In conjunction with the ACLU, represented a Muslim woman who was denied access to the Douglasville County, Georgia courthouse because she was wearing a religious head covering. When the woman refused to take off her head covering and asked to leave, she was brought before the Court, found in contempt, and sentenced to ten days in jail. She was released later that evening. As a result of the constitutional violations, attorneys prepared and filed a complaint alleging various civil rights violations and a claim under the Religious Land Use and Institutionalized Persons Act. After conducting discovery, we successfully negotiated a settlement that resulted in a policy change for the City of Douglasville, as well as monetary compensation for the client. partnered with lawyers from the ACLU to represent a transgendered woman to restore her rights to visitation with her children. The judge had suspended her rights to visitation after the children s mother filed an emergency motion to suspend visitation when the client came out as part of her transition from male to female. Firm attorneys assisted the Tampa Bay Conservancy, a land conservation organization devoted to protecting the region s natural, agricultural and scenic heritage, with several transactions including the transfer of a trusteeship of a Vault.com Inc.
3 county park, and agreements for consultants evaluating other properties under consideration for conservation easements or purchase by the conservancy. List up to three pro bono matters that are highlights (e.g., a Supreme Court case). Please limit your answer to a short paragraph per matter. In 2011, provided pro bono representation on a petition for certiorari to the United States Supreme Court. Petitioner s semi-submersible vessel was spotted by a marine patrol aircraft off the coast of the Galapagos Islands. The United State Coast Guard monitored the vessel via helicopter until seaborne vessels could intercept it. As the Coast Guard approached by sea, Petitioner and his crew emerged from the hatch and jumped into the water. The semi-submersible sank within minutes afterward. The Coast Guard rescued Petitioner and his crew, all of whom claimed Columbian nationality, and transported them to Tampa, Florida to face federal charges. Petitioner was convicted of a felony and sentenced to nine years in prison under a recently enacted federal statute that criminalizes the operation of a semi-submersible vessel in international waters anywhere in the world, which was passed under the guise of Congress s power under the High Seas clause of the Constitution. It has been nearly 200 years since the Court has addressed Congress s power to legislate under the High Seas clause, which gives Congress the power to define and punish Piracies and Felonies committed on the high Seas The petition urged the Court to take Petitioner s case in order to clarify the original meaning of that clause. The central argument presented in the petition asserted that the original meaning of the High Seas clause did not give Congress the power to define punish felonies in international waters that bore no direct connection to the United States. As such, petitioner s conviction for operating a type of vessel, with no proof of drugs on board, on the other side of the globe was unconstitutional. Ultimately, our petition for certiorari to the United States Supreme Court was denied. partnered with representatives of HUD, the Pinellas County Housing Authority (PCHA), the Pinellas County Housing Finance Agency ( HFA ), and Gulfcoast Legal Services to prevent 48 very low income families living in a distressed and failing apartment complex from losing their homes. An aging 48-unit HUD-subsidized multifamily community was purchased out of Chapter 11 bankruptcy by the PCHA through the use of federal Neighborhood Stabilization funds provided by the HFA. Through this team effort, affordable housing was preserved and the investment will ensure that Pinellas County residents will have access to safe, secure affordable housing for decades to come. handled a post-conviction appeal in the Supreme Court of Florida for an indigent prisoner serving a life sentence (under a repeat offender statute) for armed robbery. The client had already served 20 years of the sentence when another man who had confessed to the crime completed his own sentence and stepped forward with an affidavit stating he had another accomplice and that our client is innocent of these charges. The trial court and the Third DCA refused to grant post-conviction relief, and our client filed a pro se petition to the Supreme Court of Florida seeking review. The Court granted review and appointed as counsel to represent him. The Florida Supreme Court agreed with our position that the Third District Court of Appeal failed to apply the correct standards and remanded the case for an evidentiary hearing in the trial court. Our firm will continue to represent the client for the evidentiary hearing.
