1 ALAN ANDISON, CHAIR Alan Andison obtained a B.A. in History in 1974 from Simon Fraser University and a LL.B. in 1985 from UVIC. Mr. Andison was called to the Bar in Mr. Andison has experience in the areas of administrative, environmental, forestry and natural resources law. He has held a variety of positions with the BC public service including terms with the Office of the Ombudsman, the Human Rights Council and the Ministry of Environment, Lands and Parks. Mr. Andison was appointed Executive Director and General Counsel to the Environmental Appeal Board and the Forest Appeals Commission in He was appointed Chair of the Board and the Commission in 2000, and Chair of the Oil and Gas Appeal Tribunal in Mr. Andison is past Chair of the British Columbia, Circle of Chairs, is on the Executive for the British Columbia Council of Administrative Tribunals, and is a past member of the Executive of the Council of Canadian Administrative Tribunals. GABRIELLA LANG, VICE CHAIR Gabriella Lang is a retired Lawyer who practiced in Ontario, NWT, Yukon Territory and Oregon in both the public and private sectors. Her areas of practice included regulatory law with an emphasis in natural resources, administrative law, criminal and civil litigation. She also was involved in natural resources policy development and implementation. In the private sector her experience included corporate and contract law, including negotiating complex contracts for an international design build company and risk management. Ms. Lang has been a speaker at numerous continuous education seminars and public workshops. She was appointed as Vice-Chair of the Forest Appeals Commission in October ROBERT WICKETT, Q.C. VICE-CHAIR Robert Wickett holds both Bachelor of Commerce and Law degrees from the University of British Columbia. He was the Managing Partner of MacKenzie Fujisawa LLP from 2006 through May of 2011, and reassumed that role as of May Mr. Wickett is a Litigation Lawyer practicing primarily in the field of environmental and administrative law. He is the Author of and Continuing Editor of the waste management chapter of the due diligence desk book published by the Continuing Legal Education Society. Mr. Wickett was appointed as the Vice Chair of the Environmental Appeal Board in October of 2007 and is one of the Vice Chairs of the Forest Appeals Commission and the Oil and Gas Appeal Tribunal. TRIBUNAL MEMBERS MAUREEN BAIRD, Q.C. Maureen Baird holds both Bachelor of Commerce and Law degrees from the University of Toronto. She recently obtained a certificate in mediation at the Harvard Law School. She was called to the Bar in British Columbia in 1984 after a clerkship with the Chief Justice of British Columbia. Ms. Baird is also appointed as a legal member and chair of panels of the Mental Health Review Board and is a legal member of the Discipline Committee of the College of Physicians and Surgeons of BC. Ms. Baird is a litigation lawyer practicing primarily in the field of administrative law. She advises professional regulatory bodies on governance, discipline and credential matters and bylaw amendment. She frequently is asked to provide training to tribunal members. She is co-author of a chapter of the Administrative Law Manual and a frequent speaker at continuing legal education 1
2 programs. She has been Chair of the Administrative Law Section of the Canadian Bar Association (both nationally and the BC Branch). LORNE RICHARD BORGAL Lorne Borgal is the past President and Chief Executive Officer of Hudson Bay Mount Resort Inc. Previously he was the President and Chief Operating Officer for Group Incorporated and the Chief Executive Officer for Whistler Mountain Ski Corporation. Active in his community he serves as Member of the Health Professions Review Board. In the past, Mr. Borgal was the Chairman and Director of the Whistler Resort Association, and the past President and Director Whistler Chamber of Commerce. Mr. Borgal holds his Bachelor of Science from University of British Columbia, and his Master of Business Administration from Stanford Graduate School of Business. MONICA DANON-SCHAFFER Monica Danon-Schaffer earned her PhD in Chemical and Biological Engineering (UBC), M. Eng. in Civil/Environmental Engineering (UBC), and her B.Sc. Chemical Engineering (Universidad Iberoamericana). With over 28 years of experience, she is a registered P. Eng. in various provinces and territories across Canada, as well as Mexico, and has extensive experience dealing with environmental, social and geologic challenges of the Arctic. Her expertise covers mine site and oil and gas investigations, chemicals management, and regulatory policy analysis. Dr. Danon-Schaffer has acted as QP on numerous N technical reports on a variety of projects/commodities. She has worked in Argentina, Bolivia, Brazil, Chile, Colombia, Ecuador, Kazakhstan, Mexico, Peru, Spain, Venezuela, and the U.S.. In her capacity as a chemical engineer, she has specialized in assessments of environmental and compliance and liabilities, and has experience conducting due diligence, compliance and waste audits, impact assessments, site