3 CHIMNEY OAKS ARCHITECTURAL DESIGN GUIDELINES 1.0 INTRODUCTION 1.01 Objective f the Design Guidelines This dcument has been prepared by Banks Cunty Glf, LLC fr the purpse f prmting the develpment f a residential glf cmmunity knwn as Chimney Oaks (the Develpment ). The standards f design expressed in this dcument are intended t describe ur visin f the Develpment thrugh prcedures that are clearly utlined and infrmative. Our intent is t expedite yur prcess f building an exceptinally high-quality residence. Thrughut the curse f the Develpment, we may review and revise these Design Guidelines as necessary t reflect changing cnditins Relatinship t Legal Dcuments These Design Guidelines are supplementary t the Declaratin f Cvenants, Cnditins & Restrictins fr Chimney Oaks ( Declaratin r Cvenants ), recrded in the Banks Cunty, Gergia public recrds. The criteria are intended t cmplement the Declaratin and, shuld a cnflict arise, the Declaratin shall prevail Cmmunity Master Plan Chimney Oaks is a Master Planned Glf Cmmunity that includes apprximately 363 acres. The site includes an 18-hle glf curse and assciated clubhuse, as well as swim, tennis, and future recreatinal areas. It is the intent f the develper t prtect the natural features f the cmmunity thrughut the curse f develpment. Cnsequently, these Design Guidelines will als reflect that sensitivity in its apprach tward the design review and cnstructin f residences within the Develpment. 2.0 ORGANIZATION AND RESPONSIBILITIES OF THE ARCHITECTURAL REVIEW BOARD ( ARB ) 2.01 Missin and Functin The Declaratin states that n structure is t be erected in the Develpment withut being apprved by the Architectural Review Bard ( ARB ) pursuant t Article IX f the Declaratin. The ARB wrks with these Design Guidelines and the Cvenants t assure an attractive, cmpatible, and aesthetically pleasing cmmunity. The Design Guidelines are used by the ARB fr the evaluatin f prjects submitted t them. The final decisin f the ARB may be based n purely aesthetic cnsideratins. It is imprtant t nte that these pinins are subjective and may vary as cmmittee members change ver time. The develper reserves the right t revise and update the Design Guidelines as well as the perfrmance and quality standards t respnd t future changes Membership The ARB is cmprised f 3 t 5 members appinted by Banks Cunty Glf, LLC ( Declarant ). A member f the Declarant s staff will chair the cmmittee. The right t appint members t the ARB shall be retained by the Declarant until ne hundred percent f the Lts have been develped and cnveyed t purchasers in the nrmal curse f develpment. At such time, the Bard f Directrs f the Assciatin shall appint the members f the ARB in accrdance with Article IX, Sectin 1 f the Declaratin.

4 2.03 Scpe f Respnsibility The ARB has the fllwing respnsibilities: 1. Evaluating each f the plans submitted by an wner fr adherence t the Design Guidelines and cmpatibility f the design with the adjining sites and cmmn spaces. 2. Apprving all new cnstructin. 3. Mnitring the design and cnstructin prcess in rder t ensure cnfrmance with the Cvenants and Design Guidelines. 4. Enfrcing the Design Guidelines thrugh special assessment r self-help as described in the Cvenants. 5. Interpreting the Cvenants and Design Guidelines at the request f the Owners. 6. Apprving all mdificatins t existing structures, including but nt limited t walls, fences, exterir painting, material replacements, windw tinting, renvatins, additins, play structures, and landscaping Enfrcement Pwers Any structure r imprvement that is erected n any Lt withut ARB apprval is cnsidered t be in vilatin f these Design Guidelines and the Declaratin. The ARB has the pwer t request that the nncnfrming structure be brught int cmpliance at the wner s expense. Shuld the wner fail t cmply with the requests f the Bard, the ARB will act in accrdance with Article IX Sectin 7 f the Declaratin t bring the nncnfrming item int cmpliance Limitatin f Liability Apprval by the ARB des nt cnstitute a representatin f warranty as t the quality, fitness, r suitability f the design r materials specified in the plans. Owners shuld wrk with their architect and r cntractr t determine whether the design and materials are apprpriate fr the intended use. In additin, apprval by the ARB des nt assure apprval by any gvernmental agencies that require permits fr cnstructin. Owners are respnsible fr btaining r ensuring that their architect r cntractr btains all required permits befre cmmencement f cnstructin. The Declarant, the Assciatin, the Bard f Directrs, any cmmittee, r member f any f the freging shall nt be held liable fr any injury, damages, r lss arising ut f the manner r quality f apprved cnstructin n r mdificatins t any Lt. In all matters, the cmmittees and their members shall be defended and indemnified by the Assciatin as prvided in the Declaratin Amending the Design Guidelines As the develpment grws, it may becme necessary t amend the design guidelines. Suggested amendments t the guidelines may be discussed during the administrative prtin f the ARB meeting. The ARB shall agree upn what is t be amended and the exact wrding f the prpsed amendment. After ne hundred percent f the Lts have been develped and cnveyed t purchasers in the nrmal curse f develpment, the ARB will then recmmend t the Bard f Directrs that the amendment be adpted and the Bard f Directrs shall then vte t apprve r reject the amendment t the design guidelines. All amendments t the Design Guidelines shall either be published n the Assciatin s website r distributed t all prperty wners. 3.0 DESIGN REVIEW PROCESS 3.01 Review f Plans The ARB will review design submissins at scheduled ARB meetings. Preliminary/Final submissins must cntain: engineering drawings fr all elevatins, site develpment/grading plans, material samples and anything else as required by the ARB. Submissins are due ten (10) calendar

