West Island general waste will be collected on a weekly basis commencing Thursday 5th January. Recycled Waste With the introduction of the Recycle Shed on West Island, the collection of the waste aluminum cans and glass bottles will be collected on a fortnightly basis. 4 Cocos (Keeling) Islands News (cont d) Berita Pulu Cocos (Keeling) (seterusnya) TOWN PLANNING SCHEME NO.1 NOTICE OF PUBLIC ADVERTISEMENT OF APPLICATION FOR PLANNING APPROVAL PROPOSED ATOLL DISCOVERY CENTRE ON WEST ISLAND TRUST LAND It is hereby notified for public information and comment that the Council has received an application for Planning Approval from Mr David McKinney and Bianca McKinney, West Island residence, seeking the approval of Council to develop an Atoll Discovery Centre and Caretaker s with provision for future eco tourist accommodation on West Island Trust Land. The proponents have advised that they intend to establish an interpretive centre that is dedicated to telling stories of the atoll environment and the natural history of the islands. Visitors to the centre will be able to explore and discover the Islands via a series on modern, digital exhibits that use interactive displays and technology to experience the marine, land, air and environments of the islands. To achieve this development, the proponents have also sought the approval from Council to acquire approximately 1 hectare of Trust Land, North of the Big Barge Art boundary. The proponents have also indicated that the interpretive centre will be the primary tourist facility of the proposed business. Approval is also sought for a caretakers residence for management and maintenance of the centre, and the option to develop two small off-grid retreats for eco tourist accommodation at a later stage. The proposed operations can be permitted within the General Rural zoning of the Shire of Cocos (Keeling) Islands Town Planning Scheme No.1 on the proviso that Council has exercised its discretion in granting Planning Approval. Further information in relation to the proposed Development Application including a copy of the submission by Dave and Bianca McKinney is available for viewing at both shire offices. Coffee makers, microwaves, blenders and other kitchen appliances use energy (even when turned off) anytime they re plugged into a socket. 12 Public Notices Notis-notis Umum Criminal offences concerning careless driving, dangerous driving and reckless driving - II These are short articles about legal issues that may interest you. They are not legal advice. You should always obtain individual legal advice for your situation. There are a number of criminal offences associated with bad driving. In the first article we discussed careless driving, dangerous driving, what are circumstances of aggravation if you commit these types of offences and the applicable penalties for those offences. In this article we will discuss the criminal offence of dangerous driving causing bodily harm and the penalties applicable to this offence. In the third article we will discuss dangerous driving causing death or grievous bodily harm and reckless driving. You should read all 3 articles to understand the offences. The offence of dangerous driving causing bodily harm is where you drive dangerously (as discussed in the first article) but cause bodily harm (injury) to a person. So the elements (parts) of the offence are where you a) drive a motor vehicle and b) are involved in an incident that c) causes bodily harm to a person and d) you are driving dangerously at the time. Bodily harm is any harm (injury) that is less than grievous bodily harm. Grievous bodily harm is harm where there is, or is likely to be, a risk of death, or harm that is, or is likely to be, permanent. Examples of causing bodily harm might be where there is bruising or lacerations, or concussion or bone/s fractures that will heal and will not cause any permanent harm to a person. The penalty for a first offence of dangerous driving causing bodily harm is imprisonment for up to 9 months and a fine up to $9,000. Also, your motor driver s licence (MDL) must be disqualified for at least 12 months. The maximum penalties for a second or subsequent offence are higher and the disqualification period longer. But, if the offence (either first or subsequent) is committed in the aggravating circumstances of driving the vehicle without the permission of the owner, or at or more than 45 km/hour higher than the speed limit on the road or applicable to the vehicle, it is more serious and can be dealt with in either the Magistrates Court or District Court. The maximum penalties that apply in the District Court