3 FAQ FAQ Frequently asked questions regarding our products Frequently asked questions regarding our products Are LED-luminaires dimmable? A luminaire is noisy during dimming. Is that normal? Does a LED develop heat? How long is the service life of a LED? Are the LED boards of LDM luminaires replacable? Basically yes, with a few exceptions, all LDM luminaires are dimmable. Please also note the note about the individual products in this factbook. The dimming ability always depends on the power supply and the correct combination with the dimmer. For this purpose so-called load symbols can be found on both devices, which should at least correspond with one parameter. Examples for load symbols are: RLC CAUTION! Corresponding load symbols don't guarantee corresponding compability! There may always be producer-dependent differences regarding dimming behaviour and dimming curve. Also the installation and operating instructions have to be observed. In any case the minimum load of the respective dimmer plays an important role. The minimum load may not exceed the sum of the performance data of the luminaires to be dimmed. Otherwise the connected luminaires may flicker caused by shortfall of the minimum load indicated on the dimmer. Flicker can also be caused by ripple-control pulses of the power stations. Yes! Every electronical power supply makes a noise during operation, which is more or less strong, this depends on the type and the producer. Depending on the surrounding area can this noise particularly be heard during dimming. Noise-free dimming is physically not possible, only low-noise dimming! Operating noise in conjunction with the dimmer is absolutely normal. The strength of this operating noise depends on the dimming-modus and becomes a little bit louder with decreasing brightness. A noise generation that is too loud and clearly audible indicates as a rule a fault and can also be caused by a mechanical vibration, if i.e. electrical parts have no solid connection. Or if i.e. a wrong power supply/dimmer combination had been chosen (see chapter dimmer/load symbols!). Of course yes! Each LED develops heat.the often common public opinion that LEDs don't get hot doesn't comply with the real physical facts. Depending on the power consumption and the current flow of the LED the LED chip can get hot up to 90 at its base. This heat development is normal and has to be dissipated, otherwise the LEDs can be damaged. Therefore it is absolutely necessary to provide sufficient cooling space in the product design. For all LDM luminaires the necessary cooling space for the particular product is individually calculated and implemented in order to guarantee a maximum service life of the LEDs. It also has to be noted that polished surfaces heat more intensive than e.g. Powder-coated surfaces. As cooling space can serve the luminaire itself when it is e.g. made of aluminium or a specially for this purpose mounted component which e.g. for recessed luminaires vanishes into the ceiling. CAUTION: Especially for recessed luminaires an adequate ventilation must always be ensured in order to avoid heat accumulation! The service life of a LED depends on several factors. There is no guarantee. One of the most important factors to reach the maximum service life is the optimal cooling and heat dissipation (look above). It is generally assumed that under ideal conditions a service life of > hours is absolutely realistic. Afterwards the LED isn't broken, but only provides 80% of its initial brightness. Basically yes! LDM exclusively uses high-quality boards, that all have been developed indvidually for LDM products and offer a maximum of luminous efficiency. Due to the high performance of the LEDs an optimal heat transmission to the heat sink component is necessary. In order to assure this also after a replacement, the change has to be carried out by a qualified electrician of LDM. Furthermore LED chips are sensitive semi-conductors, which should only be inserted into a luminaire by means of special technical aids (e.g. earthed working places to avoid static charge). In the event of a repair we would be pleased to submit you an individual and fair quote. LDM offers e.g. for the ECCOLED procuct series DALI/EIB-capable power supplies which however cannot be integrated into the ECCOLED MODULA profile rails due to their construction and size. These power supplies only can be located externally on site. Furthermore special solutions for individual cases can be developed. This depends significantly on the individual combination power supplies/current/consumer. For this reason general statements cannot be made.please contact us directly with your individual case! Our technical department is pleased to work together with you to provide the optimal solution for your fitting situation. Please generally clean luminaires only in switched-off and cooled (!) state. Otherwise there is a danger of getting burned or getting bandings. Never use aggressive or chemical cleaning agents. We recommend mild soapy water and smooth, lint-free cloths, preferred microfiber clothes. Never use paper towels or tissues! Aluminium polished surfaces always have due to the material a very soft surface. An easily visible line formation by polishing is normal and emphasizes the handcrafted quality of the product. By cleaning with hard cloths (paper towels or tissues, see above) the surface can be scratched additionally. Brass-matted surfaces can due to the material darken and get blisterings as i.e. dark spots. This is caused by the alloy of copper, zinc and lead. WYNG lightboards made of acrylic glass should be cleaned with the care kit offered by us. This contains a box of compressed air to remove loose particles of dust before cleaning, an anti-static plastic cleaner and a special microfibre cloth for high-quality