3 SPEAKER PROFILES David Kreider, Worldwide Independent Arbitrator Appointed in related proceedings as sole arbitrator and as chairman, respectively, in a complex IP licensing dispute between Singaporean and P.R. China parties, under an agreement requiring that the arbitrator be bilingual in both Chinese and English. Chaired an SIAC reference and drafted the award in a dispute between Australian and Malaysian parties to a software distribution and licensing agreement requiring that the arbitrator must have recognised expertise in information technology. Appointed co arbitrator and rendered award in a substantial ad hoc arbitration in Hong Kong under the UNCITRAL Arbitration Rules (1976). Appointed co arbitrator by the ICDR in a dispute seated in New York between Singaporean and Canadian parties under a technology distribution and licensing agreement. Appointed co arbitrator in a substantial ICC M&A arbitration in Hong Kong, arising under an agreement by a European party to acquire a Chinese telecommunications value added services ( VAS ) provider. Constantine Partasides Q.C,, Three Crowns LLP Prior to founding Three Crowns LLP, Constantine led the international arbitration practice of a leading international law firm in London. He has appeared as counsel on some of the largest commercial arbitrations of the last decade, relating to the energy, telecommunications and satellite sectors. Most recently, Constantine has been lead counsel for commercial clients in claims against sovereigns and state entities in Indonesia, Algeria and Kazakhstan, and recently led a team that obtained a final award for a client against the Nigerian National Petroleum Company in excess of $2bn. Constantine has also advised and represented a variety of investors and states in relation to disputes under relevant bilateral and multilateral investment treaties, and was counsel of record in high profile ICSID successes for the Republic of Kenya in World Duty Free v. Republic of Kenya, and for the Republic of Lithuania in Parkerings v. Republic of Lithuania. Constantine has been named as one of the top 20 individuals in the world of arbitration in the 2011, 2012 and 2013 Who s Who of Commercial Arbitration. He is a coauthor of the fourth and fifth editions of the leading textbook on international arbitration Redfern and Hunter on International Arbitration, and the news editor of the leading journal International Arbitration Law Review. Bruce Collins QC, XXIV Old Building Chambers & Wentworth Chambers Bruce Collins has practised extensively in arbitration for over 36 years. He is a member of the I.C.C. Court of International Arbitration in Paris, a member of the I.O.C. Court of Arbitration for Sport, an Adjunct Professor of Law and honorary lecturer in International Commercial Arbitration. He is a former Assistant Commissioner against Corruption in N.S.W., a Supreme Court Referee, and Supreme Court Neutral Evaluator. He lectures widely in arbitration subjects,is presently chairing the N.S.W. Government Enquiry into Insolvency in the Construction Industry and representing Australia in the World Trade Organisation proceedings in Geneva commenced by Ukraine, Honduras and the Dominican Republic. Hughes, Independent Arbitrator and Mediator Benjamin Hughes is an independent arbitrator and mediator based in Seoul and Hong Kong. Previously he was the founding co-chair of the international dispute resolution practice group at Shin & Kim, and adjunct professor of law at Korea University Law School. Mr. Hughes has extensive experience as counsel in international arbitrations in Asia, Europe and the United States, and under all major arbitral rules. He has been appointed as the sole, chair or co-arbitrator in arbitrations under the rules of the ICC, SIAC, HKIAC, CIETAC and KCAB. Mr. Hughes has been recognized as a leading practitioner in the field of international arbitration in Chambers Asia-Pacific, Legal 500, PLC Which Lawyer, Who s Who Legal, the Global Arbitration Review, Asialaw and Asia Legal Business. Fluent in Korean, Mr. Hughes has played an active role as an advisor to the KCAB and the Korean Bar Association. In October 2011, Mayor Won-Soon Park made Mr. Hughes an Honorary Citizen of Seoul in recognition of his contributions to the legal community. Hiroshi Yokokawa, President, Japan Commercial Arbitration Association Hiroshi Yokokawa is the President of the Japan Commercial Arbitration Association. He also