11 U 2010/ A1 May 20, 2010 YTEMAND METHOD FOR CONDUCTING A PATENT EARCH CRO-REFERENCE TO RELATED APPLICATION Thi application i baed upon and claim the ben efit of priority from Proviional Application No. 60/988,389 filed Nov. 15, 2007, the entire content of which are incorpo rated herein by reference. FIELD Thi preent dicloure relate generally to patent earching, and in particular but not excluively, relate to a ytem and method for automating variou operation that are normally conducted manually by patent profeional and inventor during the preparation of a patent prior art earch report and the creation of a final patent earch report. BACKGROUND 0003) A new invention mut meet certain criteria in order to be conidered patentable. Under thee criteria, an invention mut be novel, non-obviou to one killed in the art, and ueful. In order to determine whether an invention i novel or non-obviou, inventor and their patent agent or attorney typically conduct a earch on a databae containing exiting United tate and foreign patent or publihed patent appli cation, technical journal article, pecialized databae for genomic equence or chemical tructure, a well a other technical or cientific reference, to determine whether the invention wa previouly patented or dicloed by another. If the earch reult in the dicovery of a document that di cloe the ame invention, the preent invention may not be patentable. The tudy of thee earlier reference i called a prior art earch. Patent examiner at the U Patent and Trade mark Office (UPTO) conduct a prior art earch on every newly ubmitted patent application to determine whether the claimed invention i patentable over the prior art Prior art earche are alo conducted for reaon other than determining patentability. Profeional in the intellectual property indutry routinely earch prior art data bae to invetigate the potential infringement of a product on a granted patent, or to earch for prior art that may be ued to argue the potential invalidity of a granted patent. 0005) A peron conducting a comprehenive prior art earch typically follow a complex, iterative proce of earching prior art databae, uually through the ue of a computer connected to a databae and earch interface, recording the earch querie ued to conduct the earch, con tinuing to refine the earch, copying of additional information from the earch reult lit, for example, the lit of reference mot cloely related to the new invention being earched, typing a lit of explanation that dicu difference between the new invention and prior art reference found during the earch, and compiling all of the earch information into a ingle report for delivery to the inventor, an attorney, or to the UPTO in aociation with a patent application. ince a earch i conducted on a new invention prior to filing for a new patent application, which will be examined by a patent office examiner at ome later date, the final work product i typically referred to a a Pre-examination earch Report The compilation of the report require the report preparer to ubmit the information contained in the report following a pecified tructure that clearly preent the detail of the earch including, but not necearily limited to a report ection pecifically identifying the location within each prior art reference where the reference dicloe art imilar to the claimed invention, a report ection howing where each claim in the patent application i upported within the Written decription of the application, a ection identifying the data bae that were ued for the earch, and one or more ection including variou tatement related to the earch, uch a a precie tatement of utility for each independent claim of the patent application, tatement howing upport for each mean-plu-function, or tep-plu-function claim limitation, a tatement of mall entity tatu if neceary, and a variety of other tatement pecifically relating to the earch report. invention or related patent application The earcher, or poibly an adminitrative upport peron, will typically prepare a number of pre-formatted form to accompany the ubmiion of the Pre-examination earch Report to the patent office. In the United tate, the form typically prepared for ubmiion to the UPTO include a tranmittal form, an Information Dicloure tate ment that lit prior art reference and variou petition or other patent office form that would typically accompany the patent application and earch report It can be readily undertood from the previou decription that earch report preparation i a complex, time conuming proce that relie primarily on manual labor. The proce alo require the earcher or preparer to exercie extreme diligence in following each tep of the workflow proce, uually in equence, to enure that the report i complete, that no tep are mied, and that the final Pre examination earch Report and all required form for report ubmiion are properly completed. Mied tep, or miing information required to be in the earch report could reult in the patent office' rejection of the earch reportin it entirety Variou oftware and patent earch engine provider have attempted to automate variou tep of the earch report proce. For example, LexiNexiR PatentOptimizerTM er vice wa developed pecifically to aid in the drafting and analyi of patent application and granted patent. Thi oft ware decontruct the claim of a patent to how frequency of keyword ued in claim contruction, and how prior art reference where the ame keyword appear in the claim of referenced prior art document. However, thi olution i more appropriately ued to ait an attorney in drafting the claim of a new patent application rather than aiting in the actual prior art earch or preparation of a Pre-examination earch Report. In combination, PatentHunter, a oftware tool that retrieve patent document baed on a keyword earch, and PatentWizard R., a oftware tool that ait in compiling a patent application, provide a rudimentary level of automa tion, but thi combination i primarily limited to the creation of a proviional patent application, and doe not addre Pre-examination earch Report. PatentProR and Pat enteae R are two oftware application that automate the compilation of non-proviional patent application, but they do not provide a mean to conduct a prior art earch, and do not ait in the preparation of a Pre-examination earch Report. earch engine provider uch a Delphion do provide elementary oftware tool that may ait a earcher to pre pare a earch report, uch a the recording of earch querie ued in the prior art earch, or the aving of prior art refer ence that will be later included in the Information Dicloure tatement that accompanie the Pre-examination earch Report. Delphion alo provide a utility called Workfile:

12 U 2010/O A1 May 20, 2010 however, Delphion provide no mean of automating the pro ce of earching, claifying a patent application or patent claim, or compiling earch report or tandardized form It can be readily een that there i not a lack of attempt to automate the workflow proce of earching pat ent, creating earch report, or preparing tandardized form, and uch attempt have been only marginally ucce ful in emi-automating a very limited number of any of the tep encountered in the overall Pre-examination earch Report workflow proce.
