3 NOTICE AND CALL FOR BID Police Building Furniture NOTICE IS HEREBY GIVEN that sealed bids will be received at City Hall in Green River, Wyoming, ATTN: Trish Mansfield, 50 East 2nd North, on or before 2:00 pm (Mountain Standard Time) on Tuesday, April 22, 2014, at which time all bids in hand will be publicly opened and read. Specifications, bids forms and other contract documents are on file and may be obtained free of charge from the Purchasing Division at City Hall, 50 East 2nd North, Green River, Wyoming. Specifications are also available at No bid shall be awarded by the City until such time as the City has had sufficient time to study all bids to assure that the bid awarded will meet the standards as set out in the Specifications. All bids shall be accompanied by a Bid Bond or Cashier s Check in the amount of five (5) percent of the amount of the bid. No personal or company checks will be accepted. Bid Bonds must be issued in the name of the bidder. Successful bidder shall be required to provide a Performance Bond in the total amount of the bid. Proof of Wyoming Department of Employment certification of residency status, if applicable, must accompany the bid. GREEN RIVER, WY. 4) Descriptive literature must accompany all items being bid, if other than specified. 5) Items are to be delivered to Police Building, 375 W. Flaming Gorge Way, Green River, WY 82935, unless otherwise instructed. 6) Sealed bids will be opened on Tuesday, April 22, 2014 at 2:00 p.m., Mountain Standard Time, at City Hall, 50 East 2 nd North, Green River, WY. Bidders are welcome to attend. 7) Wyoming statutes require preference for Wyoming products and a five percent (5%) preference shown to Wyoming contractors/companies. 5 GENERAL CONDITIONS Police Building Furniture INTENT The City of Green River desires to purchase and have installed Furniture for the New Police Building and respectfully invites your bid. The quantities stated herein represent the best estimates of the total requirements that can be made up to the time of issuance of these specifications. These quantities are given as a guide to bidders in quoting quantity prices, freight, handling, costs, etc. While it is expected that orders will be in these approximate quantities, the City of Green River reserves the right to alter the quantities according to its needs at the time of placing orders, and after learning what the costs will be. SECURING DOCUMENTS Specifications and/or documents required for the submission of bids may be obtained from the City s Purchasing Division: Trish Mansfield City of Green River 50 East 2 nd North Green River, WY tmansfield@cityofgreenriver.org Questions relating to the bid process should be directed to Trish Mansfield at the supplied address, or by calling... (307) Bidders shall be in a position to supply equipment, supplies, materials, and/or services equal or superior in all respects to those specified and are financially and physically able to deliver. No charge is made for the documents. BIDS Bids are to be submitted on the Bid Form supplied. Any Bidder seeking Wyoming residency status must submit proof of Wyoming Department of Employment certification of residency status with the bid. The original copies of the Bid Form, Notice to Bidders, and Specifications are to be returned. Your company may make reprints of the bid if you desire a copy of the bid for your files. Any item, part or section you feel that you cannot supply, please insert N/B for that item, part or section. 4

