10 SCOPE OF WORK The Scope of work includes Concept, interior Designing, Printing, Fabrication, Supply, Erection and installation of facilities for setting up of innovation hub at Science Voyage Hall of Pushpa Gujral Science City, Kapurthala. The existing structure installed in the hall should gel with the newly fabricated structure create good ambience. The pictures of the existing structure installed in the hall is enclosed as per Annexure IX. The representative layout showing the cabinets, tables and various other facilities under innovation hub are enclosed as Annexure II. The total approximate area to be covered under different sections of the innovation hub is 250 sq m. The Innovation Hub area will have the following sections: 1. Innovation Resource Centre - This section will be used to showcase innovative ideas/products that have transformed the world. Besides these, implements/ samples of appropriate technology and traditional knowledge systems, art and craft and other areas of importance in public life in the respective regions shall be exhibited. The section will also serve as a resource centre, duly provided with broad band connectivity, for accessing information on inventions/inventors/patents and multimedia/films on innovations. The total area covered of this section is approx. 50 Sq m and is marked with number 2 in the representative drawings enclosed as Annexure III. The scope of work includes Partition Wall: Fabrication of new boundary partition wall approx. size Length 42, height 8, fully grouted to floor marked as New Wall in the drawing. Please refer to Annexure III drawing for details. Hall of Fame section : Fabrication of area consisting of three number of computer kiosks covering approx. length 16 height 8 labelled as Hall of fame in the drawing. Please refer to representative picture (No. 1, 2 & 3) of Annexure III for details. Exhibit Cabinets: Fabrication of modular exhibit cabinets of approx. length 15 width 2 height 2.5 with top shelf for setting up of two number of computer stations. There will be top file cabinets covering approx. size: Length 15 Width 1.5 height. The cabinets are marked as wooden cabinets in the drawing. Please refer to representative picture (No. 4 & 5) of Annexure III for details. Display Cabinets: Fabrication/Supply of Four number of display cabinets for display of innovative models marked as AL1 in the drawing. The approx. size of cabinets will be 8 X1.5 X7.5. Please refer to representative picture (No. 6) of Annexure III for details. Glass Doors with support structure: Supply and Installation Glass doors (approx. 4 in No.) made of 12mm toughened glass with machine fitting labelled as glass door in the drawing for Entrance and Emergency exit and connecting to the sections. Doors will installed using support structures such as pillars having sufficient strength for smooth operation of the doors. Glass Window: Providing the provision of Glass windows (approx. 2 No.) made of 6mm glass in the partition boundary walls such that Science City Pushpa Gujral Science City/ Innovation Hub Page 10

11 visitors can glance at the activities being performed inside. The placement of Glass windows is marked as Glass Window in the respective drawing of the section. Signages: Supply and Installation of Signages (front and back-approx 6 No.) on each entry, exit and connecting sections. Signage s should be readable from at least a distance of 20. Laminated Panels: Printing, Supply and Installation of theme based laminated colorful panels (vinyl pasted on 3mm sun board) on interior walls wherever space is available for depicting scientific /Innovative feel to the gallery. No wall should be left blank i.e. without panels inside the section. PVC Flooring: Supply and Installation of PVC flooring of approved make having min thickness of 1.5 mm in approx. 50 sq meter area. Electrification: Supply and Installation of Switches (approx. 17), Sockets (approx. 17), Cables and LED tube lights of with switches (approx. 6) for uniform lighting of the section. Electricity source will be provided by PGSC. Refer Annexure B for Schedule of items for electrification work. The representative drawing of the innovation resource centre is enclosed at Annexure III. The drawing is only for the reference purpose. 2. Idea Lab - This lab will have necessary basic facilities for children to pursue creative and innovative hobbies/activities that involve model making, basic science experimentation, design & fabrication of useful gadgets of practical use, teaching/learning kits or aids for better classroom transactions, testing of samples like soil, water, food items etc. Idea lab will consist of following sections 2(a) Chemistry Lab: The chemistry lab will provide students an opportunity to perform experiments that explore important chemical concepts and introduce proper lab techniques and safety. The total area covered of this section is approx. 30 Sq m and is marked with number 3A in the drawing enclosed as Annexure IV. The scope of work includes Partition Wall: Fabrication of new boundary partition wall approx. size Length 13, height 8, fully grouted to floor marked as New Wall in the drawing. Please refer to Annexure IV drawing for details. Chemistry Lab cabinets: Fabrication of exhibit cabinets of approx. size Length 35 Width 3 height 3 with top shelf made of granite for chemistry lab having provision for placing lab equipment s and ceramic lab sink. The ceramic lab sink will be of approx. 