ECA Projects become Successes Stefan Thomann Budapest, 19 May 2017
Today s Topics 1. Standardisation Commission Decision / Standardisation Mandate Revision of CEN Candle Standards 2. Joint Research Scented Candle Emission Study (cooperation with NCA and ALAFAVE) Multi-Stakeholder Emission Studies in Denmark Joint Emission Results Data Base (cooperation with AECM, A.I.S.E. and IFRA) 3. Compliance ECA Product Compliance Guide Consultation and Services 4. Fair Competition & Economic Improvement Suspension of Duties on Paraffin Wax Imports Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
1. Standardisation Standardisation is EXTREMELY important for the candle industry: Filling the numerous blank spots in legislation with substance in the candle industry s best interest Establishing facts to avoid involvement of EU and national authorities Standards are developed by experts for these products and work in practice Establishing a level playing field for both domestic candle manufacturers and third country producers exporting to the EU Increasing consumer safety Reducing the risk of erratic Court Decisions Products complying with quasi-harmonised standards trigger an assumption of safety Standardisation should be TOP PRIORITY for candle industry! Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
1. Standardisation - Commission Decision / Mandate EU Commission Decision / future Standardisation Mandate Discussion of safety requirements in the Consumer Safety Network (CSN) and GPSD Committee (Dec Jun. 2015) Member State representatives accept the draft CD (Oct. 2015) European Parliament and Council accept the draft (Feb. 2016) COM publishes the CD -> NOT done yet, expected in??? COM issues a Standardisation Mandate to CEN -> 6 months after publication of CD CEN develops standards -> typical timeline for new standards is 3 years, i.e. first new quasi-harmonised standards published in 2021 Important: The safety requirements are not legally binding, only the standards transposing them are! Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
1. Standardisation - Revision of CEN Candle Standards EN Specification for sooting behaviour Major changes: no separate test procedure for tea lights anymore clear description of the maximum diameter plus illustrated guidance for irregular candle types detailed description of all procedures figures in line with CEN requirements Next steps: Translation into French and German CEN enquiry ballot (July September 2017) Formal vote (April May 2017) Publication of revised standard by June 2018 at the latest Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
1. Standardisation - Revision of CEN Candle Standards EN Specification for fire safety Major recent changes: Informative (non-binding) annex explaining the evaluated data and the difficulties with measuring container surface temperatures Recommendation to use safety information Do not touch, may be hot! Open point: Development of test procedures for self-extinguishing candles, i.e. candles that shall [ ] at the end of the burning time self-extinguish and effectively prevent the ignition of the surface underneath by constructive features.. Different types of self-extinguishing candles normal selfextinguishing candles and special self-extinguishing candles for use on highly flammable surface, e.g. on Advent wreaths, flower arrangements, etc Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
1. Standardisation - Revision of CEN Candle Standards EN Specification for fire safety Planned timeline: Finalising draft and registration as New Work Item by March 2018 CEN enquiry ballot (December 2018 February 2019) Formal vote (summer 2019) Publication of revised standard in Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
1. Standardisation - Revision of CEN Candle Standards EN Product safety labels Major recent changes: Abbreviating safety texts Improving comprehensibility of symbols based on 2016 Consumer Comprehension Study (ongoing) Open points: Different optional safety information for different candle types Reducing the number of used safety messages to a minimum, based on a risk assessment Splitting up mandatory safety information (front side) and optional safety information (back side, inner sides) in case of small labels Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
1. Standardisation - Revision of CEN Candle Standards EN Product safety labels Planned timeline: Finalising draft and registration as New Work Item by March 2018 CEN enquiry ballot (December 2018 February 2019) Formal vote (summer 2019) Publication of revised standard in Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
2. Joint Research Scented Candle Study Scented Candle Emission Study (cooperation with NCA and ALAFAVE) Objective Follow-up study to the 2007 Ökometric study on unscented candles made of 5 different fuels Up-to-date study on emissions from scented candles in general and for all major fuels Gaining more knowledge on combustion products and levels Defending the candle industry Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
2. Joint Research Scented Candle Study Details 5 fragrance mixtures (Floral, Fresh, Fruit, Oriental and Spice&Edibles) including carriers (BB, DOA and IPM) 4 fuels (Paraffin, Palm, Soy and Stearin) 5% fragrance load 24 different combinations 5 fragrance mixtures x 4 fuels 4 unscented fuel as control Testing by Fraunhofer acc. to EN with some modifications on e.g. VOC, e.g. benzene Aldehydes, e.g. formaldehyde PAH, e.g. naphthalene Fine / ultrafine particles Planned conclusion in autumn Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
