3 INTRODUCTION The NVCA s planning fees are under review t cnsider their effectiveness and fairness. The NVCA s Planning and Engineering Advisry Cmmittee (PEAC) has been tasked with the rle f reviewing the current NVCA Planning Fee Schedule and prviding preferred ptins and recmmendatins t the Bard f Directrs this fall fr cnsideratin and apprval. The cmmittee is cmpsed f 8 members frm NVCA s Bard f Directrs alng with Directr f Engineering and Technical Services Glenn Switzer, Directr f Planning Services Chris Hibberd and Chief Administrative Officer Gayle Wd. The review prcess includes engaging key stakehlders prir t submissin f recmmendatins t the Bard. The engagement prcess includes inviting stakehlders t meet as a subcmmittee f the PEAC with the fllwing prpsed cmpsitin: Agricultural Cmmunity: 5 representatives BILD: 4 representatives Custmers at Large: 2 representatives Aggregates Industry: 1 representative In supprt f ur fee review, NVCA has prepared this discussin paper which includes an histric perspective, an intrductin t ur past and current review fees, and next steps in the review prcess. BACKGROUND/LEGISLATION In Canada, the respnsibility fr water management is shared by the federal, prvincial and municipal gvernments. When it cmes t water gvernance in Canada, the federal gvernment has jurisdictin related t fisheries, navigatin, federal lands and management f bundary waters. Canadian prvinces have primary jurisdictin ver mst areas f water management and prtectin. 4 functins t lcal authrities that may be respnsible fr a particular area r river basin. 1 In Ontari, the prvince has delegated sme water and cnservatin land respnsibilities thrugh the passage f the Cnservatin Authrities Act This prvincial legislatin enabled municipalities t recmmend the creatin f a cnservatin authrity t: undertake in an area ver which it has jurisdictin, a prgram designed t further the cnservatin, restratin, develpment and management f natural resurces (Sectin 20). Specifically, Sectin 28 f the Act allws, subject t the apprval f the Minister, an authrity t make regulatins applicable in the area under its jurisdictin: a) Restricting and regulating the use f water in r frm rivers, streams, inland lakes, pnds, wetlands and natural r artificially cnstructed depressins in revers r streams; b) Prhibiting, regulating r requiring the permissin f the authrity fr straightening, changing, diverting r interfering in any way with the existing channel f a river, creek, stream r watercurse, r fr changing r interfering in any way with a wetland. HISTORY OF CONSERVATION AUTHORITIES/NVCA FUNDING Given the shared respnsibility fr water resurces in Canada (prir t the creatin f cnservatin authrities in 1946), the prvince established a Cnservatin Branch which began with $100,000 f prvincial funding in In 1961, the budget f the Branch alne was abut $2.25 millin and by 1970 it had risen t $ millin, mst f which was in the frm f grants t the [then] thirty-eight cnservatin authrities. 2 The traditinal funding scenari upn which the Cnservatin Authrities Act 1946 was premised, was based n a 50/50 cst share mdel with the prvince cntributing t 50% f a cnservatin authrities budget and the matching 50% frm member municipalities (pr-rated accrding t the current value assessment f the municipalities within the watershed). 1 Gvernment f Canada, Federal Plicy and Legislatin and Shared Respnsibility, Envirnment Canada Bulletins, Mdified and A.H. 5 Based n this, by the time the NVCA was created in 1960 the traditinal prvincial/cnservatin authrity funding mdel lked like that utlined in the 1946 revenue chart belw. 6 b) Arund 1955, an Order-in-Cuncil made prvisin fr the purchase f land n which buildings had been destryed due t flding. Generally, the prvince paid the full cst f prperty acquisitin [fr fld plain lands] in the municipalities utside f Metr 3 c) In the early 1960 s the release f Cnservatin Reprts by the prvince fr the cnservatin authrities was a special ccasin. It began with a dinner fr the authrity, then came a public meeting, t which 150 r mre interested citizens were invited by printed invitatin, and at which the Minister presented the reprt, a cpy f which was given t each member f the authrity. Later, if funds were available, an attractive bulletin was published summarizing the reprt and abut 3,000 cpies were distributed t the watershed. 