24 X18 X10 in size. The cabinets are marked as wooden cabinets in the drawing. Book Cabinets: Fabrication/Supply of two number of Books cabinets made of powder coated Mild steel for library purpose of approx. size 3 X6 marked as Al3 in the Annexure IV drawing. Doors will be installed using support structures such as pillars having sufficient strength for smooth operation of the doors. Centre Table: Fabrication of one number of Centre table of approx. size 8 X4 having granite top. Please refer to representative picture (No. 12) of Annexure IV for details. Students will learn more by doing things practically using day to day scrap. The total area covered of this section is approx. 65 Sq m and is marked with number 3D & 3E in the drawing enclosed as Annexure VII. Laminated Panels: : Printing, Supply and Installation of theme based laminated colorful panels (vinyl pasted on 3mm sun board) on interior walls wherever space is available for depicting scientific /Innovative touch to the gallery. No wall should be left blank i.e. without panels inside the section. PVC Flooring: Supply and Installation of PVC flooring of approved make having min thickness of 1.5 mm in approx. 40 sq meter area. Electrification: Supply and Installation of Switches (approx. 14), Sockets (approx. 14), Cables and LED tube lights with switches (approx. 8) for uniform lighting of the section. Electricity source will be provided by PGSC. Refer Annexure B for Schedule of items for electrification work. The representative drawing of the Design Studio is enclosed at Annexure VIII. The drawing is only for the reference purpose. Computerized 3D Model of the Design The soft and hard copy of computerized 3D graphic view of concept, design along with detailed drawings of all sections has to be submitted by the Pushpa Gujral Science City/ Innovation Hub Page 16

17 successful bidder whom the work is awarded within 21 days from the date of placement of order. 3D graphic View should show the landscape placement of all the facilities along with interior exhibit cabinets, tables, wall panels, flooring and signage s as given in the tender document. These are to be got approved before using in fabrication. Only approved Ply of premium grade only will be accepted. 5) All the visible surfaces of exhibit cabinets/partition from visitors movement area should have laminated / painted finish. Refer to specifications for laminated finish and paint finish as per details given in Clause No. (B) and (C). 6) Use only a p p r o v e d adhesive for frame joining; ply fixing on frames, laminate pasting works etc. 7) All the exhibit structures to be firmly grouted to the floor / walls etc. as per direction at site. 8) Proper eco-friendly anti termite chemical shall be applied on all wooden/ plywood surfaces. 9) All wooden beadings used for fixing of Glass / acrylic / polycarbonate sheets shall be Teak Beading polished to melamine finish. 10) The glass used in the cabinets/doors/windows should be only toughened float glass and should be clear, transparent, wrinkle and scratch free with proper thickness. Glass door should be of 12mm thickness and glass window should be of 6mm thickness. 11) Transparent polycarbonate and acrylic sheets free from any scratches or stains shall only be used. 18 used. 13) Electrical cables of min specification of 2 core X 1.5 sq mm + 1 core X.75 sq mm shall only be used. 14) PVC conduit pipes of minimum 20 mm diameter shall only be used. 15) LED tube lights for illumination of the hub will be of standard /ISI marked brands 16) Dimensions given in the drawings are indicative. The actual dimensions for fabrication may vary depending on site conditions. (B) Specification for pasting decorative laminates on exhibit cabinets and partitions: 1) The selected tenderer(s) shall use latest stock of make 1mm thick decorative laminates conforming to IS: as per the colour scheme required for individual cabinets. 2) The selected tenderer(s) shall undertake pasting of laminates as per approved design that may be plain or designed using multiple colour shades. 3) All laminates shall be pasted with quality adhesive only. 4) Edges of laminates shall be beveled before pasting to avoid visibility of all edges etc. 5) Utmost care to be taken by providing sufficient support while pasting laminates on vertical as well as horizontal surfaces to avoid air bubbles, undulations etc 6) In case workmanship of laminate pasting is found defective and unsatisfactory during inspection, the successful tenderer(s) shall arrange to replace the laminates at his/her own cost as per the approved shade and make. 7) Up to 5% of the laminate used will be of metallic/ texture shade/ finish (C) Material specifications for polyurethane paint with PU clear glossy/mattfinish on wooden surfaces, wherever required. 1) All polyurethane paints, primers, filler materials and thinner only shall be supplied by the selected tenderer(s) as per actual requirement. 