5 days befre each meeting. The ARB Administratr will review submissins in advance f the scheduled meeting. Final Apprval must be btained befre beginning cnstructin. Builders must submit final plans reflecting any required changes/cnditins impsed by the ARB t the ARB Administratr in rder t schedule a clearing inspectin. Submissin requirements are utlined in Article IX f the Declaratin and Sectin 5.01 f these Design Guidelines. Incmplete submissins will nt be reviewed Cnditins f Apprval / Rejectin f Plans Apprval by the ARB shall in n way relieve the wner f respnsibility and liability fr the adherence t any applicable rdinances and cdes. Plans submitted fr review, r any prtin theref, may be disapprved upn any grunds which are cnsistent with the purpse and bjectives f the ARB including purely aesthetic cnsideratins Architectural and Cntractr Requirements All plans fr the cnstructin f dwellings and ther buildings r significant structures in the Develpment must be designed and drawn by a registered licensed architect r a prfessinal experienced hme designer licensed t practice is their specific trade. All cnstructin wrk must be cmpleted by a cntractr licensed in the State f Gergia Preliminary / Final Review The design review prcess is divided int tw steps, (1) a Preliminary/Final Review and (2) a Final Submissin. The purpse f the Preliminary Review is t allw the Owner and ARB t wrk tgether t arrive at an apprved design that cmplies with the Design Guidelines and Cvenants. Fr the Final Review the applicant r authrized agent must submit accurate engineering drawings f the prpsed building and site layut fr apprval. The ARB reviews these plans fr design and technical issues as set frth in the Design Guidelines, and may apprve, apprve with cnditins, r reject the plans. N cntractr may present preliminary plans with the intentin f cmmencing cnstructin prir t a subsequent final apprval. The ARB may, at its sle discretin, grant Final Apprval t begin cnstructin withut impsing requirements/cnditins. If the builder is granted Final Apprval at the time f the review, a clearing inspectin will be scheduled immediately. Nte: Each applicatin t the ARB shall cntain a representatin and warranty by the wner that use f the plans submitted des nt vilate any cpyright assciated with the plans. Neither the submissin f the plans t the ARB, nr the distributin and review f the plans by the ARB shall be cnstrued as publicatin in vilatin f the designer s cpyright, if any. Each wner submitting plans t the ARB shall hld the members f the ARB, the Assciatin and the Declarant harmless and shall indemnify said parties against any and all damages, liabilities, and expenses incurred in cnnectin with the review prcess f this Declaratin Final Submissin Fr Final Apprval, the applicant r authrized agent must submit tw cpies f amended plans fr the prject. These drawings shuld address all the cnditins impsed by the ARB during the Preliminary/Final Review. The ARB Administratr will verify that all cnditins/requirements impsed by the ARB have been implemented, r, in the case f a divergence, schedule the submittal fr anther review Additinal Meetings with the ARB If an applicatin fr apprval is denied r cnditins are unacceptable, the applicant may appeal the decisin and resubmit the prpsal at the next scheduled ARB meeting Variances Frm time t time the Design Guidelines r existing site cnditins may impse an undue hardship that may inhibit cnstructin n a particular Lt. In such case, the applicant may submit a variance

6 applicatin (in additin t the cnstructin applicatin) t the ARB. The ARB will grant r deny the variance request in writing. N variances are allwed unless the applicant has received a written ntice f apprval frm the ARB. Any variance granted is unique and des nt set any precedent fr future decisins f the ARB Design Review Fees Design review fees will be established and published by the ARB. The purpse f these fees is t cver all expenses related t the prcessing f applicatins fr cnstructin. Unscheduled final presentatins will be cnsidered n a case-by-case basis fr prjects nt requiring majr engineering r site develpment changes. The ARB reserves the right t refuse an unscheduled review fr any reasn. The Bard reserves the right t change r waive these fees frm time t time withut prir ntice. The design review fee must be included in the preliminary submissin. Submissins