3 Review Process Overview Receive request (2 Days) Log case, apply fee, assign reviewer Reviewer sends Revision Request Received letter Perform Initial Technical Review and send either (5 days): 316-AD letter (Request for Additional Data) or 316-ACK letter (Acknowledgement that data required for Detailed Technical Review has been received) Perform Detailed Technical Review and either: Send 316-AD letter or Prepare draft Determination Documents

5 Initial Technical Review Check whether all regulatory and technical data items required to process the case are submitted Modeling, model results, and mapping accuracy are not reviewed at this stage Reviewer assumes project is as described in MT-2 forms when determining what data is required

6 Initial Technical Review Items MT-2 Form 1 signed by a community official responsible for floodplain management for each community affected by the request All applicable MT-2 Forms must be provided and filled out completely and correctly Models must be provided for new or hydrologic or hydraulic analyses. Design plans and/or certified as-builts must be provided for all project elements Must be based on latest FEMA approved information

A topographic work map must be provided and include: Engineer Certification Effective 1%, 0.2%, and Floodway Boundaries Proposed/Post-Project 1%, 0.2%, and Floodway Boundaries Topographic Contour Information used for the boundary delineation and Vertical Datum used on the map All cross sections used in the model (within the vicinity) Scale and north arrow Channel Centerline

Must be at the same scale as effective FIRM Must be based on latest FEMA approved panel Must show any revised 1% floodplain, 0.2% floodplain, or floodway boundaries Flooding and base map information should match effective information outside of the S_LOMR boundary area

11 ESA Compliance A CLOMR request received on or after October 1, 2010 cannot be processed until ESA compliance has been achieved. This policy applies to any case processed by FEMA s contractors or its Cooperating Technical Partners performing reviews as part of a LOMR Delegation program

12 ESA Compliance Requirements The requestor must demonstrate ESA compliance by submitting to FEMA any of the following documents from the Services: Incidental Take Permit, Incidental Take Statement, A not likely to adversely affect determination from the Services, or An official letter from the Services concurring that the project has No Effect on listed species or critical habitat.

13 ESA Compliance The local offices of the Services do not offer a determination or concurrence letter for most projects. FEMA has agreed on an alternate solution

14 ESA Compliance Include in your submittal: Biological Assessment with No Effect or Is not likely to Adversely Afffect determination Copy of a request for concurrence w/ mailing receipt Copy of USFWS Form Letter Response A memo with the 6 points to the right included 1. A description of the action that could affect an endangered species 2. A description of the specific area that may be affected by the action proposed in the CLOMR submittal 3. A description of any listed species or critical habitat that may be affected by the proposed action in the CLOMR submittal 4. A description of the manner in which the proposed action may affect any listed species or critical habitat and an analysis of any cumulative effects 5. Please provide relevant reports, including any environmental impact statement, environmental assessment, or biological assessment prepared 6. Please submit any other relevant available information on the action, the affected listed species, or critical habitat.

15 Initial Technical Review Items (cont.) For LOMRs following CLOMRs: Any additional data listed in the 104 letter as a submission requirement in applying for a LOMR

16 Detailed Technical Review Begins when all data required in Initial Technical Review is received and 316-ACK letter is sent Review includes modeling, model results, mapping accuracy, and regulatory compliance based on model and mapping changes

17 Hydrology Check Should only update Hydrology for peak flow change of 10% or greater Latest approved model must be used with correct version Provide backup data to support any changes to drainage area boundaries, TC&R calculations, routing reaches, or diversions Ensure new flows are correctly distributed in HEC-RAS, and the Summary of Discharge table is updated

18 Hydraulics Check Latest approved model must be used with correct version Flow distribution should match FIS flow distribution unless Hydrology is revised Boundary condition should match effective unless change is well justified Model should extend to mapped Limit of Detailed Study Backup analysis should be provided for any overflow areas

19 Hydraulics Check Cross sections should not intersect one another or intersect the stream centerline more than once Skew angles should be correct Cross section stationing should agree with GIS data and downstream reach lengths n-values should be reasonable Ineffective or blocked areas should be justified

20 Bridge and culvert geometry should match plans Hydraulics Check Bridge methodology must be appropriate (Energy, Momentum, or both)

21 Hydraulics Check 1% flow should match between Floodway and Multiple Profile runs Floodway must not have surcharges >1.0 ft Floodway must not have negative surcharges (except right at structures)

22 Mapping Check Mapped 1% and 0.2% floodplain boundaries must agree with topography and model water surface elevations Mapped floodway boundaries must match the modeled floodway water surface extents at cross sections Boundaries should be smooth

23 Limit of Detailed Study line at the upstream end of modeled reach Mapping Check Zone AE, Floodway, and Shaded Zone X should stop Zone A should be mapped to 1% WSE at most upstream cross section BFEs should be perpendicular to flow and cross the entire 1% floodplain If you delete a lettered XS, reassign the letter to another XS

26 Increase Notification Requirements If 1% water surface elevation increases or any area is added to floodplain versus effective conditions, submit: A copy of notification letters sent to impacted property owners & certified mailing receipts, OR A copy of public notice and proof of publication in a local newspaper, OR A certified statement that any increase is limited to requestors property

27 65.7 Requirements If floodway boundary is being revised Copy of public notice and proof of publication in a local newspaper, OR Obtain and submit a statement from the community that all affected property owners have been notified

28 65.12 Requirements If a CLOMR which proposes encroachments on the floodway has 1% water surface elevation increases due to the project, submit: A copy of individual legal notice sent to impacted property owners & certified mailing receipts, AND An evaluation of alternatives which would not result in an increase and explanation of why alternatives are not feasible, AND Certification that no structures are located in areas which would be impacted by the increased water surface elevation
