1 The Forty-Niner Serving Minnesota, North Dakota and South Dakota April, 2018 Message From The Business Manager All year we have been celebrating the accomplishments that we have achieved in the past 90 years as a Local Union. We have been celebrating all of the members- past, present and future and the work you have done literally building Minnesota, North Dakota and South Dakota. As we near the end of our 90th year, I feel like it s important to look back at where we came from, where we are, and where we are going. Past Local 49 was chartered on June 10, 1927 as a result of the unification of Twin Cities Locals 84 and 86. On December 31, 1938 our charter was reissued to cover approximately 300 hoisting and portable members in the state of Minnesota. Back then, meetings were held above Witt s Grocery on Hennepin Avenue in Minneapolis. By Glen D. Locals 560 and 568, located in Rapid City, South Dakota merged with Local 49 on December 1, 1950, which finally resulted in our charter now including all of Minnesota, North Dakota and South Dakota. Most recently, Local 50 out of International Falls, Local 35 of St. Paul and Local 756 out of Rochester also merged with Local 49. As mentioned above, Local 49 membership meeting at one time took place in a room above Witt s grocery store in downtown Minneapolis. The Local moved its location many times over the years and finally settled in its current building at 2829 Anthony Lane South in Minneapolis on June 24, A significant expansion to the office and meeting hall was completed in Throughout these 90 years, Local 49 has only had a total of six business managers. This is unique in the construction industry, as some unions have new leadership every few years. This stability shows that Local 49 is committed to the longevity and vitality of this Union and you should be extremely proud of that. A pension plan for members working under the Builders and Highway and Heavy labor agreements went into effect on January 1, It was only a year later, on January 1, 1968 that a health and welfare plan was introduced. Since then, many labor agreements have included either the Central Pension Plan, the Health and Welfare Plan, or both. The Apprenticeship and Training Fund was initiated on July 1, At the time, a nickel per hour was negotiated for the training program. The Apprenticeship Program actually began operations without a training site. The first year, the training site was located at the Local 49 Minneapolis Union Hall. A parcel of land was rented from the University of Minnesota in Rosemount, Minnesota on February 29, 1979 to house the new Local 49 training facility. Local 49 outgrew the Rosemount location and initiated a search for a training site with more acreage and better soil conditions. On November 1, 2006 Local 49 moved into their new training center in Hinckley, Minnesota. Present Today, Local 49 is thriving. We are at our highest membership we ve had in decades, with approximately 13,500 members. Our diverse membership works in a variety of fields including highway and building construction, energy, sand and gravel, public sector and shops. With our membership growing, the local is also expanding its facilities. Local 49 Training Center recently completed an addition that will house the crane training and instructors. This addition was completed in early A new office and meeting hall was completed in May 2017 to serve the members in the Fargo-Moorhead area. This new union hall is situated on nearly 3 acres of land on Maine Avenue in West Fargo, North Dakota. The Training Fund purchased 37 acres in Mandan, North Dakota with plans to build our second training center site. Our Health and Welfare Fund is one of the most robust in the industry. While healthcare costs are rising all over the country, we are doing everything we can to try to keep costs under control. We are going to continue to make smart decisions that continue to provide quality benefits at a reasonable cost. We are building relationships with contractors and project developers. By using our political strength to help projects win approval and in turn having those projects built with union labor, we are creating opportunities for the membership. It is important that

2 From The Business Manager continued from page 1 these contractors and developers understand we are their allies and not their adversaries. We are partners in building the future with them. We hope you have noticed the increased effort to communicate with the membership. Local 49 s refreshed website now included a member s only section. In the member s only section, you can access the out of work list as well as many of Local 49 s contracts. You can also review the Minutes of the general membership meetings online. Along with our effort to increase communication with the membership, we are also working hard to better communicate our message to the public. While keeping Local 49 s administrative dues the lowest of any trade in the industry, we were able to raise funds to combat right to work and prevailing wage repeal. We believe it s necessary to educate the public on these critical issues. If we can educate the public on these issues and the effect they have on Minnesota workers, we know they will be on our side. As Business Manager, one of the most important things is having staff in place I can trust and that you can trust. Right now, I have that. Business Agents are visiting job sites and enforcing contracts. We have included in this newsletter a map defining the agents territories. I encourage all