CASE STUDY OF FORENSIC ANALYSIS IN CRIMINAL PROSECUTION Presented by David Wall This technical program will study the investigation and prosecution of Ryan Rude, who ran a $5-million Ponzi scheme in Southern California s Inland Empire from 2007 to The program gives the audience detailed inside information regarding techniques and approaches employed in a white-collar criminal investigation and prosecution. Detailed analysis and explanations are provided giving deep insight into the forensic examination, approach, and presentation are described in detail. Additionally this session addresses specific information regarding the format and content of expert testimony as presented to the jury, and upheld in two days of blistering cross examination. Legal elements and evidentiary requirements for criminal cases will be discussed as will defenses to white collar crime. Learning Objectives: 1. Learn specific procedures for forensic analysis and presentation in criminal cases. 2. Gain knowledge of legal elements and evidentiary requirements for criminal cases. 3. Predict challenges and defenses to forensic evidence and testimony in white-collar crime. David Wall, JD, CPA, CFE David Wall has been employed in the areas of financial investigation and fraud examination in Southern California for over 25 years. Mr. Wall is a fraud specialist, with credentials as a certified public accountant, certified fraud examiner, and licensed attorney. Mr. Wall is a director in the forensics practice of Vicenti Lloyd Stutzman LLP, a 63-year-old accounting firm with offices in Downtown Los Angeles and Glendora, California. Mr. Wall leads forensic investigations in governmental entities, nonprofit organizations, and middle market corporations. He represents a number of prosecutorial offices, including the Riverside County District Attorney, and works on behalf of private litigants in state and federal litigation involving fraud, embezzlement, breach of fiduciary duty, fraudulent transfer, and similar claims. His specialties include the acquisition, reconstruction, and analysis of financial records, and the presentation of observations and opinions to judges and juries. TUES. OCT 25, :30 12:00 P.M. CYBERSECURITY AND DATA BREACH RESPONSE. WHAT S HAPPENING, WHAT S NEW, AND WHAT YOU NEED TO KNOW. Presented by Christine Arevalo This session will cover cyber security threat and vulnerability. You will learn about emerging threats, existing scams, and the effect they can have on you, or your organization. We will also touch on data breach trends, and company and industry response to unprecedented attacks on our private data Christine Arevalo is a founding employee of ID Experts. Since 2003, she has helped healthcare organizations assess their patient-related information risks, communicate with consumers regarding privacy issues, and develop their data breach response strategies. Christine currently leads the development and adoption efforts for MIDAS the patent-pending and award winning Medical ID Alert System. MIDAS is the first and only member-focused solution to engage health plan members in the early detection and prevention of health care fraud and medical ID theft. Christine also serves as founding member of the Medical ID Fraud Alliance (MIFA) the first cooperative public/ private sector effort created specifically to unite all stakeholders to jointly develop solutions and best practices for the prevention, detection and remediation of medical identity fraud (MedIDFraud.org). Arevalo has served as a founding member of the ANSI PHI Project that created a compelling business case for discussing investments and resources to strengthen healthcare privacy and security programs; contributed to the 43rd President s Identity Theft Task Force; authored identity theft legislation; and has testified on behalf of identity theft victims. Arevalo holds a B.S. in Criminal Justice Administration and M.S. in Economic Crime Management. She is the President and Board Chair of the MIFA Institute, and an active member of national organizations including IAFCI, ACFE, IAPP, NHCCA, and the Oregon/SW Washington Privacy Network.

3 TUES. OCT 25, :00 3:00 P.M. CATCH HER IF YOU CAN TODAY S PINK COLLAR CRIMINAL Presented by Kelly Paxton This topic is Kelly s most widely requested due to the increase in women embezzlers. Tom Brokaw has declared the 21st century as the Century of Women. With a woman recently named head of the Secret Service and a woman named head of IBM, Brokaw believes this will be the century of women. The Pew Research Center just published a study showing that 40% of women are primary breadwinners. Most people won t begin to think that with this progress comes other not so good statistics such as the increase in women embezzlers. In a 10-year period, women embezzlement arrests rose over 40% while male embezzlement arrests only rose 2%. Women now have access to funds and are in positions where embezzlement is generally most prevalent. Kelly will show you what to look for in your business to make sure your most trusted employee is not a pink collar criminal. Kelly Paxton is a Certified Fraud Examiner. She has a background as a commodities trader, stock broker and bond trader. While Kelly was working at a financial services firm, a client was arrested on wire fraud charges. This led Kelly to a new, much more exciting career as a special agent for US Customs. Kelly specialized in white collar crime, narcotics and undercover operations. Kelly has also been a contract investigator for the Department of Homeland Security where she carried out background investigations. She performed hundreds of top secret clearance background investigations for the federal government. From 2007 to 2009, Kelly was the fraud analyst at the Washington County Sheriff s Office Fraud and Identity Theft Enforcement team. Kelly