1 1 ORDNANCE 17, AN ORDNANCE OF THE CTY COUNCL OF THE CTY OF PALM 5 BEACH GARDENS, FLORDA REGARDNG APPLCATON TO 6 ESTABLSH THE AVENR PLANNED COMMUNTY DEVELOPMENT 7 ( PCD) COMMUNTY DEVELOPMENT DSTRCT ( CDD), 8 CONSSTNG OF APPROXMATELY ACRES OF LAND 9 LOCATED APPROXMATELY ONE ( 1) MLE EAST OF PRATT- 10 WHTNEY ROAD ON THE NORTH SDE OF NORTHLAKE 11 BOULEVARD; MAKNG FNDNGS OF FACT REGARDNG THE 12 PETTON; ESTABLSHNG AND NAMNG THE AVENR 13 COMMUNTY DEVELOPMENT DSTRCT; DESCRBNG THE 14 BOUNDARES OF THE DSTRCT; NAMNG THE FVE (5) PERSONS 15 DESGNATED TO BE THE NTAL MEMBERS OF THE BOARD OF 16 SUPERVSORS; PROVDNG CONSENT FOR THE EXERCSE OF 17 CERTAN POWERS; PROVDNG A CONFLCTS CLAUSE, A 18 SEVERABLTY CLAUSE, AND AUTHORTY TO CODFY; 19 PROVDNG AN EFFECTVE DATE; AND FOR OTHER PURPOSES WHEREAS, the Florida Legislature enacted and amended Chapter 190, Florida 23 Statutes, to provide an alternative method to finance and manage basic services for 24 community development; and WHEREAS, a Petition (the "Petition ") to establish Avenir Community Development 27 District ( the " District") pursuant to Chapter 190, Florida Statutes, was submitted to the 28 City of Palm Beach Gardens, Florida (the "City") by Avenir Holdings, LLC, a Florida limited 29 liability company, on September 27, 2016; and WHEREAS, the proposed District comprises approximately two thousand four 32 hundred twenty-seven and one-half (2,427.5) acres, all located within the City; and WHEREAS, pursuant to Section (1)(d), Florida Statutes, notice of the 35 public hearing on the Petition to establish the proposed District was published in the Palm 36 Beach Post once a week for four (4) consecutive weeks prior to the hearing ; and WHEREAS, the City Council held a public hearing on the Petition to establish the 39 District on January 5, 2017 ; and WHEREAS, pursuant to Section 18-1(3)(a) of the City's Charter, notice of this 42 Ordinance was published in the Palm Beach Post at least fourteen ( 14) days prior to 43 adoption ; and Page 1 of 4

2 Ordinance 17, WHEREAS, the City Council, having considered the Petition and all information 2 presented at the public hearing 1 and being fully advised and informed of the premises, 3 has determined that it is in the best interest of the citizens of the City to approve the 4 Petition to establish the District and approve this Ordinance NOW, THEREFORE, BE T ORDANED BY THE CTY COUNCL OF THE CTY 8 OF PALM BEACH GARDENS, FLORDA that: 9 10 SECTON 1. The foregoing findings that are expressly set forth herein are 11 hereby adopted and made a part hereof SECTON 2. The City Council hereby makes the following additional findings of 14 fact: The property proposed to comprise the District consists of approximately two 17 thousand four hundred twenty-seven and one-half (2,427.5) acres, more or 18 less; lies entirely within the boundaries of the City; and is generally located 19 as identified on the location map attached hereto as Exhibit "A". A metes and 20 bounds description of the external boundaries of the proposed District is set 21 forth in the legal description attached hereto as Exhibit "B " The City Council has reviewed the Petition to establish the District and found 24 all the statements therein to be true and correct The establishment of the District is not inconsistent with any applicable 27 element or portion of the state comprehensive plan or the effective local 28 government comprehensive plan The District is of sufficient size, is sufficiently compact, and is sufficiently 31 contiguous to be developable as one functional, interrelated community and 32 as an independent special district The creation of the District is the best alternative available for delivering the 35 community development services and facilities set forth below to the area that 36 will be served by the District The community development services and facilities of the District will be 39 compatible with the capacity and uses of existing City and regional 40 community development services and facilities The area that will be served by the District is amenable to separate special 43 district government Page 2 of 4

The City Council hereby grants the Petition to establish and create 2 a community development district that shall be known as " Avenir Community 3 Development District." 4 5 SECTON 4. The external boundaries of the District shall be as depicted on 6 Exhibit "A" attached hereto and described in Exhibit "B" attached hereto. 7 8 SECTON 5. Pursuant to Section (2)(d), Florida Statutes, the charter for 9 the District shall consist of Sections through , Florida Statutes, inclusive SECTON 6. The five (5) persons designated to be the initial members of the 12 Board of Supervisors are as follows : David Serviansky 15 Rosa Eckstein Schechter 16 Eduardo Stern 17 E. Daniel Lopez 18 Virginia Cepero SECTON 7. As provided in Chapter 190, Florida Statutes, the District shall 21 have, subject to the regulatory jurisdiction and permitting authority of all applicable 22 governmental bodies, agencies, and districts having authority with respect to any area 23 included within the District, those special powers relating to public improvements and 24 community facilities authorized by Section , Florida Statutes SECTON 8. The City Council hereby consents to the exercise of and grants to 27 the District the powers set forth in Sections (2)(a), ( b) ( as to installation of fire 28 lines and hydrants only) and (d), Florida Statutes SECTON 9. All ordinances or parts of ordinances in conflict be and the same 31 are hereby repealed SECTON 10. n the event a court of competent jurisdiction shall hold or 34 determine that any part of this Ordinance is invalid or unconstitutional, the remainder of 35 the Ordinance shall not be affected thereby, and it will be presumed that the City Council 36 for the City of Palm Beach Gardens did not intend to enact such invalid or unconstitutional 37 provision. t shall further be assumed that the City Council would have adopted the 38 remainder of this Ordinance without said invalid and unconstitutional provision, thereby 39 causing said remainder to remain in full force and effect SECTON 11.