members to contact their business agent for any questions regarding their contracts or job related issues. Things are very positive for Local 49. We are growing, improving and moving in the right direction. Future The future of Local 49 is very bright. The strength of our Union is in every member. Our power is a result of our unified voices, standing together demanding policies and actions that will benefit ourselves and our families and the working class. When we knock on the door with close to 14,000 members, those doors open and people listen. We have to realize that our industry is changing and that we need to change with it. Whether it s training the membership on the latest equipment or understanding the current dynamics of employer/ employee relations. We have to work hard to make sure that the membership gets what they want while at the same time satisfying the workforce needs of our signatory employers. Again, it s a partnership. Over the last several years, the Local has hired many new agents with an eye toward the future. We understand that stability is important for the future. These agents are tasked with enforcing the contracts while at the same time building relationships with employers. It is these relationships that are going to help us grow and continue to build Local 49. As a Local Union, we must continue to organize. Everyone that works in the trade is our brother and sister and we need to lift them up. In our Constitution, the stated purpose of this organization is, to elevate the trade of operating engineers to its proper position This is our call to action. We must make it our priority to elevate our trade and those who work at it. Our goal as an organization is to ensure good wages, great family healthcare and a secure retirement for everyone working in the trade. When we all work together, there s no doubt in my mind that we will continue to accomplish our goal. Work safe and have a great 2018! Previous Business Managers David Weeks Photo not available Dale Burchett Frank Pendzimas Robert Pueringer Fred Dereschuk West Fargo Office In June of 2016, Local 49 made the decision to purchase 2.98 acres of land on Main Ave in West Fargo, ND to build a new Union Hall for the Fargo-Moorhead area. US Sitework broke ground on October 1st of the same year and Local 49 selected McGough Construction as the General Contractor. 3 From Your Officers Clayton Johnson President In June of 1927, a small group of people came together to form what is now Local 49, and throughout this year we have taken time to celebrate our 90 year history. In 1927, members had a vision of what Local 49 should be and they led organized labor forward into the decades to come. Would our founding Brothers and Sisters be proud of what Local 49 is today and what we have accomplished in the last 90 years? ABSOLUTLEY!! A pension and healthcare second to none and current wages and working conditions, which are the envy of every non-union worker throughout our jurisdiction. Members today need to have a vision of what Local 49 is going to look like 90 years from now. We need to stand together so that we not only survive but thrive for the next 90 years. My Brothers and Sisters, WE are the Union. Bruce Stahnke This year marks the 90th anniversary for the International Union of Operating Engineers, Local #49. Ninety years is an incredible milestone and calls for celebration. It is a time to look back and honour those who have lead and help build our great union, and look with optimism towards the generations of Local 49 members to come. Before having the privilege of serving as your Vice President, I started out my 49 career working in the sewer and water and pipeline industries. Looking back at how far we have come amazes me. Our pension fund remains as strong as ever and our insurance coverage is unmatched. We have built an incredible training center and political program that continues to educate Local 49 members at a level incomparable to many other locals. We have made great strides in our ninety years, and while we should all take time to celebrate these endeavors, it is also a time that calls for forward thinking; because without question, our greatest accomplishments still lie ahead of us. Vice President Looking towards the future, I feel strongly that it is the responsibility of our officers, executive board members, trustees and most importantly the membership to continue to educate each other and the general public on issues pertaining to our industry. Stay informed on political matters, get involved, ask questions and most importantly, vote. I am proud to be a member of Local 49 and look forward to taking on any challenges that are in store for us in the future. Eric O Gary Congratulations on 90 years 49ers. We, the members working in the field created this Union and we have survived the rough times and thrived in the good times. We have continued to do this through commitment, dedication and being the best at what we do, along with representing the membership and organizing the Non-Union. Organizing is the life blood to any Union and we should be very proud that just over the last few years, we have organized and successfully secured over twenty (20) new, first time contracts, this is not common and very difficult to do but, with such a strong and committed membership we will continue this success for years to come. As we continue to renegotiate contracts throughout our industry we have been able to negotiate some of the best contracts we have ever seen in the highway, builders, sand, gravel