1 COMMISSIONER PROCEEDINGS September 16, 2008 Minutes of the Wilkin County Board of Commissioners held at the Courthouse, Breckenridge, Minnesota, on Tuesday, September 16, All Commissioners except Commissioner Perry were present. Chairman Blaufuss called the meeting to order at 8:00 A.M. Motion by Hovland, seconded by Miranowski and carried, to approve the agenda with additions. Motion by Miranowski, seconded by Folstad and carried, to approve the minutes of the September 8, 2008, meeting. Motion by Folstad, seconded by Miranowski and carried, to approve the Public Health Nursing contract with the Breckenridge School District. Motion by Hovland, seconded by Miranowski and carried, to approve the Public Health Nursing contract with the Campbell-Tintah School District. Motion by Miranowski, seconded by Folstad and carried, to approve the Public Health Nursing contract with the Rothsay School District. Motion by Miranowski, seconded by Folstad and carried, to authorize the Public Health Nursing Department to hire a full-time nurse to replace the 4/5 time nurse that recently resigned. Motion by Folstad, seconded by Miranowski and carried, to authorize Public Health to provide flu shots for County Employees. Motion by Folstad, seconded by Miranowski and carried, to approve the Public Health Nursing Report. Motion by Hovland, seconded by Folstad and carried, to approve the Ag. Inspector Report. Motion by Folstad, seconded by Hovland and carried, to approve an amended food service contract with Aviands Food Service, Roseville, Minnesota. The following claims were allowed and ordered paid on September 18, 2008, as provided by Chapter 673, Law of 1969, on motion by Miranowski, seconded by Hovland and carried. After review and on motion by Miranowski, seconded by Folstad and carried, the quarterly mileage logs were approved. Pursuant to notice duly given, sealed bids for projects SAP and SAP , both bridge replacement projects, were opened, read, and recorded as follows: Central Specialties, Inc., Alexandria, Minnesota, SAP $239,300.00, SAP $53,300.00, total bid $292,600.00; Landwehr Construction, Inc., St. Cloud, Minnesota, SAP $173,608.92, SAP $39,687.62, total bid $213,296.54; Riley Brothers Construction, Inc., Morris, Minnesota, SAP $170,812.00, SAP $44,930.00, total bid $215, Motion by Hovland, seconded by Miranowski to turn the bids over to the County Engineer for tabulation. Motion by Miranowski, seconded by Folstad and carried, to grant an easement through tax forfeited property to the City of Breckenridge to allow flood protection construction. Commissioner Hovland offered the following resolution and moved for it s adoption. The motion was seconded by Commissioner Folstad and carried.

4 RESOLUTION RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT BE IT RESOLVED, that the Wilkin County Sheriff s Office enter into a grant agreement with the Minnesota Department of Public Safety, Office of Traffic Safety, for the project entitled SAFE AND SOBER COMMUNITIES during the period from October 1, 2008 through September 30, BE IT FURTHER RESOLVED, that the Wilkin County Sheriff is hereby authorized to execute such agreement and amendments as are necessary to implement the project on behalf of the Wilkin County Sheriff s Office and to be the fiscal agent and administer the grant. Adopted this 16 th Day of September, (Seal) Chairperson Motion by Hovland, seconded by Miranowski and carried, to accept a proposal from Ericksen Ellision and Associates, Inc., St. Paul, Minnesota, to assist in arriving at a solution for the air intake problem being experienced in the LEC/Jail with a fixed fee of $2, Motion by Folstad, seconded by Miranowski and carried, to authorize a county employee to attend training to obtain a Minnesota Grade C Boiler License and pay the training fee with an Auditor s Warrant in the amount of $330.00, to Minnesota State Community & Technical College, Moorhead, Minnesota. Motion by Miranowski, seconded by Folstad and carried, to accept the low bid of Landwehr Construction, Inc., St. Cloud, Minnesota, in the amount $213, for bridge replacement projects #SAP and #SAP Commissioner Hovland offered the following resolution and moved for it s adoption. The motion was seconded by Commissioner Miranowski and carried. RESOLUTION NO COUNTY STATE AID HIGHWAY FUNDS ADVANCE RESOLUTION WHEREAS, the County of Wilkin has implemented County State Aid Projects in 2008 which will require State Aid funds in excess of those available in its State Aid Town Bridge Construction Account, and WHEREAS, said County is prepared to proceed with the construction of said projects through the use of an advance from the County State Aid Construction Fund to supplement the available funds in their State Aid Town Bridge Construction Account, and WHEREAS, the advance is based on the following determination of estimated expenditures: Account Balance as of date $ 175, Less estimated disbursements: Project # SAP $ 191, Project # SAP $ 38,200.00

5 Total Estimated Disbursements $ 230, Advance Amount (amount in excess of acct balance) $ (54,948.79) WHEREAS, repayment of the funds so advanced will be made in accordance with the provisions of Minnesota Statutes , Subd. 5 & 7 and Minnesota Rules, Chapter 8820, and WHEREAS, the County acknowledges advance funds are released on a first-come-first-serve basis and this resolution does not guarantee the availability of funds. NOW, THEREFORE, Be It Resolved: That the Commissioner of Transportation be and is hereby requested to approve this additional advance for financing approved County State Aid Highway Projects of the County of Wilkin in an amount up to $60, in accordance with Minnesota Rules , Subp. 9. I hereby authorize repayments from subsequent accruals to the Town Bridge Construction Account of said County in accordance with the schedule herein indicated: (initial one) Repayment from entire future year allocations until fully repaid. Repayment in equal annual installments Repayment from future year allocations in amounts listed below until fully repaid (maximum 3 year repayment). $ CY $ CY $ CY Adopted this 16 th day of September, (seal) Chairman Motion by Miranowski, seconded by Folstad and carried, to set the Proposed Payable 2009 Wilkin County Levy that is subject to the State Levy Limits at $4,429, Motion by Hovland, seconded by Miranowski and carried, to set the Proposed Payable 2009 Wilkin County Special Levy that is subject to State of Minnesota approval at $1,392, Motion by Folstad, seconded by Miranowski and carried, to set the Proposed Payable 2009 Wilkin County Budget at $11,604, Motion by Folstad, seconded by Miranowski and carried, to approve the Welfare Report as presented by David Sayler, Family Service Director. With no further business before the Commission and the next regular scheduled meeting set for October 14, 2008, at 8:00 A.M. in the Commissioners Room, Chairman Blaufuss adjourned the meeting at A.M.
