1 2 June 2014 SEMINAR ON REDAS DESIGN AND BUILD FORM OF CONTRACT AND ESSENTIALS OF PROCUREMENT PRACTICE LAUNCH OF TWO BOOKS, ONE BY CHOW KOK FONG AND THE OTHER BY EUGENE SEAH Dear Friends, I write to invite you to the above seminar and the launch of two (2) books on 11 July 2014 at Grand Copthorne Waterfront at 2.00 p.m. The seminar will feature a Key Note address by Mr Wong Meng Meng SC that will be followed by a paper presented by me. A panel discussion will conclude this session with the panel comprising Mr Wong Meng Meng, Mr Chow Kok Fong and myself and chaired by Mr. Ho Chien Mien. Following the seminar, there will a launch of two (2) books The Singapore Developers Design and Build Contract written by Chow Kok Fong, and Construction Procurement, Contract Administration and Law written by Eugene Seah. The book by Chow Kok Fong will be launched by Justice Chan Seng Onn while that of Eugene will be by Wong Meng Meng with presentations by the two authors themselves. Design and build contracts are becoming more widely accepted. It is also not to be denied that administering a design and build contract is not straightforward but fraught with legal and contractual issues, not least the much vaunted principle of contractor s design liability. It is therefore timely and even fortuitous that we now have a book written by Kok Fong that provides in-depth commentaries on a multitude of topics under the REDAS form of contract that will surely instil in us a better understanding of the form. The book written by Eugene Seah on the other hand covers a myriad of topics on procurement and contract administration practice. Each topic is succinctly and clearly narrated in a way that will equip contract administrators with the necessary knowledge and confidence to handle contractual issues effectively and professionally. 4 PROFILES AND PRESENTATIONS Dr Ting Seng Kiong is the Deputy President (Academic) and Provost of the Singapore Institute of Technology (SIT). Dr Ting s research interests are in sustainable construction technology and management. He was awarded the Singapore Concrete Institute Award for Excellence in Concrete research in 1986 and the MND R&D Award 2013 (Merit Award) for his innovation in converting waste to structural concrete and constructing the first building in the region with up to 100% recycled concrete aggregates (RCA). He has been a consultant or expert witness to more than 50 projects over the last ten years. He has one patent to his name. He is a Singapore registered Professional Engineer (PE). Dr Ting Seng Kiong President Society of Project Managers He is active in service to the professional bodies, the local industry and society. He is a Town Councillor in the Sembawang GRC co-chairing the Finance committee. He is a Fellow of the Society of Project Managers (SPM) serving currently as SPM current President. He is a member of the Workplace Safety & Health (Construction and Landscaping) committee under the Workplace Safety & Health Council. He is Chairman of the Committee of Impartiality of the Singapore Construction Safety & Consultancy Pte Ltd. He received his B Eng (1st Honours) in Civil Engineering from Monash University, Australia under the President s and the Colombo Plan scholarships. He obtained his M Eng from NUS before he went to Massachusetts Institute of Technology for his SMCE and ScD (Structural Engineering) under the NUS Overseas Graduate scholarship. Wong Meng Meng, Senior Counsel, founded WongPartnership in 1992, and the Firm ranks amongst the top law firms in Singapore today. Meng Meng retired from the Partnership in 2006, but remains with the Firm as Founder-Consultant, a position that aptly acknowledges his role as the man who, in the words of The Straits Times in its 16 December 2006 article, "set up a law firm that achieved a meteoric rise to prominence." Meng Meng sits on the Board of several public and other companies. He was awarded the Public Service Medal in Meng Meng has been recognised in the areas of Arbitration and Mediation, Construction as well as Litigation since 2008 by Best Lawyers. Wong Meng M Meng Founder-Consultant WongPartnership LLP The Euromoney Legal Media Group identified Meng Meng as one of the world's leading litigation lawyers and also ranked him as one of the top five litigation lawyers in Singapore. He was recognised in Expert Guides Guide to the World s Leading White Collar Crime Lawyers, 3rd Edition in The Legal 500: Asia Pacific The Client s Guide to the Asia Pacific Legal Profession, from year 2001 to 2010, had identified Meng Meng as a leading individual in Singapore for dispute resolution work. He was also recognised for corporate governance work in Singapore by PLC Which Lawyer Directors Duties & Liabilities in Meng Meng will be speaking on some recent issues relating to Fitness of Purpose in Design and Build Contracts. Seah Choo Meng is the Director of Langdon & Seah Singapore Pte Ltd and Langdon & Seah Project Management Pte Ltd, having been Executive Chairman of Davis Langdon & Seah Singapore and Deputy Chairman of Davis Langdon & Seah International (UK, Asia Pacific, Australasia, North America and South Africa) from January 1999 to December Seah Choo Meng Immediate Past President Society of Project Managers In a distinguished professional career spanning more than 45 years, he has led the firm in handling numerous construction projects and covering all aspects of investment studies, project management and quantity surveying services that have shaped the construction industry across the Asia Pacific. He has also acted as Arbitrator, Adjudicator or Mediator for many construction disputes. Choo Meng sits on the Board of Directors of publicly listed Mapletree Industrial Trust Management and is a member of its Audit & Risk Committee. He is also a Board Director of Ren Ci Hospital and Chairman of its Building Committee and a Board Member of the Singapore Green Building Council and Trustee of SGBC Pte Ltd. Design and Build Early Contractor Involvement ( ECI ECI ) Process Langdon & Seah has implemented ECI successfully since the early 1990s for various projects and Mr. Seah Choo Meng has been at the forefront of these initiatives, As a project delivery method and procurement process, ECI harnesses and elevates the productivity level in construction activities. Selected contractors are engaged during the pre-tender stages of design (i.e. concept design or schematic design stages), or during an extended period of tendering, to seek these contractors expertise especially in the areas of buildability, constructability, construction scheduling and planning, value management or value engineering and the latest construction technologies or methods. From experience, ECI should be considered for higher value projects where the employer s requirements and project brief is clear. It also requires a paradigm shift in the way employers, contractors and consultants collaborate during pre-contract stages. Our firm s experience with the implementation of ECI since the early 1990s has edified us with a number of valuable lessons that Mr. Seah will share during the session.