2) The wooden/plywood surfaces shall be thoroughly cleaned with emery paper 36/80/120 to make the surface smooth before application of the penetration primer and subsequent coats of knifing filler, soft cutting filler, glossy / metallic polyurethane paint and clear glossy/matt polyurethane paint. Manufacturer s specifications and applications and application procedure shall be strictly followed to ensure the desired quality of finish. 3) The successful tenderer(s) shall arrange to bring to their own spray gun, compressor for spray painting and tools and tackles required for the work. 19 4) The tenderers may obtain details of paint application procedure in case they so desire before submitting the quotation. Following points must be noted very carefully. No deviation on any of the following points will be accepted in any case. Brand specified or approved equivalent must strictly be followed. 1. All Glasses are toughened clear glass. Thickness of the glasses will be 6 mm upto a height / span of 1.2 meter and 8 mm thick beyond this, unless specified in drawings. 2. Exact colour scheme of laminates and fixing pattern will be g o t a p p r o v e d before fabrication by the successful tenderer. 3. Wherever needed Service door of minimum size 2 X6 should be provided with frame work and mortise lock. Locks are to be provided and fixed by the party. 4. Use only approved make of phenol bonded plywood of appropriate thickness. The vertical straight panels created should be made of framework having 50mm X 38mm for vertical members and 50mm X 25mm for horizontal members and the grid size shall be 1½ x 1½ for 6mm thick ply covering & 2 X 2 for 12mm thick ply covering. 5. All polycarbonate sheets are compact, clear and transparent polycarbonate of 3mm thickness sheets. 6. The non-laminated portion of structure that is visible from service corridor should be paint finished using approved paint/primer. Synthetic enamel paints on wood primer of similar make. 7. All inside surfaces of exhibits from front side which are not laminated should paint finished with Emulsion / Enamel paints of approved shade / color. in two or more coats on primered surface to get even finish. 8. Wherever mentioned put 2mm thickness PVC flooring of required shade. Flooring should be fixed with adhesive of required quality and have seamless PVC welding of the joints. 9. All curved surface are to be made 50mm x 38 mm wooden section in 1.5 feet gaping (vertical) and 1 X3 curved cutting of 19 mm ply (of above make) in horizontal face in 1 feet gaping making 1.5 ft. X1ft grid. 10. All the Stainless Steel works w h e r e v e r r e q u i r e d to be executed, Stainless Steel surface is to be buffed and polish finished. 11. Grade 304 Stainless Steel is to be used. 12. Powder coated MS having minimum gauge of 22 should be used for Book Cabinets 13. In all exhibits, Doors are to be provided for easy access inside for maintenance purpose. Doors are to be provided with good quality lock and key. 22 INSTRUCTIONS CONCEPT, DESIGN, FABRICATION, SUPPLY, ERECTION AND INSTALLATION OF FACILITIES FOR SETTING UP OF INNOVATION HUB AT PUSHPA GUJRAL SCIENCE CITY, KAPURTHALA, PUNJAB. 1. The offer should be submitted in three separate envelopes. Part - I (Envelope - I): containing Earnest Money Deposit Part II (Envelope - II): containing Technical Bid / DESIGNS Part III (Envelope - III): containing Financial Bid 2. The procedure for submitting the tender shall be as under: - ENVELOPE I: superscribed EARNEST MONEY DEPOSIT should contain Earnest Money Deposit in the form of Demand Draft Tender submitted without the Earnest Money will be summarily rejected. The earnest money deposited with PGSC will be refunded to the unsuccessful tender after finalization and the award of work as per terms & conditions of the contract. In case of successful Tenderer, the Earnest Money will be retained as part of the Security Deposit for satisfactory execution of the contract. In case the Tenderer does not return the signed copy of the work order within 15 days of the award of work, the earnest money shall be forfeited by the PGSC. COMPANY PROFILE Intending Tenderers must have the experience of executing similar type of work. Experience in fabricating work of similar nature for any Government / Government Undertaking Organizations will be given preference. The following documents must be enclosed along with the offer: 1. In case, a tender is being submitted by a Firm, it must be signed by a member or members of the Firm having legal authority to do so, and if called for, legal documents in support thereof as also of the fact that the Firm is registered under the Indian Partnership Act be produced. In case of a joint family business, the names, addresses and descriptions of the joint family should be mentioned and satisfactorily established. Signature will indicate acceptance of the contents of those tender papers by the Tenderers. In case, a tender is being submitted by a Company, copy of the registration certification of the company needs to be enclosed. 3. Copies of Testimonials/Certificates etc. regarding past experience of the similar work done by the Tenderer. 