serves as the Managing Director of the Japan Association of Arbitrators (JAA) and the Vice President of the Asia Pacific Regional Arbitration Group (APRAG). Graduated from the University of Tokyo with B.A. in Law, Mr. Yokokawa worked at the Ministry of International Trade and Industry for 30 years. During the period, he experienced various management positions and held several research positions including as Visiting Scholar at Harvard University and University of California at Berkley. He was the Executive Vice President of Osaka Gas Corporation, the second largest gas utility in Japan, when he was elected President of JCAA in Aside from his academic positions, he also serves as the President of the Japan Association of Athletics Federations. Andre Yeap SC, Senior, Rajah & Tann LLP As Senior of Rajah & Tann LLP, Senior Counsel Andre Yeap also heads the firm s International Arbitration Practice. With a diverse portfolio of international arbitration cases to his name, Andre has acted in several billion-dollar disputes, including one involving a steel plant, and another, a failed port venture, and other disputes involving a regional vehicle franchise, the development of hospitality resort project, hotel ownership and management, power plants, telecommunication systems, and underwater channels, and has also represented telecommunication giants such as AT&T. Andre specialises in a broad range of corporate and commercial dispute work. Often acting for financial institutions, he also represented an insurance conglomerate in a dispute over a highly complex US$220 million securitization transaction involving pulp and paper receivables, and had successfully restrained the execution and implementation of a series of collaterised equity leveraged loan securities backed notes in excess of US$180 million. Andre has also led some of the largest insolvencies in Singapore and the region, including the Lehman Brothers Group and MF Global Singapore and was responsible for the compulsory liquidation of Daewoo Singapore, with debts in excess of S$400 million. In his varied practice, Andre was involved in some of the largest property disputes in Singapore, including the $500 million en-bloc sale of Horizon Towers, and the $550 million en-bloc sale of Gillman Heights. He also represented the Commissioner of Estate Duty in a dispute relating to the valuation of one of the largest estates in Singapore. Andre also has a significant construction law practice. Apart from disputes relating to building projects, he has been involved in cases concerning the construction of vessels, oil rigs and a collapsed silo facility. Alvin Yeo S.C., Senior Counsel, Senior, Wongship Alvin YEO, Senior Counsel, is the Senior of Wongship. His main areas of practice are banking and corporate disputes, insolvency and restructuring, and construction and civil engineering matters. Alvin also has extensive experience in arbitration proceedings both in Singapore and in the region, primarily in corporate, commercial and infrastructure disputes. He is a member of the Court of the SIAC, the ICC Commission on Arbitration, the Court of the LCIA, a Fellow of the Singapore Institute of Arbitrators and on the panel of arbitrators of the International Centre for Dispute Resolution, the Hong Kong International Arbitration Centre, the Korean Commercial Arbitration Board, the Kuala Lumpur Regional Centre for Arbitration and the South China International Economic Trade Arbitration Commission. Tatsuya Nakamura, General Manager of Arbitration and Mediation Departments, Japan Commercial Arbitration Association (JCAA) Prof. Tatsuya Nakamura is the General Manager of Arbitration and Mediation Departments of the Japan Commercial Arbitration Association as well as a Professor of Law, Faculty of Law of Kokushikan University where he teaches International Dispute Resolution, Arbitration Law and Alternative Dispute Resolution. Professor Nakamura is also a lecturer for the Graduate School of Law, Kyushu University, Fukuoka and Keio Law School, Keio University. In 2009, he was a Visiting Scholar at the University of Sydney. He has written extensively on the law and practice of international arbitration. Yoshiaki Muto,, Baker & McKenzie Yoshiaki Muto has two decades of experience handling international corporate transactions and dispute matters. He is currently the Managing and Dispute Resolution Practice Group leader of the Firm s Tokyo office, and a