6 The signature of all persons authenticating the bid shall be in longhand. By filing a bid, the bidder warrants that he/she is willing and able to accept the bid, and will comply with the Bid Form, General Conditions and Specifications. It is the sole responsibility of the bidder to see that it s bid is received at the stated time and date. Bids shall be irrevocable for a period of thirty (30) days after the date set forth for the bid opening. BRAND NAMES Styles, brand names, etc. referred to are for descriptive and quality purposes only and are not restrictive. Brands of equal or superior quality or type are acceptable, but substitutions must be noted on the bid form by indication of manufacturer name and stock number. By listing a substitute, the bidder guarantees that the item or items being bid are of equal or superior quality. Offers submitting substitutions must provide with the bid, detailed descriptions, technical specifications, catalog cuts and standard color swatches, where applicable, and warranty information to be used for evaluation. However, if it is determined by the City of Green River that the materials are not of equal quality, these materials will be returned to the supplier at their expense. The City of Green River reserves the right to make the final decision as to comparable items. Be very certain that items upon which you bid and deliver are equal or superior to those items listed. SUBSTITUTED ITEMS All vendors must list the manufacturer and model number of the exact item on which their bid is based on the line identified as SUBSTITUTED MANUFACTURER / SUBSTITUTED PRODUCT CODE for each item on this bid. If this section is not completed for each item, the vendor will be required to deliver the exact item(s) as specified. AWARD OF BIDS The City of Green River reserves the right to reject or accept any and all bids; to waive any irregularities or informalities; and to re-bid or re-advertise for bids if it is determined to be necessary or desirable; based upon their being the sole determinant in taking this action to accept or reject. PRICING Prices are to be quoted F.O.B. Police Building, 375 West Flaming Gorge Way, Green River, WY Prices to be without State of Wyoming or Federal Excise Tax. It is the responsibility of the Vendor to examine all specifications and instructions provided by the bid package. Any conflict, misunderstanding, or liability resulting from a failure to do so shall be at the risk of the Vendor. In the event of an error in extension of prices on the bid, the unit price will prevail. 5

7 Bids may not be changed after receipt by this office. Accuracy of the bid is the responsibility of the bidder. Erasures are not acceptable on bids. If necessary to make changes, strike out or draw a line through the incorrect figure or number, and write the correct price above. All corrections must be initialed. DELIVERY AND DELIVERY DATE All bids must be F.O.B. Police Building, 375 West Flaming Gorge Way, Green River, WY 82935, unless otherwise instructed. The delivery date is very important and must be noted on the bid in the space provided. Unless the City states a delivery date, it will be the responsibility of the bidder to do so. WARRANTY AGREEMENTS AND GUARANTEES All warranties and agreements must be passed on to the City of Green River, and honored. PAYMENT The successful bidder may request progress payments once materials are received. This progress payment request will be subject to a 10% retainage deduction until completion of the project. The Governing Body of the City of Green River must approve all invoices before any payment is made. FORM OF CONTRACT The successful bidder shall be required to enter into an agreement with the City of Green River. A sample contract is included with this bid document. The Bid Form, General Conditions and Specifications shall be an integral part of the contract. INTERPRETATION OF SPECIFICATIONS Should any ambiguity or conflict in the specifications become apparent to any bidder, he should forthwith apply to the City of Green River Purchasing Division for a written interpretation; which interpretation will be sent to all bidders who have been supplied specifications. The City of Green River Purchasing Division will issue any Addenda to the specifications in writing. No oral statements, explanations, or commitments by the seller or buyer shall be in effect, except those, which are confirmed in writing by the City of Green River Purchasing Division. RETURN OF BIDS Each bid must be in a sealed envelope and clearly marked as to type of bid, bid opening date and time. Bids shall be accompanied by a Bid Bond or Cashier s Check in the amount of five (5) percent of the total amount of bid. No personal checks will be accepted. 8 Specifications for Police Building Furniture The City of Green River currently has under construction a new Police Building that will require furnishings. This building is located at 375 West Flaming Gorge Way, Green River, Wyoming and consists of three floors. The anticipated completion date is the end of May Scope of Work To deliver all furniture for the new Police Building upon completion of the building. The successful bidder is also responsible for unpacking, complete installation, placement of all furniture in locations as specified by Owner, and removal of all packing materials from the site. The building is a three-level structure with an elevator and stairs. The use of the elevator is permitted if necessary. Any damages resulting in use of elevator will be the responsibility of the vendor. Required elements of Project 1. Included in this bid document are three sections, one for each floor level. Each section contains: a. Drawing and layout of furniture placement. b. Itemized list of furniture along with quantities. i. This itemized list will also act as a part of the bid form. ii. Supply manufacture name and item number for substitutions. c. Information pertaining to each piece of furniture. The itemized list manufacturer is Global Industries for all items. These specifications are descriptive in nature and not meant to be restrictive. Brands of equal or superior quality or type are acceptable, but substitutions must be noted on the bid form by indication of manufacturer name and stock number. Your bid must meet or exceed these specifications. 2. All supplied cabinets must be lockable. 3. Items on desk, credenzas and room cabinets are to be lockable and office keyed alike. 4. All metal legs, where possible, are to be black in color. 5. The successful bidder is responsible for setup and placement of all furniture as indicated on attached drawings. 6. The successful bidder is responsible for the removal and disposal of all trash and packaging waste at its own expense. No trash may be deposited into the Owner s containers. 7

