Freedom Mobile co-location on Rogers Communications Monopole File: BVI Mr. Chury On behalf of Freedom Mobile we are writing to you to confirm our understanding and position in reference to the proposed co-location of Freedom Mobile Antenna on the existing Rogers Communications Monopole located on Gorge Vale Golf Club property. Background: Freedom Mobile is in the process of establishing a Wireless Cellular communications and data network throughout the greater Victoria Area. At this time within the immediate vicinity of the Gorge Vale Golf course we have established 5 additional Broadcast facilities. These locations are identified on the enclosed map. Our Radio Engineers have further identified a gap in coverage and capacity in close proximity of the golf club. As such we have determined that co-location on the existing Rogers Tower would address this coverage Gap.

9 Freedom Mobile has in place a standard co-location agreement, and financial remuneration rates with Rogers Wireless, and other carriers in the co-utilisation of structures across the Country. This is in line with various mandates from Industry Canada, and local land use jurisdictions to minimise the number of free standing communication structures. We understand that per the terms of the Clubs agreement with Rogers Wireless, that the Clubs consent is required for any third party access to the site and structure. Based on our earlier discussions, we understand that there are a number of outstanding and un resolved issues between the Club and Rogers, including the aesthetics of the tower, and financial terms of the site licence agreement. We would consider these issues a private matter between the Club and Rogers, and are not in a position to influence or to engage directly with Rogers.

10 Aesthetics: Based on our previous discussions we are well aware of the aesthetic issues related to the existing Rogers structure. The Shrouded portion of the tower is not available for co-location. Any available space within the shrouded portion of the tower is in use or designated for use by Rogers. We have investigated with the help of our structural engineering firm, the opportunity to extend the shrouding, however it was determined the tower was not able to structurally accommodate such a modification The space / elevation on the tower which has been made available to Freedom Mobile is at the 19 meter level of the tower. We have proposed an antenna attachment design which staggers the antenna at two elevations on the tower ( 19M and 17M ). This configuration allows us to place the antenna tightly to the face of the monopole as technically feasible. In addition we have lowered the Microwave antenna to 17 M which we believe further shields the dishes from view. All antenna and attachment hardware will be painted to match the monopole as closely as possible. Below is an illustration of the proposed installation.

11 We believe that this configuration is the least visually obtrusive, and given the elevation of our antenna, much of this installation will be shielded from view by surrounding trees.

12 Financial Terms: Freedom Mobile confirms that for rights of access to the site, including the ability to install 2 radio cabinets at the tower base, we are in agreement to compensate the Club in the Amount of 24 thousand dollars per annum. We are unable to negotiate any additional compensation beyond this point. Request: Our request to the Board and members of the Gorge Vale Golf Club is to obtain a firm commitment to proceed with our proposal, based on the financial and design terms presented, on or before January 25 th, We hope the Club can understand that we are under some time pressure in this matter, and should a decision to proceed not be possible by January 25, we will need to find an alternate solution to address our coverage needs in the area.
