2 SHALIMAR SRINAGAR Subject: - Rate contract for purchase of Chemicals & Glassware etc. As recommended by the Central Purchase Committee (Chemicals & Glassware) and approved by the Hon ble Vice Chancellor, the manufactures/ dealers/ suppliers as per Annexure-I are placed on rate contract for supply of chemical/glassware/plastic ware/ reagents/ disposables/ lab media/ diagnostics/ molecular grade reagents/ kits etc. for the year The rate contract shall remain valid up to and shall be governed by the terms and conditions as indicated in the Annexure-II. The addresses of the approved manufacturers/suppliers/firms along with the telephone numbers etc. are depicted in Annexure-III to this contract. 6 ANNEXURE-II Terms & Conditions The supply of items (chemical/glassware/plastic ware / reagents/ disposables/ lab media/ diagnostics/ molecular grade reagents/ kits etc.) shall be made on the rate as per printed price list valid for of the Company/Manufacturer with offered discount by the supplier. The delivery of the items shall be made FOR destination of ordering Constituent unit of the university in Kashmir valley and Ladakh. The escalation in price during the rate contract period shall not be considered If the supplier fails to deliver items/articles as per the delivery schedule, the University shall be free to procure the balance undelivered supply at the risk and cost of the supplier and penalty as considered appropriate by the competent authority of the University including to forfeit the CDR. The University is registered with Department of Scientific and industrial Research (DSIR), Ministry of Science and Technology, Govt. of India and has been exempted from payment of Excise duty in terms of Government Notification No.10/97 Central Excise dated March1, 1997, as amended from time to time. The University is registered with DSIR and has been exempted from payment of Customs duty in terms of Govt. Notification No. 51/96- Customs dated June 15, 16 as amended from time to time. Other taxes as applicable at the time of delivery of the items shall be paid. Supply order shall be executed within a month after the placement of the supply order. No advance payment will be made. CDR will be released in favour of successful tenderer on completion of supplies only after expiry of the validity period of rate contract. Any dispute arising between the parties (University and Supplier) shall be settled within the jurisdiction of Kashmir Division of J&K State. Any failure or omission to carry out the provision of this contract shall not give rise to any claim by the University and successful contractor s one against the other, if such failure or omission arise from act of nature which shall include all acts of natural calamities such as fire, floods, earthquake, riots and war. All conditions of Force Majoure clause to be provided through documentary evidence. The rate contract shall be valid upto from the date of its issuance.
