Investments, L.C. A PART OF LOTS 4A AND 4B IN THE RE-PLAT OF LOTS 4 AND 7 OF GESINGER S COMMERCIAL 2 ND ADDITION TO THE CITY OF STORM LAKE, BUENA VISTA COUNTY, IOWA AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: Beginning at the Northeast (NE) corner of Lot 7, of Colby Development s First Addition to the City of Storm Lake, Thence North East along the East line of said Lot 4A, feet; Thence South West, parallel with the South line of East 16 th Street, feet to the West line of said Lot 4B; Thence South West, along said West line, feet; Thence South East, feet; Thence South West, along the West line of said Lot 4B, feet; Thence North East, feet to the Point of Beginning. 3 Building Official Scott Olesen addressed the commission reviewing the application submitted by B.T. Investments, L.C. for a preliminary plat for a major subdivision described in the legal description above. Commissioner Duane Queen arrived at 5:34 pm. Scott Olesen explained the major subdivision is required because it would be the third lot split from the Geisinger s Commercial 2 nd Addition. This major subdivision lot will eventually be sold to a developer to construct 2 16 unit apartment buildings that was awarded housing tax credits from the Iowa Finance Authority. At this time B.T. Investments, L.C. is only asking for the subdivision as the land is today and once the land is sold to the developer, a development agreement will be created between the City and the developer and will be brought to the Planning and Zoning Commission for review and then to the City Council for approval. Commissioner Egland had a question on the current zoning of R-4 on the property versus the existing use as agriculture land, and whether continuing the existing use was permitted since the zoning is R-4. Scott Olesen explained to the commission that the agriculture land is a nonconforming pre-existing use and therefore it is still allowed to continue to be used as farm land. Moved by Commissioner Ken Converse to recommend approval to the City Council for the preliminary major subdivision application filed by B.T. Investments, L.C., because it complies with the Storm Lake Zoning and Subdivision Ordinance and the Storm Lake Comprehensive Plan. Seconded by Commissioner Duane Queen. Building Official Scott Olesen addressed the commission reviewing the application submitted by B.T. Investments, L.C. for a final plat for a major subdivision that was previously described in the agenda item above. The creation of this lot would be the third lot split from the Geisinger s Commercial 2 nd Addition which is why a major subdivision is required. Scott Shevel, Surveyor for I&S Group, addressed the commission explaining a reason for subdivision is to make a legal description easier. In this particular case, the subdivision is just creating one lot. Moved by Commissioner Ken Converse to recommend approval to the City Council for the final major subdivision application filed by B.T. Investments, L.C., because it complies with the Storm Lake Zoning and Subdivision Ordinance and the Storm Lake Comprehensive Plan. Seconded by Commissioner Roger Egland.

5 Staff Summary May 13, 2013 Agenda Item # 2 REPORT TO: FROM: Planning and Zoning Commission Scott Olesen, Building Official SUBJECT: Review Site Plan For 10 th Street Townhomes Development BACKGROUND: Southwest Minnesota Housing Partnership received an allocation for Low Income Housing Tax Credits from the Iowa Finance Authority for their proposed 10 th Street Townhomes development. With this allocation of tax credits, SWMHP is proposing to development eight townhome buildings for a total of 42 units and a commons facility building. This development will be located east of the Field of Dreams and southwest of Hy-Vee. The 10 th Street Townhome project will extend the current Ontario Street north onto the parcel. The road will incorporate a traffic calming measure that was referenced in the new Comprehensive Plan by winding through the new development to slow traffic. The road will end with the installation of a temporary gravel hammerhead so the road could be further extended north for new development that may occur. The common facility building will contain an exercise facility, storage units, computer lab, office, and meeting room. Eight public parking spots will be located outside the common facility building to serve the development. Sidewalks will also be located on both sides of Ontario Street and the north side of West 10 th Street. The development will also contain a playground and community garden for those living in the townhomes. Three townhome units will be single-story accessible units and one unit will accommodate for hearing or vision impairment. All the site plans for this development are included in the Planning and Zoning meeting packet.
6 COMPREHENSIVE PLAN: The proposed development is in accordance with the Storm Lake Comprehensive Plan Future Land Use Map shown on page 4-11 which depicts the area as medium density residential uses. The comprehensive plan defines medium density residential as multi-family housing in either a side by side configuration or smaller two or three story buildings with multiple units. The Comprehensive Plan addresses housing in the seventh Guiding Principle Add New Housing Choices listed on page 3-7 of the plan, and the Guiding Principle also appears at the beginning of every chapter in relation to the specific chapter topic. The Comprehensive Plan also devotes an entire chapter to Housing, and with this development, more housing will be created that follows the Housing Goals and Policies and Implementation that can be found on page 5-6. RECOMMENDATION: The Commission should review the site plan for the new 10 th Street Townhomes development and provide any recommendations for the site to City Staff. No formal action is needed at this time, but the Commission could indicate its support for the site plan as the development process continues to move forward.
