1 MINNETONKA PLANNING COMMISSION June 11, 2015 Brief Description Seven Hi sign plan amendment Recommendation Adopt the resolution repealing and replacing the existing sign plan Project No a Property 4848 County Road 101 Applicant Background Proposal Staff Analysis Target Corporation The existing Seven Hi sign plan was approved in The plan regulates sign location, square footage, dimensions, construction type, color, and materials for six buildings in the Seven Hi commercial area. The plan also includes specific design/exhibits. (See page A14 A23.) The Super Target at Seven Hi will undergo a significant interior remodel over the next several months. In conjunction with that remodel, Target Corporation is proposing to revise the store s exterior wall and monument signs. The overall square footage of the proposed signs would be within the allowances of the existing sign plan. However, the design and text of these signs would not reflect the specific plan s design/exhibits. As such, Target is seeking an amendment. (See narrative and plans on pages A1- A13.) Staff finds that an amendment is appropriate. In staff s opinion, a good sign ordinance or sign plan: (1) regulates total area and dimensions of signage; and (2) the permitted total area and dimensions are appropriate for the size of the building and the site on which the signs are displayed. While a landlord or property owner may choose to control the manner in which signs are affixed to a building, primary sign colors, materials, and the font of sign text, these are not items a city-enforced sign ordinance or sign plan should regulate. To that end, city staff has drafted a revised sign plan for the Seven Hi commercial area. The revised plan does not alter the total area and dimensions of signage approved in Rather,

An argument could be made that the grocery, wine and spirits, and pharmacy signs illustrated on applicant s submittal constitute product advertising and should, therefore, not be allowed. However, staff finds that these signs would be allowed for three reasons: (1) The sign ordinance permits the city to approve sign plan with requirements/allowance different that the ordinance. (2) In 2001, the city chose to allow advertising when it approved Archer Farms and Bank tenant signage on the Target building as part of the Seven Hi sign plan. (3) The city must carefully evaluate the current sign ordinance in the near future. Various court cases including one currently pending before the United States Supreme Court address the validity of sign ordinances that regulate signs based on their content. For instance, an ordinance may not be considered reasonable/valid if it allows a business to display a 50 square foot sign that says McDonald s but not the same 50 square foot sign that says hamburgers here. Motion Options The planning commission has three options: (1) Concur with staff s recommendation. In this case a motion should be made to adopt the resolution repealing and replacing the existing sign plan. (2) Disagree with staff s recommendation. In this case a motion should be made recommending denial of the amendment. The motion should include findings for denial.

The motion should include a statement as to why the request is being tabled with direction to staff, the applicant or both. Appeals Neighborhood Comments Any person aggrieved by the planning commission s decision regarding the amended sign plan may appeal such decision to the city council. A written appeal must be submitted to the planning staff within ten days of the date of the decision. The city sent notices to 17 area property owners and received no comments to date. 6 Project Narrative Sign Plan Amendment Package April 24, 2015 Target Corporation ( Target ) is pleased to submit this project narrative and the enclosed plan documents which outline our proposed amendment to the sign plan for building and site signage at 4848 County Road 101. This amendment is focused only on the Target building and does not include any modifications to the signage existing on the Great Tile building façade. Target s update of the sign plan is proposed to coincide with the planned interior remodel and the anticipated new market strategies contemplated in the remodel. Target has been contemplating an interior remodel of the Store for the past couple of years, and we have arrived at what we believe is the right reinvestment for this SuperTarget. This remodeling will involve Target making a substantial investment in the Store to refresh its interior appearance and to enhance the offerings in the facility. Target has already submitted plans to the City for review in connection with this remodeling, and current plans are for this interior work to commence in the early summer of In connection with this remodeling, Target is seeking approval to revise and update its exterior signage at the Store and on the site. Additionally, Target is also seeking approval to replace the panels in the three existing pylon signs on the site to include text that matches the new building signage plan. Because the Store is located in a Planned Unit Development and because there is a sign plan (and corresponding sign covenants) in place for the existing signage, Target is requesting that the City approve an amendment to the existing sign plan and sign covenants to accommodate the new site and building signage Target is proposing. Enclosed please find a site plan, plan sheet (A201) that depicts the new exterior signage that Target is proposing to install at the Store and the detailed individual sign plan for each sign being proposed. We understand that the signage Target is proposing will require some relief from the strict requirements of the Code relating to signage that is allowed as a matter of right in the City s business districts. Under Section (9)(h) of the City Code, however, the City has the authority to allow flexibility in the requirements of the Sign Ordinance through the sign plan approval process. We respectively request that the City grant Target the flexibility it seeks with respect to the following two aspects of its proposed exterior signage: A2