5 Ho Chien Mien is a Partner in Litigation & Dispute Resolution and Energy and Infrastructure. Chien Mien's areas of practice encompass a wide range of contentious and non-contentious work in the areas of construction, engineering and infrastructure projects. Chambers Asia (2009) commends Chien Mien as being the obvious choice for building and construction work and for being really savvy from a commercial and legal point of view. According to Who s Who Legal Singapore (2008), Chien Mien is known for his formidable litigation, arbitration and mediation experience, both at home and abroad. Ho Chien Mien Partner Allen & Gledhill LLP Chow Kok Fong Founding President Society of Project Managers Author of the book The Singapore Developers Design and Build Contract The Asia Pacific Legal 500 (2007/2008) notes that construction specialist Ho Chien Mien has a solid reputation and that he continues to be a leading light in construction disputes. He is also listed as a key practitioner for Project Finance, Infrastructure and Energy in Asia Law Profiles (2007), for Construction in Asia Pacific Legal 500 (2009/2010/2011/2012/2013) and Who s Who Legal 2011/2012/2013 and for Projects and Energy in Chambers Asia 2011/2012/2013. Chow Kok Fong is a Chartered Arbitrator and currently practices as a mediator, arbitrator and adjudicator. He was previously CEO of Changi Airports International, Managing Director of Capitaland Commercial Ltd and Director of Projects of City Developments Ltd. Prior to joining the private sector he was Chief Executive and General Manager of the Construction Industry Development Board (now the Building and Construction Authority). He is Founder President of the Society of Project Managers, Past Chairman of the Society of Construction Law and currently Chairman of the Construction Adjudicators Accreditation Committee. He has authored 12 other leading text books including the two volume work Law and Practice of Construction Contracts (4th edition 2012) and Security of Payments and Construction Adjudication (2nd Edition 2013). On 1 November 2013, he was awarded the quinquennial Singapore Academy of Law Merit Award 2013 for contributions in promoting and advancing the development of Singapore law. The Singapore Developers Design and Build Contract This book considers the leading standard form for design and build contracts from the perspectives of firstly a project manager, who is tasked with the management of projects placed on the design and build model and secondly that of advisors and consultants who have to consider the common issues presented in arbitration and adjudication. The text reviews the principles arising from the design and build model and a chronology of the development of this construction procurement model in Singapore. A major part of the book consists of a commentary on the 3rd Edition of the Contract. The comments are drawn from an extensive range of authorities and writings. In critical areas, the text contrasts the positions in a design and build contract with that found in a traditional build only contract. Mr Chow has clearly established himself as a leading authority on the subject. Having been involved in this specialised area of practice for several decades, he is without question eminently qualified to give a detailed analysis and commentary on the REDAS standard contract. The Honourable Justice CHAN SENG ONN, Judge of the Supreme Court of Singapore Eugene Seah is the Joint Managing Director of Langdon & Seah Singapore Pte ltd. He has a background in Quantity Surveying, Information Technology, Construction Law and Alternative Dispute Resolution, Sustainable Building Design, Value and Risk Management and an AMP from Harvard Business School. He is also an Adjudicator with SMC and a Mediator under SISV. As an advocate for Sustainability and an ambassador for Productivity for BCA, Eugene researches into these aspects, studying practical value drivers and related cost. This has led him to his interest in BIM of which he has written two technical guides and is undergoing a thesis in BIM networks. Eugene Seah Author of the book Construction Industry: Procurement, Contracts Administration and the Law He is also active in Industry activities, participating in a wide range of programs by the Government or professional institutions such as SISV where he takes up council positions. He gives talks regularly in national, regional and international platforms and on topics related to construction, CSR, BIM and Value of which he has won commendations, awards and citations. He also volunteers time in NCSS and other community organisations that require special contributions in construction knowledge. Construction Procurement, Contract Administration and Law As professionals, we are darting around, busy with our everyday lives. When we run into questions, we sometimes look for practical guides to give quick insights to industry practices which will have some bearing to the law and contract in the construction industry of Singapore. This inaugural book by Eugene considers these aspects and summarises key issues and practices. Current topics like Early Contractor Involvement, Procurement, Effects of Time in Construction and Design For Safety, are all discussed and celebrated in the text of the book. The text is like a collection of short stories, short case studies and practical examples on topical talking points in the industry now. It is not meant for heavy reading, but rather, to give an enjoyable read to students and industry professionals alike. Eugene has set out a format that becomes a reference point for understanding and meeting the various by roads and intersections of what would have been an impossible journey.
