1 Citizens Infrastructure Oversight Commission Annual Report to the Orinda City Council 2016 Paving and Storm Drain Activities April 12, 2017 This report is a summary of the activities of the Citizens Oversight Commission [CIOC] for Contained in the report is an update of the condition of Orinda s roads, the on-going Pavement Management Program, charts covering the use of all funds, and maps showing where work has been done or is scheduled to be done, as well as other infrastructure activities. Arterial and Collector Roads (including Grant Projects) During 2016, approximately $775,000 was available from State Gas Tax and Contra Costa Transportation Authority [CCTA] Sales Tax Return to Source. Orinda also received $437,000 of CCTA Measure J Grant funds to contribute to completion of Arterial and Collector roads. The Town of Moraga also contributed approximately $180,000 toward their half of Ivy Drive near Miramonte High School. The Pavement Management Program Policy [Exhibit 1] has these funds dedicated for repair and maintenance of Arterials and Collectors, the roads most heavily traveled. In 2016 the following road segment was rehabilitated: ROADWAY NAME BEGIN LOCATION END LOCATION Ivy Drive Fiesta Circle (north) 1,000 west of Moraga Way Residential Roads and Drains [2012 Measures L and 2014 Measure J] Revenues from 2012 Measure L Sales Tax and 2014 Measure J and 2016 Measure L Bonds are dedicated to repair our Residential roads and drains. In 2016, $2,095,000 was available from 2012 Measure L and $4,900,000 was budgeted for use from 2014 Measure J funds. The total revenue available for the Residential roads program in 2016 was $6,995,000. For FY 2016, a total of 36 Residential road segments were selected and approved for repair per policy [Exhibit 2]. Ultimately, 35 road segments were rehabilitated in last year s paving project, with one segment (Virginia Drive) deferred to 2017 due to utility relocation delays. All of the rehabilitated roads for 2016, listed below, were selected using the criteria developed by the CIOC and were approved by the City Council. 1

For each road segment in the paving projects, storm drains under and adjacent to the road segment are inspected, and, where necessary, repaired or replaced. In 2016 a total of 3,092 linear feet of pipes were inspected and cleaned and 919 linear feet of pipes were replaced. 5,727 linear feet of 2
3 6 asphalt concrete dike was installed to confine surface drainage and to protect side slopes susceptible to erosion. After completion of the 2016 Pavement Rehabilitation Projects, the average Pavement Condition Index (PCI) of the City s entire public street network is 56. Funding The 2012 Sales Tax Measure L and 2014 Bond Measure J Revenue and Expense Summary as of March 30, 2017 is included as Exhibit 5. While there was some carryover from one year to the next, all revenue was expended for the purpose intended. The carryover is the result of the projects that could not be accomplished during construction season due to utility conflicts or from differences between the Engineer s estimate and the actual bid amounts. The funds from both measures are strictly spent on repair of Residential streets and drains Pavement Rehabilitation Project The list of roads for the 2017 Pavement Rehabilitation Project has been approved by the CIOC and the City Council and is provided as Exhibit 6. The project was advertised for bids on March 8, The City received and opened four bids on April 4, Construction on these roads is scheduled to begin in May Other significant developments in 2016 are as follows: Though not formally part of the 2016 project, important drainage improvements were made with the North Lane Storm Drain project. The Project installed close to 1,300 feet of 60- inch reinforced concrete storm drain pipe (RCP). This new system works in addition to the combined pre-existing 48-inch corrugated metal pipe/open channel system that reached its capacity and overflowed during significant storm events in the course of the winter of 2005/2006. In May 2016, the City Council awarded the construction contract of this project to Bay Cities Paving & Grading, Inc. in the amount of $2,298,827. Seventy five percent (75%) of the construction cost was funded by the Federal Emergency Management 4