member of the Asia Pacific Regional Council and the Global Policy Committee of Baker & McKenzie. Mr. Muto was recommended as a dispute resolution practitioner in Japan by PLC Which Lawyer and Global Counsel 3000, and was recently named a leading individual in the litigation field by Chambers Asia. Mr. Muto focuses his practice in the areas of domestic and international dispute resolution, including litigation and arbitration, corporate investigation and compliance. He also advises on international trade, general corporate and commercial matters, including those pertaining to corporate law, contract law and competition law. Mr. Muto has acted for clients in a wide range of industries, including Japanese and foreign manufacturing, finance, distribution services and computer systems. He particularly focuses on the medical and pharmaceutical industries. Christopher Chuah, Head of Infrastructure, Construction & Engineering Practice, Wongship Christopher CHUAH heads the Infrastructure, Construction & Engineering Practice and is a in the China Practice. His main areas of practice encompass both front-end drafting/advice and construction disputes, both litigation and arbitration. He is a leading light in the field of building and construction law and has authored various books on this subject. He is one of the General Editors of the Singapore Construction Adjudication Review. Christopher graduated from the London School of Economics. He is admitted to the English Bar and to the Singapore Bar. Apart from a law degree, Christopher has a Diploma in Surveying (Distinction) from the College of Estate Management, Reading, UK. Christopher is a legal advisor to the Singapore Contractors Association Limited, as well as a member of the Committee for International Construction and Building Contracts. He is a Fellow of the Singapore Institute of Arbitrators and Chartered Institute of Arbitrators, as well as the Chartered Institute of Building. He has also been appointed to the Singapore International Arbitration Centre s Main Panel of Arbitrators and is also on the Panel of Arbitrators of the Kuala Lumpur Regional Centre for Arbitration. Christopher is an accredited adjudicator under the Building & Construction Industry Security of Payment Act (Cap 30B) and a member of the Construction Adjudicator Accreditation Committee, formed by the Singapore Mediation Centre to assist with the training and accreditation of adjudicators. Kelvin Poon, Equity, Rajah & Tann LLP Kelvin regularly acts in major construction, corporate and commercial disputes for private and public listed companies, major international corporations, and financial institutions. Kelvin has represented clients in numerous institutional and ad hoc arbitrations involving ICC, JCAA, LCIA, SIAC and UNCITRAL rules. Kelvin also regularly appears in the High Court and the Court of Appeal in Singapore. Dr Colin Ong, President AABD Managing, Dr Colin Ong Legal Services Colin Ong is Managing of Dr Colin Ong Legal Services, Brunei and a member of the Brunei, English and Singapore bars. He is a Chartered Arbitrator and has acted as arbitrator or as counsel in many arbitrations in civil and common law jurisdictions and under most arbitration rules. Chris Bailey,, Dispute Resolution, Ashurst Chris is a in Ashurst s Dispute Resolution practice in Tokyo. He has been practicing in Asia since 2006, with over 5 years of service in Japan. Chris is highly experienced in litigation, arbitration and all forms of alternative dispute resolution. As a Tokyo based outbound dispute specialist, Chris has been involved in international/cross-border disputes and regulatory matters across a wide range of sectors, but the core of his practice concerns energy and resources. Since arriving in Asia back in 2006, Chris time has been almost exclusively in Tokyo, including a two-year secondment with one of Japan s leading trading companies, but has also included a year on-the-ground in South East Asia. Prof. Jeff Waincymer, Kluwer Law Author, Australian Government Nominee Panellist for the WTO Jeff Waincymer is a qualified legal practitioner, practicing solely in the fields of arbitration, international trade and investment, and ADR. He is also an Australian Government Nominee as a panelist for the WTO and has acted as a panelist. He is a Fellow of ACICA and is on the HKIAC, ICDR, KLRCA and SIAC arbitration panels. Jeff Waincymer is also a Professor at the Faculty of Law, Monash