Part 3: Regulator s Role 1. Conservation Authority Mandate 2. Flood Risk 3. Design Questions and Clarifications 4. Fisheries Requirements 5. Habitat Re-creation King Road Project / CN Rail Title Grade & Date Separation 18 18

Part 3: Regulator s Role 1. Conservation Authority Mandate Empowered by through Conservation Authorities Act Mandated by Minister of Natural Resources and Forestry through O.Reg 162/06 to ensure development does not affect control of flooding, erosion, dynamic beaches, pollution, or the conservation of land Bound by Board approved policies Approval Authority King Road Project / CN Rail Title Grade & Date Separation 19 19

Part 3: Regulator s Role 2. Flood Risk Falcon Creek Indian Creek Limit of Creek Works Indian Creek has a broad, shallow floodplain. This extends Conservation Halton s regulatory authority to include all areas bounded in yellow. King Road Project / CN Rail Title Grade & Date Separation 20 20

Part 3: Regulator s Role 2. Flood Risk Sizing the Corridor: Safely convey Q Reg - 21m 3 /s Maintain incremental storage without artificial backwater Prevent increases in erosive velocities, flood depth off-site, creation of new spill zones, or increases to existing spill Meander belt sets valley floor Long term stable top of slope sets limit of corridor Minimum 0.3 m freeboard King Road Project / CN Rail Title Grade & Date Separation 21 21

Part 3: Regulator s Role Indian Creek Falcon Creek 2. Flood Risk Added Complications Spill Known - Falcon Creek spills frequently (1:5 year rainfall return period) Unknown Ratio of spill contributing to Indian Creek vs. Grindstone Creek EA anticipated Falcon Creek spill could be mitigated, however during detailed design City initiated a separate study of Falcon Creek Changes in spill conveyance cannot impact existing neighbourhoods beyond Falcon Creek floodplain limits King Road Project / CN Rail Title Grade & Date Separation 22 22

Part 3: Regulator s Role 2. Flood Risk Ice Induced Flooding Potential for layered ice build-up along the aqueduct or frazil ice formation causing blockages and flooding CH required AMEC analyze ice impacts on flooding, to determine the level of risk and appropriate mitigation strategies to control public safety risk from ice and spill King Road Project / CN Rail Title Grade & Date Separation 23 23

Part 3: Regulator s Role To limit property impacts, Indian Creek was elevated 1.6 m at the Grade Separation, necessitating the 475 m realignment 50 m length of flat geomorphic referenced engineered (GRE) design 350 m pool and riffle morphology (flattened to 0.44%) natural channel design 22.5 m creek bridge at 0.5% slope 50 m armoured step pool design (GRE) at 3.4% King Road Project / CN Rail Title Grade & Date Separation 24 24

Part 3: Regulator s Role 3. Design Questions and Clarifications How does flattening the channel grade over 400 m impact sediment transport? What geomorphic measures are required to fix the creek at the mouth of the creek bridge and prevent down-cutting and erosion at the embankment? How do we ensure increased grade downstream will not impact channel beyond tie-in? Aqueduct Wingwall King Road Project / CN Rail Title Grade & Date Separation 25 25

Part 3: Regulator s Role 3. Design Questions and Clarifications Grade separation must withstand the full range of forces anticipated under a Regional Storm CH required the Design Engineer s confirmation the structure can withstand: soil saturation, static and impact loadings, and catastrophic down-cutting, as well as prevent channel migration and overtopping. King Road Project / CN Rail Title Grade & Date Separation 26 26

Part 3: Regulator s Role 4. Fisheries Requirements Fish passage had to be maintained when flow persists Grades must be less than 4% Natural & appropriately sized substrate must be maintained bioengineering approaches preferred 80% TSS removal required for King Road per RAP Sediment release during construction is not permitted erosion to be controlled, work to be completed in the dry King Road Project / CN Rail Title Grade & Date Separation 27 27

Part 3: Regulator s Role 5. Habitat Re-creation EA approved works adjacent to/within a Regional Candidate Significant Woodland Prior to site alteration the site contained a regionally rare tallgrass prairie savannah community Landscaping Guidelines had to be implemented such that both of these habitats were re-created King Road Project / CN Rail Title Grade & Date Separation 28 28
