Collins Monday through Thursday, closed Friday Hours: 6:30 a.m. 4:30 p.m. Meeting: First Monday, 7:00 p.m. SUPERVISORS MEETING August 3, 2015 The regular meeting of the Providence Township Board of Supervisors was held in the Township Municipal Office on Monday, August 3, 2015 at 7:00 p.m. Present were Chairman David Gerhart, Vice Chairman William Shaffer; Member Gregory Collins; Solicitor Melvin Newcomer, Manager Vicki Eldridge and twenty (20) observers. The meeting was called to order by Mr. Gerhart at 7:00 P.M followed by the Pledge of Allegiance. Mr. Gerhart offered prayer. MINUTES Mr. Gerhart explained that each Supervisor received a copy of the written minutes from the July 6, 2015 Board of Supervisors Meeting. With no additions or corrections to the minutes, Mr. Shaffer made a motion, seconded by Mr. Collins to approve the minutes. The motion was carried unanimously. FINANCIAL REPORT Vicki Eldridge read the financial report. Mr. Collins made a motion, seconded by Mr. Shaffer to ratify payment of July bills in the amount of $78, from the general account and $106, from the state account. The motion was carried unanimously. REVIEW OF BUDGET Mr. Collins had several questions regarding revenues. PUBLIC COMMENT Rose Cooper told the board that her property is cleaned up. She didn t understand why a burn barrel and go-kart were not allowed on the property. Merv Conrad asked for an update on the Route 272 roundabouts. Shannon Paddock asked for an update on Main Street issues involving the apartment houses. Mr. Gerhart shared that he did visit with the owner of the apartment houses located at Main Street to discuss the issues involved with the tenants. Mr. Gerhart felt the conversation was positive. Clayton Harnish had questions regarding the Radcliff Road Bridge. Shawn Reimhold of Martin s Appliance asked the board to consider an amendment to the zoning ordinance that would allow advertising flags and banners outside of commercial businesses. 200 Mount Airy Road New Providence, PA Fax

2 Kerrick Nettke expressed appreciation to Mr. Gerhart for visiting the owner of the apartments on Main Street. He asked for an update on the speeding issue. He raised concern over the apartment building at 41 Main Street. Ed Smith expressed gratitude to Mr. Gerhart for meeting the apartment owner. He also asked for an update on speed regulation in the village. Rob Musser said that a contractor is onsite making improvements to the apartments. Jeanne Graver expressed concerns regarding the activities occurring at the apartment house located at 41 Main Street. PARKS/RECREATION REPORT There was no parks/recreation report given. The parks/recreation committee meeting will be held on Thursday, September 10, 2015 at 7:00 p.m. Until further notice, the committee will begin meeting every other month. The Sigman Road parking area has been finished. SOUTHERN LANCASTER COUNTY INTERMUNICIPAL COUNCIL REPORT Mr. Gerhart reported that PennDOT representatives, Senator Lloyd Smucker and representatives from the office of Bryan Cutler were in attendance to discuss the future improvements to Route 272 from Willow Street to Mount Airy Road. The improvements will involve the intersections of Route 272 with Pennsy, Mount Hope School and Byerland Church Roads. OLD BUSINESS: Mr. Gerhart announced that the township has ordered a new dump truck. Delivery is expected in the spring of Mr. Gerhart announced that the Radcliff Road Bridge was closed indefinitely on Thursday, July 30, The supervisors asked the manager to set up a meeting with Pequea officials to discuss the future of the bridge. Mr. Gerhart announced that the road master met with the township engineer to discuss the speed table on Main Street. At this time, the supervisors are not in favor of adding height to the current speed table or adding an additional speed table. Residents shared their ideas for slowing traffic on Main Street including a cul-de-sac near Pennsy Road and limiting truck traffic. Mr. Gerhart announced that Rob Visniski is preparing a cost estimate for the repairs that need to be completed on Old Road at the Quarryville Wastewater Treatment Facility. Once this estimate is received, the township solicitor will forward it to the bonding company for review. The supervisors agreed to have the township solicitor review the proposed changes to the Subdivision and Land Development Ordinance. NEW BUSINESS: Mr. Gerhart announced the township offices will be closed on Monday, September 7, 2015 in observance of Labor Day. Mr. Gerhart announced the September Board of Supervisors Meeting will be held on Tuesday, September 8, 2015 at 7:00 p.m. Following discussions regarding 2015 budget workshops, Mr. Collins made a motion, seconded by Mr. Gerhart to advertise for the budget workshops on the following days, September 14, September 21, October 19, October 26 and November 9 at 7:00 p.m. The motion was carried unanimously. 