed faclty. The Department of Publc Health revewed the report and determned that the 3

Once the nstallaton s constructed and operatonal a second report documentng the actual RF emssons wll be prepared and evaluated for complance. 9. Department of Publc Health Revew and Approval. The exstng RF levels at the ground level of the ste were less than 1% of the FCC publc exposure lmt. There were observed no other antennas wthn 100 feet of ths ste. Verzon proposes to add LTE servce by addng three new Antel Model LNX66512 T4M drectonal antennas. There were no other antennas observed wthn 100 feet of ths ste. The estmated ambent RF feld from the proposed Verzon transmtters at ground level s calculated to be mw/square centmeter whch s 1.6% of the FCC publc exposure lmt. The three dmensonal permeter of RF levels equal to the publc exposure lmt s calculated to extend 30 feet and does not reach any publcly accessble areas. Excluson zones marked wth yellow strpng must be placed on the roof extendng to the roof edge n front of the antennas. Warnng sgns must be posted at the roof access door barrcades and antennas n Englsh Spansh and Chnese. Workers should not have access wthn 6 feet of the front of the antennas whle they are n operaton. 10. Mantenance Schedule. Accordng to the Project Sponsor the proposed mantenance schedule (after nstallaton) wll reman the same as s currently practced whch s that a cell techncan from Verzon wll vst the equpment room approxmately once a month and Verzonʹs vendors wll vst the ste approxmately three tmes a year for varous audts. 11. Communty Outreach. A Communty Outreach Meetng was conducted for the proposed project. The meetng was held at 7:30 PM on Wednesday November at the Calvary Baptst Church located at 5655 Msson Street San Francsco CA Accordng to the Project Sponsor no neghbors attended the meetng. 12. Fve year plan: Verzon submtted ts latest fve year plan as requred on October Publc Comment. The Department has not receved publc comment snce the flng of the applcaton as of the date of ths moton. 14. Plannng Code Complance. The Commsson fnds that the Project s consstent wth the relevant provsons of the amendments to Plannng Code n the followng manner: A. Use. A WTS faclty s consdered a publc utlty under Plannng Code Secton whch requres Condtonal Use authorzaton n the NC 2 Dstrct. 15. Plannng Code Secton 303 establshes crtera for the Plannng Commsson to consder when revewng applcatons for Condtonal Use approval. On balance the project does comply wth sad crtera n that: A. The proposed new uses and buldng at the sze and ntensty contemplated and at the proposed locaton wll provde a development that s necessary or desrable and compatble wth the neghborhood or the communty. 4

The approval of ths authorzaton has been found frst and foremost to nsure publc safety and ensure that the placement of antennas and related support and protecton features are so located desgned and treated archtecturally to mnmze ther vsblty from publc places to avod ntruson nto publc vstas avod dsrupton of the archtectural desgn ntegrty of buldng and nsure harmony wth neghborhood character. The proposed project wll also provde mproved facltes for emergency transmsson and mproved communcaton for the neghborhood communty and the regon. The Project has been desgned to be vsually camouflaged and compatble wth exstng development n the neghborhood. B. The proposed project wll not be detrmental to the health safety convenence or general welfare of persons resdng or workng n the vcnty. There are no features of the project that could be detrmental to the health safety or convenence of those resdng or workng the area n that: Nature of proposed ste ncludng ts sze and shape and the proposed sze shape and arrangement of structures; The proposed project must comply wth all applcable Federal and State regulatons to safeguard the health safety and to ensure that persons resdng or workng n the vcnty wll not be affected and prevent harm to other personal property. An evaluaton of potental health effects from RF radaton conducted by the Department of Publc Health has concluded that the proposed wreless transmsson facltes wll have no adverse health effects f operated n complance wth the FCC adopted health and safety standards. The Department has receved nformaton that the proposed wreless system must be operated so as not to nterfere wth rado or televson recepton n order to comply wth the provsons of ts lcense under the FCC. The Department s developng a database of all such wreless communcatons facltes operatng or proposed for operaton n the Cty and County of San Francsco. All applcants are now requred to submt nformaton on the locaton and nature of all exstng and approved wreless transmsson facltes operated by the Project Sponsor. The goal of ths effort s to foster publc nformaton as to the locaton of these facltes. The accessblty and traffc patterns for persons and vehcles the type and volume of such traffc and the adequacy of proposed off street parkng and loadng; No ncrease n traffc volume s antcpated wth the proposal to add three addtonal antennas to an exstng WTS faclty. Accordng to the Project Sponsor the WTS faclty would operate 24 5