4 The Cnservatin Reprts, Bulletins and events were paid fr by the prvince. d) In 1963, Ontari experienced an extreme drught. As a result it was recmmended that the gvernment s assistance t cnservatin authrities fr the cnstructin f water supply reservirs be increased frm the existing 50 percent. The new plicy made prvincial assistance available t authrities in the frm f a grant f as much as 100 percent f the cst f a dam and reservir including land acquisitin. Twenty-five percent f the grant was t be repaid within thirteen years after the initiatin f the prject. The first three years f the repayment perid were interest free. 5 The fllwing small water supply reservirs within the NVCA watershed, which were cnstructed during this perid f time, included: New Lwell Utpia Tttenham. e) In March 1967, in respnse t public cncerns in relatin t the Niagara Escarpment, the prvince initiated a study which resulted in the previsin f a subsidy t cnservatin authrities f 75 percent t acquire escarpment lands. 8 g) In the 1970s many cnservatin authrities built structures fr their resurce educatin prgrams. Water and related land management prgrams received a 55 percent prvincial grant, and cnservatin and recreatin prgrams (land securement and management) received a 50 present prvincial grant. 10 much as an 85 percent ttal grant n water prgrams such as fld warning/frecasting, fld/ersin cntrl infrastructure/maintenance, and plan input/review. Fr cnservatin and recreatin, supplementary grants up t 25 percent were prvided. This included capital as well as perating grants. 13 Summary: Frm the abve, the fllwing bservatins can be made: There has been a substantial reductin in prvincial funding cntributins t cnservatin authrity budgets ver the years. The prvince has eliminated funding fr several prgram areas, including educatin, land securement, lands maintenance, stewardship and administratin. The reductin in prvincial funding has resulted in the NVCA initiating a fee system fr develpment planning applicatins and Sectin 28 permit reviews; causing significant negative respnse frm clients. Incnsistent funding has made it very difficult t budget, year ver year. In 2012, Cnservatin Ontari develped a Whitepaper Watershed Management Futures fr Ontari. The Whitepaper utlines hw cnservatin authrities can assist the prvince in meeting their mandate as well as verviews funding transfer fr this wrk. Cnservatin Ontari cntinues t strngly advcate fr the Whitepaper with Prvincial gvernment agencies. Additinally, the recently annunced federal Natinal Disaster Mitigatin Prgram hlds prmise fr investment in fld mitigatin prject csts f up t 50 percent fr eligible prvincial prjects. It is clear that NVCA needs t be an integral part f Cnservatin Ontari s advcacy prgram fr re-investment in cnservatin authrities. Further, it is anticipated that the new federal Natinal Disaster Mitigatin funding will result in updating NVCA Fld Plain Mapping cmpleted in the 1970s and 1980s. As well, new and innvative appraches at the lcal level need t be investigated in relatin t future funding t supprt NVCA prgrams. INTRODUCTION TO NVCA REVIEW FEES As a result f the 1995 Prvincial Ecnmic Statement, transfer payments t the NVCA were dramatically reduced. Since then, NVCA s annual transfer payments have been held at $188,490. This funding is used by NVCA slely fr the Fld Warning and Frecasting (Engineering) Prgram, which is a delegated respnsibility frm the Prvince f Ontari. Given the pressure resulting frm the Prvincial Ecnmic Statement, cnservatin authrities became mre fcussed in their ability t deliver planning prgrams, which include the fllwing cmpnents: Discussin Paper 2015 Review NVCA Planning/Permitting Fees Page 11