2. Joint Research Multi-stakeholder studies in Denmark Multi-Stakeholder Emission Studies in Denmark Background Many negative media reports about fine particle emission from candles in Denmark and other Nordic countries Consumers are nervous and use LED imitations instead Candle market in Denmark decreased by 15% in the past years Problem Measurements cover only size and number of the emitted particles, not the chemical composition Candle particles are very different from the persistent particles emitted by other sources, e.g. by diesel cars or wood fires Mostly salts used for wick preparation Non-toxic and water-soluble dissolve immediately when inhaled Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
2. Joint Research Multi-stakeholder studies in Denmark Smaller study (approved) Objectives: Partners: Timeline: Size, number and chemical composition of particle from three different candle types Development of candles that emit less health relevant particles with otherwise same performance Danish EPA (Miljøstyrelsen), DTI (Danish Technological Institute), ASP Holmblad, Liljeholmens, Promol, ECA January 2017 June 2018 Study scope too narrow for holistic statement for candles in general Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
2. Joint Research Multi-stakeholder studies in Denmark Larger study (applied for) Objectives: Partners: Timeline: Comprehensive investigation of candle emissions (gaseous and particles) from a great number of different candles Evaluating the health effects of particle emissions in particular Development of candles with lower health relevant emission Danish Innovation Fund, DTI (Danish Technological Institute), University of Aarhus, University of Lund, ASP Holmblad, Liljeholmens, Promol, ECA, Coop Denmark, AAK, Danwax 36 months Study scope large enough for holistic statement for candles in general, but not approved yet Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
2. Joint Research Joint Emission Test Data Base Joint Data Base with Emission Test Results for Scented Candles together with AECM, A.I.S.E. and IFRA Background Emission testing acc. to EN is expensive (min EUR/sample) Customer start requiring confirmation France considers legally binding emission limits Objectives Predicting the emissions based on candle type, diameter, fuel, fragrance and fragrance load, burn rate, etc. Avoiding expensive own testing Argumentation towards national and EU authorities Status and next steps Simple pilot data base with ca. 180 data sets exists Next step: Check if there is sufficient correlation between the results Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
3. Compliance - ECA Product Compliance Guide ECA Product Compliance Guide Background Compliance with all EU and national legislative and normative requirements has become increasingly complex and time-consuming Non-compliance can have serious financial consequences or even threaten a company s existence Smaller and medium-sized companies do not have the financial means to employ a full-time compliance manager Concept Comprehensive summary of all legal & normative requirements in understandable language Finding all relevant requirements for a specific product in minutes Developed by experts with the input of candle manufacturers Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
3. Compliance - ECA Product Compliance Guide Scope All relevant legal & normative requirements General product safety (e.g. GPSD) Chemical legislation (e.g. REACH, CLP, etc.) Relevant standards (e.g. EN 15493, EN 15494, EN 16738, EN 16740, etc.) Packaging, disposal, transport, etc. National legislation & standards All different candle types indoors / outdoors scented / unscented end-consumers / professional use Countries EU28 Individual EU Member States EFTA Member States (Iceland, Liechtenstein, Norway, Switzerland) Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
3. Compliance - ECA Product Compliance Guide Structure Part I General Requirements in EU Part II National Requirements in EU + EFTA Member States Part III Decision-making trees for certain products Benefits Exact requirements for a specific product, e.g. scented glass with 0.3% limonene e.g. type and content of labelling with sample label, possible packaging, safety data sheet yes/no, shipping label, etc. Easy-to-understand summary of relevant requirements Clarity re. current legal situation, especially in individual Member States Increased legal certainty and proactive prevention of compliance violations Legal competence as a differentiating factor compared to competitors Saving working time and costs for external experts Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
4. Fair Competition & Economic Improvement Suspension of Duties on Paraffin Wax Imports Background Anti-dumping duties on Chinese candle imports were not prolonged in August % import duty on candle imports since 2015 Production capacities for fully-refined paraffin wax in Europe have decreased significantly Production volume does not cover demand Candle manufacturers have to import FRP, either directly or via distributors Import duty of 2.2% on FRP imports from most third countries Discrimination of European candle manufacturers! Stefan Thomann, Gütegemeinschaft PCM e.v., May 2017 Stefan Thomann, European Candle Association ASBL,
4. Fair Competition & Economic Improvement Suspension of Duties on Paraffin Wax Imports Requests for tariff quota filed by candle manufacturers in 5 EU Member States annual volume of tons (entire EU) fully-refined paraffin wax with < 0.75% oil content (CN ) Objection filed by one paraffin wax producer, but compromise found annual volume of tons of FRP < 0.75% oil content Tariff quota as of 1 July 2017 open to all industries, not only to candle industry Greyhound principle import duties on imports exceeding tons Potential to save million Euros import duties each year!
