33 Findings of Fact Necessity for the public convenience at the particular proposed location: absent the proposed use, cellular service delivery within the Village will be significantly impaired Effects of the proposed design, location and operation on the public health, safety and welfare: The proposed use will improve upon the safety and welfare of Kenilworth residents who utlilize and depend upon the reliability of cellular service for their primary telephone, data connections (internet), and as a means to access emergency services Injury to the value of other property in the neighborhood in which it is proposed to be located: The proposed use is compatible with M-2 zoning and use of the public works facility and storage yard. In addition there is no evidence to suggest that the current presence of cellular antennas at the water tank has negatively affected property values Interference with the use and enjoyment of neighboring properties: The proposed use will not generate parking, operational noise, movement, illumination or other actions that would negatively impact the area Compatibility with permitted uses in the district in which it is proposed to be located: the proposed use does not conflict with the current use of the property which is used to deliver municipal services to the community 33

34 Findings of Fact: Continued Increased traffic congestion on public ways or increased parking required on public ways: The proposed use will not increase traffic congestion in the neighborhood, and once constructed there will be minimal traffic to the site to maintain equipment. Parking will be maintained within the public works enclave and not impact the surrounding residential areas Damage to or destruction of natural scenic or historic features of significance to the Village or the immediate neighborhood: Although the proposed use would be visible from various areas within the Village, the lower portion of the monopole would be screened by tall trees and the Public Works facility buildings and ground equipment would be screened by the natural elevation of the Green Bay Trail and the Public Works facility buildings. In the case of playground equipment. N/A 34

35 Antennas must be relocated Conclusion Public works property presents best alternative for construction of new site Monopole will allow ALL carriers to collocate, eliminating need for future telecommunication structures Cellular Service delivery will be maintained/improved 35