plastic surfaces. Do not use cleaning agents containing solvents as i.e. methylated spirit! Never use hard cloths (see above) as the sensitive plastic surface can be scratched. Almost always this is about a mounting error! ECCOLED MODULA profile rails are made of aluminium. Each metal and especially aluminium as a good heat conductor changes under the influence of heat. When you mount the ceiling mountings without the supplied plastic spacers, it may happen that the profile is pressed to the ceiling with a huge pressure and is under permanent voltage. During cooling down after the switch-off these voltages discharge with a clearly audible cracking noise. Therefore please check firstly that the luminaire had been mounted correctly. If the spacers have been correctly installed with the ceiling mountings, an uniformed shadow gap can be seen between profile rail and ceiling! In order for the touch-dimmer to work perfectly, generally two things have to be noted: 1. The luminaire mustn't have direct contact to the surrounding as i.e. ceiling or floor. Therefore an isolating layer has to be applied under the base stand of floor-standing and table luminaires. Floor-standing luminaires shouldn't stand on deep-pile carpets or in this case have to be put on a raised plane. 2. The user has to be earthed 100%! If the user i.e. stands on a carpet or a wooden floor and additionally wears shoes with rubber soles, no contact closure comes about and the touch-dimmer will not react or will react poorly. Taking off the shoes or touching a wall or a radiator at the same time (connecting to earth) lead in most cases to success. Can LDM luminaires be integrated into a DALI/EIB-system? Which cable lengths are secondarily possible? How to maintain the surfaces of LDM luminaires? ECCOLED MODULA system makes cracking noises. What can be done? The touch-dimmer reacts poorly or not at all! 4 5

4 The silhouette of WYNG shows the impression, elegance and lightness of a bird. It consists of a special acrylic glass surface, printed with light-conducting material. In a newly developed lightboard LED light is invisibly coupled in and coupled out again by means of a precisely calculated dot screen in the form of dots and cubes. 54 GTS General Terms of Sale LDM Licht, Design, Metallelemente GmbH Frankstr. 25, Pforzheim Article 1 General - Scope 1. The following General Terms of Sale (GTS) shall be applicable to all present and future business relations as well as to all statements in connection herewith in brochures, Price (excl. VAT.) lists, advertisements etc, regardless of whether these are made orally, in writing or on the internet. Any changes to a concluded agreement must be made in writing. Any GTS deviating from these conditions shall not be recognised. By placing an order, you accept the validity of these conditions. LDM is be entitled to change these GTS at any time with future effect. 2. A Consumer, as defined in the GTS, is every individual person who purchases LDM products for a purpose, that can neither be attributed to his/her commercial nor self-employed professional activity. Entrepreneurs, as defined in the GTS, are individual or legal entities or a company with legal capacity who purchases products from LDM, exercising a commercial or self-employed professional activity. A Customer, as defined in the GTS, is everyone who purchases from LDM, both Consumers and Entrepreneurs. 3. Deviating, opposing or supplementary GTS, even if they are known, shall not be a part of the agreement unless their validity is explicitly agreed in writing by LDM. Article 2 Conclusion of the agreement/delivery 1. Our offers shall be non-binding. Any technical changes as well as changes to shape, colour and/or general quality within reasonable bounds shall remain reserved. We shall reserve all property and copyrights to any documents belonging to the offer, said documents may not be made available to any third parties and shall be immediately returned to us at our request, particularly if the order is not placed with us. 2. By ordering a product, the Customer shall be deemed to have declared its intention to purchase the ordered goods. We shall be entitled to accept the contractual offer constituted by the order within two weeks after receipt. Acceptance can either be declared in writing or on delivery of the goods to the Customer. 3. If the Consumer orders goods electronically, we shall confirm receipt of the order immediately. Confirmation of receipt shall not represent binding acceptance of the order. Confirmation of receipt can be linked with the declaration of acceptance. 4. The agreement shall be concluded subject to the condition of correct and timely delivery by our supplier. This shall only apply in the event that we are not responsible for non-delivery, especially on conclusion of a congruent hedging transaction with our supplier. The Customer shall be informed immediately about any insufficient availability of services. Any advance payments made shall be immediately reimbursed. 5. LDM shall be entitled to make partial deliveries and services at any time. 6. If, after conclusion of the agreement, as part of further product development and improvement/changes to the goods are made, we shall be allowed to deliver the modified version. Furthermore we are entitled to any customary or permissible deviations of images, drawings, descriptions, colours, forms, design and versions as well as measurements, weight, quality and other information according to the German Institute for Standardisation (DIN). When placing an order, the Customer must notify us if their specifications and standards may under no circumstances be deviated from. 7. If the Consumer orders goods electronically, the text of the agreement shall be stored by us and sent to the Customer on request by , along with these GTS. Article 3 Retention of title 1. For agreements with Consumers, we shall retain title of the goods until receipt of payment in full of the purchase Price (excl. VAT.). For agreements with Entrepreneurs, we shall retain title of the goods until full settlement of any claims from a current business relationship. If the value of the goods subject to retention of title exceeds the value of the claims by more than 20%, at the request of the Customer, LDM shall declare the release of the securities according to its choice in the excessive amount. The release statement shall be subject to writing. 