1 City f Sarasta Public Art Requirements Infrmatin Package APPLICABILITY: Any prperty wner r develper wh applies t the City fr a Building Permit t cnstruct r make imprvements that exceed $250, in cnstructin value t a multi-family, mixed-use r cmmercial building r nn-residential prtin f a mixed-use building lcated in the, Dwntwn Edge [DTE], Dwntwn Cre [DTC], Dwntwn Bayfrnt [DTB], Cmmercial- Central Business District [C-CBD] zne r the Theater & Arts District [TAD] zne, r public building n Gvernmental Use [G] zned prperty lcated in the Cmmunity Redevelpment Area as depicted in the Cmmunity Redevelpment Plan adpted September 22, 1986, shall be required t make a public art cntributin. EXEMPTIONS: Buildings r prtins f buildings that include attainable husing units as defined by the City Cmmissin shall nt be required t cnfrm t these requirements. Building Permits fr individual cndminium units shall nt be required t cnfrm t these requirements. CONTRIBUTION OPTIONS: Fr buildings less than $1,000,000 ttal cnstructin valuatin f the building permit: Make a cntributin t the Public Art Fund f ne half f ne percent (.005) f the cnstructin valuatin f the building permit. Fr buildings mre than $1,000,000 ttal cnstructin valuatin f the building permit: Make a cntributin t the Public Art Fund f ne half f ne percent (.005) f the ttal cnstructin valuatin f the building permit. (Maximum cntributin $250,000). OR Prvide public art, subject t apprval by the Public Art Cmmittee, n the develpment site r in a public place ff site, f a value f ne half f ne percent (.005) f the ttal cnstructin valuatin f the building permit. (Maximum required value $250,000). Optins fr prviding public art are: Purchase an existing piece f art wrk, r; Have a specific piece f art wrk cmmissined. Fr cmmissined wrk, a depsit with the Building, Zning and Cde Enfrcement Department f ne hundred and fifteen percent (115%) f the value f the public art is required, prir t the issuance f a building permit. 2 DEFINITION OF PUBLIC ART: Public art r public wrks f art is defined as the creative applicatin f skill and taste by artists t prductin f permanent tangible bjects accrding t the aesthetic principles, including but nt limited t: paintings sculptures site specific installatins engravings carvings frescs mbiles murals cllages msaics statutes bas-reliefs Public art r public wrks f art shall als include the creative applicatin f skill and taste by artists accrding t the aesthetic principals t the architectural embellishment f a building r structure. Architects and landscape architects are nt cnsidered artists under this definitin. The fllwing shall nt be cnsidered public art r public wrks f art: Reprductins r unlimited cpies f riginal art wrk; Art bjects which are mass prduced; Wrks that are decrative, rnamental r functinal elements f the architecture r landscape design, except when cmmissined frm an artist as an integral aspect f a structure r site; and Architectural rehabilitatin r histrical preservatin. BUILDING PERMIT APPLICATION AND APPROVAL PROCESS: Prir t the issuance f a building permit, the Public Art Cmmittee will review all dcumentatin submitted by the prperty wner r develper, as utlined n the Applicatin fr Public Art frm. The Directr f Building, Zning and Cde Cmpliance will nt issue a building permit unless the public art requirement has been satisfied by: apprval by the Public Art Cmmittee; dnatin t the Public Art Fund; r depsit f 115% f the value f the required public art cntributin. Nte: If funds will be placed in escrw, the fllwing infrmatin als needs t prvided: a descriptin, in writing, f the prcess by which the artist(s) were r will be selected; a prpsed schedule fr the creatin, cmpletin and installatin f the apprved art at the develpment site; and the lcatin where the public art is t be installed. 3 Fr Applicant Chsing t Cntribute t the Public Art Fund: Cmplete Applicatin Frm: Prir t the issuance f a building permit, the prperty wner r develper cmpletes the public art applicatin frm and submits the frm and a check fr the required amunt (payable t the City f Sarasta) t the Building, Zning and Cde Enfrcement Department. Fr Applicants Chsing t Prvide Public Art: 1. Pre-Applicatin Meeting: Because f the many variables and time required t cmplete this prcess, the prperty wner r develper is encuraged t arrange a pre-applicatin meeting with the City Staff t achieve a mre efficient prcess. Please call Dr. Cliffrd Smith, Senir Planner f the Planning Department at (941) t arrange a preapplicatin meeting and/r placement n the apprpriate Public Art Cmmittee agenda. 2. Cmplete Applicatin Frm: Cmplete all sectins f the applicatin and submit ten (10) cpies f the applicatin with required supplemental materials t the Planning Department. Applicatins must be received tw weeks prir t the Public Art Cmmittee meeting which is nrmally held quarterly beginning February n the secnd Wednesday f the mnth. 3. Public Art Cmmittee Review: Fr public art prvided n the develpment site, the Public Art Cmmittee will apprve, deny, r request additinal dcumentatin fr the prpsed cntributin. All wrks f public art lcated n private parcels shall be installed utside f any and all buildings and cmpletely visible frm the adjacent public right-fway and must be apprved by the Public Art Cmmittee t cmplete the review prcess. 4. City Cmmissin Review: Fr public art prpsed in a public place, n a zning lt ther than the zning lt prpsed fr develpment, the City Cmmissin must apprve the prpsal after receiving a recmmendatin frm the Public Art Cmmittee. 5. Installatin f the Art Wrk: The Directr f Building, Zning and Cde Cmpliance will nt issue a Certificate f Occupancy until: the public art is prperly installed; r an extensin f time f up t ne year has been apprved by the Public Art Cmmittee and a depsit f 115% f the required cntributin is made t the City. If the public art has nt been installed and/r the extensin f time fr the installatin has elapsed, the depsited funds (115%) culd be frfeited. Public Art Infrmatin Package Page - 3

4 DETERMINATION OF VALUE: Existing Art Wrks: The value f existing art wrks shall be: Determined by an independent appraisal r ther evidence f value, such as an artist s price qute r a bill f sale. The cst f the appraisal is the respnsibility f the prperty Owner r develper. Based n a bill f sale which shall be submitted t the Building, Zning and Cde Enfrcement Department prir t the issuance f a certificate f ccupancy. Prpsed Art Wrks: The value f prpsed art wrks shall be determined by cmpetent detailed cst estimates fr fabricatin and installatin f the prpsed wrk. The estimate shall nly include items that the artist(s) is respnsible fr creating. ONGOING RESPONSIBILITIES: Maintenance and Insurance: The private prperty wner shall have the sle respnsibility fr maintenance and insurance f the wrks f public art lcated n their prperty. If the art wrk is dnated t the City, the artist is required t submit maintenance prcedures fr their prpsed art wrk fr prper maintenance by the City. Remval r Replacement: After a wrk f art has been apprved by the Public Art Cmmittee and/r the City Cmmissin, such wrk f art shall be retained n site in its apprved lcatin and shall nt be mved r remved withut prir apprval f the Public Art Cmmittee and the City Cmmissin, as required by cde. Change in Ownership: If the prperty is sld, these respnsibilities shall be assumed by the new prperty wner.