4. Agencies who had earlier done any job / work for Pushpa Gujral Science City in the past have to compulsorily submit a Certificate of Satisfactory Performance. 5. Sales, Service Tax and VAT (if applicable) Registration Certificates. 8. Copies of Audited Annual Accounts/ Complete Balance Sheet for the last 3 years. II Tender Document 1. All entries in the tender documents shall be in one ink. Erasing and over writings are not permitted. The concerned tenderer with proper indication of the name, designation and address of the signee should duly sign all pages including cancellations and insertions. 2. Tenderers shall fill in all required particulars in the blank spaces provided for this purpose in the tender documents and also sign each and every page of the tender document including the drawings attached thereto before submitting their tender. 3. 24 attached to the tender document or in doubt as to their meanings, he should at once address to the authority inviting the tender for clarifications during pre-bid meeting. Every endeavor is made to avoid any error which can materially affect the basis of the tender but the successful tenderer shall take upon himself to provide for the risk of any error which may be subsequently discovered and shall make no subsequent claim on account thereof. 4. In the event of tender being submitted by a firm, the tender be signed separately and legibly by each partner or member of firm or in their absence, by the person holding the power of Attorney on behalf of the firm concerned. In the later case, a copy of the Power of Attorney duly attested by a Gazetted Officer must accompany the tender. 5. Conditional and unsigned tenders, tenders containing absurd rates and amounts, tender which are incomplete or otherwise considered defective, tenders which are not in accordance with the tender conditions laid down by the Accepting Officer and tenders not submitted in the prescribed forms are liable to be rejected. 6. The PGSC reserves the right to reject any or all the tenders received or accept any tender or part thereof without assigning any reason thereof. In the case of acceptance of a part of tender, the time for completion may also be reduced to the extent considered appropriate by the accepting authority. 7. Before submitting the tenders, the firms are advised to inspect the site of work and its environment and make necessary investigation in regard to site conditions etc in carrying out the work in accordance with the specifications, conditions of contract, the actual working and other prevailing conditions, position of material and labour etc. If they feel any difficulty, it may be brought to the notice of PGSC immediately or during the Pre-bid Meeting. They should be well versed with the PGSC Kapurthala and General conditions of contract. 8. The tenderer shall specially note that it is tenderer's responsibility to provide any item which is not specifically mentioned in the scope of Pushpa Gujral Science City/ Innovation Hub Page 24

25 work or representative drawings, but which may be necessary to complete the work. 9. Any bid received after the deadline for submission of bids shall be rejected or returned un-opened to the Tenderer. 10. Tenders should be submitted only by Government Post or by hand. Tenders submitted by Govt. post should be posted with due allowance for any delay in postal delivery. PGSC shall not be responsible for any delay due to any reasons in the transit. Tenders received after the due date and time of opening tenders shall be rejected. 11. If the Tenderer deliberately gives wrong information in his tender, then PGSC Administration reserves the right to reject such tender at any stage. 12. Words imparting the singular number shall also be deemed to include the plural number and vice-versa where the context so requires. 13. The General and Special Conditions of Contract are complementary to each other and where they are in conflict, the special conditions shall prevail. 14. The contractor's responsibility under this contract shall commence from the date of receipt of the acceptance of this tender. 15. If a Tenderer expires after the submission of his tender or after the acceptance of his tender, the PGSC may at their discretion cancel such tender. If a partner of the firm expires after the submission of the tender or after the acceptance of the tender PGSC Administration may cancel such tender at their discretion unless the firm retains its character/s. 16. The PGSC Administration will not be bound by any Power of Attorney granted by the tenderer or by changes in the composition of the firm made subsequent to the execution of the contract. They may however, recognize such power of Attorney and changes after obtaining proper legal advice, the cost of which will be chargeable to the contractor concerned. A soft and hard copy of the proposed presentation should be submitted at the time of presentation. OTHER DOCUMENTS Tenderers can attach any other documents to show his / her strengths for completing the project. ENVELOPE III: superscribed FINANCIAL BID should contain only the price bid. The price bid shall be opened on the date and time as decided by the Committee to be constituted by the PGSC for this