2 The project site is locted on Pcific Gs nd Electric (PG&E) pole locted in the front yrd re, on the property line between 427 Anit Drive nd 431 Anit Drive, on the south side of Anit Drive between the west nd est legs of Henry Plce, U-shped street connecting to Anit Drive. The re is in the foothills of the centrl portion of Millbre, between Centrl Prk to the south nd Green Hills Country Club to the north-west, within the Single Fmily Residentil (R-1) Zoning District nd identified in the Generl Pln s Low Density Residentil. PROPOSAL Verizon Wireless is proposing to instll smll cellulr stndlone site t this loction to improve the network coverge nd cpcity of their network. Smll cellulr sites re short rnge mobile cell sites used to complement lrger mcro cells (cell towers) nd enble the Verizon network to dd cpcity to high trffic res. (See ttched Cell Site Coverge Mps). The proposed wireless telecommunictions fcility nd relted equipment will be locted on n existing privte wooden utility pole within the public right of wy nd will be instlled nd operted in complince with ll pplicble ordinnces nd regultions. The instlltion of wireless telecommuniction fcilities is regulted by locl, stte nd federl ordinnces nd regultions, including Millbre Municipl Code Chpter 1.3, s well s by the Stte of Cliforni, Cliforni Public Utility Commission (CPUC), nd Federl Communiction Commission (FCC). The pplicnt will instll one ntenn nd ssocited equipment including: (1) cnister ntenn on n existing wooden PG&E utility pole, (2) new Remote Rdio Units (RRUs), (1) new utility disconnect switch on pole, pproprite wrning signge, ground rods nd buss br, conduit instlltion for power nd telco, (1) new electricl meter on existing pole nd (1) new hndhole t ground level. The pplicnt will be required to obtin n Encrochment Permit from the Public Works Deprtment for the instlltion of ground equipment within the public-right-of-wy s Condition of Approvl for this project. ISSUES & ANALYSIS The pplicnt is requesting Discretionry Use Permit to llow wireless telecommunictions fcility nd relted equipment for commercil purposes on privte property (PG&E privte utility pole) within the public right of wy, djcent to 427 Anit Drive nd, in the Single-Fmily Residentil (R-1) Zoning District. The proposed wireless telecommunictions fcility nd relted equipment is n expnsion of n existing telecommunictions network which will enlrge the existing wireless phone coverge re, increse cll cpcity, nd enhnce the overll qulity of service for existing nd future Verizon customers. Discretionry Use Permit This wireless communictions fcility requires pprovl of Discretionry Use Permit by the Plnning Commission. Millbre Municipl Code Section B. generlly llows the Community Development Director to pprove wireless communictions fcilities on public property including rights of wy nd in commercil or industril zones by dministrtive

3 permit. However, if the proposed fcility impcts residentil zone, the Community Development Director my determine tht use permit is required. In generl, the Community Development Director requires use permits for wireless communictions fcilities where the public property is public right of wy in or djcent to residentil zone. Alterntive Site Anlysis The pplicnt prepred n Alterntive Site Anlysis (see ttched Alterntive Site Anlysis) s required by the Community Development Deprtments submittl requirements for wireless communiction fcilities. In ddition to the existing utility pole site selected, Verizon Wireless considered (3) three lterntive privte utility poles locted djcent to 439 Anit Drive, 419 Anit Drive nd 43 Anit Drive. All three of these sites re locted on the south side of Anit Drive within the sme block s the proposed site. These three lterntive sites were evluted nd eliminted by Verizon Wireless becuse the existing equipment instlled on this pole would not llow for the required climbing spce to be mintined per the CPUC Generl Order G.O. 95, 5. A-E. Generl Order G.O. 95 is the governing dministrtive lw for the design of wood pole structures in the Stte of Cliforni. According to the pplicnt, existing ntenn towers, monopoles, nd rooftops locted more thn 15 feet from the proposed loction re not vible lterntives for the smll cell network becuse they do not meet Rdio Frequency Coverge requirement nd the network objectives of Verizon Wireless. Rdio Frequency (RF) Environmentl Evlution Report The pplicnt submitted the Rdio Frequency (RF) Environmentl Evlution Report (prepred by EBI Consulting), s required for this ppliction. (See ttched Rdio Frequency (RF) Exposure Report) The purpose of the RF Report is to determine the rdio frequency electromgnetic exposure (RF- EME) levels from the Verizon wireless communictions equipment t the proposed site. The FCC hs developed Mximum Permissible Exposure (MPE) Limits for generl public exposures nd occuptionl exposures. The RF Report summrizes the results of RF-EME modeling in reltion to relevnt FCC RF-EME complince stndrds for limiting humn exposure to RF-EME fields. A site is considered out of complince with FCC regultions if there re res tht exceed the FCC exposure limits nd there re no RF hzrd mitigtion mesures in plce. According to the Report prepred by EBI Consulting, bsed on worst-cse predictive modeling, there re no modeled res on ny ccessible ground-level wlking/working surfce relted to the proposed ntenn t this site tht exceed the FCC s occuptionl or generl public exposure limits t this site. At the nerest wlking/working surfces to the Verizon ntenn, the mximum power density generted by the Verizon ntenn is pproximtely 1.8 percent of the FCC s generl public limit (.36 percent of the FCC s occuptionl limit). Workers should be informed bout the presence nd loctions of ntenns nd their ssocited fields. Recommended control mesures