5 (FEMA), the remaining twenty five percent (25 %) was split between the City of Orinda and EBMUD. No new proposals were submitted in 2016 by citizens under the Neighborhood Initiated Road Repair Policy [Exhibit 3]. There was one request by a citizen to accelerate the repair of Ichabod Lane ahead of others but the CIOC determined that re-prioritization was not necessary. Several citizens reported workmanship issues by our contractors, which staff continues to address as warranty-related repairs and/or corrections. In 2016 the City Council directed the CIOC to update the Road and Drainage Repairs Plan to reflect the additional funds voted on and approved by the citizens. That work is ongoing and will be presented as a separate agenda item. On June 7, 2016 the citizens of Orinda voted on and approved a second bond measure, 2016 Measure L, that will, along with the previous 2012 Measures L and 2014 J, provide most of the funds needed to repair our Residential roads. With the additional funds from 2016 Measure L, the CIOC and staff decided that a longrange plan is needed to make the most efficient use of available funds and to accelerate the program overall. Road repair lists for 2018 and 2019 are provided as Exhibits 5 and 6, respectively. The long-range planning indicates that there is a small projected cost saving based on the current Road and Drainage Repairs Plan funding proposal. The projected cost saving is due to receiving favorable construction bids for the 2015 & 2016 accelerated paving program. The construction bids were lower than the engineer s cost estimate for the following two reasons: 1) A drop in oil prices which ultimately lowered the asphalt cost for the past few years; 2) An overall reduction in unit bid prices due to the expanded 2015 & 2016 paving projects. Currently, there are plans to have another bond measure request before the Orinda voters in 2018 for $22 million. This may be reduced based on the construction bid cost for the 2017 paving project or additional funds can be allocated toward much needed drainage improvements. Alternatively, a funding plan can be developed to address both the remaining one-time fund request along with long term on-going maintenance funding needs. The CIOC, in conjunction with the City s communication staff, continues to contribute articles giving updates on road projects and improvements to help ensure that the public is well informed. With the development of the new City website, staff and the CIOC recommended posting all of the reports, maps, charts, and lists as they are approved. Based on the current projections, the City is anticipating rehabilitating all Residential roads by the end of 2019, after which, the system-wide average PCI will be 88. This will be considered one of the best ratings in the entire Bay Area. These projections could change if asphalt and construction prices rise in the next few years. The City will still need additional funding to rehabilitate all the Arterial and Collector roads, address more drainage repairs, and to meet the overall program goal 5
6 of system-wide average of 70 or greater with no individual road of less than 50. The sinkhole on Miner Road shines a light on the necessity to emphasize drainage rehabilitation work as quickly as possible. Staff has been providing survey information on the condition of many of the drains and culverts and has been asked to continue that work so the CIOC can be confident in the selection and bid process. The Commission continues to welcome participation by Orinda citizens in its meetings and would like to thank everyone who has taken their time to attend and offer their input and suggestions. It is especially valuable to hear of oversights and safety concerns. 7 Exhibit 1 City of Orinda Pavement Management Program (PMP) Policy and Criteria for Selecting Streets for Repair Adopted October 18, 2011 Policy: Current budgetary constraints and the poor and deteriorating condition of Orinda s roads require the City to apply budgeted PMP funds only to those roads where the most benefit for the most residents can be obtained. Simply stated, this means that only Arterials, Collectors and School Routes will have repair priority; emergency repairs will be made to Residential streets only when severe safety concerns arise. Recognizing that urgent/emergency repairs on Residential streets will increase under this policy, the City should also allow for certain urgent repairs to be performed on all street classifications including residential streets that meet specific criteria. Criteria for Priority Selection of Arterials and Collectors 1. Frequency of use, as measured by Average Annual Daily Traffic (AADT) 2. Efficiency of expenditure, as measured by the StreetSaver program 3. Availability of significant cost savings through partnering, (i.e., with utilities and/or residents) 4. Proximity to schools Criteria for Urgent Pavement Repair Selection on Arterial, Collector and Residential City of Orinda staff should consider and evaluate pavement condition/damage relative to: 1. Safety - Pedestrian, Bicycle, and Vehicle More Frequent Accidents Increased Stopping Distance Hazard Avoidance Emergency Vehicle Access 2. Evaluation of Failure and Estimation of Repair Cost/Repair Life
8 Size of the failed area (larger than a pothole) and severity of the failure (i.e. base failure) Related Drainage Issue Weakened Sub-grade Underground Springs Exclude Geotechnical Recommendations of Slide Repairs (Separate Slope Stabilization Fund Source) 3. The Citizens Infrastructure Oversight Commission (CIOC) shall review and approve the recommended repair locations.