9 7. Offers submitting substitutions must provide with the bid, detailed descriptions, technical specifications, catalog cuts and standard color swatches, where applicable, and warranty information to be used for evaluation. 8. In the event that any temporary storage is required prior to delivery, the Successful bidder will be responsible for any associated charges. 9. A minimum five-year guarantee against defects in materials and workmanship is required for all items on this bid. A copy of the manufacturer s complete guarantee/warranty is to be submitted with your bid. 10. The successful bidder shall provide appropriate protection for all doorjambs and protection for the flooring and other finishes and furnishings during installation. The successful bidder shall be held responsible for any damages, dents and marks to the product and the Owner s building, no matter how minor, caused by the movement of his materials, labor or installation. Samples Upon request, and without cost to the owner, samples may be required in order for the City to judge adequately the quality and construction of the substituted item. Samples shall be delivered within five (5) days of such request. Failure to comply within the time prescribed shall be deemed sufficient grounds for rejection of the bid. Bidder Representation Bidder is to provide the name, address and telephone number of the representative that will be responsible for handling this project. Delivery/Setup/Placement 1. The successful bidder shall consult with, and be responsible to the Owner, for all aspects of the furniture delivery and installation. The successful bidder shall coordinate his/her work with the assigned Owner s representative. 2. The successful bidder will be allowed a two-week period for delivery, installation and placement of all furniture. Delivery shall commence on July 7, 2014 and must be completed on July 18, Delivery must be coordinated with the Owner s representative. Insurance Successful bidder shall supply Owner with proof of liability insurance in the amount of $1,000, each occurrence and $1,000,000 aggregate for bodily injury, (naming the City as an additional insured). Personal Injury for $2,000,000 aggregate coverage, Comprehensive Automobile Liability for $1,000,000 each person, $1,000,000 each occurrence and $1,000,000 for property damage. Vendor must also provide copy of Worker s Compensation as required by Wyoming State Statutes. Proof of insurance must be provided throughout the entire contract period. As new insurance policies replace old policies, new certificates must be provided to the Owner. Bonding A Performance Bond in the amount of 100% of contract cost will be required of the successful bidder prior to start of work. 8

Contractor must also provide copy of Worker s Compensation as required by Wyoming State Statutes. Proof of insurance must be provided throughout the entire contract period. As new insurance policies replace old policies, new certificates must be provided to the Owner. 3. A standard Performance Bond in the amount of the total bid is required. 4. Contractor will indemnify, release, and hold the Owner harmless from any claims or causes of action which may arise due to the negligence of the contractor, its officers, employees, or agents. 5. Contractor shall be responsible for unpacking, complete installation and placement of all furniture in locations as specified by Owner. 6. Contractor shall be responsible for the removal and disposal of all trash and packaging waste at its own expense. 7. In the event that any temporary storage is required prior to delivery, the Contractor will be responsible for any associated charges. 8. The Contractor shall provide appropriate protection for all doorjambs and protection for the flooring and other finishes and furnishings during installation. The Contractor shall be held responsible for 87

89 any damages, dents and marks to the product and the Owner s building, no matter how minor, caused by the movement of his materials, labor or installation. 9. In the event that either party to this Agreement shall institute any action or proceeding against the other relating to the enforcement of this Agreement or any default hereunder, the unsuccessful party to such action or proceeding shall reimburse the successful party its reasonable attorney s fees, costs and expenses incurred thereby.