2. The Customer shall undertake to treat the goods carefully. If maintenance and inspection work is required, the Customer shall regularly carry this out at its own expense. 3. The Customer shall undertake to inform us immediately if any third parties gain access to the goods, for instance in the event of seizure of property as well as any damage to or destruction of the goods. The Customer shall inform us immediately of any change of ownership for the goods as well as any change of their own residence or business location. 4. We are entitled to withdraw from the agreement and reclaim the goods in the case of any Customer behaviour contrary to the agreement, in particular in the case of default in payment or violation of a duty according to articles 3 and 4 of this agreement. 5. The Entrepreneur shall be entitled to resell the goods in the course of ordinary business. It shall assign all claims to us to the amount of the invoiced amount which arise from resale to a third party. We shall accept the assignment. Once the Entrepreneur has assigned its claims to us, it shall be authorised to collect the claim. We shall reserve the right to collect any claim ourselves as soon as the Entrepreneur does not fulfil its payment obligation and is in default of payment. 6. Handling and processing the goods through the Entrepreneur shall always be made in our name and on our behalf. If processing is carried out with items that do not belong to us, we shall acquire joint ownership of the new items in proportion to the value of the goods delivered by us to the other items processed. The same shall apply if the goods are mixed with other items that do not belong to us. Article 4 Price (excl. VAT.)s and terms of payment 1. Any product Price (excl. VAT.)s stated do not include delivery, insurance or installation costs or taxes; these costs shall be invoiced separately. LDM reserves the right to adjust costs correspondingly for future transactions in the case of changes in exchange rates, tax, carriage and insurance costs, and cost Price (excl. VAT.)s. Cheques shall only be accepted on account of performance. 2. The Customer undertakes to pay the purchase Price (excl. VAT.) within ten days after the receipt of the goods. Upon expiry of this period, the Customer shall be in default of payment. During the default, the Consumer shall be charged interest on the debt to the amount of 5% above the basic interest rate. Entrepreneurs shall be charged 8% interest above the basic interest rate on the debt. For Entrepreneurs we shall reserve the right to prove higher default damages and assert these claims. 3. The Customer shall have a right to set off only if its counterclaims were ascertained to be res judicata or are uncontested by us. The Customer may only exercise a right of retention if its counterclaim is based upon the same contractual relationship. Article 5 Place of performance/passage of risk 1. The place of performance for all performances shall be the head office of LDM. 2. If the buyer is an Entrepreneur, risk of accidental destruction or deterioration of the goods shall pass over to the buyer on handing over the goods if the goods are delivered to a place other than the place of performance, when the goods are handed over to the carrier, transport contractor or any other party or organisation involved in the shipping. 3. If the buyer is a Consumer, the risk of accidental destruction or deterioration of the sold item shall pass over to the buyer, also if the goods are delivered to a place other than the place of performance, when the item is handed over to the buyer. 4. If the buyer defaults on acceptance, this shall be deemed equivalent to a delivery. Article 6 Guarantee/notification of defects 1. If the buyer is a Entrepreneur, we shall offer a guarantee for defects of the goods by rectification of a defect or by providing a replacement at our discretion. 2. If the Customer is a Consumer, then, in consideration of our economic interests, the following procedure shall be agreed to rectify a defect of the goods: If the buyer is a Consumer, he/she initially has the choice whether supplementary performance should be made through rectification or a replacement. However, we shall be entitled to withhold the type of supplementary performance chosen if it is only possible with disproportionate costs and the other type of supplementary performance has no substantial disadvantages for the Consumer. 3. If the supplementary performance fails the Customer may demand a reduction in Price (excl. VAT.) (decrease) or rescission of the agreement (withdrawal). However, in the event of an insignificant contractual violation, particularly for insignificant defects, the Customer has no right to rescission. 