(Patriot) was contracted to perform lead-based paint sample collection services for the site listed above. The structures surveyed included single-story to three-story commercial building structures. Seventy-six (76) paint chip samples were collected from various locations throughout the interior and exterior of the subject structures. The consumer products safety commission defines lead-based paint as any paint, varnish, lacquer, putty, plaster, or similar coating material, which contains lead or its compounds in excess of 600 ppm. FINDINGS The table above indicates that several painted surfaces throughout the subject structures contain lead. These sample results are indicative of all similar building components located throughout the surveyed structures. Ten (10) of the 76 paint chip samples were Page 6 of 5 Attachment 3A

7 determined to contain lead above 5,000 ppm. A complete copy of all laboratory data is provided as an attachment to this document. On the day the inspection was conducted the interior and exterior painted surfaces of the buildings were in good condition CONCLUSIONS / RECOMMENDATIONS Prior to demolition / renovation Patriot recommends that waste characterization sampling be conducted on all components that were determined to be above 5,000 ppm to establish the waste disposal requirements for these items. Physical removal of the components should only be conducted in accordance with Title 17, CCR, Division 1, Chapter 8: Accreditation, Certification, and Work Practices for Lead-Based Paint and Lead Hazards. It is important to note that lower concentrations of lead were detected on other components throughout the site structures (see lead-based paint summary data). Therefore, Patriot recommends that any contractor who would disturb any leadladen surfaces be notified of the hazard and their requirement to comply with the OSHA Lead in Construction Standard ( ) and Cal/OSHA CONSTRUCTION SAFETY ORDERS, LEAD SECTION , Title 8, California Code of Regulations (CCR), effective November 4, 1993 (revised March 7, 1997). All lead related construction work performed in the State of California must be in compliance with Title 17, CCR, Division 1, Chapter 8: Accreditation, Certification, and Work Practices for Lead-Based Paint and Lead Hazards. 39 Introduction: Lead Survey As requested, JLM Environmental surveyed painted surfaces and settled dust around windows of the interior of the community center and South wing at the subject property. This survey was performed for the purpose of risk assessment and prior to renovations activities that will disturbed the painted surfaces on and around the interior of the windows. This survey was performed by Mr. Jonathan Massey, a California State Department of Health Services Certified Lead Inspector/Assessor, # The lead sample results and locations are included as Table 1. The survey was performed in general compliance with the 1995 U.S. Department of Housing & Urban Development (HUD) Guideline for the evaluation and control of lead-based paint hazards in housing (1997 revised Chapter 7 of the HUD Guidelines) and the California Department of Health Services Title 17, California Code of Regulations, Division 1, Chapter 8: Accreditation, Certification and Work Practices for Lead-Based Paint and Health Hazards. This survey was performed by Mr. Jonathan Massey, a California State Department of Health Services Certified Lead Inspector/Assessor, # The survey was performed in general compliance with the 1995 U.S. Department of Housing & Urban Development (HUD) Guideline for the evaluation and control of lead-based paint hazards in housing (1997 revised Chapter 7 of the HUD Guidelines) and the California Department of Health Services Title 17, California Code of Regulations, Division 1, Chapter 8: Accreditation, Certification and Work Practices for Lead-Based Paint and Health Hazards. The survey was performed by x-ray fluorescence (XRF). A Niton XLp 300 series analyzer was utilized for the inspection and sampling method as required by HUD Guidelines and manufacturer instructions. The instrument was calibrated to the manufacturers specifications at the start of inspection and periodically every 4 hours as determined by the National Institute of Standards and Testing (NIST). The scope of this survey was to determine the lead content of various surfaces of building components for the following purposes: Provide the required information so proper abatement can be performed prior to building, renovation, remodeling, and/or demolition activities in order to minimize exposure of workers to airborne lead particulates, Identify the painted components/surfaces with lead content exceeding any regulatory hazard threshold, Identify any immediate response actions required due to the condition of lead-containing painted components/surfaces Provide the necessary regulatory compliance requirements for all above conditions as well as long term in-place management of lead-containing paints. Inspection Notes: Limited lead inspection of the subject property for the purpose of risk assessment. Survey was limited to paint and settled dust around the interior windows through the first floor, second floor, and south wing of the community center. Two story, community center and south wing. Children are included as occupants at the various areas throughout the subject property. Multiple locations throughout the subject property were found to have lead-based paint (LBP) in fair and poor condition on windows that are to be restored. Due to the LBP in poor condition in multiple areas, paint stabilization by a CDPH certified lead abatement contractor is recommended. Attachment 3B 2