10 Moton No. CASE NO C Hearng Date: March Msson Street hours per day seven days per week as an unmanned faclty whch wll only requre access by company representatves once a month for mantenance. The safeguards afforded to prevent noxous or offensve emssons such as nose glare dust and odor; Whle some nose and dust may result from the erecton of the antennas and transcever equpment once the faclty s bult mpacts wth regards to the above wll lkely be nsgnfcant. v Treatment gven as approprate to such aspects as landscapng screenng open spaces parkng and loadng areas servce areas lghtng and sgns; The subject ste has ample landscapng and open space. The Project has been desgned to mnmze ts vsual mpacts by concealng the proposed antennas wthn a faux cupola and as a result wll also not affect any exstng landscapng lghtng or servce areas. All sgnage wll be revewed by the Plannng Department pror to approval. C. That the use as proposed wll comply wth the applcable provsons of the Plannng Code and wll not adversely affect the General Plan. The Project comples wth all relevant requrements and standards of the Plannng Code and s consstent wth objectves and polces of the General Plan as detaled below. 16. General Plan Complance. The Project s on balance consstent wth the followng Objectves and Polces of the General Plan COMMERCE AND NDUSTRY ELEMENT Objectves and Polces OBJECTVE 1: MANAGE ECONOMC GROWTH AND CHANGE TO ENSURE ENHANCEMENT OF THE TOTAL CTY LVNG AND WORKNG ENVRONMENT. Polcy 1: Encourage development whch provdes substantal net benefts and mnmzes undesrable consequences. Dscourage development whch has substantal undesrable consequences that cannot be mtgated. Polcy 2: Assure that all commercal and ndustral uses meet mnmum reasonable performance standards. 6

Addtonally the project would comply wth Federal State and Local performance standards. OBJECTVE 2: MANTAN AND ENHANCE A SOUND AND DVERSE ECONOMC BASE AND FSCAL STRUCTURE FOR THE CTY. Polcy 1: Seek to retan exstng commercal and ndustral actvty and to attract new such actvty to the cty. Polcy 3: Mantan a favorable socal and cultural clmate n the cty n order to enhance ts attractveness as a frm locaton. The ste s an ntegral part of a new wreless communcatons network that wll enhance the Cty s dverse economc base. OBJECTVE 4: MPROVE THE VABLTY OF EXSTNG NDUSTRY N THE CTY AND THE ATTRACTVENESS OF THE CTY AS A LOCATON FOR NEW NDUSTRY. Polcy 1: Mantan and enhance a favorable busness clmate n the Cty. Polcy 2: Promote and attract those economc actvtes wth potental beneft to the Cty. The project would beneft the Cty by enhancng the busness clmate through mproved communcaton servces for resdents and workers. COMMUNTY SAFETY ELEMENT Objectves and Polces OBJECTVE 3: ENSURE THE PROTECTON OF LFE AND PROPERTY FROM THE EFFECTS OF FRE OR NATURAL DSASTER THROUGH ADEQUATE EMERGENCY OPERATONS PREPARATON. Polcy 1: Mantan a local agency for the provson of emergency servces to meet the needs of San Francsco. Polcy 2: 7