4 re outlined in Section 5. nd within the Site Sfety Pln signge in the RF-EME report prepred by EBI Consulting. This Site Sfety Pln includes procedures to shut down nd lockout/tg-out this wireless equipment in ccordnce with Verizon s stndrd operting protocol. Stff review of the RF Environmentl Evlution Report for the fcility shows tht the cumultive nonionizing electromgnetic rdition clcultions (NIER) emitted by the fcility nd ny nerby fcilities will be consistent with FCC regultions. Federl lw prohibits stff from bsing its permitting decision on the effects of rdio frequency emissions so long s the rdio frequency emissions comply with the FCC s stndrds. This includes the effects tht rdio frequency emissions my hve on property vlues or public helth. Visul Impcts The pplicnt submitted proposed site loction photos (see ttched Site Photos) showing the existing pole loction nd photo simultion t the proposed site showing the wireless ntenn locted on top of the pole nd the proposed support equipment locted 7 feet high from grde. Stff lso conducted site visit on 3/14/18 to verify the proposed cell site loction t the privte utility pole. The ntenn cnister will be mounted t the top of the pole nd the bottom of the equipment will be locted t height of 7 feet bove the ground s required by PG&E utility pole requirements. The wireless equipment will project bout 2.5 feet from the pole nd be rotted t n pproximte 45 degree ngle, outside of the public right-of wy re (sidewlk), towrds the lndscped front yrd of the djcent property t 427 Anit Drive. In ddition, the electricl meter, power cbinet, RRUs nd ntenn will be pinted Brown to mtch the existing PG&E pole. Stff conducted site visit, reviewed the pplicnt s site photos, photo simultions nd pln designs to minimize visul impct by mtching the equipment with brown color of the existing pole nd rotting the equipment wy from the sidewlk. Bsed on evlution of this informtion for the proposed instlltion of the wireless communiction equipment t this site stff cknowledges tht the utility pole will pper bulkier but considers tht this proposl will not rise to the level of creting significnt visul impct to the property or surrounding properties. Public Notice Requirement The City of Millbre Community Development Deprtment follows leglly required public noticing requirements outlined in the Municipl Code Section including: publishing the Plnning Commission meeting dte, not less thn ten dys prior to the hering, in newspper of generl circultion in the city nd miling notice crds to property owners within 3 foot rdius of the subject property. In ddition, stff posts notices in t lest three public plces long the street nd stkes plcrd t the subject property t lest ten dys before the public hering. At lest three dys before the meeting, stff posts the project meeting dte on the City website Plnning Commission clendr; nd on the bulletin bords t City Hll nd the Millbre Public Librry.

The proposl will not be detrimentl to the helth, sfety, morls, comfort, nd generl welfre of persons residing or working in the neighborhood. The wireless communictions fcility complies with the FCC prescribed limits on RF-EME exposure levels. 2. The estblishment, mintennce, or opertion of the use pplied for will not, under the circumstnces of the prticulr cse, be detrimentl to property nd improvements in the neighborhood of such proposed use.

An dministrtive use permit my be issued when the wireless communictions fcility 1) is on public property, commercil zone, or n industril zone; 2) meets certin criteri estblished in the Municipl Code; nd 3) hs no impcts to residentil zone or the Community Development Director determines tht the impcts to the residentil zone do not merit Plnning Commission review. No lterntive sites qulify for dministrtive use permits becuse the lterntive sites re lso in residentil zone nd re not locted in commercil or industril zone. The proximity of the fcility to residences justifies the need for use permit. b. The fcility either: 1) does not require n Rf Environmentl Evlution Report; or 2) the Rf Environmentl Evlution Report for the fcility shows tht the cumultive NIER emitted by the fcility nd ny nerby fcilities will be consistent with FCC regultions. 7 ENVIRONMENTAL REVIEW This project is Ctegoriclly Exempt from the Cliforni Environmentl Qulity Act (CEQA) pursunt to subsection (b) of Section 1531, Existing Fcilities of the CEQA Guidelines in tht the project is minor ltertion to n existing structure owned by public utility nd used to provide public utility services used for public utility (i.e. commercil telecommunictions), nd the project involves negligible expnsion of the use. A Revocble Encrochment Permit issued by the Deprtment of Public Works, Engineering Division, is required nd shll be obtined prior to instlltion. 2. The wireless communiction fcility shll conform to these conditions of pprovl nd to the pproved plns nd documents on file in the Community Development Deprtment s pproved nd dted Jnury 9, 218. No significnt chnges or modifictions shll be mde to the fcility without prior review nd written pprovl by the Community Development Director. 3. The proposed micro ntenn cnister, equipment cbinets, metering device nd ll cbles shll be pinted brown color to mtch the existing PG&E pole. 4. The wireless communiction fcility site shll be developed nd mintined in net, quiet, nd orderly condition nd operted in mnner so s not to be detrimentl to djcent properties. 5. The wireless communiction fcility, including ll equipment nd structure(s), shll conform to Uniform Building Code requirements. A Building Permit Appliction shll be submitted within six (6) months of the dte of this pprovl; otherwise, this pprovl shll expire, unless request for n extension is submitted in writing to the Community Development Deprtment. 6. This Discretionry Use Permit nd ll rights hereunder shll be vlid for five (5) yers from the dte of pprovl its effective dte. This permit my be renewed prior to the dte of expirtion. At the discretion of the Community Development Director, this permit my be renewed dministrtively, with or without hering pursunt to Municipl Code Section C, s mended from time to time. 7. This pprovl shll become invlid if the wireless communiction fcility ceses to operte under the terms or conditions specified by this permit nd/or to the regultions specified in Title 1, Chpter 6 of the Millbre Municipl Code. Upon written notifiction specifying non-complince with ny of the terms or conditions of this permit nd/or to the regultions of the Millbre Municipl Code, the opertor will be required to cese nd remove the fcility from its loction within ninety (9) dys. 8.