4. On receipt of the goods, Entrepreneurs must comply with the obligation to inspect and notify in accordance with articles 377 and 378 German Commercial Code (HGB) and immediately report any defects in writing; otherwise enforcing guarantee claims shall become impossible. Timely dispatch shall be sufficient for complying with the time limit. The Entrepreneur shall bear the full burden of proof for all claim requirements, especially for the defect itself, for the point in time in which the defect was found and for promptly making a complaint about the defect. Consumers must inform us in writing about obvious defects in writing within the deadline of one month after the time that the goods were discovered to be in violation of the contractual conditions. Receipt of the notice by us is essential for complying with the deadline. If the Consumer fails to provide this information the guarantee rights shall expire one month after noticing the default. This shall not apply in the case of fraudulent intent on the part of the seller. The Consumer shall bear the burden of proof for the time of noticing the default. If the Consumer was moved to buy the goods due to inaccurate manufacturer statements, he/she shall bear the burden of proof for this purchase decision. For used goods, the Consumer shall bear the burden of proof for the item s defectiveness. 5. If the Customer chooses to withdraw from the agreement because of a deficiency of title or material after a failed supplementary procedure the Customer is not entitled to any additional damage claims due to the defect. If the Customer chooses compensation for damage after a failed supplementary procedure the goods shall remain with the Customer if this is reasonable. Compensation shall be restricted to the difference between the purchase Price (excl. VAT.) and the value of the defective goods. This shall not apply if we have fraudulently caused the breach of contract. 6. For Entrepreneurs the guarantee period shall be one year from delivery of the goods. For Consumers the guarantee period shall be two years from delivery of the goods. For used goods the limitation period shall be one year from delivery of the goods. This shall not apply if the Customer has not promptly notified us of the defect (article 4 of this agreement). 7. If the buyer is an Entrepreneur, only the product description from the manufacturer regarding the quality of the goods shall be deemed to be agreed. Public statements, recommendations or advertising from the manufacturer shall not represent any additional contractual details as to the quality of the goods. 8. If the Customer receives inadequate assembly instructions, we shall only be obliged to deliver adequate assembly instructions and this is only if the inadequacy of the assembly instructions prevents proper assembly. 9. The Customer shall not receive any guarantees from us in the legal sense. Manufacturer guarantees shall remain unaffected hereof. 10. Particularly, LDM shall not provide a guarantee for: - defects caused by faulty installation by you or by a third party commissioned by you, - operating errors, - interference in or modifications to the product by you or an unauthorised third party as well as defects caused by external influence on the product, - suitability of the product for a specific intended purpose - services which were performed according to your specifications. Article 7 Liability limitation 1. In cases of slightly negligent breaches of obligations, our liability shall be limited, according to the type of goods, to foreseeable, contractually typical and direct average damage. This shall also apply in cases of slightly negligent breaches of obligations by our legal representatives or vicarious agents. We shall not be liable to Entrepreneurs for any slightly negligent breaches of non-material contractual obligations. 2. The above liability limitations shall not affect Customer claims for product liability. Furthermore any liability limitations shall not apply to cases of bodily harm and damage to health attributed to us or by the Customer s loss of life. 3. Customer s compensation claims due to a defect shall lapse after one year from delivery of the goods. This shall not apply if we are to blame for fraudulent intent. Article 8 Data protection Your data undergoes electronic data processing within the framework of handling business transactions. LDM shall respect the provisions of the German Federal Data Protection Act when using personal data. Article 9 Product name/copyright/purchasing 1. Any processing, changing or labelling of our products which create the impression that the goods are products of the Customer shall be forbidden. 2. The Customer is entitled to resell any goods from LDM in their shops, branches and online shops for which the goods were ordered. 3. Upon conclusion of the purchase agreement the Customer shall undertake to purchase exclusively from LDM and not from other suppliers. 4. In cases of infringement against these obligations according to articles 1 to 3 the Customer undertakes to pay a penalty to LDM. The extent of the penalty shall be set by LDM at their discretion and, if necessary, shall be submitted to the relevant court for its review. The penalty shall amount to at least EURO 2, Any injunctive relief as such shall remain unaffected by making such payment. Article 10 Final provisions 1. The law of the Federal Republic of Germany shall apply. The applicability of the Uniform International Sales Law shall be excluded subject to other agreements between the parties. 2. If the Customer is a business person, a legal entity under public law or special corporation under public law, the exclusive place of jurisdiction for any disputes from this agreement shall be our place of business, Pforzheim. The same shall apply if the Customer does not have a general place of jurisdiction in Germany or if its residence or permanent address is not known at the time of commencement of an action. 3. If any individual provisions of the agreement with the Customer are or become entirely or partly ineffective, including these GTS, this shall not affect the effectiveness of the remaining provisions. The entire or partly ineffective provision shall be replaced with a provision whose economic purpose comes a close as possible to the ineffective provision.