University, Melbourne, Australia. Zachary Sharpe, In-house lawyer, Hyundai Heavy Industries CO.Ltd Zachary Sharpe is an in-house lawyer at Hyundai Heavy Industries where he manages a number of international arbitration and dispute-related matters connected with the shipbuilding, offshore and construction industries. Prior to joining Hyundai Heavy Industries, he spent several years working as a senior foreign attorney at a maritime law firm in Seoul focusing on shipping, shipbuilding, insurance and trade disputes. Zac is a member of the International Advisory Committee to the Korean Commercial Arbitration Board and their Panel of Arbitrators. For many years, he has also coached the arbitration teams of the Judicial Research and Training Institute of the Supreme Court of Korea. He is admitted to practice law in New York. Ruth Stackpool-Moore, Managing Counsel, HKIAC Ruth is an Australian and UK qualified lawyer working as Managing Counsel of the Hong Kong International Arbitration Centre (HKIAC). She oversees the administration of arbitrations and other forms of dispute resolution proceedings at the HKIAC and works to promote the use of Hong Kong arbitration and other forms of dispute resolution worldwide. Prior to joining the HKIAC, Ruth worked with several international law firms in London, Sydney and Paris advising on a wide range of proceedings including international commercial arbitrations conducted under the ICC, LCIA, UNCITRAL, ICDR, VIAC and WIPO rules of arbitration as well as associated national court proceedings in civil and common law jurisdictions. She also provided advice regarding the formulation and drafting of arbitration and dispute resolution clauses in commercial contracts, including multi-party and multi-contract situations. Ruth graduated from the University of Sydney with a Bachelor of Economics (Social Science) in 2001 and a Bachelor of Laws (First Class Hons) in She was admitted as solicitor of the Supreme Court of New South of Wales and High Court of Australia in 2006 and in England and Wales in Junya Naito,, Momo-o, Matsuo & Namba Junya Naito practices in the areas of domestic and international litigation/ arbitration, cross-border transactions, corporate and M&A and international bankruptcy/insolvency. A globally recognized expert in international arbitration, Mr. Naito has long-standing experience as both arbitrator and counsel. Yoshimasa Furuta, Litigation, Anderson Mori & Tomotsune Yoshimasa Furuta is a litigation partner at Anderson Mori & Tomotsune with extensive trial expertise. He specializes in international & domestic litigation, commercial arbitration and other dispute resolution procedures. Mr. Furuta represents Japanese and foreign companies in all kinds of business disputes, both in Japan and overseas, involving sales of goods, technology licensing, intellectual property infringement (patent, copyright, trademark, know-how and unfair competition), labor & employment, corporate management, complex financial products and other business transactions. Among the many court cases that he has litigated, more than 30 cases have been published in the case reports of the Japanese courts. In addition to his professional experience at Anderson Mori & Tomotsune, Mr. Furuta serves as a professor of law at the University of Tokyo (2013 to present), where he teaches various courses, such as International Dispute Resolution, the Supreme Court Civil Case Review, RW&D (Research, Writing & Drafting), Legal Ethics and Civil Mock Trial. He has also taught classes and seminars on commercial transactions, civil procedure, international litigation, commercial arbitration and other courses as a professor of law at Seikei University (2003 to 2011), and as an adjunct lecturer at Rikkyo University (2000 to 2008), Keio University (2008 to 2009) and Tsukuba University (2008 to 2009). Mitsuru Claire Chino, Executive Officer, General Manager, Legal Division, Itochu Corporation Claire received her B.A. (cum laude) from Smith College and her J.D. from Cornell Law School. She was a partner of an international law firm before she joined Itochu Corporation as its corporate counsel. In April 2013, she became the first female executive officer of any major trading company. Yoon is a partner at Kim & Chang and the co-chair of the firm s International Arbitration Cross-Border Litigation Group. Mr. Yoon has extensive experience in arbitration both within and outside of Korea.