received withut the design review fee will be cnsidered incmplete and returned t the Owner. At the time these initial guidelines are adpted, the design review fees are as fllws: New Cnstructin $ Revisins t Existing Structures* $ Unscheduled Review $ * Fees fr Revisins are applicable 18 mnths fllwing start f cnstructin. Revisins applied fr prir t cmpletin f a prject are nt subject t additinal review fees Cnstructin Depsit The builder will pst a refundable cnstructin depsit f $1,000 befre receiving apprval fr cnstructin. The ARB will nt accept payment frm prperty wners fr the cnstructin depsit. The builder may nt transfer the wnership f the cnstructin depsit t the prperty wner unless authrized in writing by the ARB. Shuld the builder accrue any fines during cnstructin, the amunt f the fine will be deducted frm the cnstructin depsit. The builder will then be required t replenish the amunt deducted frm the cnstructin depsit within fifteen days f incurring the fine, r be subject t the enfrcement prvisins f Article IX, Sectin 7 f the Declaratin Renvatin / Additins t Existing Structures All renvatins, additins, r imprvements t existing structures must be apprved by the ARB. The applicant r authrized agent shall submit plans shwing the nature f the wrk t be perfrmed, an applicatin fr revisins, and a $300 review fee. In additin, a $500 cnstructin depsit shall be submitted befre starting wrk. The ARB reserves the right t increase this depsit as necessary t cver the scpe f wrk prpsed by the applicant. This cnstructin depsit shall be returned when all wrk is cmplete and the prject has been inspected and apprved by the ARB Final Apprval A Final Apprval Letter will be issued after the ARB apprves the submitted plans fr cnstructin Cmpletin / Occupancy Upn cmpletin, all structures, landscaping, and drainage must be inspected fr cmpliance with the apprved final plans. Upn passing inspectin, a certificate f cmpletin will be issued t the hmewner and cpied t the file.

7 Nte: Apprval by the ARB des nt cnstitute a representatin f warranty as t the quality, fitness, r suitability f the design r materials specified in the plans. Owners shuld wrk with their architect and r cntractr t determine whether the design and materials are apprpriate fr the intended use. In additin, apprval by the ARB des nt assure apprval by any gvernmental agencies. In all matters, the cmmittees and their members shall be defended and indemnified by the Assciatin as prvided in Article IX f the Declaratin. 4.0 THE CONSTRUCTION PROCESS 4.01 Cnstructin Time Limit All dwellings and ther structures must be cmpleted within ne year frm the date f lt clearing. Exceptins may be granted where such cmpletin is impssible, when cntinuatin wuld result in great hardship t the wner r builder due t strikes, fires, natinal emergencies, r natural calamities as deemed by the ARB. If an extensin is needed, the builder may submit an extensin request, including prjected cmpletin date, in writing t the ARB. Failure t cmplete the prject within the deadline will result in either special assessments, self-help measures, r ther enfrcement rights as set frth in the Declaratin. If cnstructin has nt cmmenced within three mnths after the date f the final apprval, it shall be deemed t have expired unless applicant, prir t such expiratin date, has requested and received an extensin in writing frm the ARB Custm Builder s Sign Only Apprved Builders, as defined by the Declaratin and apprved by the Declarant, will be allwed t have a Builder sign n each jb site. N ther Builders will be allwed t have a Builder sign. Builder signs shall be installed at the start f clearing and grading. The sign shall remain prperly installed thrughut cnstructin. Specificatins fr the standard builder s sign can be fund in Sectin Subcntractr signs r vendr advertising signs are nt allwed Prt-A-Jhn A prt-a-jhn will be required fr each jb site. The prt-a-jhn must be placed in the right f way t either side f the cnstructin entrance, with the dr pening tward the rear f the lt and must nt impede the flw f traffic. All prt-a-jhns shuld be serviced n a weekly basis Tree Prtectin As mentined in the intrductin, ne f the primary gals f these Design Guidelines is the preservatin f the prperty s existing natural features. Because f this, tree remval utside f the building envelpe must be kept t an abslute minimum. All trees that are 6 in caliper and greater are cnsidered prtected, except sweet gum trees and pine trees which are nt prtected. Each applicant must submit a tree survey, and flag trees t be remved prir t cmmencing cnstructin. Tree prtectin requirements are as fllws: 1. Prtective fencing shall be installed at the drip line, prir t any clearing, site wrk, r cnstructin activity. (See Sectins 15 and 16 fr tree prtectin details.) 2. The barricade shall be cnstructed f suitable pst extending a minimum f 4 feet abve grade. Psts shall be spaced apprpriately and shall be jined cntinuusly by range plastic mesh fencing. 3. The barricade shall remain in place and in gd cnditin fr the duratin f the cnstructin activity and shall be the last item remved frm the site during final cleanup.

