WildernessWatchistheonlynationalnonprofitconservationorganization focusedsolelyontheprotectionofwildernessesthatarepartofthe NationalWildernessPreservationSystem(NWPS).Wehavemembersin everystateinthenation,includingcalifornia,andweworktoprotect WildernessesacrosstheentireUnitedStates.WildernessWatchengagesin awidevarietyofadvocacyefforts,includingcitizenengagement, legislation,andlitigation.wildernesswatchhasthestrongesttrackrecord ofsuccessfullylitigatingwildernessactcasesofanyconservation organizationinthenation. AsweunderstandfromtheNovember30 th letterfromyouroffice,the proposedactionincludesbuildingapproximately7.5milesofpermanent fuelbreakswithintheventanawilderness.theproposalenvisionstheuse ofchainsawswithinthewildernesstocut150 foot widefuelbreaks,and useofheavyequipmentforpilingofwoodymaterials,pileburning,and mastication. WildernessWatchisadamantlyopposedtothesepartsoftheForest Service(FS)proposal. Ourspecificcommentsfollow:
2 2 1.ProposalViolatesWildernessAct.TheForestServiceproposalwouldviolatethe WildernessAct,specificallythebansonmotorizedequipmentandvehiclesandthe requirementtomaintainuntrammeledwildernessmanagedsoastopreserveitsprimeval characterandinfluenceanditsnaturalconditions. TheWildernessAct,Section4(c)states: ExceptasspecificallyprovidedforinthisAct,andsubjecttoexistingprivaterights, thereshallbenocommercialenterpriseandnopermanentroadwithinany wildernessareadesignatedbythisactandexceptasnecessarytomeetminimum requirementsfortheadministrationoftheareaforthepurposeofthisact (includingmeasuresrequiredinemergenciesinvolvingthehealthandsafetyof personswithinthearea),thereshallbenotemporaryroad,nouseofmotor vehicles,motorizedequipmentormotorboats,nolandingofaircraft,noother formofmechanicaltransport,andnostructureorinstallationwithinanysuch areas.(emphasisadded) Inaddition,Section4(b)oftheWildernessActunambiguouslydirectstheFStopreserve thewildernesscharacteroftheventanawilderness: ExceptasotherwiseprovidedinthisAct,eachagencyadministeringanyarea designatedaswildernessshallberesponsibleforpreservingthewilderness characteroftheareaandshallsoadministersuchareaforsuchotherpurposesfor whichitmayhavebeenestablishedasalsotopreserveitswildernesscharacter. (emphasesadded) Furthermore,thedefinitionofWildernessinSection2(c)oftheWildernessActrequiresthe FStoprotecttheuntrammeledcharacteroftheVentanaWilderness: Awilderness,incontrastwiththoseareaswheremanandhisworksdominate thelandscape,isherebyrecognizedasanareawheretheearthanditscommunity oflifeareuntrammeledbyman,wheremanhimselfisavisitorwhodoesnot remain.anareaofwildernessisfurtherdefinedtomeaninthisactanareaof undevelopedfederallandretainingitsprimevalcharacterandinfluence,without permanentimprovementsorhumanhabitation,whichisprotectedandmanaged soastopreserveitsnaturalconditions. (emphasesadded) 2.SpecialProvisionsareAmbiguous.Thespecialprovisionsinthestatutesthatadded landstotheoriginalventanawildernessareconfusingandambiguous,anddonot constituteaclearauthorizationoftheproposedaction. In2002,forexample,Congressincludedthefollowinglanguageinthelawthataddedover 37,000acrestotheVentanaWilderness: (a)revisionofmanagementplans. TheSecretaryofAgricultureshall,bynot
3 laterthan1yearafterthedateoftheenactmentofthisact,amendthemanagement plansthatapplytoeachoftheventanawildernessandthesilverpeakwilderness, respectively,toauthorizetheforestsupervisorofthelospadresnationalforestto takewhateverappropriateactionsinsuchwildernessareasarenecessaryforfire preventionandwatershedprotectionconsistentwithwildernessvalues,including bestmanagementpracticesforfirepresuppressionandfiresuppressionmeasures andtechniques. P.L ,Sec.4(a)(emphasesadded) WildernessWatchbelievesthatthepresuppressionactivitiesproposedintheplanned action,thedevelopmentofpermanentfuelbreaksinthewilderness,andtheuseof chainsawsandmotorvehiclescannotbeaccomplished consistentwithwildernessvalues withoutdestroyingthosewildernessvalues. 3.SpecialProvisionsDon tauthorizechainsaws,permanentfirebreaks.thespecial provisionsinthestatutesthataddedlandstotheoriginalventanawildernessdonot authorizeuseofchainsawsorheavymotorvehicles,ordevelopingpermanentfirebreaksin Wilderness.TheFSsimplycannotusechainsawsormotorvehiclesintheVentana Wilderness,nordeveloppermanentfirebreaks. 