remediation, environmental forensic investigations, and project management on local and international projects throughout the Americas. Monica has more than 20 years of experience leading and directing site-wide environmental monitoring program, including water and soil sampling, environmental monitoring, and environmental data management. Dr. Danon-Schaffer is fully bilingual in English and Spanish, with working knowledge of French and Portuguese. In addition, she is a lead environmental auditor. CINDY DERKAZ Cindy Derkaz graduated with a Bachelor of Laws from UBC in 1978 and practiced corporate, real estate and estate law in Salmon Arm until retiring in Ms. Derkaz was first appointed to the Environmental Appeal Board in 1997 and served until 2007, including as Vice Chair from She was re-appointed to the Environmental Appeal Board, Forest Appeals Commission and Oil and Gas Appeal Tribunal in Ms. Derkaz is an active volunteer in the Shuswap including 18 years with Shuswap Community Foundation as a Founding Member, President for 12 years, and Member of the Fund Development Committee. BRENDA L. EDWARDS Brenda Edwards is a Senior Lawyer and part time Judicial Officer with the Provincial Court of British Columbia with a background as a public sector leader and educator and extensive experience in the executive and judicial branches of government and in working with the public. Ms. Edwards is also a member of the Health Professions Review Board. Active in her community, 2
3 she serves as Member of the Board for the Restorative Justice Society (Victoria), Member of the Advisory Committee to Legal Services Society regarding Gladue Reports, and Member of the Equality and Diversity Committee and Women Lawyers Forum (Mentoring Committee) for the British Columbia Bar Association. Previously, Ms. Edwards has served as Member of the Access to Legal Services Advisory Committee for the Law Society of British Columbia, President of the Victoria Youth Empowerment Society, and Director and Treasurer for the Victoria Society for Educational Alternatives. LES GYUG Les Gyug holds a Bachelor of Science in Biology (Honours) from Carleton University and a Master of Science in Zoology from the University of Western Ontario. He has been a self-employed Biologist with Okanagan Wildlife Consulting since Previously, he was a Wildlife Technician and Biologist with the Canadian Wildlife Service and Keystone Wildlife Research, and a Seasonal Park Interpreter with Parks Canada. He is currently Chair of the Environmental Advisory Commission of the Central Okanagan Regional District. JEFFREY HAND Jeffrey Hand has been a practicing lawyer and member of the Law Society of British Columbia since He is the Managing Partner at Singleton Urquhart, Legal Counsel. Mr. Hand has appeared at all levels of Court in the Province of British Columbia and has had extensive involvement in mediations and arbitrations. Mr. Hand has a broad range of experience in resolving a variety of commercial disputes, with particular emphasis on construction related claims and professional liability matters. His practice also includes resolving insurance coverage disputes and claims involving property damage, bodily injury, work place injuries, liability insurance, marine claims and product liability matters. As a trained Mediator and Chartered Arbitrator, Mr. Hand is a roster member of the British Columbia Arbitration and Mediation Institute and a Chartered Arbitrator of the ADR Institute of Canada. He is also a member of the CDRS, International Panel of Construction ADR Specialists, an organization that provides mediation and arbitration services to the construction industry. Mr. Hand is also on the mediation Roster for WorkSafe BC disputes. Mr. Hand has written and lectured on the topic of alternative dispute resolution and is an Adjunct Professor at the University of British Columbia, Faculty of Law where he lectures on alternative dispute resolution and on construction law matters. ROBERT (BOB) GORDON HOLTBY Bob Holtby holds a Bachelor of Science in Agriculture in Farm Management and a Master of Science in Agricultural Economics from the University of British Columbia, and is a Professional Agrologist. He is the Principal of Regency Consultants Ltd., a private practice providing land use management studies, marketing studies, policy analysis, and expert witnesses in litigation on agricultural issues. Previously, Mr. Holtby was a sessional Instructor at the University of Northern British Columbia, the College of New Caledonia, and the City University, as well as a District Agriculturist. Mr. Holtby is a former President of the Prince George Chamber of Commerce and the Salmon Arm Bay Nature Enhancement Society. KENT JINGFORS Kent Jingfors is an environmental consultant. He was the Regional Programme Coordinator for the International Union for Conservation of Nature (IUCN) Asia and the Director of the Yukon Fish and 3