8 4. Strage, temprary r therwise, f equipment r materials is nt permitted under the drip line f trees. 5. N signs shall be nailed t trees. 6. N cntrlled fires will be allwed in a tree save area r elsewhere in the Develpment. 7. N cncrete washut shall be allwed in a tree save area. 8. N petrleum-based prducts r ther ptentially hazardus r txic substances may be dispsed f underneath any tree save area. 9. All trees shall be maintained, cared fr, and repaired in the event f damage by builders until the prperty is transferred by lease r sale t a third party. 10. If trees designated fr preservatin are cleared r remved during cnstructin, the builder shall be subject t a fine f $200 fr each tree remved. In additin, replacement trees may als be required. The replacement trees shall be f the same species as a replacement rate f 0.5 caliper fr every caliper remved. Fr example, if 3-8 caliper (24 ttal caliper) trees are remved, they shall be replaced by 12 (24 x 0.5) ttal caliper f replacement material. 11. Failure t fllw any f the tree prtectin standards listed abve will result in a fine f $200 per incident Ersin Cntrl An ersin cntrl plan is mandatry fr all Lts. The fllwing ersin cntrl measures shall be fllwed n all jb sites: 1. Type C silt fence shall be installed n the lwer prtin f the disturbed area, as per the detail prvided in Sectin 17 f these Design Guidelines. 2. A rcked/gravel cnstructin entrance shall be established at the time f initial clearing and grading and maintained until a permanent pavement drive has been installed. (See Sectin 18 fr cnstructin entrance details.) 3. All rf drains shall be tied t undergrund piping r ther apprpriate dispersin methds. 4. All undergrund piping shall daylight a minimum f 10 feet frm the prperty line. 5. All disturbed areas must be permanently seeded and stabilized within 10 days f establishing final grade arund the huse and the cntractr must install temprary seeding and mulching n all disturbed areas when n land disturbing wrk is being accmplished n site (i.e. grading). 6. All drainage shall be ruted t avid damage r ersin n adjacent prperties, the glf curse, and/r cnservatin easements. Furthermre, ersin cntrl measures submitted t the ARB shall be maintained by the builder during cnstructin. Failure t prperly maintain ersin cntrl measures will result in a fine f $2,000. Each ffense thereafter will als incur a $2,000 fine. In additin, multiple ffenders will reimburse the Develpment fr any csts incurred in bringing jb site ersin cntrl measures int cmpliance, as well as fr repairing any damage t adjacent prperties due t a lack f maintenance. The Assciatin reserves the right t inspect and require mdificatins r crrectins t existing drainage systems adversely affecting adjacent prperties and/r easements Site Maintenance Cntractrs and subcntractrs must maintain the jb site in a clean and rderly cnditin. 1. N fires are allwed n cnstructin sites. N petrleum-based prducts r ther ptentially hazardus r txic substances may be dispsed f n any lt r any drainage ditch, stream, r lake. 2. N materials may be stred r placed in the streets, swale, right-f-way, natural areas, r glf curse frntages.