and equipment shops. We need to Treasurer continue to enforce our contracts and above all, make sure we are in safe working conditions out there this year. To our Equipment mechanics, our Highway, Building, Sand and Gravel and Public-Sector members, again congratulations and here s to another great 90 years. Tim Olson Recording- Corresponding Secretary When I think about local 49 celebrating its 90th anniversary, I think about the positive impact the Union has had on the members and their families throughout the years. Thousands of Union households have benefited greatly by earning a good wage, having good family health care, and building a secure retirement. All of this was gained through collective bargaining and being part of a Union. I appreciate the efforts of those that came before us, who took the initiative to form a union and had the vision to help it progress through the years. We are fortunate to earn a good living and enjoy the benefits we have. Those things didn t come easy for the people before us and they re not going to be easy to keep. Every day, we have to remember what we have in common. We have to remember that our strength is a product of our unity. I stand with all members of Local 49, past, present, and future, looking back on the past thankfully and forward to the future hopefully and congratulating Local 49 on our 90th anniversary! 6 Meet Your Business Agents Robert Joe Chastan Joe handles National Pipeline and Distribution Pipeline projects and activity throughout the 3-state area in Local 49 s jurisdiction from our Bagley, MN office, while working with members and employers in NE Minnesota. Todd Djonne Todd supports public-sector members working for employers from our Bagley office. Matt Watkins Matt joined Local 49 in 2008 as a pipeliner working mostly for Enbridge and TransCanada. In 2015, he became an Agent helping members and contractors on pipeline projects in the northern areas of Local 49 territory. Al Henke, Darrell Miller Brian Martell, Nathan Brand Nathan Brandt Nathan joined Local 49 in He was a crane operator until becoming a Business Agent in early He is the Vice president of the Southeast ND Building Trades. He works with contractors and members on Heavy/Highway and Building contracts in ND out of our West Fargo Office. Brian Martell Brian joined Local 49 in He has worked Distribution Pipeline, water and sewer, and mainline Pipeline. He was a steward on several mainline Pipeline jobs before becoming a Business Agent in Alan Al Henke Al has been a member since 1996 and an Agent since He serves members and employers on job sites in western North Dakota from our Mandan Office. Darrell Miller Darrell has been a member since 1999 working for Onyx Construction for 10 years and several other contractors, mostly at power plants and refineries. He became an Agent & Organizer for the Local in Rapid City: Leon Fenhaus Sioux Falls: Will Thom Leon Fenhaus Leon had a 40 year career in the rail industry. 29 years of that he was a union representative for the Brotherhood of Maintenance of Way Employes. Leon was hired as a Business Agent for Rapid City, SD in He covers the area West of the Missouri River in SD. Will Thomssen Will became a member in 1999, working for Don Jerke Construction and for M.A. Mortenson Construction as a crane and forklift operator. 7 Meet Your Business Agents Ryan Davies Ryan became a member in He s an Agent based in our Virginia office working primarily with members and private employers on job sites in northern Minnesota. Dan Snidarich Dan has been a member since He s based in our Virginia office as an Agent working primarily with members and employers on job sites in northern Minnesota. Eric Gulland Eric became a member in 1998 and serves the Duluth area and along the North Shore. dt Mike Parrot Mike has worked in the construction industry for over twenty years and studied both architecture and estimating in college before he became a member of Local 49 in He serves as an Agent in the Duluth area and along the North Shore. William Bentley Will has been a member since He supports members in Central Minnesota as an Agent working from our St. Cloud office. Kent Courrier Kent became a member in 1997, an Organizer in 2006 and now supports members and employers throughout Central Minnesota as an agent in our St. Cloud office. Metro agents on page 8 Bruce Stahnke Bruce joined Local 49 in 1991 working as a pipeliner. He became and Agent in 2004, served on our Executive Board and various committees while working as an Agent supporting members and employers on job sites throughout Central Minnesota from our St. Cloud office. Bruce is the Vice-President of Local 49. ssen Clayton Johnson Gene Grover Nathan Runke Clayton Johnson Clayton has been a member since 1984 and is currently the President of Local 49. He worked in Houston County Highway Department for 23 years, where he was a steward for 17 years, before becoming an Agent in Clayton covers jobs in southeastern Minnesota from his office in Rochester. Marvin Hose Marv became a member in 2002 and is an Agent based in our Mankato office since Eugene Gene Grover Gene has been in the construction industry since 2000 and a proud member of Local 49 since Gene worked in both the public and private sector, serving as a Shop steward for 2½ years before becoming an Agent in Nathan Runke Nate has been a member since He studied Urban Forestry in college and worked for both the private sector and most recently the City of Rochester for 6 years, including 4 years as a steward, before becoming an agent in Nate represents public sector members in southeastern Minnesota from our Rochester office. 