14 plan input and review; cnservatin authrity regulatins and permitting; and strategic planning. Plan Input and Review is the service prvided t municipalities in rder t cmment n Official Plans, Zning Bylaws, etc. In the late 1990s, NVCA s Bard f Directrs determined that this service wuld be cmpleted by Planning Staff using municipal levy. At that time, the Bard determined t charge fr regulatins/permitting reviews and issuance n a cst recvery basis. The ability t charge a fee fr this service required prvincial apprval. In rder t determine the apprpriate Planning (Regulatins/Permitting) Fees, NVCA cmmenced a Planning Fees Review in 1999 and since that time has cmpleted several updates. The NVCA had charged fees prir t this time hwever the 1999 fee schedule prvided a cmprehensive fee schedule addressing permitting and planning including strmwater management review. PAST FEE REVIEWS NVCA has cnsulted with several partners, stakehlders and neighburing cnservatin authrities ver the years. The planning fees have been reviewed annually t mnitr the effectiveness f the schedule f fees and (accrdingly) t make any changes. In the past staff have brught frward any suggested changes t the NVCA Fee Plicy thrugh the Planning Advisry Cmmittee (PAC). The plicy and the recmmended amendments are discussed at the PAC. The PAC, then, recmmends t the Executive Cmmittee f the NVCA Bard that the plicy and the amendments receive preliminary apprval. Once preliminary apprval is received frm the Executive Cmmittee, the plicy is frwarded t the Bard f Directrs fr final apprval. This three-tiered gvernance mdel and its meetings were pen t the public fr cmments. The Bard f Directrs were infrmed f the prpsed changes t the plicy at the utset f the prcess and were encuraged t cnsult with their municipal staff. The plicy is als circulated t the Ministry f Natural Resurces fr their infrmatin and cmment. In 2013, with the eliminatin f the PAC and Executive Cmmittee, this prcess invlved the creatin f review fee cmmittee cmprised f Bard f Directr members. At the cnclusin f the prcess the cmmittee recmmended a fee schedule t the Bard fr their apprval. The 2013 review prcess invlved municipal and key stakehlder cnsultatin and discussins including the pprtunity fr deputatins t the cmmittee. 15 CURRENT FEES NVCA planning fees (see Schedule 1) address bth planning applicatins and permitting apprvals. The review fees are intended t recver review csts f develpment applicatins n an averaged basis. NVCA s prgram csts include: Wages and Inter-prgram Charges (staffing cst t implement planning prgram), Other Inter-prgram Charges (GIS and technical supprt, ffice and ccupancy csts, wrkshp and vehicles, crprate administratin, etc.) and Other Expenses (staff training, department material and supplies, legal csts, etc.). NVCA review fees and assciated plicy dcument is based n the user-pay principle. The fees and revenues generated are designed t recver the csts assciated with administering and delivering the services n a prgram basis. In the 2014 budget, revenue generated frm review fees cvered apprximately 62 percent f the verall prgram csts. The prgram csts include: staff wages (54%); department material and supplies including legal csts (5%); and, verhead (41%). This user fee t levy rati represents the maximum reliance n user-fees in rder t safeguard the planning prgram and its services against ecnmic vlatility and subsequent budgetary uncertainty. It is als intended t reflect that significant effrt and resurces are used fr nn-develpment related activities and prpsals including Municipal Permitting, Official Plans, Secndary Plans, and Cmprehensive Zning By-Laws. PROVINCIAL GUIDANCE ON REVIEW FEES MNRF s Plicies and Prcedures fr the Charging f Cnservatin Authrity Fees In 1997, the MNRF (Ministry f Natural Resurces and Frestry) a guideline dcument t assist cnservatin authrities in develpment f fee schedules. This dcument is intended t guide cnservatin authrities in fee develpment and addresses the fllwing key pints: Sectin 2 (Legislatin) f MNRF s fee plicy ntes that Subsectin 21(m.1) gives cnservatin authrities the pwer t charge fees fr services apprved by the Minister. Sectin 4 (Plicy Principles) f MNRF s fee plicy advise that cnservatin authrities are entitled t charge and cllect fees fr services rendered applying a user pay principle. 