5 Change Your Mind Set - There is No Safe Level of Lead Lead is a neurotoxin Values assigned to safe lead levels whether it is in blood, in coatings, or in dust continue to decrease Poisoned, elevated, blood lead level of concern, reference value the goal is 0 µg/dl History of coatings and the definition of dangerous level of lead has similar history Loose paint (leaded or unleaded) can be a Sanitary Code violation Help your owners protect themselves and children living in their units. 9 Accessible, Mouthable Deleading Standard Nothing has changed: Lead-based paint, other coating, plaster or putty shall be abated on accessible, mouthable surfaces to a height of five feet, and four inches in from each edge, or such surfaces may be contained. Encapsulants applied to suitable accessible, mouthable surfaces must be applied to the entire surface, rather than only to a height of five feet and only four inches in from each edge. 9

10 Deleading Options VS Deleading Standards A Deleading Standard sets the minimum requirement. It is not meant to encourage or promote coating removal. Deleading Options include high risk coating removal, moderate risk removal and replacement, low risk covering and encapsulation. Which option is best depends on a lot of variables and will vary from home to home. 12 Friction Deleading Standard- New Standard: Lead-based paint, other coating, plaster or putty shall be abated on friction surfaces at all points of potential friction where the components meet Stair treads must be abated in their entirety to the wall or balusters, or such surfaces may be contained Friction surfaces may not be encapsulated 12

13 Loose Lead Hazards Nothing has changed: Regulatory definition -means paint, other coating, plaster or putty on a surface that is peeling, flaking, chipping, crumbling, cracking, deteriorated or damaged in any manner Field Guidance: When any layer of paint on the surface is coming away from another layer of paint or the substrate. Check by running your finger or top of a pen over the surface. If any paint falls record the surface as loose Be conservative 13

41 Door Jambs Door jambs without doors are not a friction hazard If doors are removed as a deleading method, then they must be replaced if It is a rental unit and the occupant is protected under MGL Ch. 93A The Sanitary Code requires it, e.g. bathrooms, and exterior doors If the door is not replaced, then the hinges must be removed and the holes and hinge area on the jamb must be repaired and finished (intact and filled), in a workmanlike fashion. 41

52 Grandfathering Properties Complied pre-1988 Minor Changes: Took out references to True PCADs because it s not practical and the old formatting too different 12B policy almost 30 years ago very small percentage of requests. Reminder: Documents issued pre-1988 need a grandfathering waiver/letter from CLPPP 52

54 PCADs/Grandfathering Rule Compliance Letters do not expire (except Interim Control) Properties where compliance is legitimate, deleading methods were appropriate, and the property has been maintained can remain under pre-2017 standards and are automatically grandfathered To verify this standard was met you must have the following: 1. The compliance letter with an address that is an exact match (or you have a mis-match address waiver in your hand) 2. LOFIC and Comprehensive Initial Inspection Report (no signs) 3. LOFDC s and the Final Deleading Reinspection Report documenting the appropriate deleading method for each and every surface. 54

55 PCADs/Grandfathering 2017 How to Assess True PCAD is visual using the report (deleading report or initial without hazards), to identify: 1. Loose paint (Pb, NA, Met, Masonry) Make intact 2. Damaged but appropriate Encapsulants or Coverings Repair 3. Missed components Test and bring to current standards 4. Inappropriate deleading methods; missing/incorrect reinspection information Bring to current standards 55

56 True PCAD Reminders (Refresher 2008, Refresher 2011): The first 3 steps in the process when conducting a True PCAD: 1. Collect past documents 2. Make copy of the re-inspection report and mark it with a red pen as the working copy 3. Using the red pen, audit the report in the field by checking off to make sure each component is identified and still in compliance 56

57 How to Assess Inappropriate Deleading methods - Encapsulants Failed encapsulants and Step-Up-Step Down, or inappropriate use Is the surface an A/M (sill, handrail, railing cap)or F (door, door jamb) hazard? 59 How to Assess and Record Damaged Encapsulants Localized failure (damage, small break due to an isolated impact) and no step up and step down, can be repaired on A/M surfaces (sill, handrail, railing cap). If not loose, circle the A/M with a note that the encapsulant needs to be repaired. If loose, circle A/M and L with note that surface needs to be made intact and then encapsulant repaired Field standard for Loose Surface must be reinspected and documented as intact before the encapsulant is re-applied. 59

63 Properties with Missing Documentation Missing Inspection/Reinspection Documentation: Cannot do a visual; the report is missing Because the reports identifying lead hazards and how they were deleaded are missing you must test We cannot accept inappropriate methods or drive-bys Previously dipped, scraped, or encapsulated surfaces may test positive Friction surfaces will have to be brought to current standards We err on the side of caution and identify the hazards Units with compliance documents or with compliance indicated in our database are still eligible for PCAD rules so long as the address is an exact match and waiver granted if needed 63