8 Minneapolis Public Sector Agents Cory Bergerson Cory, a third-generation 49er, has been a member for 18 years. He organized the City of North Branch and worked as a steward until becoming an Agent in Cory represents the public groups listed below: Raymond Donohoe Ray was the former Business manager of IUOE Local 35 and has been a member of International Union of Operating Engineers since Ray became an Agent when Local 35 members merged into Local 49 at the end of Ray represents the groups listed below: Ron Boesel Ron works out of the Minneapolis office representing over 600 public sector members. He joined Local 49 in 1987 and worked for Washington County Public Works Division for 28 years serving as Union Steward for 24 years before becoming an Agent in Ron represents the public groups listed below. Jonathan Turner Jonathan worked the last 10 years with the city of Saint Paul operating equipment in the City s forestry Division. Tim also serves as Local 49 s Recording Corresponding Secretary, a role he has held since He is based out of the main Hall in Minneapolis. Gordon Johnson Gordon became a member in 1977 and served as a pipeline steward before becoming an Agent in He works primarily with members and contractors in the southwest Twin Cities metro area. Steve Piper Steve Piper began his career with Local 49 in 2006 as an organizer, and transitioned to a business agent in Currently he represents the south metro area. He is our lobbyist at the MN State Capitol, and also oversees our legislative work in North Dakota and South Dakota. He works closely with the International Union in Washington DC to make sure we are educating federal elected officials in our jurisdiction to support IUOE efforts to create infrastructure jobs, preserve Davis-Bacon, stop right to work, and other important federal labor issues. Shop/Sand & Gravel Business Agents Kelly Zins Kelly became a member of the IUOE local 49 in 1999 while employed with Ziegler Inc. prior to becoming a business agent in May Based out of Minneapolis, he supports members on multiple stand-alone contracts including Ziegler Inc., Cummins, Forklifts of Minnesota, Forklifts of North Dakota, Kraemer Mining and Materials, Minneapolis Park and Rec mechanics and Butler Machinery. Brent Berghuis Brent handles shops and private agreements out of the Minneapolis office. He became a member in 2004 working with Hinkels & McCoy, Southeast Directional Drilling, Northern Clearing, Ziegler and Ames prior to becoming a Business Agent in April, page 9

11 From Dispatch When MEMBERS are unemployed they need to be on the Out of Work list at the Hiring Hall. You should be on the list whether you plan to return to your previous employer or need other job opportunities. This is required to receive and continue receiving unemployment insurance. In order to remain on the out of work list, members NEED to re-register at least every 30 days until employed. It is the MEMBER S obligation to remain in good standing by staying current on monthly dues. REGISTERING ON THE OUT OF WORK LIST Call your area office, Dispatch, OR Register online in the member only section at Use your register number to create your member account. Once your account is created, you have the option of downloading 49 s app on your mobile phone or tablet to register, re-register, or return to your previous employer. By updating your equipment skills, work related certifications, and ensuring a current telephone number you will increase your opportunities for work. Once back to work please remove your name from the out of work list. Dispatching from an accurate list is more efficient and a better use of time. Matt Rooney Matt, a 2nd generation 49er has been a member since 1999 working under both, the Highway Heavy and Building Trades agreements, most recently as a crane operator. In February, 2016 he was hired as the Twin Cities Dispatcher. Any member who is current in their dues and in good standing is eligible to nominate candidates. Local 49 retirees on Death Benefit Withdrawal are not eligible to nominate candidates for office or vote in Local 49 s Election. To qualify as a candidate and be eligible to run for office, a member must satisfy all the requirements specified in Local 49 s Bylaws and the International Constitution, including the following: Members must be in continuous good standing in IUOE Local 49 for a period of one (1) year preceding the month of nominations and shall also have been a member of the organization for two (2) years immediately prior to the election. For the position of Business Manager, members must be in continuous good standing in IUOE Local 49 for a period of two (2) years preceding the month of nominations. Members cannot be receiving a pension that restricts full-time employment in the trade or be the owner/operator of an entity that employs Operating Engineers. Candidates must accept nomination through submission of a written acceptance form to Recording-Corresponding Secretary Tim L. Olson. In April, accordance 2018 with the International Constitution, notices of acceptance sent via , fax, or hand delivered satisfy this requirement as long page 3 as the acceptance is received by the Recording Secretary within ten (10) days of the date the candidate is notified of his/her nomination. As a reminder, members need to have their current address on file in order to receive notification as well as a ballot to vote when the election is held.