purpose. Budget: Rs 30 Lakhs(approx.) However, the Committee has the right to accept higher bids than the budgeted amount mentioned in the tender document depending upon the selected design, suggested materials and overall appeal of the design. All the envelopes mentioned above should be submitted in a larger envelope double-sealed cover, super-scribing the Tender for CONCEPT, DESIGN, FABRICATION, SUPPLY, ERECTION AND INSTALLATION OF FACILITIES FOR SETTING UP OF INNOVATION HUB AT PUSHPA GUJRAL SCIENCE CITY, KAPURTHALA, PUNJAB. within due date. 3. PROCEDURE The procedure of opening the tender shall be as follows: Envelope I shall be opened in first instance. Bids without proper Earnest Money shall be out rightly rejected and Envelope II and III shall not be opened. Envelope II shall only be opened with Earnest Money in Envelope I as required. FINANCIAL SCORE MAXIMUM MARKS: 25 Financial Scores (S F) will be calculated as under: S F = (100 x F m / F) x 0.25 Fm Lowest bid received. F Price quoted by the bidder under consideration. OVERALL SCORE (S O) MAXIMUM MARKS: 100 The sum of Technical Score & Presentation Score and Financial Score. 29 GENERAL CONDITIONS OF CONTRACT 1. WORKING CONDITIONS 1.1 The contracting firm has to work under the guidance / supervision of the officer(s) authorised by the Director General / Director, PGSC. 1.2 The materials used by the successful tenderer shall conform to the description and/or specification given by PGSC, Kapurthala. Sub-standard quality of materials will not be accepted. The samples must be got approved in advance from the competent authority of Pushpa Gujral Science City, Kapurthala. 1.3 Bad workmanship will not be accepted and if carried out is liable to be rejected and should be rectified by the successful tenderer at his cost as per specifications and directions given by the authorized representative of Pushpa Gujral Science City, Kapurthala. Decision of Pushpa Gujral Science City, Kapurthala., as to items of bad workmanship and proper replacement/rectification will be final and binding on the successful tenderer. 2. Inspections 2.1 The successful tenderer shall arrange for inspection of all raw materials by the authorized official of the Pushpa Gujral Science City, Kapurthala to conform to the specified brand and specifications as per the tender document before the raw materials are used for fabrication of the ordered jobs. 2.2 Inspection after erection of the wooden structures of the wooden cabinets. 2.3 Inspection after fixing ply boards, fixing of laminations wherever applicable, prior to starting the finishing work. 2.4 Inspection after pasting of decorative laminate sheets wherever applicable. Inspection may also be made any time during the process of fabrication, if felt by the officials of Pushpa Gujral Science City, Kapurthala. Any defect pointed out by the competent representative of the Pushpa Gujral Science City, Kapurthala during such inspections shall be promptly rectified to ensure desired quality of work. It would be mandatory on the part of the successful tenderer to arrange inspection and obtain approval at every stage of work failing which action will be taken as deemed fit by the PGSC. The decision of PGSC in this regard shall be final and binding on the successful tenderer 3. PAYMENT SCHEDULE 3.1 No Advance payment will be made at the time of release of the order 3.2 First installment of running payment of 30% of the contracted cost could be considered after 50% satisfactory completion of the total work at the site. 3.3 Second installment of running payment of 30% of the contracted cost could be considered after 75% satisfactory completion of the total work at the site. 3.4 Third installment of final payment of 40% of the contracted cost will be considered after 100% satisfactory completion of the total work at the site. 3.5 Ten(10) % of each installment of payment will be deducted and retained as Retention Money for Defect Liability Period. 30 released after expiry of Defect Liability Period or after receipt of Bank Guarantee of equivalent amount valid for Defect Liability Period. The performa for Bank Guarantee is enclosed at Annexure-A 3.6 TDS and / or any other tax will be deducted as per rules. 4. TIME SCHEDULE AND DELAYS 4.1 Contract time: The time of completion of the work would be 3 months from the award of work. 4.2 Within one fortnight of the occurrence of any of the following, which the contractor might regard as impediments in the progress of work, the contractor shall apply in writing to the Director General, PGSC for extension of time, setting out the reasons for delays sought to be condoned. a. Addition, alteration or substitution ordered in the work, which could have a significant time impact and issued to the contractor under an official change order only. b. Act of God or force majure, i.e. a situation arising out of any occurrence totally beyond the control of the contractor, and explicitly excluding consequences of actions of the contractor or his staff or agents. c. Forced closure of the works by a general political strike and unrest not related to contractor s labour or personnel. 