7 1. Square Footage The total square footage of the exterior building signage Target is proposing is 520 square feet. According to our calculations, this is 107 square feet (approximately 17%) less than the square footage of the existing exterior signage at the Store. Additionally, the square footage of the pylon signs will remain the same. Given the large scale of the building and the need for Target to maintain adequate visibility for its Store within the 7-Hi development, Target believes strongly that the amount of signage it is proposing is entirely appropriate for this site and consistent with the overall character of the development as a whole. Moreover, Target has been operating the Store with the existing signage for more than 14 years, and, to its knowledge, there have been no concerns or complaints concerning the amount of exterior signage during this period. Accordingly, Target believes that the amount of signage it is now proposing will complement the existing development and will not be problematic. 2. Types of Signs In addition to Target s brand identification signage, Target is also proposing to install three signs on the exterior of the Store that identify certain of the individual business units (i.e. Grocery, Pharmacy, Wine & Spirits) located within the Store. Notably, these signs are substantially similar to the Archer Farms Market and Bank Tenant signs that are allowed under the existing sign plan and sign covenants. The existing sign plan and sign covenants allow Target to install 153 square feet of these types of signs on the exterior of the Store, whereas the new signage Target is proposing contains only 125 square feet of these types of signs. As such, the three signs Target is proposing for the separate business units within the Store are entirely consistent with and actually smaller than the exterior signage that was approved previously. The City s continued allowance of this type of exterior signage is consistent with the spirit of the Sign Ordinance which allows building owners to use exterior signage to inform customers of the businesses and services that are offered within a building. Under the Sign Ordinance, the Store constitutes a limited tenant building, and on these types of buildings, the display of signage that identifies the tenants operating within such a building is permitted. Target s pharmacy and wine and spirits are separate business units that operate within the Store. In nearly all regards these separate business units operate and function no differently than tenants would in a traditional multi-tenant building. For instance, the Wine & Spirits area of the Store features a separate entry, a separate backroom area for inventory storage, different operating hours, and different operating and delivery protocols, and all products sold in this area must be purchased within the physical confines of this area. Similarly, the pharmacy has separate operating hours, separate operating procedures and protocols, and is staffed and operated by licensed professionals that work exclusively in that area of the Store. The pharmacy also has product which can only be obtained and purchased at A3
8 the pharmacy counter. Target would be permitted to install signage to identify each of these separate businesses in the Store as a matter of right if these were operated by tenants. The City should not treat Target s proposed signage for these business units differently just because Target owns them. Finally, the City should also allow Target to install the proposed signage from a fairness and competitive standpoint. Directly to the east of the Store across Highway 101 is a Cub Foods store. At this Cub Foods location, the City has allowed Cub Foods to install exterior signage identifying the pharmacy and bank located within that grocery store. The content, purpose, and effect of Cub Foods s signs is virtually identical to the signs Target has currently and the new signs it is proposing Cub Foods is similarly identifying to its customers the different businesses located within its store. It would be unfair and place Target at a competitive disadvantage if Target was denied the opportunity to install similar signage at the Store. In sum, the spirit and intent of the Sign Ordinance is to allow for signage on the exterior of buildings to identify the separate businesses housed within such building. Target has been doing this for years at the Store with its existing signage, and Cub Foods is doing the same thing on the other side of Highway 101. Target is merely seeking to continue this practice with its proposed amendments to the sign plan for the Store. 28 2015 A. GENERAL PROVISIONS All signs must be approved by the approving parties of the Seven Hi Operation and Easement Agreement and the city of Minnetonka. All wall signs must be constructed of individual channel letters and logos. All wall signs must be located wholly within the tenant space for which the sign is displayed and within a consistent sign band on each building. The wall sign and freestanding sign provisions outlined in Section B and C of this document apply to the locations depicted on attached Seven Hi Site Diagram. B. WALL SIGN PROVISIONS 1. Target 627 total SF of walls signage if permitted. Maximum vertical dimension of letters is 5 feet and maximum dimension of logos is 9 feet by 9 feet. 2. Target Tenant Two (2) signs are permitted, provided they are not located on the same building face. No signs are permitted on the west face of the building. Maximum vertical dimension of letters is 36 inches and maximum dimension of logos is 48 inches by 48 inches. Signs are limited to tenant name and logo HI Corner Individual tenants 5,000 SF and greater are permitted two (2) signs, provided they are not located on the same building face. Maximum vertical dimension of letters is 26 inches and maximum dimension of logos is 36 inches by 36 inches. Individual tenants less than 5,000 SF are permitted one (1) sign. 31 Resolution No Resolution repealing and replacing the Seven Hi sign plan for the properites at and State Highway 7 and 4754, 4848, 4900, and 4912 County Road 101 Be it resolved by the Planning Commission of the City of Minnetonka, Minnesota, as follows: Section 1. Background 1.01 The Seven Hi Planned Unit Development (PUD) includes the properties located at and State Highway 7 and 4754, 4848, 4900, and 4912 County Road In 2001, the city approved a sign plan for said properites. The sign plan regulates sign location, square footage, dimensions, construction type, color, and materials. The plan also includes specific design/exhibits. Section 2. Findings 2.01 The existing regulations pertaining to sign location and dimensions continue to be reasonable in the context of the Seven Hi PUD. However, the regulations pertaining to construction type, color, materials, and specific design/exhibits restrict reasonable changes. Section 3. Planning Commission Action The existing Seven Hi sign plan, a copy of which is attached to the resolution as Exhibit A, is repealed A new Seven Hi sign plan, a copy of which is attached to the resolution as Exhibit B, is hereby approved In the event that additional freestanding buildings are approved for construction on the Target property, city staff may administratively replace the sign plan diagram to reflect the additional buildings.
