5 14296 Notice was received from the South Dakota Department of Health of a Disinterment Permit issued for the remains of Jonathan Boade, Hills of Rest Memorial Park, Sioux Falls, South Dakota. Reinterment, Woodlawn Cemetery, Sioux Falls, South Dakota. LIEN COMPROMISE Robert Wilson, Assistant Commission Administrative Officer, gave a briefing on a request for compromise of lien for DPNO and DPNO The request is submitted by a husband and wife who are attempting to purchase a home, and the liens need to be satisfied prior to the closing on May 27, DPNO is in the name of the wife, and is for Public Defender and Human Services assistance provided between 1990 and A total of $900 has been paid on the lien bringing it to the current balance of $ DPNO is in the name of the husband and his former wife. The lien originated in 1993 and was compromised in full by the Commission in 1995 at an amount of $4, Between 1997 and 2001 assistance was provided by the Public Defender s Office on two occasions. Those charges were paid in full. The couple divorced in August of Between 2009 and 2010 additional services were provided by the Public Advocate, Public Defender, and Human Services in the amount of $24, % of the lien is for medical assistance provided to the husband. The applicants report a total 2015 income of $79,731. They report assets of approximately $11,000 and liabilities in excess of $64,000 including debts owed to a credit union and student loans. Due to the amount of medical claims in 2010, the County applied for and received $2, in assistance from the Catastrophic County Poor Relief (CCPR) fund. If a compromise is approved and partial payment is made on DPNO 31088, the first $2, received must be repaid to the CCPR. The applicants were present and addressed the Commission regarding their compromise request. MOTION by Bender, seconded by Beninga, to compromise and release DPNO in full with no payment (Resolution MC16-18). 5 ayes. MOTION by Kelly, seconded by Bender to compromise and release DPNO in full upon payment of $6, ayes. Barth, Beninga, and Heiberger voted nay. Motion fails. MOTION by Barth, seconded by Beninga, to compromise and release DPNO in full upon payment of $1,000. SUBSTITUTE MOTION by Kelly, seconded by Barth, to compromise and release DPNO in full with no payment. VOTE on substitution, 5 ayes. VOTE on Main Motion as substituted (Resolution MC16-19). 5 ayes. RESOLUTION MC16-18 WHEREAS, a County Aid Lien in the amount of $648.10, purports to exist in favor of Minnehaha County and against DPNO as Lienee, and 0 by Law, NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorize the Chairman of the County Board and the County Auditor to execute the following: Compromise and release the lien in full with no payment. 6 RESOLUTION MC WHEREAS, a County Aid Lien in the amount of $24,074.13, purports to exist in favor of Minnehaha County and against DPNO as Lienee, and WHEREAS, said lienee has filed an application with the County Auditor stating such facts as provided for by Law, NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorize the Chairman of the County Board and the County Auditor to execute the following: Compromise and release the lien in full with no payment. AGREEMENTS DJ Buthe, Highway Superintendent, gave a briefing on a Professional Services Agreement for construction administration services with JSA Engineers and Land Surveyors, Inc. for Project MC-149-Reconstruct. The services include shop drawing review, preconstruction meeting, survey, full-time on site construction inspection, and post construction documentation. MOTION by Barth, seconded by Kelly, to authorize the Chair to sign the Professional Services Agreement for construction administration services between Minnehaha County and JSA Engineers and Land Surveyors, Inc. for Project MC-149-Reconstruct in an amount not to exceed $225, ayes. DJ Buthe, Highway Superintendent, gave a briefing on a Professional Services Agreement for design services with Stockwell Engineers, Inc. for Project MC-137-Reconstruct. The services include a field survey and evaluation of existing conditions, environmental assessment, design and preparation of the construction documents for reconstruction work, and project bidding. MOTION by Kelly, seconded by Barth, to authorize the Chair to sign the Professional Services Agreement for design services with Stockwell Engineers, Inc. for Project MC-137-Reconstruct at a cost not to exceed $297, ayes. AMENDMENT Carol Muller, Commission Administrative Officer, gave a briefing on an amendment to the FY 2016 State contract for detox funding. The current contract is in the amount of $134,703 and expires May 31, Due to less than anticipated expenditures from Minnehaha County for this contract year, the State is adjusting the current contract to $60,703. MOTION by Kelly, seconded by Bender, to authorize the Chair to sign Amendment #1 to

7 14298 the State of South Dakota Department of Social Services Division of Behavioral Health agreement for Clinically Managed Residential Detoxification Services in the amount of $60, ayes. LIAISON REPORTS Scott Anderson, Planning and Zoning Director spoke on a cost estimate for a 2017 flight acquisition with Pictometry. Mr. Anderson also reported the Municipal Separate Storm Sewer System (MS4) program will be delayed in its implementation until revisions to the program are made by the State of South Dakota and the Environmental Protection Agency. NEW BUSINESS Commissioner Heiberger reported hail damage repairs are underway at the Sioux Empire Fairgrounds, and the audit of the Sioux Empire Fair Association has been completed. OLD BUSINESS Commissioner Heiberger stated the County Board of Equalization will be meeting again on Thursday, April 21, MOTION by Barth, seconded by Beninga, to adjourn into executive session for contract negotiations and personnel. 5 ayes.