40 During the course of future renovation/demolition activity precautionary measures should be implemented by the contractor in order to protect workers, general public, and the surrounding areas or land from lead contamination. At a minimum the general contractor should perform renovation/demolition activity in accordance with Cal-OSHA Lean In Construction Standard If applicable there may be other local, state, or federal laws not outlined in this report that might supersede the information or recommendations documented herein. Recommendations: In locations where lead contaminated dust on the floor along with poor condition LBP, it is recommended to initially perform a precleaning of the floors utilizing wet methods and HEPA vacuum. Once a visual inspection of the floors area has been completed, recommend to build containment 10 feet out from the windows under negative pressure. Recommend on the interior sides of the windows to remove all loose/flaking LPB by wet scraping and use of power tools with HEPA attachments. Following the removal, recommend to wet wipe and HEPA vacuum the work area within the containment. Encapsulate the interior of windows, trim and sill. In locations where intact LBP is found on the interior side of the windows, recommend to build a containment under negative pressure, 10 feet out from the windows. Recommend on the interior sides of the windows to remove all loose/flaking LPB by wet scraping and use of power tools with HEPA attachments. Following the removal, recommend to wet wipe and HEPA vacuum the work area within the containment. Encapsulate the interior of windows, trim and sill. In the senior living room and EOC room area, LBP and lead contaminated dust on the window sill was detected. Recommend to have a CDPH certified lead abatement contractor HEPA vacuum the carpet below the windows (prior to paint stabilization) and sign a liability release stating that contractor will clean the carpet to the best of their abilities. Build a containment under negative pressure, 10 feet out from the windows. Recommend on the interior sides of the windows to remove all loose/flaking LPB by wet scraping and use of power tools with HEPA attachments. Following the removal, recommend to wet wipe and HEPA vacuum the work area within the containment. Encapsulate the interior of windows, trim and sill. LAWS, REGULATIONS, APPLICABILITY, AND DEFINITION OF TERMS California Senate Bill 460 declares any building unsafe and in violation of the State Housing Law if that building contains a lead hazard resulting in lead exposure and endangering the health of the public and building occupants. Lead hazards are any deteriorated (poor condition) lead-based paint, lead-contaminated dust, lead-contaminated soil, and disturbing lead-based paint or presumed lead-based paint without containment. SB 460 provides local enforcement agencies the authority to issue orders to: Cease and desist performing any activities that create lead hazards; or abate/correct a lead hazard. Improper lead abatement can cause lead poisonings; the dust generated from such activities may contaminate personal items and property. Use caution and proper work practices. Abatement/correction requires the use of CA Department of Public Health (CDPH) lead certified contractors per Title 17 CCR, section (a)(1). Lead abatement/correction of LBP can be performed using the following three approaches: Use caution and proper work practices. OPTION A: This option will abate/eliminate the lead-based paint hazards or reduce them for a minimum of twenty years. Abatement options include: Removing lead-based paint from a surface and repainting the surface. Attachment 3B 3

41 Removing and replacing a component such as windows and doors Enclosing a surface with approved materials and methods such as paneling. Encapsulating a surface with an approved sealant. OPTION B: Stabilize paint using the following lead-safe work practices (17 CCR 36100): Wet scrap loose and peeling paint. Let dry and then encapsulate. Friction surfaces on doors and windows can be wet scraped to the substrate and repainted. Use Personal Protective Equipment (PPE) such as a half-face respirator labeled "recommended for lead paint removal" (Type N-100 Particulate) PPE must be cleaned or disposed of as necessary. Please note: lead-based stabilization requires ongoing monitoring and maintenance. OPTION C: If the child has a history of chewing on the painted surfaces, cover the painted surfaces by: Using materials such as a rigid plastic or thin paneling to cover walls or the lower half of doors Use rigid plastic or coil stock to cover windowsills and/or window troughs Use glue, adhesive or metal fasteners to secure covering materials Please note: if the paint condition is determined to be poor, perform stabilization prior to covering. The following methods of lead-based paint removal are prohibited by law: Open flame burning or torching (includes propane-fueled heat grids) Machine sanding or grinding without HEPA local vacuum exhaust tool Uncontained hydroblasting or high pressure wash Abrasive blasting or sandblasting without HEPA local vacuum exhaust tool Extensive dry scraping or sanding Heat guns operating above 1100 degrees Fahrenheit Excessive dry scraping or sanding Methylene chloride paint removal products Please see the attachment section of this report for additional and more detailed information on applicability of various lead regulations. Components coated with intact lead based paint do not pose a lead hazard to occupants. However, conditions can change over time and JLM Environmental recommends that the owner periodically inspect the lead positive components for damage. Moreover, the owner should possess an Operations and Maintenance Plan describing safe ways to minimize the likelihood of developing a lead hazard. Fair: Fair surfaces should be repaired