4.3 The contractor s application for extension of time in any of the above circumstances shall be considered by DG, PGSC and his decision shall be final and binding. 4.4 The granting of any extension of time shall not entitle the contractor to claim any additional remuneration or consideration whatever for costs incurred as a result of such delays or due to cost escalation. 4.5 Compensation for Delay: The time allowed for carrying out the work as entered in the Tender shall be strictly observed by the Contractor and shall be reckoned from the date on which the order to commence work is given to the Contractor. The work shall throughout the stipulated period of the Contract be proceeded with all due diligence. If there is delay then contractor shall pay an amount equal to 1 percent of accepted Tender for every week or part of a week that the work remains not commenced or unfinished after the expiry of the completion date. Provided always that the entire amount of compensation to be paid under the provisions of the clause shall not exceed ten percent of the value of the accepted Tender. PGSC RIGHT TO TAKE OVER WORK OR TERMINATE CONTRACT 5.1 PGSC shall be entitled to take possession of the site and works and to remove the contractor giving to the contractor seven days notice under any of the following circumstances: i. If in the opinion of the PGSC, the contractor has failed to proceed with the work with due diligence and failed to make such progress as would enable the works to be completed within the stipulated time. ii. The Contractor has suspended the work in contravention of the conditions of the contract and failed to resume the work within seven days of a receipt of such notice from the Director, PGSC. iii. The contractor has abandoned the work. iv. The contractor has neglected or failed persistently to implement instructions of the Director after due written warnings. v. The contractor has sub-let or assigned the work or any part thereof without the written consent of the Director. vi. The contractor has become or is adjudged to be insolvent. 5.2 Use of completed portions: PGSC shall have the right to take possession for any use any completed or partially completed portion of the work not withstanding that the time for completing the entire work may not have expired. Possession and use shall not be deemed acceptance of any work completed in accordance with the terms of this contract. 5.3 In the above circumstances the contractor shall neither claim compensation of the use of his property by PGSC nor other agency completing the work, nor shall he claim any losses on account of damage to or wear and tear to his property. 5.4 Should it become necessary for PGSC to take over the works under the above circumstances the contractor shall be liable to make good all construction costs exceeding the agreed rates in the contract and also incidental expenditure of every nature incurred in completing the Work and duly certified by the Director. 5.5 The total sum payable by the contractor to PGSC by way of costs incurred in completing the works, damages, and compensation shall be deducted from amounts payable to the contractor. If the amount payable to the contractor is not sufficient to cover the sum due to PGSC, the contractor is bound to pay the difference to PGSC. 6. PERFORMANCE WARRANTY 6.1 In case the structures develop cracks or defects within 1 years from the date of supply the Tenderer will have to replace / rectify the same without claiming extra charge whatsoever. 32 6.2 The decision of the DG, PGSC will be conclusive and binding on the tenderer in so far as the quality of the goods / material and installation and of workmanship are concerned. 7. WARRANTY / QUALITY: 7.1 The Warranty period shall be 1 years after successful installation of the site. 7.2 The supplier firm shall rectify defects developed in the system within guarantee period within 5 days of occurrence of any fault promptly. In case the supplier firm does not rectify the defects in further 10 days, PGSC shall have full liberty to restore the system in working condition. The expenditure so incurred by PGSC shall be deducted from the supplier firm pending claims, security deposit or in other law full manner. 8. PATENT RIGHT AND ROYALTIES: The tenderer shall indemnify the PGSC against all third party claims of infringement of patent, royalties trademark or industrial design rights arising from use of the goods or any part thereof. 9. DEFECT LIABILITY PERIOD: 9.1 The defect liability period shall be 12 (twelve) months from the date of completion of the work. The successful tenderer shall be responsible for all defects in the material supplied like defective workmanship, use of defective materials, de colouring of material, strength of materials breakage, etc. for a period of 12 (twelve) months from the date of completion of the job. The successful tenderer shall rectify the defects/defective parts within a reasonable time up to the satisfaction of the competent authority or otherwise the PGSC shall have the right to rectify the defect at the successful tenderer s own risk and the cost of which will be adjusted from the Security Deposit. Decision of Pushpa Gujral Science City, Kapurthala in this regard shall be final and binding on the successful tenderer. 