16 Sectin 5.1 f MNRF fee plicy indicates the services that cnservatin authrities are permitted t establish review fees and includes plan review. Sectin 5.2 addresses such matters as: a fee schedule, public ntificatin, review/revisin prcess, and appeal prcess. Sectin 5.3 deals with ensuring fees recver but d nt exceed the csts assciated with administering and delivering the services n a prgram basis. Sectin 5.5 speaks t cnsidering adjacent cnservatin authrities fees, preventing duplicative fees and addressing file cmplexity. Cnservatin Authrities Liaisn Cmmittee (CALC) In 2007, the prvincial gvernment created the Cnservatin Authrities Liaisn Cmmittee (CALC) in respnse t perceived lack f clarity n cnservatin authrity rles and respnsibilities in plan review and permitting apprvals. The cmmittee brught tgether representatives frm the building industry, the prvince, municipalities, cnservatin authrities, Cnservatin Ontari and envirnmental rganizatins and tasked them with clarifying the rle f cnservatin authrities in the municipal planning prcess and in the issuance f permits under Sectin 28 f the Cnservatin Authrities Act (CA Act). The cmmittee develped new guidelines, the Plicies and Prcedures fr Cnservatin Authrity Plan Review and Permitting Activities, t utline a cnsistent apprach t the permitting functin undertaken by cnservatin authrities under the Cnservatin Authrities Act and t suggest service-riented imprvements t the permitting prcess pertaining t pre-cnsultatin, cmplete permit applicatins, permit decisin timelines, and administrative review mechanisms. The Plicies and Prcedures fr Cnservatin Authrity Plan Review and Permitting Activities was finalized and apprved by the Minister f Natural Resurces in May f The Minister asked the MNR t cnduct a review f cnservatin authrity fees by the fall f Based n the reprt findings, MNR wuld cnsider the need t update existing plicies and prcedures r ptins t address identified issues related t fees. The CALC aided in this review by hearing many frmal presentatins frm CALC members n varius aspects and perspectives related t fees fr the review f develpment applicatins and cnservatin authrity permits. In Octber 2012, the cmmittee released the Review f Cnservatin Authrity Fees fr Planning and Permitting Activities. Discussin Paper 2015 Review NVCA Planning/Permitting Fees Page 14

17 KEY ISSUES, CONCERNS AND COMMENTS In past discussins with stakehlders the fllwing key areas f cncerns were raised: Fr fees using a per hectare charge, cnsideratin shuld be given t establishing a base fee reflecting the minimum amunt f wrk fr the type f prpsal, with an additinal lwer per-hectare fee which reflects the amunt f time that each hectare adds t the review. Cnsideratin shuld be given t the establishment f a maximum fee. Cnservatin authrities shuld ensure that fees recver but d nt exceed the csts assciated with administering and delivering the services n a prgram basis. When develping fees, cnsideratin shuld be given t adjacent cnservatin authrities fees. Sme stakehlders suggest that certain industries shuld be exempt frm fees. The NVCA fee structure des nt differentiate between cmplex and less cmplex applicatins. The NVCA shuld establish a fee administratin guideline including a defined fee review prcess. CONSERVATION AUTHORITY COMPARATORS In general, NVCA fees fr permits, fficial plan amendments, zning bylaw amendments, cnsents are cmparable, and in sme cases lwer, than adjacent cnservatin authrities. NVCA cntinues t have mdestly higher review fees fr subdivisins and aggregate applicatins. A cmparisn f NVCA and ther cnservatin authrities key review fees are utlined in Table 4, at the end f this dcument. NEXT STEPS Based n directin received frm the Bard, NVCA staff wuld develp a draft fee schedule and cnsult with applicable stakehlders such as the develpment industry, agricultural partners and the MNRF. T facilitate this engagement the NVCA is inviting key stakehlder t meet as a cmmittee t prvide int the fee review prcess and frmulatin f new fees. This step may als include an electrnic survey.
