Lefler, Jr. Hydrogeologist NCDENR-Inactive Hazardous Sites Branch Superfund Section 1646 Mail Service Center Raleigh, North Carolina Re: Solomon s Dump NONCD Task Order 49 Person County, North Carolina Contract No. N06010S MM&A Project No.: NCUL149 Dear Mr. Lefler: An investigation of the above referenced Site performed by Marshall Miller & Associates, Inc. (MM&A) on behalf of the North Carolina Department of Environment and Natural Resources (NCDENR) resulted in no confirmed reports that the Site was ever officially used by any community or municipality for the disposal of household waste. Based on these findings, no additional inquiry will be performed beyond what has been conducted to date. A summary of the Site information accumulated during this investigation is included below. The NCDENR inventory provided latitude/longitude data that plotted the Site along Hesters Store Road (SR-1162) in Roxboro and noted that the Site was operated by M.S. Solomon. Hesters Store Road is located south of the city limits of Roxboro and west of Highway 49. A Topographic Map of the vicinity is provided in Attachment A. During a review of files at the NCDENR, Division of Waste Management office in Raleigh, MM&A located a Land Disposal Modification Report prepared on June 16, The report indicated that the Solomon s Dump ENERGY & MINERAL RESOURCES CIVIL & STRUCTURAL ENGINEERING ENVIRONMENTAL SCIENCES HYDROGEOLOGY & GEOLOGY CARBON MANAGEMENT EXPERT WITNESS TESTIMONY MINING ENGINEERING GEOPHYSICAL LOGGING SERVICES PETROLEUM ENGINEERING

2 Mr. Bruce E. Lefler, Jr. Solomon s Dump NONCD February 18, 2010 Page 2 of 4 was located 3 miles south of Roxboro and left of Highway #49 and had been eliminated but provided no completion date. A copy of this report is included as Historical Documentation in Attachment B. MM&A conducted an online search of Person County s parcel ownership data and through online deed research located several parcels along Hesters Store Road which traced back to ownership by Mr. M.S. Solomon. Person County records indicate that Mr. Dwight Madison Solomon retained ownership of a 7-acre parcel along Hesters Store Road previously owned by M.S. Solomon. As such, a certified letter was mailed asking Mr. Solomon to contact MM&A to discuss any information he may have about a dump on or near his property. A copy of the letter is included in Attachment C. Mr. Dwight Madison Solomon contacted MM&A on January 21, 2010, in response to the letter he had received. Mr. Solomon reported that Mr. M.S. Solomon was his father, and after his father s death he had retained ownership of the parcel that had contained his father s home. He also noted that his father had previously owned several more acres all around his property. Initially his father had constructed several small homes on his land in the 1960s and 1970s as rental properties, but he eventually subdivided the properties and sold off the houses. Mr. Solomon was unaware of any trash dump ever run by his father and had spoken with his brother to gain his insight. The brothers could only remember one item that might have triggered the NCDENR report: when Highway 49 was widened back in the 1960s or 1970s, their father had allowed the state or whoever was running the project to dump any dirt and asphalt removed during the process onto his property to level off the land. They had no knowledge of any use of the property by the community or a municipality for the disposal of household trash. MM&A contacted Mr. Paul Bailey, Person County Solid Waste Director, and Mr. Tommy Warren, Assistant City Manager for the City of Roxboro, to confirm Mr. Solomon s account of the use of the Site. Neither gentleman was aware of any municipal trash dump located in this area nor any operated by M.S. Solomon, though they were familiar with the family.

Lefler, Jr. Solomon s Dump NONCD February 18, 2010 Page 3 of 4 During a visit to the Person County Soil and Water Conservation District (SWCD) office, MM&A personnel spoke with Mr. James Poindexter about the Site. Mr. Poindexter has lived in Person County for 63 years, and he was very familiar with the Solomon family and the area in question. Back in the 1960s and 1970s, Mr. Poindexter had driven a school bus in the area and his route had taken him past the Solomon s property along Hesters Store Road. He had never known there to be any municipal or community household trash dump anywhere in the vicinity, nor had he known of Mr. Solomon to run one. When MM&A inquired about Mr. Solomon s acceptance of the fill dirt from the widening of Highway 49, Mr. Poindexter indicated that Mr. Solomon was likely to have taken any assortment of fill dirt to level off the property as he had quickly worked to level, develop, and subdivide the lots. Detailed communication logs are included in Attachment C. Mr. Solomon had indicated that, to his best recollection, the likely location of the fill dirt from Highway 49 was on a parcel east of his property owned by Drew Strader. Person County parcel records indicated that the eastern adjoining parcel ( ) is owned by Charles and Anna Strader. MM&A spoke with Mrs. Strader on January 21, 2010, and she indicated that she that despite their frequent 4-wheeler rides in the undeveloped woods on her lot, she had never found evidence of any trash dumping. She did indicate that Mr. Solomon is currently dumping such items as cars, mattresses, etc. on his parcel (Attachment C). However, during MM&A s visit to the area on January 27, 2010, found Mr. Solomon s property to be somewhat untidy but not obviously being use as a dump. MM&A obtained 1951, 1960, and 1966 aerial photographs of the vicinity from the Person County SWCD. The 1951 aerial photograph showed no indications of disturbance in the area of Mr. Solomon s property. By 1960, a generally circular area on the Solomon s property had been disturbed, and Highway 49 eastward appeared to be undergoing the widening efforts. By 1966, Roseville Loop had been developed in the area of disturbance, and several homes had been constructed along its expanse. The area remains generally unchanged today. The historical aerial photographs as well as a recent (2008) aerial photograph, showing the area generally as it is today, are included in Attachment D.

He was unsure of what the letter might be referring to. He was unaware of any trash dump in or around his property. His father had owned land "all around" his parcel and had built several small houses and rented them out. Eventually he sold them all off, except the "homestead" which is where he lives now. When he got the letter, he had spoken with his brother, and they could only think of one thing. When they had widened Hwy 49 back in the 1960s or 1970s, his father had allowed the state or "whoever it was that was running the project" to dump the dirt and asphalt they had removed in the process onto his land. The land was eventually leveled it off and now it is just covered with trees. It was never used by the community, nor did it ever receive any trash. She noted that they do see the occasional trash here and there back in the woods, but nothing of any substance. They ride 4-wheelers all over their property, so she would know if there was anything suspicious. She did offer that there is currently some dumping including mattresses, cars, etc. on Mr. Solomon's parcel. Since he went to work for the city, he has not really heard anything about this. He indicated that Mr. MS Solomon had been known to have "owned a lot" so he had quite a few enterprises he was into. Mr. Warren thought that he may have at one time done garbage collection, but he wasn't sure if there was ever dumped in the reported area.
