A meteor is a fiery spark that is noticed by all, 147 though it is captured by our vision but briefly; it also aptly describes the life and legal career of Jad Davis. Born James Anderson Davis, Jr., on October 12, 1955, Jad was only 35 and had been licensed as an attorney less than 10 years at the time of his death on January 8, Yet, Jad's life was act ion-packed and we take this opportuni ty to remember and memorialize him for his contributions to the Bar. Raised on Lookout Mountain, Tennessee, Jad was the oldest of four brothers and one sister. He is survived by his parents, Jim and Gray Davis of Lookout Mountain, brothers Kevin of Charleston, South Carolina, Chris of Minneapolis, Minnesota, Greg of Washington, D.C., and sister Kathy Fortin of Charleston, South Carolina. Jad graduated from Notre Dame High School in Chat tanooga in 1973 where, among other endeavors, he was a member of the wrestling team. Thereafter, he enrolled at the University of the South at Sewanee, graduating with a Bachelor of Arts Degree in English in He was a strong supporter of both institutions until the time of this death.. ~..~.),. ~i~1 '~_-::: '; ~:~-i~~:-;f~;fi,:i:.1;~~::~~:~:~ -v:. f:i~~-$g-r.':'4;"""... 2 1,4~ - " \ Whi Ie at Sewanee, Jad was active in the Phi Del ta Theta Fraternity, the Order of the Gownsmen, the Silver Spoon Society, and served as Assistant Chief of the student-run Sewanee Volunteer Fire Department. Jad' s long-standing interest in 1 i terature blossomed at Sewanee and, wi th ever an eye for the dramatic, he was particularly drawn to Shakespeare. Even in his later years, he would read from Shakespeare l S works often and with feeling. Perhaps Jad would not object to our repeating King Henry's words from the play "King Henry the Fourth": o God! that one might read the book of fate, And see the revolution of the times Make mountains level, and the continent, Weary of solid firmness, -- melt itself Into the sea! and, other times, to see The beachy gi rdle of the ocean Too wide for Neptune' ships; how chances mock, And changes fill the cup of alteration with divers liquors! Oh, if this were seen, The happiest youth, -- viewing his progress through, What perils past, what crosses to ensue, -- Would shut the book, and sit him down and die. "King Henry IV," Second Part, Act III, Scene I. Sewanee' s locale and the beauty of its surroundings also contributed to Jad' s avid and vigorous pursuit of the outdoors and he would come to excel at kayaking, canoeing, mountain climbing, fly fishing, and backpacking. Jad also formed numerous close and lasting friendships with many people while on "The Mountain," several of whom reside in Nashville and are members of the Bar. -2- "',l\;ø~'"" \"";:'~k:;j""":";':"'i"'~~_ìt~~~''''a(;i :i;;~'6'':',~~.\+'ò~~~~':i"':~ft i,,,.(,ir ,~...".~,..,.,. ~''':'.-..~""y'.~. \,,1 ",t: _._.:ç :'k,;~"_:.";l"i.,,i,"!" 3 :149 Jad's inquisitive mind, interest in drama, and facility to argue a point maùe his choice of the legal profession as a career a natural one. For a year following his graduation from Sewanee, he worked as a runner for the Chattanooga law firm of Miller & Martin, where he also clerked for two summers while working toward his law degree. Jad entered the University of Tennessee College of Law in 1978, residing during each of his three law school years at the House of Torts, where he studied and played hard. At law school, as he had at Sewanee, Jad developed close friendships and was well-liked by his fellow students and the faculty. Among the honors he garnered during law school was his qualification as a staff member, and subsequent selection as Articles Editor, for The Tennessee Law Review. After receiving his law degree in June, 1981, Jad successfully passed the Tennessee Bar Exam and was licensed by the Supreme Court to practice law on October 3, He moved to Nashville and began his legal career that fall as an associate at the law firm of Dearborn & Ewing. In January, 1982, Jad was involved in a near-fatal automobile accident i being struck by a drunken driver in a head-on collision. He was hospitalized and bedridden for months wi th two broken legs - one a compound fracture - among -3-.f~ :~.~'r-?:r~.~+ "" ~~. Through courage, f ai th and determination, however, he was able to return to his legal practice in the fall of Because of these qualities, Jad was also able to continue his strenuous outdoor acti vi ties, to the amazement of his doctors. His enthusiasm and sense of independence guided Jad to establ i sh himse I f as a so 10 pr act i t ioner in 1988 and he developed a successful legal practice. Jad's heartfelt desire was to excel as a litigator and during his career he progressively handled matters of increasing complexi ty and substance in both state and federal courts. In 1990, he was honored by being invited to become one of only 16 charter associate members of the Harry Phillips Chapter of the American Inns of Court, an organization whose goals include promoting legal traditions and camaraderie within the Bar. The provision of adequate legal services for the poor was of vi tal concern to Jad and he became a member of the Nashville Bar Associa.tion's Pro Bono Committee and the Commi ttee' s Board in He was named Vice-Chai rman of the Committee's Board in 1990 and, at the time of his death, he had recently been named as the 1991 Board Chairman of the Committee. -4- :"~_':~v.-.~'..-.-._..._-.--, :..-.~-~~. --~ '. -.' 0'_ ~,_..~,.~r~:;.....~'èt_~~~kl*ù _::.,,,..~~~~~"":,:...''''l''(~'~.;t*~"..~~.,-?'~t~;itt~~l:
5 '\ 1.51 While living in Nashville, Jad maintained the close friendships begun during his college and law school years and, with his gregarious nature, developed a wide circle of friends and acquaintances. He balanced his busy professional life with many other interests. His love of the outdoors and outdoor pursuits continued unabated. He developed a strong interest in photography, attended the Maine Photographic Workshops, and became an accomplished amateur photographer. Following his death, several members of the legal community organized an exhibition of his photographic works, with proceeds benefitting the Nashville Bar Association's Pro Bono Program. He helped form a book discussion group which met monthly over a period of 8 years and discussed dozens of American literary classics. He was active in his church, served as a lector at the Cathedral of the Incarnation, and was devout in his faith. Jad was a well-read and gifted thinker who loved to discuss ideas and who held the wri tten and spoken word in the highest regard. He demanded excellence from himself in everything he did -- from writing a legal brief to kayaking. He was a gifted, able, and respected attorney who had many friends because he was a friend. He had the ability to make his friends laugh often and hard. The members of the Bar and the corrununi ty who have had the benefi t of Jad' s presence do and will miss him and are the poorer for his absence. -5- "".q;~i.', ":"'~~t~\~(i'p:';" "" :'\""'\"'; ~~~';:~: ~~l~1ft:.j~l,'c,;~;;;'f~,i1f;~''');",;.., ij~"'~1'~':' "'::~'iy ~_1A'.