was responsible for preparing cases for prosecution. This included testifying before Grand Jury. Since 2009, Kelly has had her own firm, Financial CaseWorks LLC, which specializes in financial and workplace investigations. What started as a research project for Kelly, investigating women embezzlers or pink collar crime, has now become a website and a very relevant and popular speaking topic. TUES. OCT 25, :15 4:30 P.M. HOW SOCIAL MEDIA NETWORKS FACILITATE IDENTITY THEFT AND FRAUD Presented by Kent Lewis Research reveals that identity theft affects millions of people a year, costing victims countless hours and money in identity recovery and repair. Kent Lewis is President of Anvil, a measurable marketing agency specializing in analytics, search engine and social media marketing. With a background in integrated marketing, Lewis left a public relations agency in 1996 to start his career in digital marketing. In 2000, Lewis founded Anvil Media, Inc. to help move its clients forward via measurable marketing. Under his leadership, Anvil has received recognition from Portland Business Journal and Inc. Magazine as a Fastest Growing and Most Philanthropic Company and Most Admired (as determined by Oregon CEOs) in In 2008, Lewis created Formic Media, specializing digital marketing services for small businesses. He s co-founder of a variety of organizations, including pdxmindshare, eroi and SEMpdx, a Portland-area SEM professional trade association. THE REAL MORAL PSYCHOLOGY BEHIND CHEATING AND FRAUD Presented by Brian Steverson Traditionally we have thought that the motivation for cheating and fraud, especially in the business world, was simply self-interest. Recent work in moral psychology has shown that such a view is too simplistic to fully account for why cheating and fraud occur. We will explore some of that recent work and how its findings impact organizational design to minimize cheating and fraud. Dr. Brian K. Steverson is the John L. Aram Chair of Business Ethics in the School of Business Administration at Gonzaga University, and Faculty President. Prior to assuming the Aram Chair, in 2008, he was a member of the Philosophy Department since He received his Ph.D. from Tulane University in His main areas of current scholarship are business ethics, professional ethics, and the ethics of entrepreneurship. His research interests include the ethics of pre-employment screening for psychopathic disorders, the growing movement for professionalizing business management, the Jesuit model of business education, and the use of choice architecture as a management technique. His work has appeared in Environmental Ethics, the Online Journal of Ethics, Topics in Contemporary Philosophy, the Business and Professional Ethics Journal, the Journal of Ethics & Entrepreneurship, and the Journal of Jesuit Business Education.

5 WED. OCT. 26, :00 3:00 P.M. SALES SUPPRESSION SOFTWARE Presented by Mike Chertude Mike has worked for DOR over 23 years and the Audit Division for 22 years. For the last 16 years he has worked in the Audit Division s SEDA (Sampling and Data Analysis) unit. Mike s expertise is in Sampling (both random and statistical) and data analysis as well as representing DOR as a member on several committees for the Streamlined Sales Tax Governing Board, a national organization to assist states as they administer a simpler and more uniform sales and use tax system. Over ten years ago Mike began the pilot project of researching sales suppression software for the Agency and is known as a national expert on this subject. Mike has given presentations to many states and at FTA conferences around the country on this subject. This presentation will touch on the history of sales suppression, Washington State s program and a demonstration of actual cases. WED. OCT. 26, :15 4:30 P.M. THE FOURTH AMENDMENT IMPLICATIONS OF COMPELLED DECRYPTION Presented by Shaakirrah R. Sanders In February 2016, a federal magistrate judge ordered Apple to assist the FBI in its search of an iphone. Whether and how that order implicates the Fourth Amendment is the subject of this presentation, which explores the long standing tension between search and seizure jurisprudence and technology. Topics include, but are not limited to, the government s authority to conduct searches and seizures and the impact on individual privacy that could result if companies or individuals are required to assist law enforcement by creating or manufacturing technology. Shaakirrah R. Sanders joined faculty at the University of Idaho College of Law in June Professor Sanders teaches subjects related to the US Constitution, including Constitutional Law II, Criminal Procedure, Advanced Criminal Procedure, and the First Amendment. Her scholarship on confrontation rights at felony sentencing has been published in the Hastings Law Journal, the University of Michigan Journal of Law Reform, and the Widener Law Journal. Companion pieces on civil and criminal jury trial rights have been published in the William and Mary Bill of Rights Journal. Professor Sanders previously practiced as a staff attorney with the Defender Association and as an associate attorney with K&L Gates in Seattle and Locke Lorde in New Orleans. She was also a judicial law clerk for the Honorable Ivan L.R. Lemelle in the US District Court for the Eastern District of Louisiana and the Honorable Lavenski Smith in the US Court of Appeals for the Eighth Circuit. Professor Sanders received her JD from Loyola University College of Law in New Orleans, where she served as Index/Casenote editor on the Loyola Law Review and was named a William Crowe Scholar upon graduation. She received a BS in Psychology from Trinity College in Hartford, Connecticut. In June 2016, she became the first African-American female to become a tenured member of the College of Law faculty.
