4 APOLLO 60 TRUNKING SYSTEM Optional anti-microbial protection available Marco s Apollo 60 trunking system has been designed for use in power and high density structured cabling systems, such as CAT5E, CAT6, CAT7, Shielded and the new CAT6A 10 gig solution. The Apollo 60 s unique top opening lid allows power cables to be installed easily and speedily. Should additional power cable wiring space be required further capacity can be obtained using the optional clip-in divider. A 50mm minimum bend radius is provided for all Marco Apollo 60 data fittings including flat angles, tees, internal and external angles. All cables can be laid into place avoiding the need to thread cables through apertures, thus ensuring that all of the Marco fittings are easy to install and to wire. An optional steel screen is available which spans the width of the data compartment. (BSEN ) MT60 Apollo 60 meets and exceeds the requirements for ANSI/TIA/EIA 568B, ISO/IEC 11801(ED 2.0) and Cenelec (BSEN ) standards. 200mm 21.5 mm 80mm 67.5mm 60mm 190mm KEY DESIGN FEATURES The unique top lid clips on easily allowing for fast power cable installation, thus removing the need to insert cables from underneath. A shelf can be added to the trunking to allow for additional power cable capacity. All lids are rigidly supported and easily snapped into place. All bends maintain the strict 50mm radius required for data cables to conform to the necessary standards. The data compartment can accommodate over 60 Cat-6 data cables, or over 100 Cat-5e. 63mm The outlet box compartment can support 25mm, 35mm and the new 50mm deep socket mounting boxes. The four-compartment Apollo trunking provides two large centre sections, ideal for applications where larger cabling needs exist. Marco Apollo trunking has several benefits for the contractor which will help keep installation times and costs to a minimum. The outer compartments have been specifically created to provide maximum capacity for data cables. The Marco socket boxes are designed to make installation of accessories quick and easy. They are available in two sizes, the standard 35mm deep version, and a 25mm deep version which is available for applications that require more wiring space. 10 MARCO POWER POLE & POST NEW Also available in White Powder Coated Finish Power Pole The double sided Marco power pole has the benefit of a strong aluminium profile designed to retain its rigidity in all installation situations. The length of the power pole can easily be modified on site and a height-adjusting locking mechanism is supplied. The pole benefits from 35mm deep accessory boxes for quick and easy installation of accessories. A 1 metre aluminium power pole extension is available, and Marco can supply power poles up to 5 metres in length, normally from stock. Each Marco power pole is supplied with six accessory boxes, ceiling shroud, floor boot, accessory spacers to help speed installation, and six metres of upvc divider. Power Post The double sided Marco power post is used in much the same way as the power pole, but transfers wiring up from the floor, rather than down from the ceiling. MTPP1 - Power Post Double Sided It is able to conceal wiring effectively and to conveniently position sockets, which is of particular benefit in offices and other application areas. Marco power posts have a metal plate on the underside which is fixed securely to the floor, and a strong steel rod that extends from the plate through to the top of the post to give the product added strength. If the Buyer fails to pay the invoice by the due date and without prejudice to any rights of the Seller, the Buyer shall: forfeit any discount given in that invoice or in any other way agreed; and pay interest on any overdue amount from the date on which payment was due to the date of actual payment (whether before or after judgement) on a daily basis at a rate of interest 3% over the base from the time quoted by the Bank and reimburse to the Seller all costs and expenses (including legal costs) incurred in the collection of any overdue amount The Buyer shall make all payments due under the Contract without any deduction whether by way of set-off, counterclaim, abatement or otherwise unless it has a valid court order requiring an amount equal to such deduction to be paid Until the Seller is in possession of cleared funds, the Buyer shall not be deemed to have made a payment and until then the Buyer shall hold the Goods on a fiduciary basis as bailee for the Seller and the Buyer shall store the Goods at no cost to the Seller If the Buyer does not make payments as required, the Seller may terminate the Contract. The Buyer shall indemnify the Seller for any losses the Seller incurs in terminating the Contract including the value of the Goods the subject of the Contract. Normally the Buyer does not pay for the goods because he has become insolvent. Under that circumstance it is sometimes possible to recover the products from the Buyer The minimum cost of any order shall be no less than fifty pounds ( 50). The Seller shall not be responsible for carriage of any Goods costing less than two hundred pounds ( 200) 7. QUALITY 7.1. If the Seller is not the manufacturer of the Goods, ( it) shall transfer the benefit of any warranty or guarantee that it has been given The Buyer accepts that it buys or is deemed to buy the Goods as seen and in the condition they are at the time the order is placed. 8. LIMITATION OF LIABILITY 8.1. The Seller shall not have any liability to the Buyer for any loss or damage of any nature arising from any breach of any express or implied warranty or condition or term of the Contract or these Conditions as may be amended from time to time or any negligence, breach of statutory or other duty on the part of the Seller or in any other way out of or in connection with the performance or purported performance of or failure to perform the contract except: for death or personal injury resulting from the Seller s negligence; and as expressly stated in these conditions The Seller shall not be liable for any defect arising from any design or specification provided or made by the Seller or if any adjustments, alterations or other work has been done to the Goods by any person except the Seller or its authorised agent The Seller shall not be liable where any Goods are lost or damaged in transit. Any claims by the Buyer may be made against the agent, third party or representative acting as the carrier All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by sections 12, 13, 14 or 15 of the Sale of Goods Act 1979) are, to the fullest extent permitted by law, excluded from the Contract In the event of any breach of these Conditions or any Contract by the Seller the remedies of the Buyer shall be limited to damages and under no circumstances shall the liability of the Seller exceed the price of the Goods The Seller shall not be liable for any consequential loss or indirect loss (including but not limited to loss of profits, contracts, damage to property of the Buyer or any third party) suffered by the Buyer arising from any breach of a duty in contract or tort or in any other way including the Seller's negligence. 