9 3. Cnstructin materials, materials t be discarded, equipment, r vehicles shall nt be placed in a designated tree save area. 4. Only usable cnstructin materials may be stred n a cnstructin site. They must be neatly stacked r placed in a way that they are nt visible frm adjacent sites. 5. All wrapping and packaging materials and fd cntainers must be placed in a cvered/enclsed trash receptacle t prevent debris frm blwing nt adjacent prperty. 6. Discarded cnstructin materials and debris must be remved daily r cntained within a sufficient enclsure. 7. Dumpsters, debris bins, and ther trash receptacles shall nt exceed capacity. Schedule prmpt pick up fr bins and receptacles exceeding 75% f capacity t avid verflw. Care shall be exercised in the strage f materials and debris. Shuld it becme necessary fr the Assciatin t clean a site r have a site cleaned, the cst will be deducted frm the cnstructin depsit Cnstructin Parking Limitatins Cnstructin parking n any internal street is limited t trade vehicles and deliveries nly. Persnal vehicles shuld be parked n the jbsite. Cnstructin trailers must be apprved by the ARB and parked n the jbsite s as nt t bstruct traffic. Cntractrs shuld use discretin in all ther areas f Chimney Oaks and make an effrt t avid dangerus traffic cngestin in neighbrhds where multiple hmes are under cnstructin Right t Enter and Inspect Prperty fr Cmpliance The right f entry and inspectin is specifically reserved by the ARB, its agents, and representatives t visit all r any prtin f the Owner s prperty fr verifying cmpliance with the requirements f the ARB. A representative f the ARB will make peridic inspectins during the entire cnstructin perid. The Owner will be ntified in writing with a cpy t the architect/designer and general cntractr f any items and exceptins nted in the inspectin reprt and all such items and exceptins must be cmpleted r reslved by the next meeting f the ARB Cnduct f Wrkers Cntractrs shall be allwed t wrk frm 9 a.m. t Dusk Mnday thrugh Friday and frm 9 a.m. t 5 p.m. n Saturday and Sunday. N alchl r drugs are permitted n site. Animals are prhibited. Firearms are prhibited. N harassing r lud behavir is permitted. Cntractrs and wrkers shall nt travel recklessly r at speeds in excess f psted limits. Wrkers shall nt be allwed t travel the prperty unnecessarily r use the amenities. Any cntractr wh is in vilatin f these regulatins will be fined in accrdance with the Fine Schedule, see Sectin Additinal vilatins may result in the cntractr being denied access t the prperty Revisins and Changes during Cnstructin All revisins and changes made during cnstructin shall be submitted in writing t the ARB fr apprval prir t the implementatin f such change. All revised drawings, material samples, and clr samples must be submitted alng with the revisin request. The ARB will grant the request in writing. Failure t btain written apprval fr any revisin during cnstructin will result in fines being deducted frm the cnstructin depsit Terminatin / Replacement f Builder The ARB shall receive written ntificatin f any decisins by the Owner t terminate r replace a builder during the cnstructin phase. Befre cmmencing with cnstructin, the new builder shall pst a cnstructin depsit. Once this depsit is received, the ARB will refund the remaining cnstructin depsit t the builder wh was terminated. In additin, the new builder shall remve the terminated builder s sign n the Lt and replace it with a sign bearing the new builder s infrmatin.

10 4.12 Return f Cnstructin Depsit When all cnstructin is cmplete, including landscaping, the builder may request a final inspectin by the ARB. At this time, a member f the ARB will inspect the prject fr cmpliance with the apprved plans. If the site is in cmpliance, the ARB representative will return the cnstructin depsit and prvide the builder with a letter stating that they are in cmpliance. If the site is nt in cmpliance, the ARB will submit a letter stating all deviatins frm the apprved plan t the builder. The builder must then submit a revised plan and r survey shwing deviatins frm the apprved plans. Nte: Any unapprved deviatin frm apprved plans may result in fines r ther measures as described in Article IX, Sectin 7 f the Declaratin Alteratins / Remdeling / Imprvements / Repainting f Apprved Structures Any exterir change t an existing structure requires apprval frm the ARB befre cmmencing with wrk. All exterir changes r renvatins shall be submitted t the ARB fr apprval as utlined in Article IX f the Declaratin. All cnstructin shall be subject t the cnstructin regulatins set frth in Sectin 4.0 f these Design Guidelines. 5.0 SPECIFIC SUBMISSION REQUIREMENTS 5.01 Plan Submissin Requirements fr Design Review The fllwing submissin requirements must be met prir t btaining final apprval fr cnstructin. A design review checklist can be fund n the last page f these Design Guidelines. 1. Existing Cnditins (min scale l = 20 ). Must include the fllwing infrmatin: A. Owner s name B. Designer s name C. The mailbx shuld be munted in the right-f-way n the side f the driveway that is clsest t the prperty line. 9.0 SITE REQUIREMENTS: GRADING AND DRAINAGE A prpsed grading and drainage plan must be submitted in rder t btain ARB apprval fr cnstructin. Drainage frm yur Lt must flw t the lwest elevatin n yur prperty. Drainage shall nt flw nt adjacent lts. Yu will be held respnsible t repair any adverse effects (i.e. ersin) f imprper r excessive strm water runff. Gutters and dwnsputs shall be required fr all hmes. Ersin cntrl measures, including silt fencing, shall be installed and maintained by

