2 File ID: Consent Item 14 Description/Analysis Issue Detail: The Department of Youth, Parks, & Community Enrichment is seeking approval to award a contract to Olympic Land Construction for the Fort Natomas Shade Structure project in the amount of $266,935. The project would be funded with Measure U proceeds (34%) and Park Development Impact Fees (66%). The improvements will consist of installing storm drain adjustments, irrigation, landscaping improvements, rubber surfacing repairs, and shade structures. The formal bid process for this project has been completed and Olympic Land Construction has been selected as the lowest responsible and responsive bidder. Construction of the Fort Natomas Shade Structure project is expected to be completed in August Fort Natomas Play Structure is located within South Natomas Community Park. South Natomas Community Park is a acre community park located at 2901 Truxel Road, in Community Planning Area 9, Council District 3. Policy Considerations: City Code Chapter 3.60 provides that City Council approval is required to enter into construction agreements over $100,000. Council Resolution , Section 4.1 requires that all appropriation changes (increases or decreases) in excess of $100,000 to the Approved Budget shall be approved by resolution of the City Council. Providing parks and recreation facilities is consistent with the City s strategic plan to enhance livability in Sacramento s neighborhoods by expanding park, recreation, and trail facilities throughout the City. This is also part of the Park Development Process for park planning as stated in the Parks and Recreation Master Plan. Economic Impacts: The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences. The park construction project, in the amount of $266,935 is expected to create 1.06 jobs (0.61 direct jobs and 0.45 indirect jobs through indirect and induced activities). Furthermore, it will create $164,815 in total economic output ($103,884 of direct output and $60,931 of output through indirect and induced activities). 3 File ID: Consent Item 14 Environmental Considerations: The Environmental Services Manager has reviewed the project for compliance with the requirements of the California Environmental Quality Act (CEQA) and determined that it is exempt from the provisions of the CEQA pursuant to Section of the CEQA Guidelines, Construction of Small Structures. Sustainability: The Fort Natomas Shade Structure Project has been reviewed for consistency with the goals, policies, and targets of the City s Sustainability Master Plan (SMP), the Parks and Recreation Sustainability Plan, and the 2035 General Plan. The Project will advance the goals, policies, and targets of these plans by improving the health of residents through access to a diverse mix of wellness and recreation activities. The park improvements are also consistent with sustainable design through the use of recycled materials and local vendors. Commission/Committee Action: None Rationale for Recommendation: The formal bidding process for the Fort Natomas Shade Structure was posted in accordance with City Code 3.60 and Administrative Policy AP The bids were opened on January 17, Staff received 2 bids and the results are listed below: CONTRACTOR Base Bid Additive Total Bid LBE% Alternate Abide Builders $175,537 $61,290 $236,827 95% Olympic Land Construction $156,035 $110,900 $266,935 95% The low bidder was determined based on the total bid amount. The Engineer s Estimate for the base bid was $130,375 and $99,475 for the additive alternates, for a total amount of $229,850. Abide Builders was determined to be non-responsive due to not meeting the contractor s license requirements set forth in bid documents. Pursuant to City Code Sections and E, it was determined that Olympic Land Construction offered the lowest responsive bid, (based on the base bid plus the additive alternate) and is a responsible bidder. The contract will be awarded for the base bid and the additive alternate in the amount of $266,935. 4 File ID: Consent Item 14 The total estimated project cost is $266,935. Additional funding of $175,000 is necessary to complete the project. This is an existing park; the annual maintenance and utilities costs are covered in the Department of Parks and Recreation s operating budget for maintenance, water, and utility costs. Local Business Enterprise (LBE): At an LBE percentage of 95%, Olympic Land Construction exceeded the 5% LBE participation requirement. 6 Documents and in no way affect or limit the interpretation of the provisions to which they refer. 2. DEFINITIONS Unless otherwise specifically provided herein, all words and phrases defined in the Standard Specifications shall have the same meaning and intent in this Agreement. 3. AGREEMENT CONTROLS In the event of a conflict between any of the terms and conditions set forth in this Agreement and the terms and conditions set forth in other Contract Documents, the terms and conditions set forth in this Agreement shall prevail, except that the provisions of any duly authorized change order shall prevail over any conflicting provisions of this Agreement. 4. SCOPE OF CONTRACT Contractor agrees to furnish all tools, equipment, apparatus, facilities, labor, material and transportation necessary to perform and complete in a good and workmanlike manner to the satisfaction of City, all the Work called for in the Contract Documents entitled: MU-Fort Natomas Shade Structure (PN: L ) Bid #B Including the Work called for in the following alternative bid items described in the Proposal Form: A1-Swing Shade Canopies Contractor agrees to perform such Work in the manner designated in and in strict conformity with the Contract Documents. 5. CONTRACT AMOUNT AND PAYMENTS City agrees to pay and Contractor agrees to accept, as complete payment for the above Work, in accordance with the schedule and procedures set forth in the Contract Documents and subject to deductions, withholdings and additions as specified in the Contract Documents, a total sum that shall not exceed the total bid amount set forth in Contractor s Proposal Form. In addition, subject to deductions, withholdings and additions as specified in the Contract Documents, payment for individual items of the Work shall be computed as follows: A. For items of the Work for which a lump sum price is specified in Contractor s Proposal Form, Contractor shall be paid the lump sum price(s) specified in Contractor s Proposal Form; and Form approved by City Attorney Page 6 of 87

87 RESOLUTION NO Adopted by the Sacramento City Council APPROPRIATE FUNDING FOR MEASURE U Park Improvements (L ) Fort Natomas Shade Structure BACKGROUND A. Fort Natomas is a play structure located within South Natomas Community Park. The community park is acres and located at 2901 Truxel Road in South Natomas (Council District 3). B. The Department of Youth, Parks, & Community Enrichment is seeking appropriation of an additional $175,000 from Park Development Impact Fees (Fund 3204) available fund balance to the Fort Natomas Shade Structure Project, a sub project of Measure U Park Improvements (L ). The additional funding is necessary to cover the construction and staff costs for the project. The project consists of installation of a 7 fabric shade structures and Minor repairs to playground and surfacing. Council Resolution , Section 4.1 requires that all appropriation changes (increases or decreases) in excess of $100,000 to the Approved Budget shall be approved by resolution of the City Council.