9. CANCELLATION The Seller may cancel a contract at any time before the Goods are delivered by giving written notice. On giving such notice the Seller shall promptly repay to the Buyer any sums paid in respect of the contract price. The Seller shall not be liable for any loss or damage whatever arising from such cancellation. No cancellation of the whole or any part of any order by the Buyer is permitted except where expressly agreed in writing by an authorised officer of the Seller and on terms which will indemnify the Seller against any loss incurred. Where the Goods are returned by the Buyer without the Seller's consent other than under the provisions of these Terms and Conditions they will not be accepted for credit. 10. INTELLECTUAL PROPERTY Unless otherwise agreed in writing by an authorised officer of the Seller all goods sold in retail packaging may be resold by the Buyer only in the packaging supplied by the Seller and in no case may any trade mark other than those applied by the Seller be marked on or applied in relation to the Goods. No right or licence is granted under this contract of sale to the Buyer under any patent, trade mark, copyright, registered design or other intellectual property right except the right to use the Goods. The specification[s] and design[s] of the Goods (including the copyright, design right or other intellectual property in them) shall as between the parties be the property of the Seller. Where any designs or specifications have been supplied by the Buyer for manufacture by or to the order of the Seller then the Buyer warrants that the use of those designs or specifications for the manufacture, processing, assembly or supply of the Goods shall not infringe the rights of any third party. 11. If the Buyer fails to make payment for the Goods in accordance with the Contract or commits any other breach of terms of these Conditions or Contract or if any distress or execution shall be levied upon any of the Buyer s goods or if the Buyer offers to make any arrangement with its creditors or if any petition in bankruptcy is presented against the Buyer or the Buyer is unable to pay its debts as they fall due or if being a limited company any resolution or petition to wind up the Buyer (other than for the purpose of amalgamation or reconstruction without insolvency) shall be passed or presented or if a receiver administrative receiver or manager shall be appointed over the whole or any part of the Buyer s business or assets or if any petition for the appointment of an administrator is presented against the Buyer or if the Buyer shall suffer any analogous proceedings under foreign law all sums outstanding in respect of the Goods shall become payable immediately. The Seller may in its absolute discretion cancel any discounts or special prices and revert to the price for any Goods ordered by the Buyers or in the Buyer s possession or control as set out in the list price. The Seller may in its absolute discretion and without prejudice to any other rights which it may have suspend all future deliveries of Goods to the Buyer and/or terminate the contract without liability upon its part and/or exercise any of its rights pursuant to clause these Terms and Conditions. 12. FORCE MAJEURE Neither party will be liable for any delay in performing or failure to perform any of its obligations under this agreement caused by events beyond its reasonable control ( Force Majeure Event ). However any delay or failure by a Sub-Contractor or supplier of the Buyer will not relieve the Buyer from liability for delay or failures except where that delay or failure is also beyond the reasonable control of the Sub-Contractor or supplier concerned. The party claiming the Force Majeure Event will promptly notify the other in writing of the reasons for the delay or stoppage (and the likely duration) and will take all reasonable steps to overcome the delay or stoppage. The party claiming the Force Majeure Event shall have its performance under this Agreement suspended for the period that the Force Majeure Event continues and the party will have an extension of time for performance which is reasonable and in any event equal to the period of delay or stoppage. Any costs arising from the delay or stoppage will be borne by the party incurring those costs. Either party may, if the delay or stoppage continues for more than 30 continuous days, terminate the contract with immediate effect on giving written notice to the other and neither party will be liable to the other for such termination. The party claiming the Force Majeure Event will take all necessary steps to bring that event to a close or to find a solution by which the contract may be performed despite the Force Majeure Event. 13. ASSIGNMENT The Buyer shall not assign, transfer, purport to assign or transfer any contract to which these Terms and Conditions apply or the benefit thereof to any other person whatsoever unless agreed in writing by an authorised officer of the Seller. 14. GENERAL Each right or remedy that the Seller and the Buyer has under these Conditions or any Contract is without prejudice to any other right or remedy that may exist In the event that any term of these Conditions or any provision of any Contract is declared by any judicial or other competent authority to be void, voidable, illegal, or otherwise unenforceable or if an indication to that effect is received by either the Buyer or the Seller from any competent authority, the Buyer and the Seller shall amend that term or provision in such reasonable manner as achieves the intention without illegality If the Seller or the Buyer: fails or delays to exercise any right or remedy, it shall not operate as a waiver of it; and partially exercises any right or remedy, neither of them shall be precluded from further exercising the right, remedy or other power Any waiver of a breach of any provision of the Contract shall not: be deemed to be a waiver of any subsequent breach or default; and affect the other terms of the Contract These Conditions and any Contract shall be governed by and construed in all respects in accordance with English law. In relation to any legal action or proceedings to enforce the contract or arising out of or in connection with these Conditions or any Contract, the Buyer and the Seller irrevocably submit to the jurisdiction of the English courts For the avoidance of doubt nothing contained in these conditions or any Contract shall confer on any third party any benefit or the right to enforce any term of these Conditions or any Contract. 15. NOTICE Any notice to be given under the Contract shall be: delivered personally; sent by first class prepaid recorded delivery or registered post; or by fax A notice shall be deemed and served as follows: if personally delivered, at the time of delivery; if posted, within 48 hours of posting or in the case of airmail seven days after the envelope was delivered into the custody of the postal authorities; and if sent by fax, the time of transmission. 27
