8 VADALISM OF HOME ISLAND CRC TOILETS It has come to the Shire s attention that the public toilets in the Home Island Community Resource Centre has been vandalised in 2 separate occasions, most recently this past weekend. The Shire have expended many hours to create a facility that is worthwhile for the community. Those doing the vandalising may see these actions as fun however it has required urgent repairs to be done by Shire staffs to rectify the blocked toilets and general tidy up which have incurred costs. It is disappointing that such foolish crimes exists in such a small community and towards a popular facility. As such the Shire will not tolerate such behaviour. In disappointment the Shire has reported this crime to the Australian Federal Police. As a last resort the Shire will be required to reluctantly lock these facilities after hours should these crimes continue which will no doubt be of disadvantage to the community. Should someone in the community know the people responsible for these crimes, please notify the Chief Executive Officer or AFP in confidence so that this issue can be dealt with appropriately. PENCEROBOHAN JAMBAN CRC HOME ISLAND Sudah dalam perhatian Shire yang jamban-jamban umum di Home Island Community Resource Centre telah dicebohkan dalam 2 kali kejadian, paling baru-baru ini di minggu yang lewat. Shire telah menggunakan masa yang banyak untuk membuatkan tempat yang berguna untuk masyarakat ini. Merekamereka yang membuat kerusakkan ini mungkin menganggap sikap mereka sebagai perkara yang menyenangkan, tetapi perbuatan mereka telah memerlukan repair dengan segera yang dibuat oleh pekerja Shire untuk membetolkan jamban yang tesumpal dan mengemaskan tempat yang juga telah memakan ongkos. Kejadian ini mengecewakan kerana didapati pelanggaran sebodoh ini berlaku dalam masyarakat sekecil ini dan terhadap tempat yang sering digunakan dalam masyarakat. 13 Drug offences and you II offences to do with prohibited plants These are short articles about legal issues that may interest you. They are not legal advice. You should always get individual legal advice for your situation. This is the second in several articles about drug offences under state-based legislation that is applied to Christmas and Cocos (Keeling) Islands and under Commonwealth legislation. The first few articles will be about offences under the state-based Misuse of Drugs Act 1981 (WA)(CI). We will call it the Act. In the first article we talked about prohibited drugs and premises and drug paraphernalia. In this article we will talk about criminal offences to do with prohibited plants under the Act. What are prohibited plants? The Act defines these as any plant from which a drug of addiction may be made, and plants listed in Schedule 2 of the Act (2 types of poppies and cannabis). A drug of addiction is further defined in the Act. Offences to do with prohibited plants A person can be charged with a simple offence of possessing or cultivating a prohibited plant. A simple offence can only be dealt with by the Magistrates Court and not a higher court. This offence attracts a maximum fine of $2,000 and/or imprisonment of up to 2 years. Sell or supply, or offer to sell or supply, a prohibited plant or drug obtained from it, or possession with intent to sell or supply a prohibited plant or drug obtained from it This is a more serious charge. Under this section of the Act, you can be charged with selling or supplying a prohibited plant, or the drug obtained from it. You can also be charged with offering to sell or supply a prohibited plant, or the drug obtained from it. Supplying includes just sharing it with friends. It does not matter how many plants you have you could be selling just one, or sharing the pod of just one prohibited type of poppy plant. If you have 10 or more prohibited plants, even though there is no evidence that you are selling or supplying, you can be presumed to have the intent to sell or supply the plants or drug obtained from them and you can be charged with possession of, or cultivating a prohibited plant, with intent to sell or supply, which is under the same section of the Act and has the same penalties. If you are charged under this section and the plants/drug obtained from the plants is cannabis only (and not resin or any other derivative), or the plants are the 2 types of prohibited poppy listed in the Act, the charge can be dealt with by the Magistrates Court or by a higher court. If it is dealt with by the Magistrates Court the penalty is a maximum fine of $5,000 and/or 4 years imprisonment. Your charge cannot be dealt with by the Magistrates Court if you have 20 or more cannabis plants, or if you have 100 or more of either of the types of poppy plants. It becomes an indictable only charge. It must go to a higher court to be dealt with. Then, the maximum penalty if the plants are only cannabis is a $20,000 fine and/or 10 years imprisonment. The maximum penalty for any other prohibited plant, such as the prohibited poppies, is $100,000 and/or 25 years imprisonment. There is also mandatory sentencing (which means that the Court must give these sentences) for the offence of sell or supply or offer to sell or supply a prohibited plant of any sort where the accused person is an adult at the time and the person they are offering or giving it to is a child under 18 years. For a first offence, the penalty must be suspended or conditional suspended imprisonment or imprisonment. For a subsequent offence, there must be imprisonment for at least 6 months. Sell or supply, or offer to sell or supply, a thing knowing it will be used in the hydroponic cultivation of prohibited plants This charge can be dealt with in either the Magistrates Court or a higher court. The maximum fine is $2,000 and/or 2 years imprisonment if dealt with by the Magistrates Court. The maximum fine is $20,000 and/or 5 years imprisonment if dealt with by a higher court. The court can also order that the convicted person not be allowed to sell or supply anything that can be used for the hydroponic cultivation of plants for up to 2 years. 15 Home Safety for Baby video showing near you Consumer Protection has been working with the State-Government-run satellite TV service Westlink, to produce a video called Home Safety for Baby. This 15 minute film features representatives from Kidsafe WA, the Royal Life Saving Society of WA, Red Nose and Consumer Protection s Principal Product Safety Officer, Luke Eaton. The Home Safety for Baby video covers product safety issues in the home and outlines the risks for babies and toddlers. The film aims to help prevent accidents, which can lead to injuries or fatalities and provides tips for parents and carers are to do with baths, curtain and blind cords, button batteries, furniture, child car seats and more. Home Safety for Baby is being shown from September at three different times of the day at many Community Resource Centres, schools and training or education facilities in regional and remote Western Australia. Look out for Petanque/Bocce/Boules (whatever you call it), a Slack Line to practice your balancing for the SUP boards and Kite Boards, Volley Ball equipment (looking at having regular games) and a BBQ and more chairs. The Club are planning to hold social gatherings for members to enjoy our facilities and learn about the equipment we have for you all to enjoy. A huge Thank You to the Ball Organisers and Helpers, especially Dianne Evans, Narelle Cahill and Tania Charlston who coordinate this big task. I m sure you would all agree it was a fantastic night.