9 Exhibit 2 City of Orinda Pavement Management Program (PMP) Policy and Criteria for Selecting Streets for Repair Using Measure L Sales Tax Funds and Measure J Bond Funds Approved September 2, 2014 Policy With the adoption of the Measure L,.5% Sales tax and the Measure J Bonds, the City has an additional source of funds for road repair and reconstruction. Measure L and Measure J represent the first and second phased of a multi-year plan to repair all of the City s streets. Even with this additional funding, current budgetary constraints and the poor and deteriorating condition of Orinda s roads require the City to apply budgeted funds first to those residential roads where the most benefit for the most residents can be obtained. With the Measure L and J funds the City has committed to make repair of the worst residential roads a priority as outlined in the Road and Drainage Repairs Plan approved by the City Council on April 22, The goal of this program is to distribute the road repair funds throughout the City over the course of a two year funding cycle. The Program Annually, funds permitting, roads to be repaired will be selected as follows: 1. The street segments must be classified as residential. 2. The street segments must be among the worst residential roads, which means the Pavement Condition Index (PCI) for that segment of road as calculated by the StreetSaver program is less than or equal to 25, and with ride quality (roughness of ride) considered using an acceptable objective measure. 3. The most heavily used residential road segments, based on actual traffic counts, will be repaired first. The road segments will be ranked in descending order of traffic volume, with the highest volume road segments forming a pool of candidate roads for the annual program. 4. Other factors, such as safety, important drainage work under roads, cost efficiency of repairing contiguous road segments and underground utility repair schedules, will be considered in selecting the annual list of road segments to be repaired.
10 August 5, 2010 City of Orinda Neighborhood Initiated Road Repair Policy Policy: It is the policy of the City of Orinda (City) to allow and provide support to neighborhoods that wish to voluntarily undertake the repair of neighborhood roads in a partnership with the City. Under this policy the City facilitates road repair projects that are funded by neighborhoods and repaired to City standards. The intent of this policy is to encourage funding that does not require the establishment of special assessment or tax districts. This is a pilot program and refinements to the policy may be necessary as experience is gained with actual projects. Requirements and Criteria: As required by state law, the City will be solely responsible for project design and construction contracting and management. As used in this policy, neighborhood means a group of Orinda residents and property owners with a common interest in one or more specific road repair projects who have agreed among themselves to raise funds necessary for those repairs and to work with the City in accordance with this policy. It is the responsibility of the neighborhood to raise the necessary funds and manage all related fund accounting, investment, and other matters prior to deposit of funds with the City. When funds are deposited, City will hold funds in a restricted account that may be used only for the neighborhood s road repair project. After City determines that proposed repairs are feasible and the neighborhood has raised half of the funds estimated to be required for the repair, the neighborhood, through its designated representative, and City will enter into an agreement defining the scope of the project and the responsibilities of each party. The agreement will be reviewed by the Citizens Infrastructure Oversight Commission (CIOC) and a recommendation made to the City Council. The CIOC recommendation will be reviewed and acted upon by the City Council. The City will work with the neighborhood to define the scope of work for each project and prepare a project cost estimate. o The City will review and approve the scope of the project (work to be performed, location of begin and end points) o The City will prepare a Preliminary Cost Estimate to be used by the neighborhood to determine project feasibility and for initial fund