17 the Owner during cnstructin. Failure t cnstruct/maintain ersin cntrl measures and drainage systems shall result in fines. (Refer t Sectin 4.05 fr specific ersin cntrl requirements.) 10.0 SITE REQUIREMENTS: DRIVEWAYS AND WALKS Walks Driveways All driveways shall be cnstructed f cncrete with a unifrm pattern f scring jints. Other driveway materials may include brick r pavers. All driveway designs and materials, including, clred r stamped cncrete, must be submitted and apprved by the ARB prir t installatin. A minimum 3-ft landscape strip shall separate the drive frm the prperty line. Driveways shall have a minimum width f 12 feet. Entry statements used in cnjunctin with the driveway are subject t ARB apprval. The entry must be discrete and reflect the architectural details and materials f ther site elements and the hme. This element must be setback ff the street behind the right-f-way line. Walkways shall be cnstructed using materials cnsistent with the driveway r prminent architectural features f the huse. All walks shall be a maximum f fur feet in width. All material selectins and lcatin f walks shall be apprved by the ARB. Apprved materials fr walkway area: 1. Cncrete/stamped cncrete. 2. Brick/stne pavers. 3. Fr natural areas, mulch r pine straw SITE REQUIREMENTS: LANDSCAPING, IRRIGATION, AND LIGHTING Landscape Budget and Submissin requirements Generally, yur landscaping budget shuld be 5-10 % f yur ttal cnstructin budget. Landscape plans shall be submitted at the final submissin. Submissin requirements fr landscape plans are lcated in Sectin and are included in the Design Review Checklist Timing f Landscape Installatin All landscape installatin shall be cmpleted within 60 days f receiving a certificate f ccupancy. If this deadline cannt be met, the wner may request an extensin frm the bard in writing. Failure t meet this deadline will result in fines being deducted frm the cnstructin depsit Irrigatin Requirements Fr lts within The Reserve, an autmatic, undergrund irrigatin system shall irrigate all landscape areas including lawn areas and plant beds fr all lts. Each landscape area shall incrprate a design fr a clsed lped system with autmatic znes. Irrigatin ver spray is nt permitted. Irrigatin strips may be installed between the sidewalk and curb. It will be the respnsibility f the wner t repair sidewalks damaged by irrigatin installatin. Dwn lighting is encuraged t reduce glare, better light drives and paths, and t prtect neighbring prperties frm bright light surces. All landscape and accent lighting shuld be lw vltage. Bulbs shuld be in the 7 t 20-watt range, depending n the number f bulbs per fixture, but nt t exceed 60 watts ttal per fixture. Bulbs shuld be sft-white. The height f lights shuld be belw the first stry rf line and nt t exceed 8 feet.

18 If LED bulbs are t be used in exterir lighting, then the clrs/styles shuld be warm white, fund traditinally in incandescent lighting, versus varius bright white r blue LED styles that can create an uncmfrtable level f light that is annying in intensity r hue. All path and landscape lighting must cnsist f lw vltage lamps. Path and landscape lighting shall have a maximum height f 36. Landscape lighting must be cncealed in daytime. Clred lights are generally prhibited. Sptlights/fldlights will be cnsidered n a case-by-case basis, depending n rientatin and lcatin. Ple lights will be reviewed n a case-by-case basis. 27 21.0 FINE SCHEDULE The fllwing is a Schedule f Fines fr vilatins f the established Design Guidelines. Vilatins may be ed r phned-in, depending n the severity f the vilatin. Once ntified, the cntractr has 48 hurs t cmply. After such time, the ARB may issue a stp wrk rder and demand that the cntractr take actin t stp the vilatin. If the stp wrk rder is ignred and the vilatin nt crrected, the cntractr, at the discretin f the ARB, may frfeit the entire cnstructin depsit. In the event f an emergency that invlves prperty damage, the vilatin f lcal rdinances, r extreme vilatins, the ARB may, at its discretin, take crrective actin t reslve any vilatin with the csts assciated with such actin being billed t the cntractr and deducted frm the cnstructin depsit.
