Wyman for mproved procedures for the recrutment and retenton of qualfed publc welfare personnel on the local level of State government, brought mmedate endorsement and commendaton from the 115,000-member Cvl Servce Employees Assn. Speakng at the 93rd meetng of the New York Publc Welfare Assn. at Grossnger's Hotel n Grossnger last week, Wyman sad that "none of the 65 local welfare departments n New York State have staffs adequate n number, tranng and experence to admnster the rehabltaton servces many welfare recpents requre to become self-supf>ortng or self-carng." Publc welfare today s so complex t can only be properly admnstered by an adequate staff wth adequate leadershp, he sad. Hals Mandated Salares Fely declared that the CSEA was "partcularly pleased wth the Commssoner's suggeston that one of the steps n readyng (desred) goals mght be mandatng salares for publc welfare workers. Mr. Fely sad furter: "t s a shockng thng that certan communtes are payng substandard salares to case workers who are jj^qured by law to have a college educaton and specal tranng. n certan localtes the turnover rate caused by nadequate salares lterally guarantees to the communty the poorest knd of socal welfare servces. n some case, the recpe'nts of welfare receve almost the same mones tat the caseworker receves after the payment of wthholdng and other deductons. CSEA Assocate Counsel The 1963 Legslatve Sesson may be best remembered by cvl servce and other publc employees for a tumultuous fght between the Governor and a segment of hs own party n open revolt. The central ssue was the Governor's budget whch contaned certan new expendtures to be sustaned through ncreases n fees as a source of new revenues. These fees were, t was contended, nconsstent wth the Governor's earler campagn assurances that he would not call for an ncrease n taxes. THE UNON, ncdentally, n enterng nto ths type of agreement, usually gves up ts rghts to go any hgher than the offcals wth whom t s meetng, even f t s not satsfed wth the results of the negotatons. FOR NSTANCE, when the unon and the jursdcton's representatves come to agreement on a partcular matter, the government offcals must go to th'^'** superors to determne f the agreement s acceptable. f the superors say no and abrogate the agreement, completely or n part, the unon has no recourse n law or any other place. LET'S LOOK at what happened n Rochester, recently, for nstance. The AFSCME supposedly sat down wth the Cty Manager there and ultmately "agreed" to a four and one-half per cent rase for cty employees. When the tme came for a publc hearng on the cty budget, CSEA appeared and presented a 7-pont employee program, whch ncluded a request for a 15 per cent salary ncrease and whch CSEA was able to prove was the mnmum hke employees needed to keep pace wth ncreased costs of lvng and compettve salary schedules n other jursdctons. Despte ths need, the unon made no proposals for employees at ths most- mportant publc hearng. need not spell out the reasons for ths lack of representaton for ts members. N PHLADELPHA, also, t has become a part of lfe that whatever the unon and cty offcals agree to, at annual meetngs, the Cty Councl, wth whom the unon does not meet, slashes drastcally before gvng fnal approval. N STLL another locale. New York Cty, whose unon contract procedures are ponted at wth prde by publc employee unons, a promnent newspaper there recently branded as a farce the long-standng collectve barganng arrangement whch calls for barganng after the budget s approved. AND THE LST goes on and on. Each unon clam of a new vctory or a refnement of an old one, or a sgnfcant break-through, or all the other tme-worn extravagances doted on by the unon, prove worthless when examned by even tle most unnformed layman. FOR YEARS, CSEA has followed the same general rule a rule whch, f you wll pardon my prde, has been exceptonally successful n New York State and local government. t s ths. n ts negotatons on all levels of New York State government, CSEA has always ressted any attempts that would have t forego the rght to go the very top f t s not satsfed wth agreements on the ntermedary level. We reserve the rght, also, to go to whatever branch of government, legslatve or executve, wth whch we feel we can successfully negotate our programs. The Employees Assn. got mportant support for one group of publc employees socal welfare ades from State Socal Welfare Commssoner George K. Wyman last week. Wyman, speakng at the 93rd annual meetng of the State Publc Welfare Assocaton, sad, n essence, that none of the 65 local welfare agences n New York State were adequately staffed to do the job that needs to be done. Wyman's proposals to correct ths stuaton were to mandate salary schedules throughout the State, apply unform Job requrements (whch would be set up by the State Welfare and Cvl Servce Commssons) and plan means to retan qualty personnel. The CSEA has sought for years to get the Legslature to mandate salary schedules n mportant employment areas such as welfare and to set up compettve ttles on the admnstratve level. mportant, as Commssoner Wyman hnted, qualfed personnel could tran