Polcy 3: Mantan and expand agreements for emergency assstance from other jursdctons to ensure adequate ad n tme of need. Polcy 4: Establsh and mantan an adequate Emergency Operatons Center. Polcy 5: Mantan and expand the cty s fre preventon and fre fghtng capablty. Polcy 6: Establsh a system of emergency access routes for both emergency operatons and evacuaton. n the event that tradtonal land lne telephones are rendered noperable durng a natural dsaster the project would enhance the ablty of the Cty to protect both lfe and property from the effects of a fre or natural dsaster by mprovng wreless communcaton servces. 17. Plannng Code Secton 101.1(b) establshes eght prorty plannng polces and requres revew of permts for consstency wth sad polces. On balance the project does comply wth sad polces n that: A. That exstng neghborhood servng retal uses be preserved and enhanced and future opportuntes for resdent employment n and ownershp of such busnesses be enhanced. No neghborhood servng retal use would be dsplaced and the wreless communcatons network wll enhance personal communcaton servces. B. That exstng housng and neghborhood character be conserved and protected n order to preserve the cultural and economc dversty of our neghborhoods. No resdental uses would be dsplaced or altered n any way by the grantng of ths authorzaton. C. That the Ctyʹs supply of affordable housng be preserved and enhanced The project would have no adverse mpact on housng n the vcnty. D. That commuter traffc not mpede MUN transt servce or overburden our streets or neghborhood parkng. The Project wll not adversely mpact publc transt or place a burden on the exstng supply of parkng n the neghborhood. Accordng to the Project Sponsor the proposal to add three antenna to an exstng WTS faclty wll only requre access by company representatves once a month. 8

That a dverse economc base be mantaned by protectng our ndustral and servce sectors from dsplacement due to commercal offce development and that future opportuntes for resdent employment and ownershp n these sectors be enhanced. The Project would cause no dsplacement of ndustral and servce sector actvty. F. That the Cty acheve the greatest possble preparedness to protect aganst njury and loss of lfe n an earthquake. Complance wth applcable structural safety and sesmc safety requrements would be consdered durng the buldng permt applcaton revew process. G. That landmarks and hstorc buldngs be preserved. No landmarks or hstorc buldngs would be affected by the project. H. That our parks and open space and ther access to sunlght and vstas be protected from development. The Project wll have no adverse mpact on parks or open space or ther access to sunlght or vstas snce the WTS faclty s panel antennas wll be mounted wthn an exstng church steeple. 18. The Project s consstent wth and would promote the general and specfc purposes of the Code provded under Secton 101.1(b) n that as desgned the Project would contrbute to the character and stablty of the neghborhood and would consttute a benefcal development. 19. The Commsson hereby fnds that approval of the Determnaton of Complance authorzaton would promote the health safety and welfare of the Cty. 9

The Project approved by ths Moton s n general conformty wth the plans dated December on fle wth the Department n the docket for Case No C (labeled EXHBT B) revewed and approved by the Commsson on March Desgn 3. The fnal plans shall meet the standards of the Plannng Code and be n general conformty wth the plans approved by the Commsson on March as Exhbt B found n the Case docket. 4. Pror to the ssuance of any buldng or electrcal permts for the nstallaton of the facltes the Project Sponsor shall submt fnal scaled drawngs for revew and approval by the Plannng Department ( Plan Drawngs ). The Plan Drawngs shall: a. Structure and Stng. dentfy all faclty related support and protecton measures to be nstalled. Ths ncludes but s not lmted to the locaton(s) and method(s) of placement support protecton screenng pant and/or other treatments of the antennas and other appurtenances to nsure publc safety nsure compatblty wth urban desgn archtectural and hstorc preservaton prncples and harmony wth neghborhood character. b. For the Project Ste regardless of the ownershp of the exstng facltes: dentfy the locaton of all exstng antennas and facltes; and dentfy the locaton of all approved (but not nstalled) antennas and facltes. c. Emssons. Provde a report subject to approval of the Zonng Admnstrator that operaton of the facltes n addton to ambent RF emsson levels wll not exceed adopted FCC standards wth regard to human exposure n uncontrolled areas. Performance 5. Project mplementaton Report. The Project Sponsor shall prepare and submt to the Zonng Admnstrator a Project mplementaton Report. The Project mplementaton Report shall: 11