3 Mr. Gerhart announced that the United States Fish and Wildlife Service intend to apply to DEP for a permit to restore 2,675 feet of Climbers Run. The restoration will restore fish habitat and stabilize stream banks, eliminating a sediment source in the watershed and the Chesapeake Bay. The intent is to install 7 log vanes, 150 feet of mudsill, 90 feet of bank grading and 165 feet of bankfull bench. This section of the stream has been subjected to a long history of farming and use by livestock. Following discussions regarding sponsoring a miniature golf fundraiser for the Pequea Watershed, the supervisors decided they do not wish to sponsor private events. SEWAGE OFFICER Marvin Stoner completed 3 perc and probes tests and issued 1 sewage permits with a total of $ remitted to the township for the month of July. MONTHLY REPORTS Secretary: Receipts totaling $117, were recorded in the month of July. Selective Insurance is requiring the implementation of a safety management program. The manager and the road master will work on developing the program. Road Master: For the month of August, the road crew will finish second round of road bank mowing. Paving will be completed in various spots along the road shoulders. Bicycle approach railings will be installed on the trail at the Sigman Road Bridge. Installations of inlets and gutter cleaning will occur throughout the township. During the month of July road bank mowing continued, roads were seal coated, cross pipes replaced and a stream bank restoration was completed on Snyder Hollow Road. Signs were installed to close the Radcliff Road Bridge. The parking area at the Sigman Road trail head was completed. ZONING REPORT: OLD ZONING BUSINESS: Rose Cooper, Enforcement Notice, property adjacent to 322 Schoolhouse Road: Ms. Cooper was in attendance at the meeting. After review, the Board of Supervisors agreed to honor the agreement and reduce the judgment due from $3, to an amount of $1, Zoning Hearing Board, July 14, 2015, variance request for Warren Griffith: The variance of the side yard was granted for the location of a new manufactured dwelling at 34 Hilltop Lane. State Line Stone/Rock Sports, 645 Lancaster Pike: A second review of the as-builts, written by RAV Associates, was presented. The property owner and Strausser s office are working on addressing the remaining comments in the review letter. Linford Wenger, 383 Pennsy Road, SWMO Enforcement Notice: Mr. Wenger was issued a permit for the improvements done on the property. The violation has been corrected. Jonas Esch, 170 Truce Road, SW Enforcement Notice: The leach trench has been installed. However, the downspouts from the barn addition have not been hooked into the trench system. After discussion, the Board agreed to allow Mr. Esch until August 31, 2015 to complete the storm water facilities. Mrs. Peiffer is to report Providence Township 3

4 on this matter at the September Board meeting. Amos Beiler, 174 Cinder Road, storm water escrow release: This project is a new poultry barn built on property at 198 Cinder Road. After review of the Township Engineer s recommendation letter, a motion was made by Mr. Shaffer and seconded by Mr. Collins to approve the release of an amount of an additional $1, in financial guarantee to Amos Beiler. The balance remaining in the Township storm water escrow account for this project is $6, The motion was carried unanimously. After discussion, a motion was made by Mr. Gerhart and seconded by Mr. Shaffer to grant a waiver of Section 3.07.D.1.a of the SWMO, to allow the basin embankment core to remain as constructed. The motion was carried with two affirmative votes. Mr. Collins voted in opposition to the motion. Subdivision escrow releases: Beiler Engine Service: $ (PT-111LAO-08) and Beiler Engine Service: $ (PT-197FP-14): Motion was made by Mr. Collins and seconded by Mr. Gerhart to authorize the release of a total amount of $ from the subdivision escrow account. The motion was carried unanimously. NEW ZONING BUSINESS: Zoning Hearing Board, Tuesday, August 11, 2015: Two hearings are scheduled: Douglas & Tanya Long, 384 Mt. Hope School Road: An appeal of an enforcement notice and a variance request, concerning a barn structure located too close to the Road and Elam Esh, 2302 Beaver Valley Pike: Multiple variance requests pertaining to planning type criteria in the zoning ordinance. Benuel Beiler, 198 Cinder Road: A letter was sent informing Mr. Beiler of the need to remove the sign at 123 Lancaster Pike, which identifies Frey