9.2 In case the work is not carried out in accordance with prescribed specifications or is not considered to be of the required standard or is not completed within the prescribed time limit, it will be open to PGSC to get the work done from other sources. 9.3 In the event of the Agency winding up its business whether voluntarily or compulsorily or making compensation or arrangements with its creditors or in case any proceedings under Insolvency Act is taken against them or a receiver of their business is appointed of failing to observe and perform any of the provisions of this agreement or is in opinion of PGSC not satisfactory proceeding with the work or unsatisfactorily completes the work, the PGSC shall have the right to terminate the work forthwith without prejudice to any other rights or remedies. 33 10 CHANGE ORDERS 10.1 The PGSC may at any time, by a written order given to the tenderer make changes within the general scope of the contract in any one or more of the following: a. Drawings, designs or specifications, where Goods to be furnished under the contract are to be specifically manufactured for the PGSC. b. The method of transportation packing. c. The services to be provided by the Tenderer If any such change causes an increase or decrease in the cost of or the time required of, the Tenderer s performance of any part of the work under the contract, whether changed or not changed by the order, an equitable adjustment shall be made in the contract price or commissioning schedule or both, and the Contract shall accordingly be amended. All claims by the Tenderer for adjustment under this clause must be asserted within thirty (30) days from the date of the tenderer s receipt of the PGSC s change order. 11 WATER AND ELECTRICITY Water and Electricity will be provided by the PGSC from where the successful tenderer has to set up the supply system and other required equipments and works. 12 FORCE MAJEURE Neither PGSC nor Agency shall be considered in default in performance of its obligations, if such performance is prevented or delayed for any causes beyond the reasonable control of the party affected such as war, hostilities, revolution, riots, civil commotion, strikes, lockouts, epidemic, fire, explosion, flood, earthquake or because of any law and order proclamation, regulations or ordinance of any Government or sub-division thereof or because of any Act of God or any other cause beyond the control of the concerned party which could not have been foreseen or avoided by the exercise of due diligence and so it becomes impossible of performance, provided notices in writing of any such cases with necessary evidence that the obligation thereby affected or prevented or delayed is hereby given within 14 days from the happening of the event and in case it is not possible to serve the notice within the said 14 days period, then within the shortest possible period without delay. As soon as the cause of Force Majeure has been removed, the party whose liability to perform its obligation has been affected shall notify the other party the actual delay occurred in such affected activity. 34 13 GENERAL 13.2 Director General, PGSC reserves the right to increase or decrease the quantity or delete some of the items depending on the needs of the institute The Director General, PGSC reserves the right to reject any or all tenders without assigning any reason whatsoever All damaged or unapproved goods shall be returned at the risk and cost of the tenderer and the incidental expenditure thereupon shall be recovered from the concerned party Any damage which may occur on the Site, while transporting, installation of will have to be rectified by the firm or paid in lieu of, as decided by the competent authority Water and Electricity will be supplied free of cost at the site Legal jurisdiction will be judicial courts of Kapurthala District All disputes and differences arising out of or in connection with, touching or concerning this work shall be referred to the sole Arbitrator appointed for the purpose by the Director General. The decision of the Arbitrator shall be final and shall be binding on both the parties subject to the provisions of the Indian Reconciliation and Arbitration Act, 1996 or any statutory modifications or reenactment there of and the rules made thereunder and for the time being in force shall apply to the arbitration proceeding under this clause. Place for Arbitration will be Kapurthala, Punjab 13.9 Clean up of the site after completion of work will be the entire responsibility of the contractor Contractor will Indemnify PGSC from all claims of laborers in case of any accident /PF/wages as per labour laws The PGSC may, at his discretion, extend this date for the submission of tender by amending the Tender Documents in which case all rights and obligations of the PGSC and the Bidder previously subject to the original date shall thereafter be Subject to the new deadline as extended. If such nominated date for pre-bid or submission of tender is subsequently declared as a Public Holiday by the PGSC / Government, the next official working day shall be deemed as the date for pre-bid and submission of tender.