65 PCADs and Poisoned Children - No authorized person requirement within 30-days RRP licensed contractor for any unit where a contractor is hired and for all rental units After 30 days all deleading rules apply No change to 2017 grandfathering standards Pre 88 grandfathering has some deleading standard caveats if there is a poisoned child 65

69 Signs of Unauthorized Deleading (No prior history)- One and Done Signs: Scraped door edge Leaded door faces (both sides positive) and edge is negative Scraped Treads Negative inside the balusters and positive outside Unusual coverage/boxing still a sign for surfaces that are M/I, A/M, or F hazards 3 Strikes: Leaded door casings but negative jamb Leaded window trim (casings and apron) but negative sill Report must be submitted for Compliance Evaluation 69

70 Demarcation Lines and No Prior History Under the new protocol, you are not required to test side casings or shelves below 5 feet. You are required to find the dangerous level of lead, new testing protocol Complete the inspection according to new protocol and check off the box on cover indicating demarcation lines Delead lead hazards to current standards Units with no prior history and demarcation lines do NOT need to be submitted for compliance evaluation: The surfaces with the demarcation lines either do not meet the new definition of a lead hazard or will require more deleading It unlikely, that there would be demarcation lines and no new hazards especially on jambs, but if no hazards, get passing dust wipes, and call CLPPP 70

72 DES Conversions - After 3 years from issuance date, the owner can (not must) convert to an LOC: Requirements: 1. Addendum Full Inspection- new testing protocol 2. Current standards for lead hazards 3. Authorized People must be used 4. No new signs 5. Passing dust 6. Issue the LOC 72

74 Dust Not New But Added to Policy Extra dust, informational wipes that FAIL LOFDC s, COMC with work, or CORC s (and even RRP) you must re-wipe until passing wipes are achieved Initial (no signs) or COMC (no work) cannot require; however we strongly recommend that passing wipes be achieved to protect both the children and owner HUD Rules another meeting, but. 78 Dust Wipes and Loose Leaded Floors How many: Minimum of 7 samples/standard set You must take a sample on each sealed leaded floor (it may be part of the standard set (2 floors) or may be in addition if. If there is high/moderate risk in the interior of the unit and there are more than 7 rooms, then take an additional wipe for each additional 2 rooms In many situations, the rule for how many won t change; it s where you have to wipe. 78

79 Dust Wipes and Loose Leaded Floors Timing for Loose leaded common area floors: Sealed leaded common area floors can be sampled at reoccupancy reinspection or at the final deleading reinspection Failing wipes- floors must be cleaned and the re-wiped If common area floors fail at Reoccupancy, then the reoccupancy reinspection fails. Follow the rules. Floors must be cleaned, and re wiped Issue re-occupancy after passing wipes for the common area floors If taking at final deleading reinspection (and there was already dust at reocc.), then just take the wipe(s) on the sealed leaded floor(s) and a blank. 79

81 Dust Wipes and Unfinished Space Cement floors in basements or garages are not good places to take dust wipes For concerns about contamination, take the wipe on the floor or landing in the closest finished area. If it fails, counsel occupants on keeping children out of basements/garages and how to avoid tracking dust. 81

82 Re-painting Dipped and Stripped Components - Components with coatings that are chemically removed (stripped or dipped) can be dangerous. Must be reinspected bare (no film, no residue) Must be coated and then reinspected painted/sealed Reoccupancy after components are sealed and properly installed You can reinspect these components bare while other deleading work is on-going This is similar to the rule for windows taken out dipped, reinspected bare, and then reinstalled and reinspected Record reinspections as stp/sld or dip/sld 82

83 Pre 12/1/17 Initial Report w/o Deleading Owner s Options: 1. Delead using old report to current standards, the inspector will catch any mistakes at reinspection 2. Hire an inspector to do an addendum full inspection using new reports and testing protocol Hazard yes to hazards no, submit to CLPPP for compliance evaluation: Only UD, if there are new signs (door edge scraped, etc.) Take dust We ll note the database about discrepancy Issue the LOFIC 83

84 Thirty Day Grace Period Active Deleading Properties that are in the process of deleading when the regulations change may delead to either pre-dec. 1 standards or new standards if: Deleading notification must show deleading began before December 1, 2017 Compliance must be obtained before January 1, Inspector must note on coversheet of the report if pre- Dec. 1 standards were used. It is fine to delead to the new standards now, but compliance can t be issued until 12/1/17. Can come under IC and delead the frictions liability protection and no need to relocate twice. 84

85 Units with a Partial Deleading Piece-meal Deleading/Reoccupancy, and Interim Control In all of these instances lead hazards were identified and full deleading compliance was not achieved. Grandfathering rules do not apply. So long as the unit passes a final deleading reinspection by January 1, 2018, the owner can decide, which standard to use: There are many variables that affect which standard will require less deleading If most of the interior hazards were already deleaded, and the exterior doesn t have a lot of hazards, then the old standard may be less expensive If the exterior has a lot of accessible, mouthable components then the new standard may be less expensive The chosen standard must be applied to the entire unit (inside commons, exterior) 85
