The Committee is comprised of the overall firm-wide pro bono partner and each office pro bono attorney representative. The majority of the pro bono attorney representatives are partners. How does the firm decide whether to take on a pro bono matter? Pro bono matters are subject to the same procedures as clientbillable matters, including conflict checks. For the purposes of the Firm s Pro Bono Program, pro bono work is defined as providing legal services without charge or at significantly reduced fees to: 1) Low-income individuals, or not-for-profit organizations whose mission is to serve low-income individuals; (2) Individuals, not-for-profit organizations or activities seeking to advance civil rights, civil liberties or the public interest; (3) Activities intended to increase the availability of legal and other services to those who are traditionally underserved; and (4) Other similar individuals, groups or activities. EBG attorneys may not undertake certain types of representation that would present a positional or other conflict with respect to major areas of the Firm s work for paying clients. Each office Managing or Administrative Partner reviews and approves all pro bono engagements, including determining if a proposed matter would present a positional or other conflict. The review process also involves consideration of: time commitments required for pro bono engagements; whether pro bono matters may present opportunities for inter-office or inter-practice coordination; the expertise and supervision required for the engagement; and the training and professional development opportunities presented by the engagement. Attorneys and staff in the Washington, DC office have participated in the DC Bar Advocacy & Justice Clinic since Through our commitment to the Clinic, Epstein Becker Green takes on new cases each year. Since 2011, the Firm has worked on 21 cases through the DC Bar. Most of the cases were disability cases, however the Firm has also done domestic and landlord/tenant cases. Epstein Becker Green is the founding sponsor of the Health Care Industry Access Initiative, a 501(c)(3) tax-exempt organization that seeks to facilitate collaborative action among all sectors of the health care industry in an effort to improve and enhance access to health care coverage and services in the United States. The Access Initiative continued to work on a broad range of programming regarding health care access, including planning the first Health Access Summit scheduled for February 13 14, 2013 in Washington, DC. PRISIONER S RIGHT CASE: In 2014, Julie Badel (, Chicago office) represented Dennis Morland in a case assigned by the Northern District of Illinois, Morland v. Ghosh et al. Mr. Morland filed a pro bono complaint under 42 U.S.C alleging cruel and unusual punishment in violation of the Eighth Amendment because the medical personnel and health care providers for Stateville Correctional Center, where Mr. Morland has been for more than 20 years, did not properly treat his medical condition. The court-appointed counsel for Mr. Morland had a conflict, and Julie was appointed as successor counsel. Very early in the case, the magistrate judge conducted a settlement conference and ordered the defendants to make a monetary offer of settlement before the conference. They did not. On behalf of Mr. Morland, a motion was filed for fees for defendants bad faith in attending the settlement conference, and the court awarded fees. More recently, we were successful in rebuffing a motion for summary judgment submitted on behalf of the individual defendants, the doctor, and physician s assistant who treated Mr. Morland. The case has not yet concluded and is currently set for trial in March List up to three pro bono matters that are highlights (e.g., a Supreme Court case). Epstein Becker Green litigators Bob Travisano and Jim Flynn (s in the Newark office) were the driving force behind the settlement of a New Jersey estate litigation that will net their client Make-A-Wish Foundation of New Jersey a near record-setting bequest of more than $4 million. The Make-A- Wish Foundation is thrilled with the results and even happier to be able to provide more wishes to children in need. In 2014, through the Veterans Consortium Pro Bono Program ( VCPBP ), Marshall Jackson (Associate, Washington, DC, office) successfully represented Mr. Wallace E. Warren in his appeal before the U.S. Court of Appeals for Veterans Claims. Mr. Warren sought representation to appeal the decision by the Board of Veterans Appeals ( Board ), an administrative tribunal within the U.S. Department of Veterans Affairs ( VA ), to deny his VA benefits for service-connected disabilities of asbestosis, asthma, and chronic obstructive pulmonary disease. Marshall was able to successfully argue that the Board did not provide a proper basis for denying Mr. Warren s benefits, that the Board failed in its obligation to assist Mr. Warren in recovering medical evidence to support granting his VA benefits, and that there was actually enough medical evidence to show service connection to his disabilities. The VA agreed to remand its decision on all of Mr. Warren s claims. In February 2014, the District of Columbia s La Clinica del Pueblo won a $425,000 grant from CareFirst BlueCross BlueShield ( CareFirst ) to implement a telemedicine behavioral health initiative that will expand remote access to its bilingual counselors and health care providers through telemedicine to about 650 patients in the DC area. Attorneys at Epstein Becker Green, led by René Quashie (Senior Counsel, Washington, DC, office), aided La Clinica del Pueblo with its grant application and is providing pro bono legal services as La Clinica implements the program. In a February 20, 2014, article, CareFirst said it will offer $1.3 million in grants to four initiatives meant to help medical providers develop telemedicine-based ways to increase access to behavioral health services. CareFirst is planning to grant money over three years to seed projects that use video conferencing or other technologies to allow doctors and others to diagnose and treat patients remotely. The grants were meant to expand access to behavioral health care for patients in both urban and rural areas of the District of Columbia and Maryland. According to AHLA, those recognized represent excellence in fulfillment of the volunteer tradition of the legal profession.