more pwple away from the need to rely on welfare. Unnecessary Delay ALTHOUGH we do not agree wth all ponts brought out by the Brookngs nsttuton's recent survey of cvl servce n New York Cty, one of the most mportant suggestons the report advsed was a decontrol over hrng replacements by the Budget Drector. All too often, needless delays n the hrng of replacements for employees who leave the servce are caused by the slow ssuance of budgetary certfcates. New York Cty prdes tself on beng effcent. t wll become more effcent when the necessty of budget certfcatons s restrcted to hrng personnel for newlycreated postons. Even ths sum was placed n serous jeopardy and only through the support of the Governor and the actve support of our members, was the Assocaton able to hold on to these new mones durng the budget cuttng perod. Ths sesson, therefore, was one wthout any mportant or sgnfcant gans, but one wthn whch Cvl servants dd not, n general, lose benefts prevously won. Puttng t another way, the success of the A.ssocaton ths year was that t avoded dsasters whch befell ether mportant groups Wthn the State. 1!!(:: Summary The Legslature convened on January Before t adjourned on Aprl 6. some 3,786 blls had been ntroduced n the Senate and 5,191 blls n the Assembly. Left wth the Governor for acton at the tme of adjournment were 1,288 blls passed by the Legslature. Of that number, the Governor sgned nto law 1.022, and vetoed 266. Of the approxmately 80 blls drafted and ntroduced or co-sponsored by the Assocaton. 14 were sgned because other measures substantally dentcal to our own blls already had been approved. The purpose of ths report s to outlne n some detal those blls whch are now law, as well as those whch, for one reason or another, faled. Condon Wadn One of the areas whch mght well.have serously mpared the ablty of the Assocaton to act on behalf of ts members was a proposed amendment to the socalled Condon-Wadln Law, that porton of the Cvl Servce Law whch prohbts strkes among publc employees. Early n the sesson, the Jont Legslatve Commttee on ndustral and Labor Condtons submtted ther bll amendng the Condon-Wadln Law whch provded, n addton to amendng the penalty provson of the law, a comprehensve employer-employee relatons act. Ths proposal n ts defnton of "approjarate barganng unts" would have segregated supervsors from non-supervsors, professonals from non-professonals and n general, "fractured" employee organzatons nto smaller, less effectve, separate unts. Deep Study Was Urged All of these proposed provsons volate the prncple that ths Assocaton can contan wthn tself a wde range of all employees of government, at all levels, and nto law. The others have met stll effectvely represent the employees varyng fates. The Governor of ths state. The Em- vetoed two of our blls; four ployees Assocaton strongly urged passed one house and not the the Governor as an alternatve Other; some of the others were to the Commttee report, to make not reported out n ether house a study n depth of the general Automaton Stuoy Commttee Formed By CSEA to Protect The nterests of Membershp ALBANY, June 24 A specal commttee to study the effects of automaton on state employees has been formed by the Cvl Servce Employees Assocaton n order to "protect" the nterests of ts members. Joseph F. Felly, Assocaton area of employer-employee relatons n the publc servce. t was our stated vew that the Condon- Wadln Law was an ant-strke law only and should not be transformed nto a labor relatons act. Thus, although the Assocaton supported the elmnaton from the Law of some of the unduly harsh forfeture provsons whch have made the Law so neffectve n the past, the Assocaton urged that the general subject of employer-employee relatons be dealt wth on a separate bass. The Assocaton receved the full support of the Governor n ths regard and he has announced hs ntenton to appont a commttee to study the ssue of employer-employee relatons n the publc servce. Although the Law stll contnues to prohbt strkes among publc employees. Chapter 702 of the Laws of 1963 reduces from three years to sx months the perod followng restoraton to servce durng whch a strker's compensaton may not be ncreased. t also reduces from fve years to one year the perod durng whch a strker s on probaton and wthout tenure followng hs restoraton to servce. Newly provded for under the Law s an automatc penalty of two days pay for each day that an employee s on strke. Ths penalty must be deducted from the employee's compensaton wthn the frst two pay perods, but n no event longer than thrty days, followng hs restoraton to servce. CSEA Stand The provsons of ths new law are. n a sense, mpledly expermental because the Law. whch became effectve on Aprl. 23, 1963, only remans n effect untl July 1, At the tme the bll was ntroduced, Joseph F. Felly, Assocaton presdent stated as follows: "The bll... falls short of the mark of total repeal (sought by the CSEA). yet we beleve t effectvely accomplshes the purpose of mtgatng penalty provsons under the (then) present law, whch?re unduly harsh. For ths reason, we favor ths measure as a sgnfcant mprovement of the exstng statute."