Compare test results for each test pont wth applcable FCC standards. Testng shall be conducted n complance wth FCC regulatons governng the measurement of RF emssons and shall be conducted durng normal busness hours on a non holday week day wth the subject equpment measured whle operatng at maxmum power. d. The Project mplementaton Report shall be prepared by a certfed professonal engneer or other techncal expert approved by the Department. At the sole opton of the Department the Department (or ts agents) may montor the performance of testng requred for preparaton of the Project mplementaton Report. The cost of such montorng shall be borne by the Project Sponsor pursuant to the condton related to the payment of the Cty s reasonable costs. 6. Notfcaton and Testng. The Project mplementaton Report shall set forth the testng and measurements undertaken pursuant to Condtons 4 and Approval. The Zonng Admnstrator shall request that the Certfcaton of Fnal Completon for operaton of the faclty not be ssued by the Department of Buldng nspecton untl such tme that the Project mplementaton Report s approved by the Department for complance wth these condtons. 8. Notfcaton pror to Project mplementaton Report. The Project Sponsor shall undertake to nform and perform approprate tests for resdents of any dwellng unts located wthn 25 feet of the transmttng antennae at the tme of testng for the Project mplementaton Report. a. At least twenty calendar days pror to conductng the testng requred for preparaton of the Project mplementaton Report the Project Sponsor shall mal notce to the Department as well as to the resdent of any legal dwellng unt wthn 25 feet of a transmttng antenna of the date on whch testng wll be conducted. The Applcant wll submt a wrtten affdavt attestng to ths mal notce along wth the malng lst. b. When requested n advance by a resdent notfed of testng pursuant to subsecton (a) the Project Sponsor shall conduct testng of total power densty of RF emssons wthn the resdence of that resdent on the date on whch the testng s conducted for the Project mplementaton Report. 9. Communty Lason. Wthn 10 days of the effectve date of ths authorzaton the Project Sponsor shall appont a communty lason offcer to resolve ssues of concern to neghbors and resdents relatng to the constructon and operaton of the facltes. Wthn 10 days of the nstallaton and operaton of the facltes the Project Sponsor shall confrm n wrtng to the Zonng Admnstrator that the facltes are beng mantaned and operated n complance wth applcable Buldng Electrcal and other Code requrements as well as applcable FCC emssons standards. 11. Screenng. a. To the extent necessary to ensure complance wth adopted FCC regulatons regardng human exposure to RF emssons and upon the recommendaton of the Zonng Admnstrator the Project Sponsor shall:. Modfy the placement of the facltes;. nstall fencng barrers or other approprate structures or devces to restrct access to the facltes;. nstall mult lngual sgnage ncludng the RF radaton hazard warnng symbol dentfed n ANS C to notfy persons that the faclty could cause exposure to RF emssons; or v. mplement any other practce reasonably necessary to ensure that the faclty s operated n complance wth adopted FCC RF emsson standards. b. To the extent necessary to mnmze vsual obtruson and clutter nstallatons shall conform to the followng standards:. Antennas and back up equpment shall be panted fenced landscaped or otherwse treated archtecturally so as to mnmze vsual mpacts;. Rooftop nstallatons shall be setback such that back up facltes are not vewed from the street;. Antennae attached to buldng facades shall be so placed screened or otherwse treated to mnmze any negatve vsual mpact; and v. Although co locaton of varous companesʹ facltes may be desrable a maxmum number of antennas and back up facltes on the Project Ste shall be establshed on a case by case bass such that ʺantennae farmsʺ or smlar vsual ntrusons for the ste and area s not created. 12. The Project Sponsor or Property Owner shall remove antennae and equpment that has been out of servce for a contnuous perod of sx months. 13. Perodc Safety Montorng. The Project Sponsor shall submt to the Zonng Admnstrator 10 days after nstallaton of the facltes and every two years thereafter a certfcaton attested to by 13

