1 FRST AMENDMENT :ro DEVELOPMENT PLAN FOR PLANNED DEVELOPMENT AREA NO. 67 OLMSTED GREEN Amercan Legon Hghway, Morton Street and Harvard Street BOSTON, MASSACHUSETTS Dated: November\1:;;2010 Pursuant to Secton 3-lA and Artcle 80, Secton SOC of the Zonng Code of the Cty of Boston (the "Zonng Code"), ths amendment consttutes the Frst Amendment to Development Plan for Planned Development Area No. 67 (the "Frst PDA Plan Amendment"). The Orgnal PDA Development Plan for PDA No. 67: On or about January 26, 2006, the Boston Redevelopment Authorty (the "BRA") approved a Map Amendment applcaton creatng Planned Development Area No. 67 ("PDA No. 67") as well as a Development Plan for Planned Development Area No. 67. Ths Map Amendment and Development Plan (together, the "Orgnal PDA Plan"), were approved by the Boston Zonng Commsson on February 15,2006. The Orgnal PDA Plan encompasses an approxmately 42.5-acre ste n the Mattapan secton of Boston, comprsng three parcels ofland owned by Lena New Boston LLC (the "Proponent" of the Orgnal PDA Plan), as descrbed n Exhbt A of the Orgnal PDA Plan and as more partcularly shown on the Ste Plans attached as Exhbt D to the Orgnal PDA Plan (the "Ste"). Two of the parcels are the former Boston State Hosptal campus parcels whch abut the east and west sdes of Morton Street, (desgnated as the "West Campus" and "East Campus", respectvely). The thrd parcel s an approxmately four-acre parcel owned by Lena Park Communty Development Corporaton (the "Lena Park Parcel") and s adjacent to the East Campus. The Orgnal PDA Plan provdes for the constructon of a new mxed-use development, ncludng resdental, senor housng, employment and job tranng facltes, communty facltes, mental health program space, urban farmng, retal, open space, accessory parkng and recreatonal facltes known as the Olmsted Green Project. As set forth n the Orgnal PDA

2 Plan, the Project nvolves the constructon on the Ste of multple buldngs and facltes contanng a total combned gross floor are of approxmately 851,000 square feet. The Frst PDA Plan Amendment: Ths Frst PDA Plan Amendment, as set forth below, amends the Orgnal PDA Plan wth respect to only the Senor Housng component so that the number of unts and the sze of the proposed Senor Housng project may be reduced from 83 unts/approxmately 76,000 ±square feet to 59 unts/approxmately 59,049 ±square feet. Captalzed terms n ths Frst PDA Plan Amendment, unless otherwse defned heren, shall be defned as set forth n the Orgnal PDA Plan. The Orgnal PDA Plan s hereby amended as follows: 1. The lne tem dentfed as "E4 - Resdental- Senor Housng" and the lne tem dentfed as "Total" n the table located at the end of Secton 3 enttled "Project Ste" are hereby deleted and replaced wth the followng text: USE Approxmate Approxmate Gross Floor Area #of Acres E4 Resdental- Senor Housng 59,049± 1.3 (approxmately 59-unts) Total: 834,000± GAF 42.4 A revsed Ste Plan s attached hereto as Exhbt D, and revsed Schematc Plans and Elevatons are attached hereto as Exhbt E. 2. The second bullet pont n Secton 4 enttled "Project Descrpton" on page 4 of the Orgnal PDA Plan s hereby deleted and replaced wth the followng text: "Up to 59 unts of low-ncome supportve senor rental housng. (the "Senor Housng Component");"

3 3. The frst sentence of the thrd bullet pont n Secton 15 enttled "Publc Benefts" on page 8 of the Orgnal PDA Plan s hereby deleted and replaced wth the followng text: "Housng. Approxmately 440 unts of famly housng and 59 unts of senor housng wll be provded by the Project." 4. The "Antcpated Project Phasng Schedule" n Secton 16 enttled "Development Schedule and Phasng of the Project" on pages 9-10 of the. Orgnal PDA Plan s amended solely to reflect the fact that the "Senor Housng Component" referred to n Phase 3 and Phase 4 wll be completed as one project and, nstead of consstng of "approxmately 42 unts" n Phase 3 and "approxmately 41 unts" n Phase 4, wll consst of approxmately 59 unts. 5. Except as the Orgnal PDA Plan s amended by Sectons through 4, above, of ths Frst PDA Plan Amendment, the Orgnal PDA Plan remans unmodfed and n full force and effect
