7 ITER Council and First Procurement signed On 28th November, ITER Director General Kaname Ikeda and Dr. Toshi Nagaoka, Director of International Affairs at the Japan Atomic Energy Agency (JAEA) signed the first Procurement Arrangement for the 25% superconductors of the 18 Toroidal Field (TF) Coils of the ITER machine symbolizing that the ITER Organization is moving on from designing to procuring. φ0.82mm Nb 3 Sn strand Spiral and Wrap Jacket Superconductor 1 4 m 28 Nov Status of JADA Takeo Nishitani

8 Procurement procedures - Contract Process (Bidding to Contract Award) JADA uses JAEA s (or JA s) contract procedure. 5 months are necessary for the contract process of large instruments. 9 Information for Discussion (1) 1. Procurement Rules JADA implements the procurement of ITER components in Japanese domestic market according to the WTO rule. The original procurement specification is issued in the Japanese language. 2. Contract Procedure and and Selection of Supplier JADA uses JAEA s (or JA s) contract procedure. The procurement is open to the public and supplier is selected by competition. 3. Qualification of Suppliers According to the provisions on Quality Assurance specified in the Management Specification and Technical Specification of Procurement Arrangement between IO and DA, JADA examines the qualification programme of supplier. 4. Intellectual Property Right For the procurement of components, JADA follows the provisions of the Annex on Information and Intellectual Property to the ITER Agreement. 9 Status of JADA Takeo Nishitani

10 Information for Discussion (2) 5. Liability JADA follows the provisions on Liability specified by the ITER Agreement and Procurement Arrangement between IO and JADA. 6. Possible Conflicts of Interests between Preliminary Engineering Studies and Future Work Packages Although the possibility of conflict of interests exists between preliminary engineering studies and manufacturing, it is rare to exclude the company who performed preliminary studies from the list of candidate suppliers for manufacturing in the past fusion development in Japan. The experience/results of preliminary design study and manufacturing R&D are taken into account for the selection of supplier. 7. Role of SMEs (Small an Medium-sized Enterprises) In the past fusion development in Japan, the prime contractor for the procurement is decided by the competition. The selection of subcontractor is left to the decision of prime contractor. 10 Status of JADA Takeo Nishitani