Emssons Condtons. t s a contnung condton of ths authorzaton that the facltes be operated n such a manner so as not to contrbute to ambent RF/EMF emssons n excess of then current FCC adopted RF/EMF emsson standards; volaton of ths condton shall be grounds for revocaton. 15. Nose and Heat. The WTS faclty ncludng power source and coolng faclty shall be operated at all tmes wthn the lmts of the San Francsco Nose Ordnance. The WTS faclty ncludng power source and coolng faclty shall not be operated so as to cause the generaton of heat that adversely affects a buldng occupant. 16. mplementaton and Montorng Costs. a. The Project Sponsor on an equtable bass wth other WTS provders shall pay the cost of preparng and adoptng approprate General Plan polces related to the placement of WTS facltes. Should future legslaton be enacted to provde for cost recovery for plannng the Project Sponsor shall be bound by such legslaton. b. The Project Sponsor or ts successors shall be responsble for the payment of all reasonable costs assocated wth the montorng of the condtons of approval contaned n ths authorzaton ncludng costs ncurred by ths Department the Department of Publc Health the Department of Electrcty and Telecommuncatons Offce of the Cty Attorney or any other approprate Cty Department or agency pursuant to Plannng Code Secton 351(f)(2). The Plannng Department shall collect such costs on behalf of the Cty. c. The Project Sponsor shall be responsble for the payment of all fees assocated wth the nstallaton of the subject faclty whch are assessed by the Cty pursuant to all applcable law. 17. All Condtons Bass for Revocaton. The Project Sponsor or ts successors shall comply fully wth all condtons specfed n ths authorzaton. Falure to comply wth any condton shall consttute grounds for revocaton under the provsons of Plannng Code Sectons and 303(d). The Zonng Admnstrator shall schedule a publc hearng before the Plannng Commsson to receve testmony and other evdence to demonstrate a fndng of a volaton of a condton of the authorzaton of the use of the faclty and fndng that volaton the Commsson shall revoke the Condtonal Use authorzaton. Such revocaton by the Plannng Commsson s appealable to the Board of Supervsors. n the event that the project mplementaton report ncludes a fndng that RF emssons for the ste exceed FCC Standards n any uncontrolled locaton the Zonng Admnstrator may requre the Applcant to mmedately cease and desst operaton of the faclty untl such tme that the volaton s corrected to the satsfacton of the Zonng Admnstrator. 14

Should any party complan to the Project Sponsor about the nstallaton or operaton of the facltes whch complants are not resolved by the Project Sponsor the Project Sponsor (or ts apponted agent) shall advse the Zonng Admnstrator of the complant and the falure to satsfactorly resolve such complant. f the Zonng Admnstrator thereafter fnds a volaton of any provson of the Plannng Code and/or any condton of approval heren the Zonng Admnstrator shall attempt to resolve such volaton on an expedted bass wth the Project Sponsor. f such efforts fal the Zonng Admnstrator shall refer such complants to the Commsson for consderaton at the next regularly scheduled publc meetng. 19. Severablty. f any clause sentence secton or any part of these condtons of approval s for any reason held to be nvald such nvaldty shall not affect or mpar other of the remanng provsons clauses sentences or sectons of these condtons. t s hereby declared to be the ntent of the Commsson that these condtons of approval would have been adopted had such nvald sentence clause or secton or part thereof not been ncluded heren. 20. Transfer of Operaton. Any carrer/provder authorzed by the Zonng Admnstrator or by the Plannng Commsson to operate a specfc WTS nstallaton may assgn the operaton of the faclty to another carrer lcensed by the FCC for that rado frequency provded that such transfer s made known to the Zonng Admnstrator n advance of such operaton and all condtons of approval for the subject nstallaton are carred out by the new carrer/provder and the authorzng Moton s recorded on the deed of the property statng the new carrer/provder and authorzng condtons of approval. 21. Compatblty wth Cty Emergency Servces. The faclty shall not be operated nor caused to transmt on or adjacent to any rado frequences lcensed to the Cty for emergency telecommuncaton servces such that the Cty s emergency telecommuncatons system experences nterference unless pror approval for such has been granted n wrtng by the Cty. 15

The maxmum ratng of the cellular and PCS transmtters s 20 watts wth the proposed LTE transmtters rated at 16 watts. The maxmum power ratng of the Metro transmtters s not known.