are higher. The offence will be dealt with in the Magistrates Court unlessyou or the Prosecutor make an application to have your matter dealt with by the District Court and the Magistrate agrees. There are rules that the Magistrate must apply in making this decision. In the aggravating circumstances above your penalty in the Magistrates Court is imprisonment for up to 3 years and a fine up to $36,000 and your MDL must be disqualified for at least 18 months. And if you are dealt with in the District Court, your penalty is imprisonment for up to 10 years and any amount of fine and your MDL must be disqualified for at least 2 years. Finally, if you commit this offence in the aggravating circumstance of driving dangerously and causing bodily harm whilst escaping pursuit from a Police officer, you must be sentenced to prison for not less than 6 months and not more than 3 years if you are dealt with by the Magistrates Court. The prison sentence cannot be suspended, so you must serve it immediately. Your MDL must be disqualified for at least 18 months. If you are dealt with by the District Court you must be sentenced to prison for at least 6 months and not more than 10 years. Your MDL must be disqualified for at least 2 years. For all of these circumstances above, if you have a provisional licence (P plates), it is cancelled and you are disqualified from getting a licence for the disqualification period. You also face the other penalties. In the final article we will discuss dangerous driving causing grievous bodily harm or death, which is an even more serious offence. Kecederaan badan adalah kecederaan (luka) yang kurang daripada kecederaan badan yang parah (teruk). Kecederaan badan yang parah ialah dimana ada, atau mungkin ada, risiko untuk mati, kecederaan yang, berkemungkinan, tetap. Contoh yang menyebabkan kecederaan badan mungkin dimana ada bengkak atau tebelah, atau concussion atau tulang retak yang akan sembuh dan tidak menyebabkan kecederaan yang tetap terhadap seseorang. Hukuman untuk kesalahan pertama driving berbahaya yang menyebabkan kecederaan badan ialah penjara hingga 9 bulan dan denda hingga $9,000. Juga, lesen driver (MDL) kamu mesti di dibatalkan (disqualify) untuk sekurang-kurangnya 12 bulan. Tetapi, kalau kesalahannya (pertama atau seterusnya) terjadi dalam keadaan yang lebih memberatkan seperti membawak kereta tanpa izin pemiliknya, atau terjadi 45km/hr lebih dari speed limit dijalan atau berkenaan dengan kereta, is akan lebih serious dan boleh diselesaikan di Magistrates Court atau District Court. Hukuman maksimum yang diberikan di District Court lebih tinggi. Kesalahannya akan diselesaikan di Magistrates Court kecuali kamu atau Prosecutor membuat pemohonan untuk menyelesaikan perkara kamu oleh District Court dan Magistrate bersetujuan. Ada undang-undang yang Magistrate mesti memohon untuk membuat keputusan ini. Dalam keadaan yang memberatkan diatas, hukuman kamu dalam Magistrates Court adalah penjara hingga 3 tahun dan denda sehingga $36,000 dan MDL kamu mesti di disqualify untuk sekurang-kurangnya 18 bulan. Dan kalau kamu diselesaikan di District Court, denda kamu ialah penjara hingga 10 tahun dan jumlah dendaan dan MDL kamu mesti di disqualify untuk sekurang-kurangnya 2 tahun. Akhirnya, kalau kamu berbuat kesalahan ini dalam keadaan yang lebih memberatkan dalam driving berbahaya dan menyebabkan kecederaan badan dimasa melarikan diri dari Police officer, kamu mesti dihukum untuk tidak kurang daripada 6 bulan dan tidak lebih dari 3 tahun kalau diselesaikan oleh Magistrates Court. Hukuman penjara tidak boleh ditangguhkan, kamu mesti ditahan dengan segera. MDL kamu mesti di disqualify untuk sekurang-kurangnya 18 bulan. Kalau kamu di selesaikan oleh District Court kamu mesti dihukum penjara untuk sekurang-kurangnya 6 bulan dan tidak lebih dari 10 tahun. MDL kamu di disqualify untuk sekurang-kurangnya 2 tahun. Untuk semua keadaan diatas, kalau kamu mempunyai provisional licence (P plates), ia dibatalkan dan kamu di disqualify daripada mendapati lesen untuk masa yang dibatalkan. Kamu juga akan menghadapi hukuman yang lain. Dalam majalah terakhir kami akan bincangkan tentang driving berbahaya yang menyebabkan kecederaan badan yang parah atau kematian, yang adalah kesalahan yang lebih berat. In the past the lunch has been held on Christmas Day at Trannies with the marquee kindly erected by North Park. Traditionally the event has been very low key with people bringing yummy food to share and providing their own tables, chairs, plates, glasses, cutlery etc. The coordinators have arranged decorations, extra tables and chairs and given some structure to the lunch.
