1 UWCHLAN TOWNSHIP BOARD OF SUPERVISORS MINUTES OF REGULAR MEETING JULY 14, 2014 The meeting was called to order at 7:30 p.m. by Chairman Frederick W. Gaines and the Pledge of Allegiance was recited. Present: Supervisors: Frederick W. Gaines, and Joseph E. Toner; Township Manager Doug Hanley; Building/Zoning Officer Tom Cooke; Township Secretary Katie Churchill; Township Treasurer Sue Bernhard; Assistant Zoning Officer Tara Caputo; Fire Marshal Mike Holmes; Police Chief Joe Pontarelli and Detective Tom Fortmann. Minutes: Mr. Toner made a motion to approve the minutes of June 9, 2014 and June 27, 2014 and Mr. Gaines seconded. Mr. Gaines asked for public comment. There being none, the motion was carried unanimously. REPORTS: Police: Chief Pontarelli reported that there were 246 traffic citations issued, 17 criminal arrests and 35 traffic accidents during the month of June. Treasurer: Ms. Bernhard has submitted her report for the month of June. The following is a list of revenues and expenses: Fund Revenues Expenses General $383, $885, Hydrant 1, , Sewer 52, , Ms. Bernhard reported that to date the Township has collected approximately 55% of its budgeted revenues and spent about 50% of its budgeted expenditures. Public Works: Mr. Hanley reported that for the month of June the Public Works Department milled along curbs around catch basins; raised manholes; paved Noel Circle, Bauman Circle, Berkley Rd., Kent Dr., Sharp Ln., Autumn Dr., Timberlake Dr., and Timber Springs Ln.; replaced pipes in the Pine Creek Rd. culvert; performed weekly meter checks and monthly grease trap checks; and performed general maintenance of vehicles. The total cost for the paving project was estimated to be $183, The actual cost was $182, He also reported that for the month of June the daily average flow to Downingtown was 2.03 million gpd and there were no new sewer connections to either DARA or Eagleview.

2 Board of Supervisors - July 14, 2014 Page 2 of 5 The Township has received 2.39 inches of rain during the month of June with a year-to-date surplus of approximately 5 inches. Fire Marshal: Mr. Holmes reported that for the month of June he responded to 7 fire calls during working hours; spent 8 hours of work time handling Fire Department activity; investigated 2 open burning complaints; and reviewed plans for commercial buildings and inspected those under construction. Lionville Fire Co.: Mr. Holmes reported that the Fire Company answered 57 alarms during the month of June, 31 of which were in Uwchlan Township. Uwchlan Ambulance Corps: Mr. Baxter reported that during the month of June the Ambulance Corps responded to 265 calls, 87 of which were in Uwchlan Township. Mr. Toner made a motion to accept the Reports as presented and Mr. Gaines seconded. Mr. Gaines asked for public comment. There being none, the motion was carried unanimously. BUSINESS: Chester County District Attorney Presentation to the Police Department: Chester County District Attorney, Tom Hogan, commended the Uwchlan Township Police Department along with the Kennett Square FBI for their work in the apprehension of serial bank robber, Marcus Ricketts. Mr. Ricketts was in the process of getting away with $30,000 from a robbery at the M & T Bank in Uwchlan Township when he was stopped by Officer Diane Ahern. Police officers given commendation were McNally, Sheller and Gale. A representative from the FBI thanked our officers, stating that the police department is one of the finest in Chester County. Brandywine Creek Greenway Presentation: John Snook, a representative from the Brandywine Creek Conservancy, discussed plans to preserve green space throughout 24 municipalities that border the Brandywine Creek either by keeping more acreage green and/or installing trail systems. Part of the project involves extending the Struble Trail and connecting an extension of the Chester Valley Trail into the Borough of Downingtown. Permission to Open Discussion with Uwchlan Conservation Trust: Mr. Hanley reported that the Conservation Trust has approached the Township with concerns for the costs involved with the continued maintenance and preservation of the Meeting House on N.

