1 City Plaza Energy Upgrades Timeline of Events Pella Window Cancellation June 3, 2010 Pella asks what is needed for submittals. See Attachment #1. June 7, 2010 Pella (Matt Tison) confirms the receipt of Preconstruction meeting date and time. See Attachment #2. June 16, 2010 Matt Tison asks for a copy of the scope of work. This would be included in his contract at the Preconstruction meeting. See the Attachment #3. June 16, 2010 Brian returns the scope of work to Matt Tison. See Attachment 3.1 and 3.2. The scope of work clearly states, Furnish all windows, doors and swinging French doors per plans and specifications. June 22, 2010 Matt Tison answers Brian Van Gorp s question about the C/L (Centerline) of the height of the latch at 1-4 above the sill or 4-0 above finished floor. His incorrect response indicates that, at this point, he does not understand the proper latch positions (1-4 from sill, or 4-0 from F.F.). Undated Attachment #5 (Pages 1-5) are documents sent by Pella asking if they can make changes to Kier s P.O. See attachment for requested changes. June 29, Brian Van Gorp sends the rejected submittal back to Matt Tison to revise his submittal. See Attachment 5.1. June 30, 2010 Matt Tison is stating that he is meeting with Dan Dazotel (Architect) to go over the submittal that was rejected. See Attachment #6. July 1, 2010 Matt Tison sends an indicating that he left a message with the architect (Dan Dazotel) to discuss the resubmittal and the RFI. He is asking what time would be best to meet. He is suggesting today or tomorrow. See Attachment #7

2 July 2, 2010 Matt Tison sends and to Dan Dazotel. He states that the one lock at the desired height will not allow them to meet the specified performance and testing requirements. See Attachment #8. July 19, 2010 Matt Tison sends and to All Western Windows (Window Installer). Matt invite the window installer to the weekly construction meeting to discuss mock-up s and best installation methods. See Attachment #9. July 21, 2010 Attachment #10 is the meeting minutes from the Construction meeting held at 1pm on July 21, The meeting minutes describe the events of the meeting. It is explained that the windows that Pella has submitted will not meet the specs. July 23, 2010 Present Matt Tison has been showing up at meetings uninvited and bothering members of the design team, construction team, and owners. September 14, 2010 Attachment #13 is a letter from Pella s attorney. September 22, 2010 Attachment #14 is a response letter from the Housing Authority of Salt Lake County. *** Also included is Attachment #15. This is the specification for these sections.