4 Wildlife Branch for the Yukon Environment Department. He was also the Chief Technical Advisor and Director of the Biodiversity Unit for IUCN Pakistan and a wildlife ecologist for BC Parks. He holds his Master of Science in Wildlife Management from the University of Alaska, his Bachelor of Science (Honours) in Wildlife Management and his diploma in Field Biology from the College of the Samis in Sweden. DARRELL LEHOUILLIER Darrell LeHouillier is the vice chair for the Workers Compensation Appeal Tribunal. Previously, he was a workers' adviser for the Workers Advisers Office, a branch of the Ministry of Labour, Citizens Services and Open Government. Prior to that venture, Mr. LeHouillier worked as a lawyer in areas pertaining to administrative law, litigation, and solicitor's work. His working experience also includes serving as an environmental assistant for Golder Associates, an environmental engineering consulting firm. Mr. LeHouillier holds his Bachelor of Applied Science degree from Queen s University and his Bachelor of Law degree from the University of British Columbia. JAMES S. MATTISON James Mattison holds a Bachelor of Applied Science degree from the University of British Columbia and a Master of Natural Resources Management degree from Simon Fraser University. He has been a registered Professional Engineer in British Columbia since Mr. Mattison worked in the road construction industry in BC and did volunteer work in Africa before joining the BC civil service. He spent 25 years with the Ministry of Environment including 4 years as Assistant Deputy Minister before he retired from government service in During his time with government, he was Comptroller of Water Rights for 10 years where he managed the review of all of BC Hydro's water licences as part of their Water Use Planning program. He also served for 10 years on the Permanent Engineering Board for the Columbia River Treaty and on both the Osoyoos and Kootenay Lake International Boards of Control. Mr. Mattison is an elected Director of the BC Water and Waste Association and a Member of the Columbia Basin Trust Water Advisory Panel. He advises government and industry on water policy and resource management regulatory processes. LINDA MICHALUK Linda Michaluk retired in 2012 as the Executive Director of the College of Applied Biology of BC, a position she held since the inception of the College (2002). Linda also served as Executive Director of the College precursor organization, the Association of Professional Biologists of BC from A Registered Professional Biologist since 1981, Linda held elected office as Mayor of North Saanich ( ; ) and a prior appointment to the Environmental Appeal Board in 1990 serving as Chair until In 2014 she was named to the Forest Appeals Commission as well as the Oil and Gas Appeal Tribunal, and reappointed to the Environmental Appeal Board. She holds a BSc from the University of Alberta and a Certificate in Conflict Resolution from the Justice Institute of BC. ROBERT MICHAEL (JOHN) DROUGHT ORR, Q.C. John M. Orr, Q.C. is a lawyer in Victoria. He was a member of the National Parole Board (10 years) and the Employment Standards Tribunal (10 years). He is currently a Senior Adjudicator for the Independent Assessment Process which hears claims and makes awards for abuses at Indian 4
5 Residential Schools. He also acts as inquest counsel for the BC Coroners Service and practices as an arbitrator and mediator in labour and employment matters. SUSAN ROSS Susan Ross is currently a lawyer at Susan E. Ross Law Corporation. She has over thirty years of experience in public law, including tribunal counsel, judicial and appellate review, and administrative justice. Ms. Ross has applied experience as an adjudicator, managing large volume case documentation, conducting hearings, writing decisions, and applying contract and personal injury law. Previously, she was a lawyer for Morley & Ross, and Arvay Finlay. Ms. Ross began her career with the BC Ministry of the Attorney General before entering private practice. Her work has included the areas of Indian residential school abuse claims, class action distribution, information and privacy, statutory investigations, regulation of child and adult care facilities, protection of children in care, human rights, horse racing, civilian oversight of police, environment, forestry and wildlife regulation, and securities and financial regulation and fraud prosecution. Her experience includes external counsel to the BC Information and Privacy Commissioner ( ), chair of the BC Community Care and Assisted Living Appeal Board ( ), and Deputy Chief Adjudicator and adjudicator of claims under the Indian Residential Schools Settlement Agreement national class action settlement (2006-present). Active in her community, Ms. Ross is a contributor/speaker for the Moot Court Program at the University of Victoria. She has also been an occasional author in the fields of access and privacy and administrative law. Ms. Ross has earned her Bachelor of Art degree from Brandon University and her Bachelor of Laws degree from the University of British Columbia. HOWARD M. SAUNDERS Howard Saunders holds degrees in Forestry (BScF, UNB 1966) and business administration (MBA, UWO, 1970). He initially worked for a forest company in various