3 Board of Supervisors - July 14, 2014 Page 3 of 5 Village Ave. He asked the Board for permission to discuss with the Trust members as to how the Township may fit in to this picture. The Board members gave their OK. Permission to Advertise - Ordinance No : To Allow for a Preliminary/Final Plan for Major Subdivisions or Land Development and to Allow for the Plan to be Reviewed as a Final Plan as Long as the Requirements are Met This Ordinance has been drafted and will be advertised for adoption. Final Plan Approvals and Resolutions: 1. St. Paul s Lutheran Church: Final Land Development Plan Resolution No Lisa D Andrea from Medveczky Associates presented the Final Land Development plan for an approximate 1800 s.f., 2-story addition to St. Paul s Lutheran Church located on Village Ave. The space will house classrooms, offices and bathrooms. Also planned are new stormwater basins as well as a reconfigured parking area. Revisions have been made based on past review letters. Applicant has received final review letters from E.B. Walsh dated June 27, 2014; Stubbe Consulting dated June 18, 2014; Police dated June 24, 2014 and Fire Marshal dated June 24, 2014 and has agreed to comply with all items including adding notes to the plan as stipulated in the Stubbe review letter. Mr. Toner made a motion to approve the Final Land Development plan contingent on compliance with all items in the above noted review letters and Mr. Gaines seconded. Mr. Gaines asked for public comment. There being none, the motion was carried unanimously. Mr. Toner made a motion to also adopt Resolution No memorializing same and Mr. Gaines seconded. Mr. Gaines asked for public comment. There being none, the motion was carried unanimously. 2. Lionville YMCA : Final Land Development Plan Debbie Shulski, Attorney for the YMCA, presented the Final Land Development plan showing a 9,000 s.f. addition to the existing building with the required parking spaces including 31 spaces to be located immediately behind the basin along Devon Dr. The Applicant has received review letters from E.B. Walsh dated June 30, 2014; Stubbe Consulting dated June 18, 2014; Tom Brown dated January 27, 2014; Police

4 Board of Supervisors - July 14, 2014 Page 4 of 5 dated June 24, 2014; Fire Marshal dated June 24, 2014 and agreed to comply with all of the comments. Mr. Gaines said he heard that there is a reciprocity of membership for Y members and asked whether this will impact the parking. Denise Day, YMCA CEO, stated that although some people may visit other YMCA s, members tend to go to their home YMCA. She does not expect a parking problem. Mr. Toner made a motion to approve the Final Land Development plan contingent on compliance with all comments listed in the above noted review letters and all Conditions of the Conditional Use Order dated April 15, 2014 and the Zoning Hearing Order dated June 4, 2014, as well as establishing an escrow for landscaping, storm drainage and erosion controls and Mr. Gaines seconded. Mr. Gaines asked for public comment. There being none, the motion was carried unanimously. Mr. Toner made a motion to also adopt Resolution No memorializing same and Mr. Gaines seconded. Mr. Gaines asked for public comment. There being none, the motion was carried unanimously. Support of PSATS Position on Pipe Line: Mr. Hanley stated that PSATS has taken a stand regarding Sunoco and their intrusion onto private property, stating that work associated with the Sunoco pipe line should comply with the municipality s zoning and subdivision and land development regulations since any pipe line placement could be detrimental to the public s health, safety and welfare. Mr. Toner made a motion to support PSATS position by sending a letter to the Pennsylvania Public Utility Commission stating same. Mr. Gaines seconded the motion and asked for public comment. There being none, the motion was carried unanimously. REQUESTS: Williamsburg Homeowners Association - Movie Night - August 16 th, 7 p.m. to 10:30 p.m. This is a yearly request. No incidents have occurred in the past according to the Police Department. Mr. Toner made a motion to approve the request and Mr. Gaines seconded. Mr. Gaines asked for public comment. There being none, the motion was carried unanimously.

5 Board of Supervisors - July 14, 2014 Page 5 of 5 ANNOUNCEMENTS: 1. 07/18 - UTIDA - 8:30 a.m /06 - Planning Commission - 7:30 p.m /11 - Board of Supervisors - 7:30 p.m /14 - Historical Commission - 7:30 p.m.- Cadwalader House OPEN TO THE PUBLIC FOR QUESTIONS AND COMMENTS 1. Mr. Toner commented that Uwchlan Township has been proactive with regards to protecting open space. Uwchlan has the most extensive trail system with 27% dedicated open space. 2. Chief Pontarelli requested permission to insure and title a vehicle for police special operations business. The Board gave their OK. 3. Patrick and Carol Brown, 211 Allen Dr., voiced their concerns with the Sunoco pipeline. They stated that the Company has no regard for the individual homeowner; if they want to gain access to your property, they just come on to it. They said they definitely support PSATS position and hope that the Township will help the residents. 4. Two Boy Scouts were present and recognized by the Board members. There being no other business, Mr. Toner made a motion to adjourn the meeting at 8:16 p.m. Mr. Gaines seconded and it was carried unanimously.