but are not yet considered a lead hazard. Poor/Defective: Lead Based paint in poor condition (i.e. flaking or peeling) poses a lead hazard and should be corrected. Poor paint will continue to erode increasing the likelihood of lead dust or paint chips falling to the ground. At a minimum, poor surfaces should be stabilized by wet scraping or sanding and then be repainted. JLM Environmental recommends that the owner only retain a California Department of Public Health certified lead abatement worker or contractor supervisor to perform the wet sanding or scraping. Lead concentration(s) greater than 1.0 mg/cm 2 trigger compliance with HUD and EPA requirements for LBP abatement in public and residential structures and Cal/OSHA Lead Construction Standard requirements for all structures. However, 0.7 mg/cm 2 is the trigger compliance level as required by the Los Angeles County Department of Health Services (LACC Title 11, Chapter , Section C). Conclusions, Recommendations and Response Action Requirements The California Department of Health Services Title 17 CCR Division 1, Chapter 8, Section defines lead-based paint as paint or another surface coating that contains an amount of lead equal to or in excess of 5,000 PPM or more than. 1.0 mg/cm2 or 0.7 mg/cm2 in Los Angeles County. All materials tested were found below regulatory limits. No response actions required. LBP in Public & Building buildings and DLL in Los Angeles County Building premises must be maintained in good condition by the building owner at all times. In addition, under HUD's rule the visual inspection determines whether the area is clear of visible conditions that can result in exposure to lead-based paint hazards, such as deteriorated paint, chips or debris, and visible dust. Following visual inspection, a 12 inch by 12 inch area was marked to layout the sampling area. Fifty-one lead dust wipe samples were taken from the 1 st & 2 nd floor community center and South wing. Lead samples collected were analyzed by utilizing x-ray fluorescence (XRF). A Niton XLp 300 series analyzer was utilized for the inspection and sampling method as required by HUD Guidelines and manufacturer instructions. The instrument was calibrated to the manufacturer's specifications at the start of inspection and periodically every 4 hours as determined by the National Institute of Standards and Testing (NIST). These standards are measured in μg/ft 2 micrograms of lead per square foot (12 in. x 12 in.). The EPA hazard standards for dangerous levels of lead in settled dust are: The EPA & Cal/OSHA standards for dangerous levels of lead in dust are: Surface Standard (micrograms in a square foot-μg/ft 2 ) Floor (smooth or carpeted) 40 μg/ft 2 Window Sills (inside sill, also known as the stool ) 250 μg/ft 2 Window Wells 400 μg/ft 2 Unit-Wide Dust Lead Hazard: If the average floor, sill, or well dust lead levels are equal to or are greater than the standard, then dust lead levels are at dangerous levels in the house. Single Lead Dust Results Are Greater than the Lead Dust Standard: If any one floor, sill, or well sample result has dust lead that is equal to or greater than the standard, then you can show that lead dust levels could be considered a lead hazard in that room. The California Lead in Construction standard (Title 17, CCR, Div 1, Ch 8, Accreditation, Certification and Work Practices for Lead- Based Paint and Lead Hazards and SB 460, the Cal/OSHA Lead in Construction Standard) has its own separate set of standards for dangerous levels of lead in dust. These standards are measured in micrograms per square foot - μg/ft 2 for dust and parts per million - ppm for soil. 56 State Lead Dust and Soil Hazard Standards Lead Contaminated Dust - Dust on inside floors is lead-contaminated when there are 40 micrograms of lead per square foot of surface. On other horizontal surfaces inside, like window sills, the level is 250 micrograms per square foot. All outside levels are hazardous at 400 micrograms per square foot. Lead Contaminated Soil - Soil is lead-contaminated in play areas - or areas children are likely to be - when it contains 400 ppm of lead. In all other areas, soil is lead contaminated at 1000 ppm. Reasonable effort is made by JLM Environmental personnel to locate and sample all suspect materials. However, for any facility the existence of unique or concealed lead paint and debris is a possibility. In addition, sampling and laboratory analysis constraints typically hinder the investigation. JLM Environmental does not warrant, guarantee or profess to have the ability to locate or identify all lead paint in a facility. Confined spaces and areas determined by JLM Environmental personnel as unsafe to access, are excluded from the scope of work. JLM Environmental does not employ professional cost estimators. Statements of probable construction cost or cost estimates prepared by JLM Environmental represent JLM Environmental professional opinion of probable costs based upon current industry information. Actual costs may fluctuate due to several variables including, but not limited to, the time the work is performed, phasing, labor availability, quantity of work performed, product availability, specification requirements, and unforeseeable changes in the economy and lead regulations. JLM Environmental is not, and has no responsibility as a: generator, operator, treater, storer, transporter or disposer of hazardous materials or waste found or identified as a result of JLM Environmental work. JLM Environmental does not guarantee or warrant that the facility or workplace is safe, nor does JLM Environmental involvement in this property relieve the Client, building owner/operator or tenant of any continuing responsibility for providing safe facility or workplace.
