1 Class 40 Treatment of materials. Explanatory Note Class 40 includes mainly services not included in oer classes, rendered by e mechanical or chemical processing, transformation or production of objects or inorganic or organic substances, including custom manufacturing services. For e purposes of classification, e production or manufacturing of goods is considered a service only in cases where it is effected for e account of anoer person to eir order and specification. If e production or manufacturing is not being performed to fulfil an order for goods which meet e customer's particular needs, requirements, or specifications, en it is generally ancillary to e maker's primary commercial activity or goods in trade. If e substance or object is marketed to ird parties by e person who processed, transformed or produced it, en is would generally not be considered a service. This Class includes, in particular: - services relating to transformation of an object or substance and any process involving a change in its essential properties (for example, dyeing a garment); consequently, a maintenance service, alough usually in Cl. 37, is included in Cl. 40 if it entails such a change (for example, e chroming of motor vehicle bumpers); - services of material treatment which may be present during e production of any substance or object oer an a building; for example, services which involve cutting, shaping, polishing by abrasion or metal coating; - e custom manufacturing of goods to e order and specification of oers (bearing in mind at certain offices require at e goods produced be indicated), for example, custom manufacturing of automobiles. This Class does not include, in particular: - repair services (Cl. 37); - certain customization services, for example, e custom painting of automobiles (Cl. 37).