s Nursery. Mr. Beiler was given until August 31, Ephraim S. Fisher, owner of 12 Main Street, Enforcement Notice: This notice sited a violation concerning the accumulation junk on this property, again. OLD SUBDIVISION BUSINESS: Daniel Beiler, 232 Pennsy Road, storm water escrow release: This is a large lot from the Benuel Beiler subdivision of the former Paul Hollinger property. The property is being developed as a new dairy farm operation. After discussion and review, a motion was made by Mr. Collins and seconded by Mr. Gerhart to deny the release of any storm water escrow, at this time. The denial is based on the large amount of items remaining to be addressed on the property. The motion was carried unanimously. Omar Smoker, Land Development Plan, PT-216FP-15, 1198 Rawlinsville Road: Craig Williams, from Strausser Surveying, was present to discuss this plan. Several waivers were reviewed. A motion was then made by Mr. Shaffer and seconded by Mr. Collins to grant the following waivers, as follows: 1. Section 403.D.22, Landscape Plan: waiver granted, 2. Section 602.J.2, Access Drive Cartway Width: waiver granted, not to include the condition of requiring a pull-off area, 3. Section 603.A.1, Parking Space Dimensions: waiver granted, 4. Section 603.A.2, Buffer Plantings: waiver granted, 5. Section 603.A.7, Parking Lot and Entrance/Exit Lighting: waiver granted, with no conditions, 6. Section 603.A.8, Parking lot Paving Standards: waiver granted, with the condition that all new paving shall comply with the required composition and detail as shown on Sheet 4 of 4. Furthermore, the detail shall specify Superpave Equivalent, 7. Section 603.B.1, Sidewalks: waiver granted, 8. Section 305, requirement for Preliminary Plan approval: waiver granted, no preliminary plan is required, 9. Section 602.J.1, Access Drive Composition: waiver granted and 10. Section 602.J.3, Access Drive Composition: waiver granted. Providence Township 4

5 The motion was carried unanimously. It was noted that a waiver request of Section 608.A, storm water management, was withdrawn by the applicant. After further review, a motion was made by Mr. Gerhart and seconded by Mr. Shaffer to grant conditional final plan approval of the Omar Smoker Final Land Development Plan, with the condition of completion of compliance of all comments from the review letter by Solanco Engineering, dated July 6, 2015 and the approval, with conditions, of all requested waivers. The motion was carried unanimously. Mr. Shaffer then made a motion to authorize the completion of the planning module for the Omar Smoker Final Land Development Plan, adopt the module with Resolution No and forward the completed module to the DEP for final approval. Mr. Collins seconded the motion and it was carried unanimously. Creekside Preliminary Subdivision Plan, 470 Fairview Road, PT-175FP-15: A letter from James Holley & Associates, concerning the application for a public water supply permit for the proposed community water system for this development, was presented to the Board. NEW SUBDIVISION BUSINESS: Quarry Ridge Builders, Waiver request of land development plan requirements, 288 Hollow Road: Zoning Hearing Board had granted permission to allow Quarry Ridge Builders to use the existing pole building at 288 Hollow Road as a contracting business. Samuel Blank and Tiny Maximus were present to represent Quarry Ridge Builders. After discussion and review, a motion was made by Mr. Shaffer and seconded by Mr. Collins to grant a waiver of the requirements for land development plan requirements to Quarry Ridge Builders, for the existing facility at 288 Hollow Road. The waiver is granted with the condition of completion of compliance with conditions Nos. 2, 3 and 4 of the Solanco Engineering review letter, dated May 15, The motion was carried unanimously. Ronald Kilgore Planning Module, 456 Cinder Road: Brian Masterson, from Regester Associates, was present to explain this proposed land development plan. The plan proposes the construction of a second dwelling on the property. After review, a motion was made by Mr. Collins and seconded by Mr. Shaffer to authorize the township manager to complete the planning module for the Ronald D. Kilgore Land Development Plan, adopt the module with Resolution No and forward the completed module to the DEP for final approval. The motion was carried. EXECUTIVE SESSION: At approximately 9:27 p.m., Mr. Collins made a motion, seconded by Mr. Gerhart to enter into an executive session to discuss potential litigation. The motion was carried unanimously. At approximately 9:45 p.m., Mr. Collins made a motion, seconded by Mr. Gerhart to come out of the executive session. The motion was carried unanimously.