4.SpecialProvisionsDon tmandateproposedaction.evenifthespecialprovisions wouldauthorizetheproposedaction,andwedon tbelievetheydo,thespecialprovisions don trequireormandatetheproposedactions. PublicLaw95 237,Section2(d),forexample,authorizestheForestServicetotake acceptablefirepresuppressionandfiresuppressionmeasuresandtechniques. ThislanguagedoesnotmandateorrequiretheForestServicetotakesuchsteps.The agencyhasdiscretionandlatitudeonthispoint.thefsshouldnotconducttheactionsas proposed,sincetheywilldegradethewildernesscharacteroftheventanawilderness. 5.TerriblePrecedent.Evenifthefirebreakswerejustified,andwedon tbelievethey are,thefswouldbesettingaterribleprecedentnotonlyforfuturemanagersofthe VentanaWildernessbutfortheentireNWPSbyauthorizingsuchextensiveuseof motorizedequipmentinwilderness.itwouldmakeiteasierforsubsequentfswilderness stewardstoauthorizemotorizedequipmentformaintainingthefirebreaks,andotherfs managersaroundthecountrycouldcitethisproposalasaprecedenttoconduct presuppressionactivitiesinotherwildernesses.ifthefscan tcarryouttheproposed activitywithouttheuseofmotorizedequipment,thentheagencyshouldn tdoitatall. 6.PresuppressionDoneOutsideWilderness.Presuppressionactivitiesshouldoccur outsidetheboundariesofthedesignatedventanawilderness,ratherthaninside Wilderness.Theemphasisshouldbeon fire proofing theprivatestructuresonprivate 3
4 landusingallthelatestresearchandmanagementtechniques,whichhaveproventobefar moreeffectiveatstructureprotectionthanhasmanipulatingtheforest. 7.Non NativeInvasiveSpecies.OnelikelyoutcomeoftheproposedactionisthattheFS willcreatea7.5 mile longcorridorofweedsinsidetheventanawildernessinthe firebreaksasnon nativeinvasivespeciesgainafootholdinthefirebreaks.thisresult mightwellrequiretheuseofherbicidestocontainoreliminatethesespecies,yetanother violationofwildernessvalues. 8.AppropriatenessofFireSuppression/Presuppression.TheFSshouldanalyze whetherfiresuppressionandpresuppressionarestillappropriateintheventana Wilderness.TheknowledgeabouttheecologicalroleoffireinWildernesshasgrown exponentiallysincethefirstspecialprovisionsforventanawerepassedin1978.the agency sunderstandingofthecostsandbenefitsoffightingfireinwildernessversus allowingwildernessfirestoburnhasalsoincreaseddramaticallysince1978.in2012,for example,whenthemandatecamefromthechief sofficetosuppressallfires,somelocalfs officialsallowedsomefirestoburninwildernessandtoallowfiretoplayitsnaturalrolein theecosystem.theagencymustre evaluatewhetherfirepreventionispossible, appropriate,desirable,orcost effectiveintheventanawilderness. 9.TheDraftEnvironmentalImpactStatement(DEIS)MustInclude: a.afullrangeofalternatives,includingatleastonewherepresuppressionactivities areconductedonlyoutsidedesignatedwilderness,andanalternativewherenochainsaw useisallowedinsidedesignatedwilderness. b.ananalysisofthenewestfsresearchthatshowsthemosteffectivemeansto fireproofhomesinawildland/urbaninterfaceistoremovethefuelsinimmediatevicinity ofhomes,notmilesaway,andto fireproof thestructuresviawraps,foam,sprinkler systems,useoffire resistantmaterials,etc. c.fullanalysisoftheimpactonwildernesscharacterandwildernessvaluesfrom theproposedaction,includingcumulativeimpactsofcreatingpermanentfirelinesin Wilderness. Outstandingopportunitiesforsolitude mustbeincludedasoneofthe wildernessvaluestobeanalyzed. d.fullanalysisofhowpermanentfirebreaksintheventanawildernessmightlead totheinvasionofnon nativeinvasivespeciesinthewildernessoraccessbymotorvehicles suchasatvsorotheroff roadvehicles. e.ananalysisofeachproposedfirelineandwhereitislocatedwithregardtothe originalventanawilderness,the1 st WildernessAddition,the2 nd Addition,etc. f.ananalysisofhowtheproposedactionistakingclimatechangeintoaccount.by mostestimates,fireswillbemorefrequentandintensewiththechangesnowunderway. Theanalysismuststudyhowclimatechangeaffectstheeffectivenessofthefirebreaks,how 4
5 oftenthefirebreakswillneedtobemaintained,andhowclimatechangealtersthe cost/benefitanalysisoffocusingonmanipulatingvegetationratherthanprotecting structures. g.ananalysisofwhetherfirepreventionandsuppressionareeitherpossibleor desirableinwilderness.