11 raising. The Preliminary Cost Estimate will include design and construction engineering and construction. o Once an agreement between the City and the neighborhood has been reviewed by the CIOC and entered into by the City Council, the City will have final design drawings and an Engineer s Estimate prepared and will prepare a Pre-Bid Cost Estimate. The Pre-Bid Cost Estimate will include design engineering, construction engineering and construction cost based on the Engineer s Estimate. The neighborhood will be required to raise 110% of the Pre-Bid Cost Estimate. Project costs will be shared as follows: o The City will be responsible for preparing Preliminary, Pre-Bid and Pre-Award Cost estimates and construction contract administration. o The Neighborhood will be responsible for project cost as defined by the Pre-Award Cost Estimate. o The City will seek bids for the construction of the project. Following an analysis of the bids received the City will prepare a Pre-Award Cost Estimate that will include the actual cost of design engineering, the construction cost as determined by the bid and an estimate of the construction engineering. o Should the Pre-Award Cost Estimate exceed the Pre-Bid Cost Estimate the City will cover the difference between the two estimates up to 120% of the Pre-Bid Estimated Cost. o If the Pre-Award Cost Estimate exceeds the Pre-Bid Cost Estimate by more than 120% the City will work with the neighborhood to revise the scope of the project or re-bid the project. Projects will be handled on a first come, first serve basis. All projects will be carried out in accordance with City, state, and federal law. Any conflict between those laws and this policy will be resolved in favor of the applicable law. Process: 1. Neighborhood submits letter to the Director of Public Works and Engineering Services requesting that the neighborhood pay for road repair work in accordance with this Policy. The letter should identify who the group is, who the spokesperson will be, how the funds will be managed and what repair work the neighborhood wants the City to undertake. 2. City will review the proposed project location and scope and if the project appears feasible, prepare a Preliminary Estimate of the project cost. The Preliminary Estimate will be given to the group for use in raising the necessary funds. The Preliminary Estimate will include the cost of design engineering, construction engineering and construction. Should the
12 estimated cost be greater than the neighborhood s ability to fund, the City will work with the neighborhood on a revised project scope if feasible. 3. Once the neighborhood provides proof that 50% of the Preliminary Estimate projects funds have been raised, the City will enter into an agreement with the neighborhood group. These funds will then be placed on deposit with the City and the City will initiate final design and estimation work. 4. The City will prepare a final design, Engineer s Estimate, and Pre-Bid Cost Estimate, typically within 60 days of the deposit of funds or within an alternate timeframe specified in the agreement with the neighborhood. 5. Neighborhood will raise the remaining project funds (based on the Pre-Bid Cost Estimate) within six months and, when sufficient funds have been collected, deposit the total remaining project funds (110% of the Pre-Bid Cost Estimate), with the City. Should the neighborhood take longer than 6 months, the neighborhood will deposit with the City sufficient funds to prepare an update of the Engineer s Estimate of project cost and the City will adjust the Pre-Bid Cost Estimate as needed. 6. Once all project funds have been deposited, the City will bid the project as described above and the work will be performed. 7. At project completion the City will return any unused funds to the neighborhood s designated representative. Definitions: Neighborhood - a group of Orinda residents and property owners with a common interest in one or more specific road repair projects who have agreed among themselves to raise funds necessary for those repairs and to work with the City in accordance with this policy. Preliminary Cost Estimate A project estimate that includes the costs of design and construction engineering and an initial rough estimate of the cost of construction. The purpose of this estimate is to give the neighborhood an initial idea of cost for their project. Engineer s Estimate A project construction cost estimate prepared by the design consultant at the completion of the final design for the project. Pre-Bid Cost Estimate A project estimate that includes design engineering, construction engineering and construction cost based on the Engineer s Estimate. The purpose of this estimate is to define the amount of money that the neighborhood will need to raise. Pre-Award Cost Estimate A project estimate that includes the actual cost of design engineering, the construction cost as determined by the actual bid and an estimate of the construction engineering.