provinces east of British Columbia, but then became a forest products and transportation analyst for investment firms in Toronto. He relocated to BC as a consultant where his clients included government and industry, working principally in the areas of resource policy, valuation, and litigation support on trade and other issues. He also served as General Manager for the Interior Lumber Manufacturers Association in Kelowna and spent two years as Forest Products Analyst in Vancouver. Until his retirement from formal employment in the investment field, he held the designation Chartered Financial Analyst. Mr. Saunders has testified as expert witness in several cases, was a member of the arbitration panel on compensation for a taking of licences in Haida Gwaii, and previously served on the Forest Appeals Commission from 1997 to His consulting projects have occasionally included financial aspects of non-forest sectors such as automotive supplies, medical supplies, real estate and transportation for clients in New Brunswick, Ontario (Ottawa), Alberta, Washington and Alaska in addition to BC. While he still owns his own consulting firm, that practice is currently inactive. DAPHNE STANCIL Daphne Stancil completed a multi-year term in late 2013 as Chair of the British Columbia Chicken Marketing Board. She retired as Assistant Deputy Minister ( ADM ) for the Ministry of Agriculture and Lands in Before being appointed ADM, she held a variety of positions with the Province including Executive Director of Economic Policy for the Ministry of Agriculture and Lands, Project Assessment Director for the Environmental Assessment Office, and Director of Legislation and Governance for the Ministry of Agriculture, Fisheries and Food. Ms. Stancil practiced law in Victoria 5
6 and served several years as a Biologist for the Province. She has a long standing interest in board governance and decision-making and has experience with a variety of boards and agencies. She is also a long-standing member of the Law Society of BC. Ms. Stancil holds a Bachelor of Science in Biology (Honours), Master of Science (Biology) and a Bachelor of Laws from the University of Victoria. GREGORY J. TUCKER, Q.C. Mr. Tucker has practiced in Vancouver as a litigator for 25 years. His practice includes a large component of administrative law, Aboriginal law and energy related matters. He is recognized by Benchmark Litigation as a litigation star in the areas of commercial litigation/insurance and Aboriginal litigation. DOUGLAS VANDINE Douglas VanDine holds degrees in Geological Engineering and Civil Engineering (Geotechnical) and is registered in BC as both a Professional Engineer and a Professional Geoscientist. He has worked for the federal government, has taught at Queen s University and worked for many years as a geological engineering consultant. Mr. VanDine is Past President of the Canadian Foundation for Geotechnique ( ) and Past President of the Canadian Geotechnical Society ( ). He is the recipient of the CJ Westerman Award from the Association of Professional Engineers and Geoscientists of BC (2005) and the Canadian Professional Geoscientists Award from Geoscientists Canada (2015). Mr. VanDine is a Fellow of the Engineering Institute of Canada (2006), Engineers Canada (2009) and Geoscientists Canada (2013). Active in the community, Mr. VanDine plays music, enjoys hiking and kayaking, and volunteers his time with a number of local organizations in Victoria. REID WHITE Reid White is a BC Licensed Professional Engineer and Registered Professional Biologist (retired). He has broad experience in Environmental Protection and Resource Management. Professionally, he first worked in commercial construction (Civil) and building performance assessments. Combining his academic interests, Mr. White joined the BC Ministry of Environment, becoming progressively the Head of Engineering, Regional Water Manager and Regional Manager Fish, Wildlife and Habitat Protection. In the process, he gained valuable experience in the specifics of numerous commercial and public undertakings, their relationship to statutory requirements, rights and obligations. His experience ranges from small municipal waste management or flooding and erosion issues, to refineries and gas plant emissions; from stream crossings in community watersheds, to guide allocations and First Nations consultation. NORMAN E. YATES Norman Yates holds degrees in Forest Management and Law. He has a broad cross-section of experience in forest management activities and tenure administration. Called to the BC Bar in 1986, he was Crown Counsel for 22 years, during which he dealt extensively with environmental and forestry matters and was F, before retiring from that role into private practice. In past years, Mr. Yates taught environmental law as an adjunct professor at Okanagan University College, and has taught courses in law enforcement and evidence gathering. He currently practices criminal law and is a certified mediator and arbitrator. He is a past director of the BC Crown Counsel Association and the Association of BC Forest Professionals. 6
